वमान नौका प्रयोग की दर जनधाारण के जलए मुंबई पत्तन न् यास मएमबीपीटीस से प्रा‍ त प्रस्ट् ताव का, इसके साथ संलग्न आदेिानुसार, जनपटान करता ह।ै महापत्तन प्रिल्ु क प्राजधकरण मामला सख्ं य ा EXTRAORDINARY [PART III—SEC.4] आदेि (ददसबं र, 2020 के 28व ेंददन पाररतस यह मामला मुंबई पत्तन न् यास मएमबीपीटीस के 23 जून, 2020 के पत्र संख् या एफए/एसीसी/200मएफआरस/1352 के साथ जेटी 5, गेटवे ऑफ इंजडया जस्ट्थत पल् वमान नौका प्रयोग की दर जनधारा ण के जलए एमबीपीटी से प्रा‍ त प्रस्ट् ताव स े संबंजधत ह।ै 2. इस प्राजधकरण ने 24 जलु ाई 2019 के आदेि संख् या टीएएमपी/5/2019-एमबीपीटी के द्वारा एमबीपीटी के सामान् य दरमान अजधसूजचत कराये थे। इस प्राजधकरण द्वारा अनुमोददत जन्‍प ादन मानक सजहत संिोजधत दरमान 3 जसतंबर, 2019 को राजपत्र संख्य ा 308 में अजधसूजचत हुए थे। 3.1. इस पृ्‍ठ भूजम म,ें एमबीपीटी 23 जून, 2020 के अपने पत्र के द्वारा जेटी 5, गेटवे ऑफ इंजडया जस्ट्थत पल् वमान नौका प्रयोग की दर के जनधाारण के प्रस्ट् ताव के साथ आया। एमबीपीटी द्वारा अपने प्रस्ट् ताव में उठाये गए मुदों ों का सार इस प्रकार ह:ै (i). गेटवे ऑफ इंजडया जस्ट्थत ‍ लवमान रेस्ट् टोर ट चलान े के जलए श्रीमती श्रीजप्रया डालजमया जथरानी को एमबीपीटी के 27 जून 2017 के पत्र संख् या टीएएमपी/बीडीसी/एफआर म04/2017-18स/247/2017- 18 के द्वारा लाइसेंस प्रदान दकया गया। गेटवे ऑफ इंजडया, जेटी संख् या 5 से सुरजित और जनरापद आरोहरण और अवरोहण के जलए उप-संरिक द्वारा पल् वमान नौका रख े जाने की अनुमजत भी दी गई। महत्वपूण ा ित ें जनम्न वत ् ह:ै- (क). नौका का प्रयोग कॉमन प्रयोक्त ा आधार पर दकया जायेगा और यह अन् य प्रयोक्त ाओं क के जलए भी होगा। (ख). लाइसेंसधारक सुरिा कार्तमक और जीवन रिकों की तैनाती भी करेगा। (ग). नौका में सुरिा और बचाव उपाय दकये जायेंगे जैस ेरेसलग, रिा-बोया, प्रकाि/प्रदीपन आदद। (घ). लाइसेंसधारक प्रयोक्त ाओं क से नाममात्र का प्रभार वसूल कर सकेगा। (ङ). लाइसेंसधारक इन नाममात्र प्रभारों का 17% एमबीपीटी से िेयर करेगा। (ii). नौका को 23.03.2019 से काम पर लगाया गया ह ै और इसका प्रयोग ‍ लवमान रैस्ट् टोर ट को और स े आन-े जाने वाल े मेहमानों को पार उतारने का काम कर रही ह।ै यह एक महत् वपूणा सुजवधा ह ै जजससे सुरिा और बचाव म ेंवृजि होती ह ैऔर इससे चढ़ने/उतरन े में भी सुजवधा हो जाती ह।ै (iii). श्रीमती श्रीजप्रया डालजमया जथरानी न े 16.04.2019 के अपने पत्र के द्वारा यह सूजचत दकया दक जेटी संख् या 5 के प्रयोक्त ाओं क से अनके ों अनरु ोध प्रा‍ त हुए ह दक उन्ह ें नौका के प्रयोग की अनुमजत दी जाए। इस संबंध म,ें 28.03.2019 को एक बैठक हुई। प्रचालक न े सूजचत दकया दक अन् य प्रयोक्त ाओं क को अपन े याजत्रयों के जलए नौका सुजवधा के प्रयोग की अनुमजत देन े को ध् यान में रखते हुए दरों के जनधाारण का अनुरोध दकया गया, एमबीपीटी द्वारा अंजतम रूप से दरों का अनुमोदन दकये जाने तक तदथ ा आधार पर ही दरें जनधााररत की जाए ं तादक उन् हें हाजन न हो और प्रयोक्त ा अपनी नौकाओं क तक पहुचं ने के जलए सुरजित और जनरापद नौका का लाभ उठा सकें। (iv). पररचालक को संभाजवत प्रयोक्त ाओं क की सहमजत से प्रस्ट् ताव प्रस्ट् तुत करने की सलाह दी गई क्य ोंदक सा प्राजधकरण से अनुमोदन प्रा‍ त करने की यह एक अपिे ा ह।ै तदनुसार, श्रीमती श्रीजप्रया डालजमया जथरान े ने 16.04.2019 के पत्र के साथ रॉयल बाम् बे याच क्ल ब, और जवज़न याच सेवाओं क के 17.04.2019 और दकरन ररसोसाज प्राइवेट जलजमटेड, मैसज ा मैरीन साल् यूिन्ज , श्री राजेि अल् या और मसै जा दक्रडेंस लॉजजजस्ट्टक्स के क्रमि: 10.04.2019, 13.04.2019, 02.04.2019 और 06.04.2019 के ई-मेल संलग् न दकय े जजसमें उन् होंने गटे वे ऑफ इंजडया जस्ट्थत जेटी संख् या 5, पर चढ़ने और उतरने के जलए[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 ‍ लवमान जेटी मनौकास के उपयोग की अनुमजत देन े का अनुरोध दकया है। (v). श्रीमती श्रीजप्रया डालजमया जथराने न े 16.04.2019 के पत्र में जनम्न वत ् प्रयोक्त ा दरों का प्रस्ट् ताव दकया ह:ै - (क). 70/-रु. एक बार/एकल प्रयोग के जलए। (ख). 9000/-रु. पूरे सीजन का पास म1 अक्त ूबर स े 1 मई तक ) (ग). 5000/- रु. आध े सीजन का पास (1 अक् त ूबर से 15 जनवरी या 16 जनवरी स े1 मई )। (vi). एमबीपीटी के न् यासी मंडल के समि प्रस्ट् ताव को रखा गया। बोडा न े 20.08.2019 की टीआर संख् या 102 के द्वारा अनुमोदन प्रदान दकया । बोडा न े जनम्न जलजखत का अनमु ोदन दकया। (क). नौका के कॉमन प्रयोक् त ा आधार पर प्रयोजन के जलए जनम् नानसु ार तदथ ादरें जनधााररत करें:- (i). 68/-रु. एक बार/एकल प्रयोग के जलए। (ii). 9000/-रु. पूरे सीजन का पास म1 अक्त ूबर स े 15 मई तक ) (iii). 5000/- रु. आध े सीजन का पास (1 अक् त ूबर से 15 जनवरी या 16 जनवरी स े1 मई )। (ख). ऊपर मकस की दरों का अनुमोदन प्रा‍ त करने के जलए प्राजधकरण को प्रस्ट्त ाव प्रस्ट् ततु दकया जाए। (vii). पत्तन के जलए जवत्तीय प्रभाव एमबीपीटी को इन प्रभारों के आधार पर लाइसेंसधारक से सकल प्राजियों के 17% की दर स े प्रा‍ त राजस्ट् व जहस्ट्स े की राजि होगी। लाइसेंसधारक द्वारा प्रत् याजित न् यनू तम वार्तषक राजस्ट् व राजि 85.40 लाख रु. ह।ै एमबीपीटी इसमें से वार्तषक 17% का पात्र ह।ै (viii) एमबीपीटी द्वारा दकया गया 68/-रु. का पररकलन नौका के एक बार प्रयोग की दर ह ैऔर आरंजभक पूंजी जनवेि और वार्तषक आवती व् यय नीच े ददया जाता ह:ै- (क). पररकलन का आधार: पररचालक ने ‍ल वमान नौका डॉक स्ट् थाजपत करने और उसकी आवती प्रचालन तथा अनुरिण लागत में आरंजभक जनवेि के आधार पर दरों का प्रस्ट् ताव दकया ह।