1.1. पत्तन, पोत पररिहन और जलमागच मंत्रालय (एमओपीएसडब्लल्यू) [तत्कालीन पोत पररिहन मंत्रालय (एमओएस)]
ने अपने पत्र संख्या पीआर-14019/16/2012-पीजी ददनांक 9 जसतम्बर 2013 और 12 जसतम्बर 2013 द्वारा महापत्तन
न्यास अजधजनयम, 1963 (1963 का 38) की धारा 111 के अंतगचत महापत्तन जस्ट्थत पररयोजनाओं के जलए प्रिुल्क के जलए
जनधाचरण के जलए संिोजधत ददिा-जनदिे जारी दकए थे।
1.2. महापत्तन न्यास अजधजनयम, 1963 की धारा 111 के अंतगचत भारत सरकार द्वारा जारी नीजतगत जनदिे ों के
अनुपालन में महापत्तन, 2013 पर पररयोजनाओं के जलए प्रिुल्क के जलए जनधाचरण के जलए उक्त ददिा-जनदिे महापत्तन
प्रिुल्क प्राजधकरण द्वारा 30 जसतम्बर 2013 को राजपत्र संख्या 254 द्वारा भारत के राजपत्र में अजधसूजचत दकए गए थे।
इन ददिा-जनदिे ों को 9 जसतम्बर 2013 से लागू दकया गया था।
2. उक्त ददिा-जनदिे ों के खण्ड 1.6 जजसे यहां 2013 के संदभच प्रिुल्क ददिा-जनदिे कहा गया ह,ै में यह जिजनर्ददष्ट ह ै
दक जब तक इसे सामान्य समय से पहले रद्द अथिा संिोजधत नहीं दकया जाता, इन ददिा-जनदिे ों की इसके जारी होने की
तारीख से 5 िर्षों के पश्चात समीक्षा की जाएगी और संिोजधत दकया जाएगा। तद्नुसार, उक्त संदभच प्रिुल्क ददिा-जनदिे ,
2013, जजन्ह ें9 जसतम्बर 2013 से लागू दकया गया है, 8 जसतम्बर 2018 तक जिजध मान्य थे।
3. पत्तन, पोत पररिहन और जलमागच मंत्रालय के पत्र ददनांक 10 ददसम्बर 2018, 15 अक्तूबर 2019 और 25
अगस्ट्त 2020 के अनुसरण में, जजनके द्वारा समय-समय पर “महापत्तन 2013 जस्ट्थत पररयोजनाओं के जलए प्रिुल्क के जलए
जनधाचरण के जलए ददिा-जनदिे ” की िैधता अिजध का जिस्ट्तार दकया जाता रहा है, इस प्राजधकरण ने समय-समय पर
“महापत्तन 2013 जस्ट्थत पररयोजनाओं के जलए प्रिुल्क के जलए जनधाचरण के जलए ददिा-जनदिे ” की िैधता अिजध का
जिस्ट्तार करने से संबंजधत आदिे ों को अजधसूजचत दकया ह।ै इस प्राजधकरण द्वारा अंजतम जिस्ट्तार का अनुमोदन आदिे संख्या
टीएएमपी/18/2013-जिजिध ददनांक 8 जसतम्बर 2020 द्वारा अनुमोददत दकया गया था जजसमें इस प्राजधकरण ने उक्त
ददिा-जनदिे ों की िैधता की अिजध का जिस्ट्तार इसकी समाप्त होने की तारीख से एक िर्षच की अजतररक्त अिजध तक अथिा 9
माचच 2020 से 8 माचच 2021 तक अथिा आगे और आदिे होने तक, जो भी पहले हो, दकया गया ह।ै उक्त आदिे भारत के
राजपत्र में राजपत्र संख्या 373 द्वारा 24 जसतम्बर 2020 को प्रकाजित दकया गया था।
4. पत्तन, पोत पररिहन और जलमागच मंत्रालय द्वारा महापत्तन न्यास और बीओटी प्रचालकों के साथ परामिच से
संदभच प्रिुल्क ददिा-जनदिे ों की समीक्षा की जा रही ह।ै संदभच प्रिुल्क ददिा-जनदिे ों को अंजतम रुप दने े में कुछ समय और लग
सकता ह।ै पत्तन, पोत पररिहन और जलमागच मंत्रालय ने अपने पत्र संख्या पीआर-14019/16/2012-पीजी ददनांक 01
माचच 2021 द्वारा “महापत्तन 2013 जस्ट्थत पररयोजनाओं के जलए प्रिुल्क के जलए जनधाचरण के जलए संिोजधत ददिा-जनदिे ”
की िैधता की अिजध का जिस्ट्तार छ: महीने की अजतररक्त अिजध अथाचत 08 जसतम्बर 2021 तक अथिा आगे और आदिे
होने तक, जो भी पहले हो, करने के जलए सक्षम प्राजधकारी का अनुमोदन संसूजचत दकया ह।ै
5. तद्नुसार, यह प्राजधकरण “महापत्तन 2013 जस्ट्थत पररयोजनाओं के जलए प्रिुल्क के जलए जनधाचरण के जलए ददिा-
जनदिे ” की िैधता अिजध का जिस्ट्तार इसके समाप्त होने की तारीख से छ: महीने की अिजध के जलए अथाचत् 9 माचच 2021 से
8 जसतम्बर 2021 तक अथिा आगे और आदिे होने तक, जो भी पहले हो, की अजतररक्त अिजध के जलए िैधता का जिस्ट्तार
को अजधसूजचत करता ह।ै

