तथा वे िविधिव(cid:12)(cid:13) संगम ह?। आगे यह भी उ(cid:6)ल ेख (cid:4)कया जाता ह ै (cid:4)क के(cid:23) C सरकार क(cid:19) यह भी राय ह ै(cid:4)क य(cid:4)द मैतेई उ)वादी संगठन* के िविधिव(cid:12)(cid:13) (cid:4)(cid:14)याकलाप* पर तुरंत काबू नह@ पाया जाता ह ै और उनको िनयंि5त नह@ (cid:4)कया जाता ह,ै तो उनको िन7न िलिखत का अवसर Aा=त हो जाएगा – (i) अपने अलगाववादी, िवघटनकारी, आतंकवादी और /हसक काय’कलाप* का िव(cid:30)त ार करने के िलए अपने काडर* को एकजटु करना; (ii) भारत क(cid:19) संAभुता और अख] डता के श5ुवत बल* क(cid:19) िमलीभगत से रा^J िवरोधी (cid:4)(cid:14)याकलाप* का Aसार करना; (iii) िसिविलयन* क(cid:19) हB या करना और पुिलस एवं सुर!ा बल का(cid:26)मक* को िनशाना बनाने के काय ’म "िल=त होना; (iv) अंतरा’^ Jीय सीमा पार से अवैध हिथयार* और गोलाबाEद* का Aापण करना और उ(cid:23) ह "शािमल करना; (v) अपने िविधिव(cid:12)(cid:13) (cid:4)(cid:14)याकलाप* के िलए जनता से बड़ी मा5ा म "िनिधय* क(cid:19) जबरन वसूली करना और उसका सं)ह करना। 5. और यत: के(cid:23)C सरकार क(cid:19) यह राय ह ै(cid:4)क मैतेई उ)वादी संगठन* के उपयु’Dत (cid:4)(cid:14)याकलाप* को य ान म "रखते Oए यह आवRय क ह ै(cid:4)क मैतेई उ)वादी संगठन* और साथ ही उनके सभी गुट*, /वग* और अ)णी संगठन* को तBक ाल Aभाव से ‘िविधिव(cid:12)(cid:13) संगम’ घोिषत (cid:4)कया जाए और तदनुसार, उD त अिधिनयम क(cid:19) धारा 3 क(cid:19) उप-धारा (3) के पर(cid:23)त ुक Lारा AदM शिNय* का Aयोग करते Oए, के(cid:23) C सरकार ने िनदशे (cid:4)दया (cid:4)क उD त अिधसूचना उDत अिधिनयम क(cid:19) धारा 4 के अधीन (cid:4)दए गए (cid:4)कसी आदशे के अ य धीन शासक(cid:19)य राजप5 म "इसके Aकाशन क(cid:19) तारीख अथा’त 13 नव7ब र, 2018 से लागू होगी। 6. उसके बाद, उD त अिधिनयम क(cid:19) धारा 5 क(cid:19) उप-धारा (1) Lारा AदM शिNय* का Aयोग करते Oए, के(cid:23)C सरकार ने यह (cid:23)य ाय- िनण’यन करने के Aयोजन के िलए (cid:4)दनांक 24 जनवरी, 2019 क(cid:19) राजप5 अिधसूचना संGय ा का.आ. 384 (अ) के तहत इस अिधकरण का गठन (cid:4)कया (cid:4)क D या मिणपुर के मैतेई उ)वादी संगठन* और साथ ही उनके सभी गुट*, /वग* और अ)णी संगठन* को ‘िविधिव(cid:12)(cid:13) संगम’ घोिषत करने का पया’T कारण मौजूद ह ैया नह@। 7. इस अिधकरण को उD त अिधिनयम क(cid:19) धारा 4(1) के अनुसार उपयु’Dत संदभ’ Aा=त होने के बाद, इस मामले क(cid:19) Aारंिभक सुनवाई (cid:4)दनांक 30 जनवरी, 2019 को (cid:4)कया जाना िनधा$’ रत (cid:4)कया गया, जब इस अिधकरण ने के(cid:23)C सरकार Lारा $रकॉड ’ पर A(cid:30) ततु क(cid:19) गई साम)ी के िवचार के उपरांत मिणपुर के मैतेई उ)वादी संगठन* को उDत अिधिनयम क(cid:19) धारा 4(2) के अंतग’त नो$टस जारी (cid:4)कया (cid:4)क वे इस बारे म " 30 (cid:4)दन* के भीतर यह बताएं (cid:4)क उनको िविधिव(cid:12)(cid:13) संगम Dय * न घोिषत (cid:4)कया जाए। इस नो$टस को िन7न िलिखत तरीके से तामील (cid:4)कए जाने का िनदशे (cid:4)दया गया : (i) मिणपुर के उ)वादी संगठन* और साथ ही उनके सभी गुट*, /वग* और अ)णी संगठन* के अंितम ‘ात पते और उनके Aधान पदािधका$रय* के पते पर (cid:30) पीड पो(cid:30)ट /रिज(cid:30)ट ड ’ए/डी Lारा। (ii) आज से तीन स= ताह के भीतर दो रा^J ीय समाचार-प5* (अिखल भारतीय अंक), एक अं)ेजी म " और एक /हदी म " तथा राH य*, जहां मैतेई उ)वादी संगठन* के (cid:4)(cid:14)याकलाप सामा(cid:23)य तया होते ह?, म " [य ापक प$रचालन वाले दो (cid:30)थ ानीय समाचार-प5* म "(cid:30) थानीय भाषा म," (cid:4)दनांक 13 नव7ब र, 2018 क(cid:19) राजप5 अिधसूचना क(cid:19) Aित के साथ Aकाशन Lारा। (iii) मिणपुर के मैतेई उ)वादी संगठन* और साथ ही उनके सभी गटु *, /वग* और अ)णी संगठन* और उनके Aधान पदािधका$रय* के अंितम ‘ात पते पर (cid:4)दनांक 13 नव7ब र, 2018 क(cid:19) राजप5 अिधसूचना क(cid:19) Aित के साथ नो$टस को िचपकाकर।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iv) ऐसे सभी राH य*, जहां संगठन* के (cid:4)(cid:14)याकलाप सामा(cid:23)य तया (cid:4)कए जाते थे या (cid:4)कए जाते ह,? (ओ) शांता दवे ी, लै$रक"गबाम माखा लेकाई के घर और इसके प$रसर क(cid:19) तलाशी के दौरान, सच’-टीम को एक आई ई डी पाइप बम िमला, िजसे घर के दि!