ै (ख). आरंजभक पूजीगत जनविे : (रु. लाख म)ें (क) मूररग सैट अलमूजनयम गग वे के साथ मैरीनटेक नौका की लागत (26 x 6मीटर ‍ लवमान डॉक के 188.00 जलए) ढुलाई संस्ट् थापन, ग गवे जमाने और उपररव् यय सजहत (ख) ढुलाई, संस् थापन और उपररव् यय सजहत सुरिा केजबन, स् कैसनग मिीन, मेटल जडटैक्ट र, 23.00 इलैजक्रकल कनैक् िन, सुरिा लाइटें (ग). जेटी 5 म ें सरु िा और बचाव व्य वस्ट् था, बचाव नौका सजहत मजोजडयक ररबस, एसओएस पेडस्ट् टल, 18.00 वॉकी-टॉकी और जीवन रिक जगयर सजहत (घ) कुल (क) + (ख) + (ग) =(घ) 229.004 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग). वार्तषक आवती लागत (रु. लाख म)ें (क) मानविजि, जेटी पयावेिक, डॉक हड स, जचदकत् सा पररचर, सुरिा कमाचारी और लाइफ गाड ा 35.00 सजहत (ख) जबजली 4.00 (ग). प ल् वमान जेटी का वार्तषक जुटाव और जवघटन ममानसून स े पहल े और बाद मेंस, जेटी नं.5 म ें 5.00 सुरिा और बचाव व् यवस्ट् था, बचाव नौका सजहत मजोजडयक ररबस, एसओएस पडै स्ट् टल, वॉकी- टॉकी और जीवन रिक जगयर सजहत। (घ) मोनसून भंडार 4.00 (ङ) जवजवध 3.00 (च) योग (क) + (ख) + (ग) + (घ) +(ङ) =(च) 51.00 (घ). प्रत् याजित न् यनू तम वार्तषक राजस्ट् व (`रु. लाख म)ें (क) वार्तषक आवती लागत की वसूली 51.00 (ख) पूंजीगत जनविे का पररिोधन (15%) 34.40 (ग) कुल प्रत् याजित न् यनू तम वार्तषक राजस्ट् व 85.40 (ङ). प्रयोक्त ाओं क की संख् या (जगनती म)ें (क) परम् परागत प्रयोक्त ाओं क की दैजनक औसत संख् या, आरबीवाईसी सदस्ट् य, अन् य नौका स्ट् वामी, 200 उनके मेहमान और कमाचारी (ख) रेस्ट् टोर ट प्रयोक्त ाओं क की दैजनक औसत संख् या 400 (ग) 1 महीने में प्रयोक्त ाओं क की कुल संख् या 18000 (घस सीज़न में प्रयोक्त ाओं क की कुल सख्ं या म7 महीनेस 126000 (च). प्रजत प्रयोक्त ा लाग ूप्रभार का पररकलन लाग ू प्रभार = प्रत् याजित न् यनू तम वार्तषक राजस्ट् व एक सीजन म ेंप्रयोक्त ाओं क की कुल संख् या = 85,40,000/-रु. / 1,26,000 प्रयोक्त ा = 68. यानी प्रजत प्रयोक्त ा एक बार एकल प्रयोग के जलए 68.00 रु. 3.2. तदनुसार, एमबीपीटी न े 01.10.2019 के पत्र संख् या टीएम/बीडीसी/एफआर(04/2017-18)/51/363/2018-19 के द्वारा श्रीमती श्रीजप्रया डालजमया जथरानी को सूजचत दकया दक प्राजधकरण द्वारा दरों का अनुमोदन प्रा‍ त होन े तक कॉमन प्रयोक्त ा आधार पर अन् य प्रयोक्त ाओं क द्वारा नौका के प्रयोग के जलए तदथ ादरें अनुमोददत की जाती ह।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5 3.3. उक्त को देखते हुए, एमबीपीटी ने इस प्राजधकरण को गेटवे ऑफ इंजडया जस्ट्थत जेटी नं.5 के ‍ लवमान नौका के प्रयोग के जलए जनम्न जलजखत प्रभारों और इन् ह ें मौजूदा अनुमोददत दरमानों म ें दरमान के भाग 9.8 म ें अंतर्तव्‍ट करन े को अनुमोददत करने का अनरु ोध दकया: “भाग – 9.8 – जटे ी सख्ं य ा 5, गटे व े ऑफ इंजडया के प्रयोग के ‍ल ावमान नौका प्रभार/दर (i). 68/-रु. एक बार/एकल प्रयोग के जलए। (ii). 9000/-रु. पूरे सीजन का पास म1 अक्त ूबर स े 15 मई तक ) (iii). 5000/- रु. आध े सीजन का पास (1 अक् त ूबर से 15 जनवरी या 16 जनवरी स े1 मई )। जवस्ट्त तृ ित ेंऔर अनबु धं न (i). नौका प्रयोग कॉमन उपयोग आधार पर होगी और आरबीवाईसी के सदस्ट् यों जनजी पांच स्ट् वाजमयों को इस सुजवधा अथवा नौका का उपयोग करने की अनुमजत होगी। (ii). नौका के 24/7 आधार पर प्रयोग की अनुमजत दी जाती ह ै बितें सुरिा कार्तमक और लाइफ गाड ा ददन- रात तनै ात दकये जात े ह। (iii). ‍लवमान जेटी न.ं 5 से नौका म ें पहुचं न े के जलए और नौका स े उन पोत को जो याजत्रयों को चढ़ाने और उतारने के जलए नौका के साथ लग जाता ह ै नौका में गाडा-रेल और ग गव े प्रदान दकये जायगें े। नौका पर रिा-बोया सरलता से उपलब्ध कराये जाने के रखे जायेंगे और रात को नौका में भली भांजत रौिनी होनी चाजहए तादक याजत्रयों को उतरने / चढ़न े में कोई करठनाई न हो। (iv). मानसून से पूवा संस्ट्थ ापन, प्रचालन, अनरु िण और अपनयन मानसून के पश् चात ् पुन: संस्ट् थापन स े संबंधी सारे व् यय नौका के पररचालक द्वारा वहन दकये जायगें े। (v). पररचालक, प ल् वमान रैस्ट् टोर ट के प्रजतित जहस्ट्स ा आधार के समान ही, नौका के प्रयोक्त ाओं क से प्रा‍ त नाजमक िुल् क की उगाही द्वारा अर्तजत राजस्ट् व में स े17% जहस्ट्स ा देगा। (vi). नौका को हर समय सागर उपयक्ु त जस्ट्थजत म ेंरखा जायगे ा। (vii). एमबीपीटी के पास सुरिा और बचाव अथवा दकसी अन् य कारण से पणू ात: अथवा दकसी भाग म ें अथवा दरूु पयोग की जस्ट्थजत म ें आवश्य कता प़नन े पर अजतररक्त ितें अनुबि करन े पर अनुपालन म ें कमी, बदनीयती स े काया करन े और/अथवा समय-समय पर उठे दकसी अन् य आधार पर इस अनुमजत को अस्ट् वीकृत/पररवर्ततत /संिोजधत/वापस लेने/जवजनछन् न करने का अजधकार आरजित ह।ै ” 4. जनधााररत परामिी प्रदक्रया के अनुसार एमबीपीटी के प्रस्ट् ताव की एक प्रजत हमारे 23 जलु ाई 2020 के पत्र के द्वारा प्रयोक्त ाओं क/प्रयोक्त ा सगं ठनों/ प्रत् याजित प्रयोक्त ाओं क/एमबीपीटी द्वारा ददये गए सुझावानुसारस को उनकी रट‍ पजणयों के जलए भेजी गई। 18 अगस्ट्त , 2020 के अनुस्ट् मारक के बावजूद मामल े की अंजतमता तक दकसी भी प्रयोक्त ा न े अपन े रट‍ पजणया ं नहीं दी जसवाए रॉयल बाम् बे याच क्ल ब मआरबीवाईसीस के। आरबीवाईसी ने 30 जलु ाई 2019 के अपन े ई-मेल के द्वारा अपनी रट‍ पजणयां भेजीं जजसे हमारे 7 अगस्ट्त 2020 के ई-मेल द्वारा एमबीपीटी को फीड बैक सूचना के रूप म ें भेजा गया। 18 अगस्ट्त 2020 और 7 अक्त बू र 2020 के अनस्ट्ु म ारकों के पश्च ात ् एमबीपीटी न े 29 अक्त बू र, 2020 के पत्र सख्ं य ा एफए/एसीसी/200 मएफआरस/2317 के द्वारा उत्तर ददया। 