2021 received from the Government of India in the Ministry of Ports, Shipping and Waterways, the Tariff Authority
for Major Ports hereby extends the validity of the „Revised Guidelines for Determination for Tariff for Projects at
Major Ports, 2013, notified vide Order No. TAMP/18/2013-Misc on 30 September 2013, as in the Order appended
hereto.

1.1. The Ministry of Ports, Shipping and Waterways (MOPSW) [the then Ministry of Shipping (MOS)] vide its
communication No. PR-14019/16/2012-PG dated 9 September 2013 and 12 September 2013 issued Revised
Guidelines for Determination for Tariff for Projects at Major Ports, 2013 under Section 111 of the Major Port Trusts,
Act, 1963 (38 of 1963).
1.2. The said Guidelines for Determination for Tariff for Projects at Major Ports, 2013 were notified by TAMP in the
Gazette of India on 30 September 2013 vide Gazette No. 254 in compliance of policy direction issued by the
Government of India under section 111 of the Major Port Trusts Act, 1963. These guidelines came into effect from 9
September 2013.
2. Clause 1.6 of the said guidelines referred here as Reference Tariff Guidelines of 2013 stipulates that unless
revoked or modified earlier, the Guidelines may be reviewed and revised after 5 years from the date of its issue.
Accordingly, the said Reference Tariff Guidelines, 2013 which came into effect from 9 September 2013 was valid till
8 September 2018.
3. In pursuance of the MOPSW letters dated 10 December 2018, 15 October 2019 and 25 August 2020, extending
the validity of “Guidelines for Determination for Tariff for Projects at Major Ports, 2013” from time to time, this
Authority has notified the Orders extending the validity of the „Guidelines for Determination for Tariff for Projects at
Major Ports, 2013‟ from time to time. The last extension was approved by this Authority vide Order
No. TAMP/18/2013-Misc dated 8 September 2020 wherein this Authority extended the validity of the said Guidelines
for the further period of one year from the date of its expiry i.e. from 9 March 2020 till 8 March 2021 or until further
orders, whichever is earlier. The said Order was published in the Gazette of India on 24 September 2020 vide Gazette
No.373.
4. The Reference Tariff Guidelines are under review by the MOPSW in consultation with the Major Port Trusts and
BOT operators. The finalization of the Reference Tariff Guidelines may take some more time. The MOPSW vide its
letter No. PR-14019/16/2012-PG dated 1 March 2021 has conveyed the approval of the Competent Authority to
extend the validity of Revised Guidelines for Determination for Tariff for Projects at Major Ports, 2013” for a further
period of six months i.e. till 8 September 2021 or till further orders whichever is earlier.
5. Accordingly, this Authority notifies the extension of the validity of the „Revised Guidelines for Determination of
Tariff for Projects at Major Ports, 2013‟ for a further period of six months from the date of its expiry i.e. from 9 March
2021 till 8 September 2021 or until further orders, whichever is earlier.