ण-पूव. घर पर छापा मारा। छापेमारी के दौरान, दो अ‘ात युवक* को उनक(cid:19) सं(cid:4)द6ध Aकृित के कारण घर म "ही िन(cid:12)(cid:13) (cid:4)कया गया िज(cid:23) ह*ने अपनी पहचान नैरोईबाम जोयशंकर /सह और बहग" बाम रामान(cid:23)द /सह के Eप म " बताई। पूछताछ करने पर, जोयशंकर ने खुलासा (cid:4)कया (cid:4)क वह पीआरईपीएके (Aो) संगठन का एक Aिश ि!त काडर है। वह इस संगठन म " वष ’ 2009 म " शािमल Oआ था और उसे आम. नं. 39914 Aा=त Oआ था और अब पीआरईपीएके (Aो) संगठन के (cid:30)व यंभू चेयरमैन पािलबा क(cid:19) कमान के तहत काय ’ कर रहा है। इस Aकार, 45 असम राइफ(cid:6)स Lारा (cid:4)दनांक 26 मई, 2016 को क(cid:19) गई िशकायत/$रपोट’ के आधार पर उसी (cid:4)दन उप िनरी!क लाकु(cid:23)C ो खैदनू Lारा िविधिव(cid:12)(cid:13) (cid:4)(cid:14)याकलाप (िनवारण) अिधिनयम क(cid:19) धारा 20/38, आयुध अिधिनयम क(cid:19) धारा 25 (1-ग), िव(cid:30)फ ोटक (cid:4)दनांक 22.09.2018 को पूवा’lन लगभग 10.30 बजे उ(cid:23) ह " आरपीएफ/पीएलए संगठन के कुछ स(cid:4)(cid:14)य काय’कता’Z क(cid:19) मौजूदगी के बारे म " एक िविश^ ट सूचना िमली थी, जो अिहतकर गितिविधय* को अंजाम दने े के िवचार से Dव ाक(cid:19)थल इलाके के सामा(cid:23)य !े5 के आसपास इधर-उधर घूम रह े थे। इस सूचना पर कार’वाई करते Oए, सी डी ओ इ7फ ाल पिdमी क(cid:19) टीम " उक्त इलाके क(cid:19) ओर रवाना हो ग(cid:128) तथा इलाके को घेर िलया और Dव ाक(cid:19)थल िथयम लेकाई म " तलाशी अिभयान शुE कर (cid:4)दया। (एल) नर"गबाम जुगेR वर /सह के घर पर इस अिभयान के दौरान, घर के अ(cid:23)द र एक अ‘ात [य िN बOत ही सं(cid:4)द6ध अव(cid:30)थ ा म " पाया गया था। मौके पर उसक(cid:19) तलाशी करने पर, उसके कiज ेसे दो मोबाइल ह?डसेट बरामद Oए। घटना(cid:30) थल पर सB यापन करने पर, उसने अपनी पहचान नार"गबाम रतन कुमार उफ’ िAयो के Eप म "बतायी और पूछताछ करने पर, उसने खुलासा (cid:4)कया (cid:4)क वह आरपीएफ/पीएलए संगठन का एक स(cid:4)(cid:14)य काय’कता ’ ह ै और (cid:30)व यंभू फाइन"स चीफ न*6 पोकनग(cid:23) बा क(cid:19) कमान के तहत काय ’ करता है। इसके अित$रDत , उसने बताया (cid:4)क वह वष’ 2012 म " उDत संगठन म " शािमल Oआ था और (cid:30) वीकार (cid:4)कया (cid:4)क अपने कमांडर (cid:30) वयंभू फाइन"स चीफ न*6प ोकनग(cid:23)ब ा के कहने पर उसने सरकारी कम’चा$रय* और सामा(cid:23) य जनता से भारी मा5ा म " धन एकि5त (cid:4)कया था। उसने आगे बताया (cid:4)क वह अपने कमा]ड र को एकि5त (cid:4)कया Oआ पैसा सुपुद ’ करने और आगे अनुदशे Aा=त करने के िलए अDस र मोरेह जाता ह।ै इसिलए, उसे पूवा’lन 11.45 बजे सभी औपचा$रकताएं पूरी करने के बाद घटना(cid:30)थ ल पर ही िगर(cid:130)तार कर िलया गया था। िगर(cid:130)तार (cid:4)कए गए [ यिN क(cid:19) िनशानदहे ी पर, 17/20 के अंतग’त एफआईआर सं. 169(9) 2018 पंजीकृत क(cid:19) गई थी। AR नगत मामले के जांच अिधकारी पी डi(cid:6) य ू-1 Lारा अिभपु^ट शपथ-प5 को Aदश ’ पी.डi(cid:6) यू.-1/1 के Eप म " Aद(cid:26)शत (cid:4)कया गया मांग प5 पाए और बरामद (cid:4)कए गए। घटना(cid:30)थ ल पर सBय ापन करने पर, िनE(cid:13) (cid:4)कए गए [य िN ने अपनी पहचान वह(cid:23)े गबैम सोमे(cid:23) Cो /सह उफ’ बॉबी के Eप म" बताई, जो कां6 लीपाक क7य The Central Government, vide Gazette Notification No. S.O. 5681(E) dated 13th November, 2018, while exercising the powers conferred by sub-section (1) of Section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), (for short, ‘the said Act’), has declared the Meitei Extremist Organizations of Manipur, namely, 1) The Peoples’ Liberation Army generally known as PLA, and its political wing; 2) The Revolutionary Peoples’ Front (RPF), 3) The United National Liberation Front (UNLF) and its armed wing, 4) The Manipur People’s Army(MPA); 5) The Peoples’ Revolutionary Party of Kangleipak (PREPAK) and its armed wing, the “Red Army”; 6) The Kangleipak Communist Party (KCP) and its armed wing also called the “Red Army”; 7) The Kanglei Yaol Kanba Lup (KYKL); 8) Co-ordination Committee (CorCom); and 9) The Alliance for Socialist Unity Kangleipak (ASUK) along with all their factions, wings and front organizations, as ‘Unlawful Associations’. 