5. कोजवड-19 महामारी और वचयुा ल बैठकों के आयोजन के बारे में पोत पररवहन मंत्रालय मएमओएसस के 16 अप्रलै 2020 के पत्र संख् या 11053/30/2020-समन व् य को ध् यान में रखकर संदभााधीन मामले में वीजडयो कान् रेससग के माध् यम से 26 अगस्ट् त, 2020 को एक संयुक् त सुनवाई का आयोजन दकया गया। संयुक् त सुनवाई म,ें एमबीपीटी ने अपन े प्रस्ट्त ाव का6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] पावर ‍ वाईंट ट प्रस्ट् तुतीकरण ददया। संयुक् त सुनवाई के दौरान एमबीपीटी और प्रयोक्त ाओं क/प्रयोक्त ा संगठनों ने अपन-े अपन े जनदेदन रखे। 6. प्रस त् ाव की आरंजभक संवीिा पर एमबीपीटी स े कुछेक मदों ु ों पर अजतररक्त सूचना/स्ट् प्‍ट ीकरण मांगा गया था। 18 अगस्ट्त , 2020 और 7 अक्त ूबर 2020 के अनुस्ट् मारकों के बावजूद एमबीपीटी न े मामल े को अंजतम रूप से जलय े जाने तक वांजछत सूचना प्रस्ट् ततु नहीं की ह।ै चूंदक प्रस्ट्ताव एक प्रिुल्क मामले के रूप म ें प्राि हुआ ह,ै इसे अजनजित काल तक लजम्बत रखना वांछनीय नहीं ह।ै 7. इस मामले में परामिा संबंधी कारावाई इस प्राजधकरण के कायाालयी ररकॉडा म ेंउपलब् ध ह।ै संबजं धत पिों द्वारा ददए गए मतों का सार उनको पथृ क रूप से प्रेजषत दकया जाएगा। ये जववरण हमारी वेबसाइट http://tariffauthority.gov.in पर भी उपलब्ध कराए जाएंगे। 8. मामले के संसाधन के दौरान एकत्र की गई सूचना की समग्रता के आधार पर, जनम न् जलजखत सूचना उभर कर सामने आती ह:ै- (i). मुंबई पत्तन न् यास मएमबीपीटीस ने गेटवे ऑफ इंजडया म ें ‍ल वमान रैस्ट् टोर ट के पररचालन के जलय े लाइसेंस धारक को लाइसेंस जारी दकया। इस संबंध म,ें ‍ लवमान रेस्ट्ट ोर ट म ें आने वाल े ग्राहकों को चढ़ने और उतरने म ें सुरजित और जनरापद व् यावस्ट् था करने के जलए, एमबीपीटी ने लाइसेंस धारक को गेटवे ऑफ इंजडया की जेटी संख् या 5 म ें ‍ लवमान नौका पररचालन के लाइसेंस की अनुमजत दी। लेदकन, व् यवस्ट् था पररचालन म ें यह संकल् पना की गई ह ै दक उक्त नौका का प्रयोग न केवल ‍ लवमान रैस्ट् टोर ट आने जान े वाले ग्राहकों के प्रयोग म ेंलाई जायेगी बजल्क अन् य प्रयोक्त ाओं क के जलए भी प्रयोग म ें लाई जा सकती ह।ै तत्क ालीन पोत पररवहन मंत्रालय द्वारा जारी प्रिुल् क नीजत 2018 के खडं 8.1, 8.2 और 8.3 और प्रिुल् क नीजत 2018 को कायााजन्वत करन े के जलए जारी कायाकारी ददिाजनदेिों के खंड 6 के साथ परठत मकायाकारी ददिाजनदेि 2018स, के अनुसार, संबंजधत महापत्तन न् यास प्रिल्ु क जवजनयमों के दायरे के अंतगता आने वाली अजधकृत सवे ाओं क की पहचान करने के पश् चात्, उन मामलों म ें अनज्ञु जि व् यवस्ट् था धारा 42म3स के अतं गता बीओटी ररयायत करार स े जभन् न होन े पर पररचालकों द्वारा उगाही जाने वाली अजधकतम दरों का प्रस्ट् ताव भेजगे ा। इस पृष्ठभूजम म,ें एमबीपीटी ‍ल वमान नौका के प्रयोग के दर जनधाारण का प्रस्ट् ताव लेकर आया ह।ै एमबीपीटी का दकसी सेवा प्रदात्ता के संदभा के जबना इन दरों को अपने दरमानों में अंतर्तव्‍ट करने का प्रस्ट् ताव ह।ै पत्तन के प्रस्ट् ताव को एमबीपीटी के न् यासी मंडल का अनुमोदन प्रा‍ त ह।ै (ii). प्रिुल् क नीजत 2018 का खडं 8.2 अनुबि करता ह ै दक यदद सी दकसी व् यवस्ट् था म ें दकसी जवजि्‍ट सेवा/सुजवधा के जलए संबंजधत महापत्तन म ें प्रिुल् क की अजधकतम सीमा जनधााररत नहीं ह ै तो पत्तन दकसी अन् य महापत्तन न् यास म ें समान सेवा/सुजवधा के जलए जनधााररत प्रिलु क् को अपना सकता ह।ै यदद दकसी भी महापत्तन न् यास म ें कोई प्रिुल् क जनधााररत नहीं ह ै अथवा जनधााररत दर संकजल्पत कायो/सेवा/सुजवधा को प्रजतजनजधत्व नहीं करती ह,ै पत्तन न् यास 2008 के ददिाजनदेिों के जसिांतों का अनुपालन करते हुए इ्‍ट तम िमता के आधार पर अथवा जनधााररत िमता के आधार पर [सेवा/सुजवधा/उपस्ट् कर की तकनीकी जवजिजियों के संदभ ा म]ें प्रस्ट् ताव दायर कर सकता ह।ै प्रिुल्क नीजत 2018 के खंड 7.6.1 के संदभा म ें कायाकारी ददिाजनदेिों का खंड 5.7.1. भी लागत जमा 16% लाभ का सूत्र जनधााररत करता ह।ै (iii). इस प्राजधकरण द्वारा दकसी अन्य महापत्तन न् यास में ‍ लवमान नौका के जलए कोई प्रभार जनधााररत नहीं दकये ह। प्रिुल् क ददिाजनदेि 2008 में ‍ल वमान नौका सुजवधाओं क के प्रिल्ु क जनधाारण संबंधी कोई जवजि्‍ट ददिाजनदेि नहीं ह।ै तदनुसार, एमबीपीटी ने अपना प्रस्ट् ताव तयै ार दकया ह ै तादक वार्तषक आवती प्रभारों की वसूली जमा पूंजीगत व् यय का पररिोधन दकया जा सके, जैसा आगामी परै ाओं क में चचाा की जा रही ह।ै[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 7 (iv). सुजवधा का प्रयोग करन ेवाल ेप्रयोक्त ाओं क की प्रजत वष ासख्ं य ा: रैस् टोर ट प्रयोक्त ाओं क की दैजनक औसत संख् या 400 आकजलत की गई ह ै और 200 अन् य प्रयोक्त ाओं क की दैजनक औसत का आकलन दकया गया ह।ै इस प्रकार एक ददन म ें 600 ग्राहकों के आने का अनुमान लगाया गया ह।ै प्रजत माह 30 ददन का और प्रजत वष ा 7 माह के सीज़न को सुजवचार म ें लेन े पर, एमबीपीटी ने एक वषा में सुजवधा का प्रयोग करने वाल े प्रयोक् ताओं क का अनमु ान 1,26,000 लगाया ह।ै यह लाइसेंस धारक द्वारा एमबीपीटी को ददये गए आकलन पर आधाररत ह और एमबीपीटी ने इसे अपने प्रस्ट्त ाव म ें सुजवचार में जलया ह।ै एमबीपीटी द्वारा बताये गए प्रयोक्त ाओं क की संख्या के आकलन पर जवश् वास दकया जाता ह।ै (v). एमबीपीटी ने प्रस्ट् ताजवत दर जनकालन े के जलए सुजवचाररत प्रत् येक लागत घटक पर नीचे के पैराओं क म ें चचाा की जा रही ह:ै (क). पजूं ीगत लागत ‍ लवमान नौका के जवकास और अन् य संबंजधत सुजवधाओं क के जलए आरंजभक पूंजीगत लागत 229.00 लाख रु. आकजलत की गई ह।ै इससे मूररग सैट अलमूजनयम गग वे के साथ मैरीनटेक नौका की लागत म26 x 6मीटर ‍ लवमान डॉक के जलएस ढुलाई संस्ट् थापन, ग गवे जमाने और उपररव् यय सजहत ढुलाई, संस्ट् थापन और उपररव् यय सजहत सुरिा केजबन, स्ट् कैसनग मिीन, मेटल जडटैक्ट र, इलैजक्रकल कनैक् िन, सुरिा लाइटें जेटी 5 म ें सुरिा और बचाव व् यवस्ट् था, बचाव नौका सजहत मजोजडयक ररबस, एसओएस पडे स्ट् टल, वॉकी-टॉकी और जीवन रिक जगयर सजहत िाजमल ह।