The Ministry of Ports, Shipping and Waterways (MOPSW) [the then Ministry of Shipping (MOS)] vide its communication No.PR-14019/16/2012-PG dated 9 September 2013 and 12 September 2013 issued Revised Guidelines for Determination for Tariff for Projects at Major Ports, 2013 under Section 111 of the Major Port Trusts, Act, 1963 (38 of 1963). 1.2. The said Guidelines for Determination for Tariff for Projects at Major Ports, 2013 were notified by TAMP in the Gazette of India on 30 September 2013 vide Gazette No. 254 in compliance of policy direction issued by the Government of India under section 111 of the Major Port Trusts Act, 1963. These guidelines came into effect from 9 September 2013. 2. Clause 1.6 of the said guidelines referred here as Reference Tariff Guidelines of 2013 stipulates that unless revoked or modified earlier, the Guidelines may be reviewed and revised after 5 years from the date of its issue. Accordingly, the said Reference Tariff Guidelines, 2013 which came into effect from 9 September 2013 was valid till 8 September 2018. 3. In pursuance of the MOPSW letters dated 10 December 2018, 15 October 2019, 25 August 2020 and 1 March 2021, extending the validity of “Guidelines for Determination for Tariff for Projects at Major Ports, 2013” from time to time, this Authority has notified the Orders extending the validity of the „Guidelines for Determination for Tariff for Projects at Major Ports, 2013‟ from time to time. The last extension was notified by this Authority vide Order No.TAMP/18/2013-Misc dated 16 March 2021 wherein this Authority has extended the validity of the said Guidelines for a further period of six months from the date of its expiry i.e. from 9 March 2021 till 8 September 2021 or until further orders, whichever is earlier. The said Order was published in the Gazette of India on 12 April 2021 vide Gazette No.153. 4. The Reference Tariff Guidelines are under review by the MOPSW in consultation with the Major Port Trusts and BOT operators. The finalization of the Reference Tariff Guidelines may take some more time. The MOPSW vide its letter No.PR-14019/16/2012-PG dated 16 September 2021 has conveyed the approval of the Competent Authority to extend the validity of Revised Guidelines for Determination for Tariff for Projects at Major Ports, 2013” for a further period of six months i.e. till 8 March 2022 or till further orders whichever is earlier. 5. Accordingly, this Authority notifies the extension of the validity of the „Revised Guidelines for Determination of Tariff for Projects at Major Ports, 2013‟ for a further period of six months from the date of its expiry i.e. from 9 September 2021 to 8 March 2022 or until further orders, whichever is earlier.