2. It is stated, in the aforesaid Notification, that the Meitei Extremist Organizations have the aim and objective of the formation of an independent Manipur by secession of Manipur State from India and have- (i) openly declared their objectives as formation of an independent Manipur by secession of Manipur State from India; (ii) been employing and engaging in armed means to achieve the aforesaid objective; (iii) been attacking the Security Forces, the Police, Government employees and law-abiding citizens in Manipur; (iv) been indulging in acts of intimidation, extortion and looting of civilian population for collection of funds for their Organisation; (v) been making contacts with sources abroad for influencing public opinion and for securing their assistance by way of arms and training for the purpose of achieving their secessionist objective; and (vi) been maintaining camps in neighboring countries for the purpose of sanctuaries, training and clandestine procurement of arms and ammunitions. 3. It is further stated, in the aforesaid Notification, that the unlawful and violent activities of the Meitei Extremist Organizations include – (i) involvement in 756 violent incidents for the last five years from 1st January, 2013 to 31st July, 2018 and; (ii) killing of 86 persons (including 35 Security Forces personnel) from 1st January, 2013 to 31st July, 2018. 4. It is also stated that for the aforesaid reasons, the Central Government is of the opinion that the activities of the Meitei Extremist Organizations are detrimental to the sovereignty and integrity of India and that they are unlawful associations. It is further stated that the Central Government is also of the opinion that if the unlawful activities of the Meitei Extremist Organizations are not curbed and controlled immediately, they would take the opportunity of – (i) mobilizing their cadres for escalating their secessionist, subversive, terrorist and violent activities; (ii) propagating anti-national activities in collusion with forces inimical to sovereignty and integrity of India; (iii) indulging in killings of civilians and targeting of the police and security force personnel;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iv) procuring and inducting illegal arms and ammunitions from across the international border; (v) extorting and collecting huge funds from public for their unlawful activities. 5. And whereas, the Central Government is also of the opinion that having regard to the activities of the Meitei Extremist Organizations mentioned above, it is necessary to declare the Meitei Extremist Organizations along with all their factions, wings and front organizations as ‘Unlawful Associations’ with immediate effect and accordingly, while exercising the powers conferred by the proviso to sub-section (3) of Section 3 of the said Act, the Central Government directed that the said Notification shall, subject to any order that may be made under Section 4 of the said Act, have effect from the date of its publication in the Official Gazette, i.e., 13th November, 2018. 6. Thereafter, in exercise of the powers conferred by sub-section (1) of Section 5 of the said Act, the Central Government constituted this Tribunal vide Gazette Notification No. S.O. 384 (E) dated 24th January, 2019, for the purpose of adjudicating whether or not there is sufficient cause of declaring the Meitei Extremist Organizations of Manipur along with all their factions, wings and front organizations as ‘Unlawful Associations’. 