ै 229.00 लाख रु. के पूंजीगत जनवेि पर भरोसा दकया जाता ह।ै इस बारे म ें आरबीवाईसी स े परामि ादकया गया उन् ह ेंकोई आपजत्त नहीं ह।ै (ख). वार्तषक आवती लागत (i). कुल वार्तषक आवती व् यय का आकलन 51.00 लाख रु. प्रजत वषा दकया गया ह।ै इसम ें मानविजि, जेटी पयावेिक, डॉक हड स, जचदकत् सा पररचर, सुरिा कमाचारी और लाइफ गाड ा सजहत के 35.00 लाख रु. प्रजत वष;ा ‍ लवमान जेटी का वार्तषक जुटाव और जवघटन ममानसून स े पहले और बाद मसें , जेटी नं.5 म ें सुरिा और बचाव व् यवस्ट् था आदद के 5.00 लाख रु.; जबजली उपभोग और मानसून भडं ारण की प्रत् यके मद के 4.00 लाख रु. और 3.00 लाख रु. अन् य जवजवध व् ययों के िाजमल ह। आकजलत व् ययों पर भरोसा दकया जाता ह।ै इस संबंध म ेंआरबीवाईसी को कोई आपजत्त नहीं ह।ै (ii). 229 लाख रु. के आरंजभक जनविे को 15% प्रजत वषा की दर स े पररिोजधत दकया गया ह ैजो 34.40 लाख रु. प्रजत वष ा बनता ह।ै (vi). जवजभन् न लागत घटकों के आधार पर, जैसी पूवावती पैराओं क म ें चचा ा की गई ह,ै एमबीपीटी द्वारा सुजवधा की वार्तषक राजस्ट् व अपेिा 85.40 लाख रु. प्रजत वषा आकजलत की गई ह।ै यह सुजवचार म ें लेते हुए दक ‍ लवमान नौका का प्रयोग करने वाल े प्रयोक्त ाओं क की संख् या 1,26,000 प्रजत वष ा रहगे ी, जैसा पहल े बताया गया ह,ै एमबीपीटी ने प्रजत व् यजि एक बार आन े के जलए 67.78 रु. की औसत लागत जनकाली ह ै जजसे एमबीपीटी द्वारा 68.00 रु. प्रजत व् यजि के जलए पूणाांदकत कर ददया ह।ै तदनुसार, ‍ लवमान नौका के जलए एक बार/एकल प्रयोग के जलए 68.00 रु. का प्रस्ट् ताव दकया गया ह।ै एमबीपीटी ने 1 अक्त ूबर स े 15 मई तक की अवजध के जलए म7.5 माहस ‍ल वमान नौका के प्रयोग के जलए पूरे सीजन पास के 9000/-रु. प्रजत व् यजि की दर से और 1 अक् तूबर से 15 जनवरी मयानी 3.5 माहस तथा 16 जनवरी से 1 मई तक मयानी 3.5 माहस की अवजध के जलए 5000/-रु; प्रजत व् यजि की दर स े आधा सीजन पास की दर का प्रस्ट् ताव भी दकया ह।ै पूरे सीजन पास और आधा सीजन पास की प्रस्ट्त ाजवत दरों पर आरवीवाईसी कोई जवजि्‍ट आपजत्त नहीं ह।ै प्रस्ट् ताजवत दरों पर भरोसा दकया जाता ह।ै8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] यह बताया गया ह ै दक दकसी भी प्रयोक्त ा न े एमबीपीटी द्वारा प्रस्ट् ताजवत दरों पर कोई आपजत्त नहीं की ह ै और यह भी दक पत्तन के प्रस्ट्त ाव को एमबीपीटी के न् यासी मंडल का अनुमोदन प्रा‍ त ह,ै यह प्राजधकरण पत्तन द्वारा यथाप्रस्ट् ताजवत प्रभारों को अनुमोददत करने को प्रवृत्त ह।ै (vii). एमबीपीटी ने इस प्रभाव की रट‍ पणी संख् या मiस का प्रस्ट्त ाव दकया ह ै दक नौका प्रयोग कॉमन उपयोग आधार पर होगी और आरबीवाईसी के सदस्ट् यों जनजी पांच स्ट् वाजमयों को इस सुजवधा अथवा नौका का उपयोग करने की अनुमजत होगी। चूंदक प्रस् ताजवत रट‍ पणी जद्वअथाकता स े बचने के जलए स्ट् प्‍ट ता प्रदान करती ह ैउक्त रट‍ पणी का जनधाारण अनुमोददत ह।ै (viii). रट‍ पणी संख् या मii) और मiii) इस प्रभाव के जलए प्रस्ट्त ाजवत की गई ह दक नौका के 24/7 आधार पर प्रयोग की अनुमजत दी जाती ह ैबितें सुरिा कार्तमक और लाइफ गाडा ददन-रात तैनात दकय े जाते ह। और स्ट् लोसपग जेटी नं.5 स े नौका म ें पहुचं न े के जलए और नौका स े उस पोत को जो याजत्रयों को चढ़ाने और उतारने के जलए नौका के साथ लग जाता ह ै नौका म ें गाड-ा रेल और ग गव े प्रदान दकये जायगें े। नौका पर रिा-बोया सरलता स े उपलब् ध कराय े जाने के रखे जायगें े और रात म ें नौका म ें भली भांजत रौिनी होनी चाजहए तादक याजत्रयों को उतरने चढ़ने म ें कोई करठनाई न हो। चूंदक, प्रस्ट्ताजवत रट‍पणी ‍ लवमान नौका का प्रयोग करने वाले याजत्रयों की सुरिा और बचाव स े संबंजधत ह,ै प्रस्ट्ताजवत रट‍पणी का जनधाारण अनुमोददत दकया जाता ह।ै चूंदक, प्रस्ट्ताजवत रट‍पणी प ल् वमान नौका का प्रयोग करन े वाले याजत्रयों की सुरिा और बचाव स े संबंजधत ह,ै प्रस्ट्ताजवत रट‍पणी का जनधाारण अनुमोददत दकया जाता ह।ै (ix). प्रस्ट् ताजवत रट‍ पणी संख् या मiv), (v), (vi), और मvii) सामान् यत: सी ित ें ह जजनका लाइसेंसधारक द्वारा अनुपालन दकया जाना एमबीपीटी स े संबंजधत ह।ै य े रट‍पजणयां पत्तन और लाइसेंसधारक के बीच लाइसेंस करार का भाग हो सकती ह। उक्त रट‍ पजणया ं ‍ल वमान नौका के प्रिल्ु क की उगाही के संदभ ा म ें असंगत ह। उक्त को देखते हुए रट‍ पणी संख् या मiv), (v), (vi), और मvii) को एमबीपीटी के दरमानों म ें अंतर्तव्‍ट नहीं दकया जा सकता। (x). परामि ा ज‍र क्रया के दौरान, आरबीवाईसी ने एक मुदों ा उठाया दक ‘एक बार’ प्रयोग के जलए जनधााररत 68/-रु. की दर पूरे ददन के जलए लाग ू होगी या नौका के प्रत् यके प्रयोग पर। इस संबंध म ें एमबीपीटी ने स्ट् प्‍ट दकया दक उसी रटकट लागत पर उसी ददन म ें एक बार के जलए ‘‘वापसी’’ की अनुमजत भी होगी। तदनुसार, एमबीपीटी के दरमान में इस प्रभाव की एक रट‍ पणी जनधााररत की जाती ह।ै (xi). प्रिुल् क और प्रिल्ु क को िासी करन े वाली सोपाजधकताए ं अनमोददत दरों के कायाान् वयन की तारीख स े प्रभावी होंगी। 9.1. पररणाम म ें और ऊपर बताये गए कारणों तथा सामूजहक जवचार-जवमिा के आधार पर यह प्राजधकरण जनम्न जलजखत नए भाग को एमबीपीटी के मौजूदा दरमान म ें भाग 9.8 – जेटी संख् या 5, गटे वे ऑफ इंजडया म ें ‍ लवमान नौका के प्रभार के रूप में अध् याय 9- जवजवध र्तव्‍ट करन े का जनदेि ददया जाता ह।ै 9.3. उक् त जनधारा ण अनुमोददत दरों के कायाान् वयन की तारीख से प्रभावी होंगे और एमबीपीटी के मौजूदा दरमानों की वैधता के साथ सह-समा‍ य होंगे। टी.