7. Having received the aforesaid reference in terms of Section 4(1) of the said Act by this Tribunal, the matter was fixed for preliminary hearing on 30th January, 2019, when this Tribunal, on consideration of the material placed on record by the Central Government, issued notice under Section 4(2) of the said Act to the Meitei Extremist Organizations of Manipur to show cause within 30 days as to why they be not declared unlawful. The notice was directed to be served in the following manner: (i) By Speed Post/Registered A/D at the last known addresses of the Meitei Extremist Organizations of Manipur, along with all their factions, wings and front organizations as well as that of their principal office bearers. (ii) By publication along with a copy of the Gazette Notification dated 13th November, 2018 in two national newspapers (all India edition), one in English and one in Hindi and also in two local newspapers having wide circulation in the States where the activities of the Meitei Extremist Organisations are ordinarily carried on in vernacular language within three weeks from today. (iii) By affixation of the notice along with a copy of the Gazette Notification dated 13th November, 2018 at the last known addresses of the Meitei Extremist Organizations of Manipur, along with all their factions, wings and front organizations as well as that of their principal office bearers. (iv) By a proclamation by beating of drums as well as loudspeakers about the contents of the notice and the Notification dated 13th November, 2018 in all the States where the activities of the Organisations were or are believed to be ordinarily carried on. (v) By displaying the notice along with a copy of the Gazette Notification dated 13th November, 2018 on the notice board of the Deputy Commissioner/District Magistrate/ Tehsildar in all the district headquarters of the States where the activities of the Organisations were or are believed to be ordinarily carried on. (vi) Notice be also served on the State of Manipur through its Chief Secretary. (vii) The notice and the gazette Notification dated 13th November, 2018 be also announced in the All India Radio/electronic media of State Edition at the prime time and shall also be pasted at the prominent places in the States where the activities of the MEITEI Extremist Organisations were or are believed to be carried on. 8. Vide Order dated 30th January, 2019, the Tribunal also directed its Registrar to check and ensure the compliance of service of the notice and also to file an independent report in this regard before the next date of hearing, i.e., 5th March, 2019. However, on 5th March 2019, the proceedings of the Tribunal could not take place on account of Full Court Reference to condole the sad demise of Hon’ble Mr. Justice Valmiki J. Mehta and the proceedings were adjourned to 6th March 2019. The affidavits of service were filed on behalf of the Union of India as well as the State of Manipur affirming the steps taken for effecting service of the notice issued¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 19 by this Tribunal. The report of the Registrar of this Tribunal dated 27th February, 2019, as regards service of notices, was also filed. 9. On perusing the material placed on record as well as the report of the Registrar of this Tribunal, the Tribunal was satisfied that the notices had been duly served on the Meitei Extremist Organizations of Manipur, their factions, wings and front organizations as well as that of their principal office bearers, as prescribed under Rule 6 of the Unlawful Activities (Prevention) Rules, 1968 (for short, ‘the said Rules’) and as per the directions of this Tribunal contained in the Order dated 30th January, 2019, as noticed hereinabove. 10. Despite service of the notices, as aforesaid, and opportunities granted by this Tribunal, neither any objections/replies/written statements were filed on behalf of the Meitei Extremist Organizations of Manipur nor anyone appeared on their behalf. Thus, they chose not to participate in the proceedings conducted by this Tribunal and vide order dated 06th March 2019, the inquiry was ordered to be proceeded further, ex parte. 