एस. बालसुब्रमजनयन, of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby disposes of the proposal received from Mumbai Port Trust (MBPT) for fixation of rate for usage of floating pontoon at Jetty 5, Gateway of India, as in the Order appended hereto. Tariff Authority for Major Ports Case No. TAMP/22/2020-MBPT The Mumbai Port Trust - - - Applicant QUORUM (i). Shri. T.S. Balasubramanian, Member (Finance) (ii). Shri. Sunil Kumar Singh, Member (Economic) O R D E R (Passed on this 28th day of December, 2020) This case relates to a proposal received from Mumbai Port Trust (MBPT) vide its letter No. FA/ACC/200(FR)/1352 dated 23 June 2020 for fixation of rate for usage of floating pontoon at Jetty 5, Gateway of India. 2. This Authority vide its Order No. TAMP/5/2019-MBPT dated 24 July 2019 has notified the General Scale of Rates of MBPT. The revised Scale of Rates along with Performance Standards approved by this Authority was notified vide Gazette No. 308 dated 03 September 2019. 3.1. In this backdrop, the MBPT vide its letter dated 23 June 2020 has come up with a proposal for fixation of rate for usage of floating pontoon at Jetty 5, Gateway of India. The main submissions made by MBPT in its proposal are summarised below:10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (i). License has been awarded to Smt. Shripriya Dalmia Thirani for operation of Floating Restaurant at Gateway of India vide MBPT Letter No. TM/BDC/FR(04/2017-18)/ 247/ 2017-18 dated 27 June 2017. For safe and secure embarkation and disembarkation from Gateway of India, Jetty no.5, permission has been granted for placement of floating pontoon by Dy. Conservator. Important conditions are as given below: (a). Pontoon usage will be on common user basis also for other users. (b). Security and life guard are to be provided by Licensee. (c). Pontoon to have safety and security features, as railings, lifebuoys, lighting/ illumination, etc. (d). Licensee may recover a nominal charge from users. (e). Licensee will share 17% from these nominal charge with MBPT. (ii). The pontoon has been put up from 23.03.2019, and is being used for ferrying the guests to and fro floating restaurants. It is an important facility enhancing the safety and security and also comfort of boarding/ de boarding, etc. (iii). Smt. Shripriya Dalmia Thirani vide letter dated 16.04.2019 informed that several requests from users of Jetty No. 5 are received to allow them to use pontoon. In this regard, the meeting was held on 28.03.2019. The operator informed that with a view to allow other users to make use of the pontoon facility for their passengers, it was requested to approve the rates at least on ad-hoc basis, till the finally approved rates are conveyed by MBPT, so that they are not put to loss and the other users can avail the improved safe and secure services of pontoon for access to their boats. (iv). The operator was advised to submit a proposal with consent of probable users as is required for approval process by TAMP. Accordingly, Smt. Shripriya Dalmia Thirani vide letter dated 16.04.2019, has enclosed email from Royal Bombay Yacht Club and Vision Yacht Services both dated 17.04.2019 and of Kiran Resources Pvt. Ltd., M/s Marine Solutions, Shri Rajesh Aiya and M/s. Credence Logistics dated 10.04.2019, 13.04.2019, 02.04.2019 and 06.04.2019 respectively requesting to accord permission to use floating Jetty (Pontoon) for embarking and disembarking at Jetty no. 5, Gateway of India. (v). Smt. Shripriya Dalmia Thirani vide letter dated 16.04.19 proposed the user rates as below; (a). `.70/- for one time / single use (b). `.9000/- for a full season pass (1st October to 1st May ) (c). `.5000/- for half season pass (1st October to 15th Jan or 16th Jan to 1st May). (vi). A proposal was placed before the Board of Trustees of MBPT. The Board has accorded approval vide its TR No.102 dated 20.08.2019. A copy of the same is furnished by MBPT. The Board has approved the following: (a). To fix the ad-hoc rates for the usage of pontoon on common user basis, as below:- (i). `.68/- for one time / single use (ii). `.9000/- for a full season pass (1stOctober to 15th May) (iii). `.5000/- for half season pass (1stOctober to 15thJan or 16th Jan to 1st May) (b). to submit proposal to TAMP for obtaining approval of rates at (a) above. (vii). Financial implications for the port is the revenue share that MBPT will get from the charges received by the Licensee @17% of gross receipts on account of these charges. The minimum annual revenue expected by the Licensee is `.85.40 lakhs. The MBPT is entitled to 17% of this annually. (viii) The calculation as made by MBPT for single usage of pontoon as one time rate of `.68/- and initial capital investment and annual recurring expenditure is given below: (a). Basis of calculation: The Operator has proposed rates based on their initial investment in setting up the floating pontoon dock and the recurring costs in operating and maintaining the same.