11. However, since this Tribunal was of the view that an inquiry in the matter should be held so as to afford an opportunity not only to the Central and the State Governments to lead their evidence in support of the averments, allegations and grounds made by them, but also to the Meitei Extremist Organizations of Manipur to rebut the material of the Central/State Governments, vide Order dated 6th March, 2019, the matter was fixed, with the consent of learned Additional Solicitor General appearing on behalf of the Union of India and learned counsel appearing for the State of Manipur, for 4th and 5th April, 2019 for further proceedings to be held at Shillong and the matter was kept for directions on 12th March, 2019. 12. During the proceedings of this Tribunal held on 4th April, 2019, at Shillong, evidence of PW-1 (namely, Ms. Anupam, SDPO – Lamphel, Imphal, West District, Manipur); PW-2 (namely, Mr. Binoy Chongtham, SDPO – Moreh, Tengnoupal District, Manipur), and PW-3 (namely Mr. Shankerjit Loitongbam, SDPO – Porompat, Imphal East District, Manipur) was recorded; while on 5th April, 2019, the partial evidence of PW-4 (namely, Mr. Athokpam Romendro. Singh, SDPO – Singjamei, Imphal, West District, Manipur) was recorded. 13. Thereafter, the matter was taken up again on 26th and 27th April 2019 at Gangtok, Sikkim, the date already fixed for recording of the remaining Evidence. 14. On 26th April, 2019 further statement of PW-4, namely Mr. Athokpam Romendro Singh, SDPO, Singjamei, Imphal West District, Manipur; PW-5, namely, Dr.Th.Charanjeet Singh, Deputy Secretary (Home), Government of Manipur, Imphal and PW-6, namely, Mr.R.K. Pandey, Deputy Secretary, Ministry of Home Affairs, Government of India was recorded and the matter was kept on 27th April, 2019 at Gangtok. Thereafter, the matter was adjourned to 1st May, 2019 for further proceedings at New Delhi. 15. At this stage, I may notice that only the witnesses of the State of Manipur and the Union of India, who had filed their affidavits by way of evidence, were examined on oath and their depositions were recorded on the respective date(s). Furthermore, during their examination-in-chief, all the witnesses admitted their signatures on their respective affidavit(s) and tendered their affidavit(s) along with all the exhibits and marked documents mentioned therein, as part of their respective evidence. 16. Despite opportunities granted, none appeared before this Tribunal for the Meitei Extremist Organizations of Manipur to cross-examine the aforesaid witnesses of the Union of India and the State of Manipur. Accordingly, the witnesses were discharged. In view of the fact that no representation, communication or any other document had been received on behalf of the Meitei Extremist Organizations of Manipur, either by this Tribunal or its Registrar, the evidence was concluded on 27th April, 2019 and the matter was fixed for further proceedings on 01.05.2019 at New Delhi. 17. I have heard Ms. Maninder Acharya, the learned Additional Solicitor General; Mr. Kirtiman Singh and Mr. Gaurang Kanth, Central Government Standing Counsel, on behalf of the Union of India and Mr. L. Roshmani Kh., the learned Counsel appearing on behalf of the State of Manipur. Having regard to the prevailing situation in the State of Manipur and placing reliance on the material on record and affidavits by way of evidence, it was prayed that the Notification No. S.O. 5681(E) dated 13th November, 2018 issued by the20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Central Government, under Section 3(1) of the said Act, thereby declaring the Meitei Extremist Organizations of Manipur as unlawful associations, be confirmed. 