[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 11 (b). Accordingly, the MBPT vide its letter no. TM/BDC/FR(04/2017-18)/51/363/2018-19 dated 01.10.2019 has informed Mrs. Shripriya Dalmia Thirani that the ad-hoc rates for the usage of pontoon by other users on common user basis till the time TAMP Rates are approved. 3.3. In view of the above, the MBPT has requested this Authority to approve the following proposed charges for12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Floating pontoon usage at Jetty No.5, Gateway of India and to incorporate in the existing approved Scale of Rates at Section 9.8 of SOR : ―Section – 9.8 – Charges/rate for Floating pontoon usage at Jetty No.5, Gateway of India. (i) `.68/- for one time / single use (ii). `.9000/- for a full season pass ( 1st October to 15th May ) (iii). `.5000/- for half season pass (1stOctober to 15thJan or 16th Jan to 1st May) Detailed terms and conditions (i). The pontoon usage will be on common use basis and the members of RBYC, private yacht owners are to be permitted to utilize the facility or pontoon. (ii). The permission to utilize pontoon on 24/7 basis is given provided security personnel and life guard are provided round the clock. (iii). The pontoon shall be provided with guard-rail and gangway for safe access from sloping jetty No.5 to the pontoon and also from pontoon to vessel that comes alongside for embarkation and disembarkation of passengers. Lifebuoys to be kept easily available on the pontoon and pontoon to be well lit at night so that passenger do not face any difficulty in alighting or boarding. (iv). All expenses towards installation, operation, maintenance and removal prior to monsoon and reinstallation post monsoon will be borne by the operator of the pontoon. (v). The operator will share 17% of the revenue that has been earned by levying nominal fee from the users of pontoon on the similar lines of percentage share basis of the floating restaurant. (vi). Pontoon to be maintained in seaworthy condition at all times. (vii). The MbPT reserves the right to reject/ alter/ change/ withdraw/ discontinue the permission subject to safely and security or any other reason in full or in part or stipulate additional conditions if and when deemed necessary on the found of misuse, lack of compliance, act in bad faith and / or any grounds arising from time to time.‖ 4. In accordance with the consultative procedure prescribed, a copy of the MBPT proposal was forwarded to the concerned users/ user organizations / prospective users (as suggested by MBPT) vide letter dated 23 July 2020 seeking their comments. Inspite of a reminder dated 18 August 2020, none of the users have given their comments except for Royal Bombay Yacht Club (RBYC), till the case was finalised. The RBYC vide its e-mail dated 30 July 2019 has furnished its comments which was forwarded to MBPT vide our e-mail dated 07 August 2020 as feedback information. After reminders dated 18 August 2020 and 7 October 2020, the MBPT vide its letter No. FA/ACC/200(FR)/2317 dated 29 October 2020 has responded. 5. In view of the outbreak of COVID – 19 and in pursuance of the Ministry of Shipping (MOS) letter No. 11053/30/2020-Coord. dated 16 April 2020 to hold virtual meetings, a joint hearing on the case in reference was held on 26 August 2020 through Video Conferencing. At the joint hearing, MBPT made a brief power point presentation of its proposal. The MBPT and the users/ user organizations have made their submissions during the joint hearing. 6. On a preliminary scrutiny of the proposal, additional information/ clarification was sought from MBPT on few points. Inspite of reminders dated 18 August 2020 and 7 October 2020, the MBPT has not furnished the requisite information till the case is taken up for finalisation, since the proposal is received as a ―tariff Case‖, it is not desirable to keep it pending indefinitely. 7. The proceedings relating to consultation in this case are available on records at the office of this Authority. An excerpt of the comments received from users / user organisations and arguments made by the concerned parties will be sent separately to them. These details will also be made available at our website http://tariffauthority.gov.in. 8. With reference to the totality of the information collected during the processing of the case, the following position emerges: (i). The Mumbai Port Trust (MBPT) has awarded License to a Licensee for operation of Floating Restaurant at Gateway of India. In this connection, inorder to ensure safe and secure embarkation and disembarkation of the patrons visiting the Floating Restaurant, the MBPT has granted permission to the Licensee for placement of floating pontoon at Jetty no. 5 of Gateway of India. However, the arrangement envisaged is that the said Pontoon will be used not only by the patrons visiting the Floating Restaurant, but will be used by other users also.