18. I have also gone through the material placed on record, the evidence adduced by and on behalf of the State of Manipur as well as the Union of India. I have also perused the reports, received from various Intelligence Agencies and Central Forces regarding the continuing unlawful activities of the Meitei Extremist Organizations of Manipur and their factions, wings and front organizations during the relevant period, which had been handed over by the Union of India in a separate sealed cover to this Tribunal. After perusal of the documents in the sealed cover, the same were returned to Mr. R. K. Pandey, Deputy Secretary, Ministry of Home Affairs, Government of India. PW-1 (namely, Ms. Anupam, SDPO – Lamphel, Imphal West District, Manipur) exhibited 3 FIRs being PW-1/2, PW-1/11 and PW-1/16. 1) In the First FIR No. 98(5) 2016 dated 27th May 2016, it was stated that on 26th May, 2016 at about 09/30 p.m., they received an input from a reliable source shared by 45 AR about the presence of an active member of PREPAK(Pro) organization in a house at Khurai Lairikyengbam Makha Leikai area who was going to commit pre-judicial activities like hurling of bombs and planting IEDs at private business centres, shops etc. Acting on the information, a surprise raid was conducted at the house of Naoroibam Joyshankar Singh of Lairikyengbam Makha. During the search of the house of Naoroibam Joyshankar Singh S/o N. (O) Shanta Devi Lairikyengbam Makha Leikai and its premises, search team found one IED pipe bomb which was kept concealed in a pile of fire wood at the south eastern side of the house. On further search, eight black colour batteries, one white colour battery, five EW marked batteries, one Panasonic battery, two steel ball bearing packets, one white colour remote control, one black colour battery case, one circuit board, three meters long black and red colour wire from the room of Joyshanker were found. On questioning of N. Shanta Devi the mother of Joyshankar she disclosed that the above recovered explosive items were brought and assembled by her son, Joyshanker and now he had gone to meet one of his associate at the house of Wahengbam Ramananda Singh at Kontha Ahallup Makha Leikai. Based on the instance of Joyshankar’s mother a combine team of CDO Imphal West comprising of Inspt P. Sanjoy Singh OC-CDO I/W led by Sachidananda Soibam MPS, Dy. SP of CDO-IW and 45 AR Ex-Chingmeiron COB led by Capt. G. Satish Kumar, under the supervision of Th. Vikramjit Singh MPS, Addl. SP(Ops.) Imphal West immediately rushed to Kontha Ahallup Makha Leikai after informing Oscar 80- Imphal East Police Control Room and raided the house of Wahengbam Ramananda Singh at around 3:30 am. During the raid two unknown youths were detained in the house due to their suspicious nature who identified themselves as Naoroibam Joyshankar Singh and Wahengbam Ramananda Singh. On questioning, Joyshanker disclosed that he is a trained cadre of PREPAK(PRO) organization. He joined the organization in the year 2009 and got an army no. 39914¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 21 and now working under the command of one s/s Chairman Paliba of PREPAK(PRO) organization. Thus, on the basis of the complaint/report dated 26th May 2016 made by 45 AR, FIR No. 98(5)2016 PRT-PS under Sections 20/38 UA(P) Act, 25(1-C) A. Act, 5 Expl. Sub. Act was registered by SI Lakundro Khaidun on the same day itself. The affidavit affirmed by PW-1, the Investigating Officer of the case in question, has been exhibited as Ex.PW-1/1 and copies of the said FIR, Report and 7 seizure memos relating to the said case, as submitted along with the said affidavit to this Tribunal, have been exhibited as Ex.PW-1/2, Ex. PW-1/3 and Ex.PW-1/4 to Ex.PW-1/10 respectively. 