[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 13 In accordance with clause 8.1, 8.2 and 8.2 of the Tariff Policy 2018 issued by the then Ministry of Shipping read with clause 6 of the working guidelines issued to operationalize the Tariff Policy 2018, (Working Guidelines 2018), the concerned Major Port Trust after identifying authorized services coming under the ambit of tariff regulation, shall forward a proposal for the ceiling rates to be levied by the operators, in the cases where authorization arrangement u/s 42(3) is other than by way of a BOT concession agreement. In this backdrop, the MBPT has come up with a proposal for fixation of rate for usage of Floating Pontoon. The MBPT proposes to incorporate the rates in its Scale of Rates, without reference to any service provider. The proposal of the port has the approval of the Board of Trustees of MBPT. (ii). Clause 8.2 of the Tariff Policy, 2018, stipulates that, in case there is no ceiling tariff prescribed in the concerned Major Port for a particular service/ facility under such arrangement, the port shall adopt the tariff prescribed for the similar service/ facility prescribed in any other Major Port Trust. If there is no tariff prescribed in any Major Port Trust or the rate prescribed is not representative for the cargo/ service/ facility envisaged, the Port Trust may file a proposal with reference to optimal capacity following the principles of 2008 guidelines or based on rated capacity. [with reference to the technical specification of the service/ facility/ equipment]. Clause 5.7.1 of the Working Guidelines also prescribes, in the context of clause 7.6.1 of the Tariff Policy, 2018, cost plus 16% return formula (iii). No charges have been fixed by this Authority for usage of floating pontoon at any other Major Port Trusts. There is no specific guidelines for determining the tariff for Floating Pontoon facilities in the 2008 Tariff Guidelines. Accordingly, the MBPT has formulated its proposal so as to recover the annual recurring charges plus amortization of capital expenditure, as discussed in the subsequent paragraphs. (iv). Number of Users expected to utilize the facility per annum: The average daily number of restaurant users has been estimated at 400 numbers and average of other users has been estimated at 200 per day, thereby aggregating to 600 users in a day. Considering 30 days per month and 7 months season period in a year, the MBPT has arrived at the annual number of users expected to utilize the facility at 1,26,000. It is based on the estimates given by the licensee to the MBPT and considered in the proposal by MBPT. The number of estimated users furnished by MBPT is relied upon. (v). Each of the cost component considered by the MBPT to arrive at the proposed rate is discussed in the following paragraphs: (a). Capital cost: Initial capital cost for the development of the floating pontoon and other related facilities is estimated at `.229.00 lakhs. This is reported to be comprising of cost of Marinetek pontoon (26 x 6m floating dock) with mooring set, aluminum gangway, transportation, installation, gangway fixing, overheads, cost of security cabin, scanning machines, metal detectors, electrical connections, security lights, including transportation, installation, overheads, Safety and rescue arrangements at Jetty 5 including rescue boat (Zodiac RIB) SOS pedestals, walkie-talkies and life-saving gears. The capital investment to the tune of ₹.229.00 lakhs is relied upon. There is no objection from RBYC consulted in this regard. (b). Annual Recurring Cost (i). The total annual recurring expenses have been estimated at `.51.00 lakhs per annum. This comprises of an amount of `.35.00 lakhs per annum towards Manpower comprising of Jetty supervisor, dock hands, medical attendant, security staff and life guards, `.5.00 lakhs per annum towards expenses of mobilization and demobilization of floating jetty (before and after monsoons) and expenses towards Safety and rescue arrangements at Jetty no. 5 etc., `.4.00 lakhs per annum each towards expenditure on Electricity consumption and Monsoon Storage and an amount of `.3.00 lakhs towards other miscellaneous expenditure. The estimated expenses are relied upon. There is no objection from the RBYC in this regard. (ii). The initial capital investment of ` 229 lakhs has been amortised by the Port @ 15% per annum, which works out to about ` 34.40 lakhs per annum. (vi). Based on the various cost components as discussed in the preceding paragraphs, the annual revenue requirement for the facility has been estimated by the MBPT at `..85.40 lakhs per annum. Considering that number of users utilizing the floating pontoon at 1,26,000 per annum, as stated14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] earlier, the MBPT has worked out the average cost of `.67.78 /- per person for one visit, which has been rounded off by MBPT to `.68.00 per person. Accordingly, the charges for usage of floating pontoon has been proposed at `. 68 for one time/ single use. The MBPT has also proposed charges towards Full Season pass for usage of Floating Pontoon for the period from 1st October to 15 May (i.e. 7.5 months) at `.9000/- per person and a charge of `.5000/- towards Half Season pass for the period from 1st October to 15 Jan (i.e.3.5 months) or from 16th Jan to 1st May (i.e. 3.5 months). There is no specific objection from the RBYC for the proposed rates for full season pass and half season pass. These proposed rates are relied upon. Given that none of the users have objected to the rates proposed by the MBPT and also since the proposal of the Port has the approval of the Board of Trustees of MBPT, this Authority is inclined to approve the charges as proposed by the port. (vii). The MBPT has proposed a note (i) to the effect that the pontoon usage will be on common use basis and the members of RBYC, private yacht owners are to be permitted to utilize the facility or pontoon. Since the proposed note gives clarity and avoids ambiguity, the prescription of the above note is approved. (viii). The Notes (ii) and (iii) have been proposed to the effect that the permission to utilize pontoon on 24/7 basis is given provided security personnel and life guard are provided round the clock and the pontoon shall be provided with guard-rail and gangway for safe access from sloping jetty No.5 to the pontoon and also from pontoon to vessel that comes alongside for embarkation and disembarkation of passengers. Lifebuoys to be kept easily available on the pontoon and pontoon to be well lit at night so that passenger do not face any difficulty in alighting or boarding. Since the proposed notes relate to safety and security aspects of the passengers who use the floating pontoon, the prescription of the proposed notes is approved. (ix). The proposed Notes (iv), (v), (vi), and (vii) are generally seen to be conditions to be complied with licensee in relation to the MBPT. These notes can form part of the License Agreement between Port and Licensee. The said notes are not relevant in connection with the levy of tariff regarding Floating Pontoon. In view of the above, the Notes (iv), (v), (vi), and (vii) are not incorporated in the SOR of MBPT. (x). During the consultation process, RBYC had raised a point as to whether the rate of `.68/- prescribed for ‗‘one time‘‘ use would be applicable for the entire day or for each usage of the pontoon. In this regard, the MBPT has clarified ―Return‖ use shall also be permitted in the same ticket cost, once in the same day. Accordingly, a note to this effect is prescribed in the SOR of MBPT. (xi). The tariff and the conditionalities governing the application of tariff shall into force from the date of implementation of the approved rates. 9.1. In the result, and for the reasons given above and based on a collective application of mind, this Authority approves incorporation of the following new section as Section 9.8 – Charges for Floating Pontoon usage at Jetty No.5, Gateway of India, under Chapter – IX – Miscellaneous Charges, in the existing Scale of Rates (SOR) of MBPT: ― Section – 9.8 – Charges for Floating pontoon usage at Jetty No.5, Gateway of India. (i) `.68/- per person for one time / single use (ii). `.9000/- per person for a full season pass ( 1st October to 15th May ) (iii). `.5000/- per person for half season pass (1stOctober to 15thJan or 16th Jan to 1st May) Detailed terms and conditions (i). The charges for one time / single use prescribed at (i) above includes return usage on the same day. (ii). The pontoon usage will be on common use basis and the members of RBYC, private yacht owners are to be permitted to utilize the facility or pontoon. (iii). The permission to utilize pontoon on 24/7 basis is given provided security personnel and life guard are provided round the clock.[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 15 (iv). The pontoon shall be provided with guard-rail and gangway for safe access from sloping jetty No.5 to the pontoon and also from pontoon to vessel that comes alongside for embarkation and disembarkation of passengers. Lifebuoys to be kept easily available on the pontoon and pontoon to be well lit at night so that passenger do not face any difficulty in alighting or boarding. ‖ 9.2 The MBPT is directed to suitably incorporate the above provisions in its Scale of Rates. 9.3. The above prescription shall come into effect from the date of implementation of the approved rates and shall remain valid co-terminus to the validity of the existing Scale of Rates T.S.