2) In the Second FIR No. 169(9)2018 dated 22/9/2018 registered U/s 17/20 UA(P) Act (Ex. PW-1/11), it was stated that on 22.09.2018 at about 10:30 am, they received a specific information about the presence of some active worker of RPF/PLA organization who were loitering in and around the general area of Kwakeithel area with a view to commit prejudicial activities. Acting on information teams of CDO Imphal West rushed to the said area and conducted cordon and search operation at Kwakeithel Thiyam Leikai. During the operation at the house of (L) Narengbam Jugeshwor Singh, one unknown person was found in very suspicious manner inside the house. On spot body search, two mobile handsets were recovered from his possession. On spot verification, he identified himself as Narengbam Ratankumar Singh @ Rataqn @ Priyo and on questioning, he revealed that he is an active worker of RPF/PLA organization and working under the command of one s/s Finance Chief Nongpoknganba. Further he disclosed that he joined the said organization in the year 2012 and he admitted that under the instruction of his commander s/s Finance Chief Nongpoknganba he had collected a huge amount of money from the Govt. and general public. He further disclosed that he frequently goes to Moreh to hand over the collected money to his commander and also to get further instructions. Hence, he was arrested on the spot at 11:45am by observing formalities. At the instance of the arrestee one ‘Vespa’, pink in colour bearing regd. No. MN01U-2341 which was used in collection of money for their organization was also seized from his residence. Thus, on the basis of the complaint/report dated 22nd September 2018, FIR No. 169(9)2018 U/s 17/20 UA(P) Act was registered by Inspector Chandrakumar Singh on the same day itself. The affidavit affirmed by PW-1, the Investigating Officer of the case in question, has been exhibited as Ex.PW-1/1 and copies of the said FIR, Report, 1 seizure memo and 2 re-seizure memos relating to the said case, as submitted along with the said affidavit to this Tribunal, have been exhibited as Ex.PW-1/11, Ex.PW-1/12, Ex. PW-1/13 and Ex.PW-1/14-Ex. PW-1/15 respectively. 3) In the Third FIR No. 431(11) 2015 registered U/s 17/20 UA(P) Act and 25(1-C) of Arms Act dated 26th November 2015, it was stated that on 26th November 2015 at about 8:45 a.m., they received a reliable information from 40 AR corroborated with their own intelligence about the presence of some active members of the valley based outfit KCP(MC) in and around Takyel Khongbal Moirangthong, a team of CDO/IE led by SI M. Uttam Singh assisted by JC No. 752 Jem. N. Bobo Singh of 1st MR attached with CDO/IE rushed to the said area and launched a search operation. As a part of the operation, mobile frisking and checking was conducted at the southern side of Moirangthong, Takyel Khongbal. In that a suspected person was detained for immediate body search and verification. On searching the detainee’s body one 9mm pistol with magazine loaded with two live rounds, one mobile phone along with one Airtel SIM card and three nos. of demand letter of KCP(MC) duly signed by one s/s Finance Secy. Of KCP(MC) namely Yaikhomba Angom were found and recovered. On spot verification, the detainee identified himself as Wahengbam Somendro Singh @ Bobby, an active member of the outfit Kangleipak Communist Party (Military Council) KCP (MC) in short who joined through one Aken of Takhel in the year 2013. He further stated that he was working under the command of the said Aken and extorted a huge amount of money from the general public. He was arrested from the spot i.e. Southern side of Moirangthong and one 9mm pistol marked as ‘U.S.A.’ with magazine loaded with two live rounds, one mobile phone (Nokia-100) along with one Airtel SIM card and three nos. of demand letters of KCP(MC) were seized from his possession.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Thus, on the basis of the complaint/report dated 26nd November 2015, FIR No. 431(11) 2015 under Section 17/20 UA(P) & 25(1-C) Arms Act was registered on the same day. The affidavit affirmed by PW-1, the Investigating Officer of the case in question, has been exhibited as Ex.PW-1/1 and copies of the said FIR, Report and 1 seizure memo relating to the said case, as submitted along with the said affidavit to this Tribunal, have been exhibited as Ex.PW-1/16, Ex.PW-1/17 and Ex.PW-1/18 respectively. 20. PW-2 (namely, Mr. Binoy Chongtham, SDPO – Moreh, Tengnoupal District, Manipur) exhibited 3 FIRs being PW-2/2, PW-2/6 and PW-2/10. 1) In the First FIR No. 1(1) 2015 registered U/s 121/121-A/324/326/307/34 IPC, 15/20 UA(P) Act and 25(1-C) Arms Act dated 14th January 2015, it was noted as per reports appearing in local news paper “Imphal Free Press” English edition dated 16.01.2015 that on 14.01.2015 at 11.30 p.m., 20 Assam Rifles located at Machi post, village were ambushed and attacked by suspected PLA militant/terrorist by using sophisticated weapons/arms with intent to killing/injured on security forces and to undermine the lawfully established Government of India/Manipur. As a result, two AR personnel received injuries on their person. So it was considered to register a suo-moto case in the matter for the purpose of investigation. The affidavit affirmed by PW-2, the Investigating Officer of the case in question, has been exhibited as Ex.PW-2/1 and attested copies of the said FIR, Report and 2 seizure memos relating to the said case, as submitted to this Tribunal, have been exhibited as Ex.PW-2/2, EX.PW-2/3 and Ex.PW-2/4- 2/5 respectively. 2) In the Second FIR No. 40(5)2018 MRH-PS registered U/s 20 UA (P) Act dated 28/05/2018 at Moreh Police Station, it was stated that by Ksh. Shantikumar Singh that at around 02:50 pm he received a reliable information regarding the movement of a hard core cadre of banned outfit United National Liberation Front (UNLF) Organization in and around Sunrise ground, Ward No. 4 Moreh. Immediately a team of CDO/Moreh conducted frisking and checking in that area. While conducting the frisking and checking their team saw one unknown youth moving around the frisking zone in a suspicious manner. On seeing the team, the unknown youth tried to flee away but he was overpowered for verification. On the spot verification, he identified himself as Haorongbam Ranjit @ Lumba, an active cadre of UNLF holding the rank of s/s Captain of the banned outfit United National Liberation (UNLF) Organization. Further, he stated that he joined the banned outfit in the year March 1996 through one s/s Major Chaoba (CS) and got one and half months basic training at Eastern Nagaland and was allotted army No. 561 of 12th batch. He further stated that after the training he was in Eastern Nagaland for 2 (two) years. Between 1998 and 2000 he was in Kumbi in the intelligence wing of the organization aiding the Sajit Tampak Battallion of UNLF. Between 2001 and 2005 he was in the Sajik Tampak Camp of UNLF. Between 2006 and 2007 he was operating in Boro Bekra area of Barak Valley. From there he again moved back to Sajik Tampak and stayed there till 2004. Towards the end of 2014 he moved to 41th Battalion at Ongia in Myanmar. In 2017 he also acted as CO of Naga Revolutionary Front (NRF). He was presently based in GHQ of UNLF at Thongren. Hence, he was arrested at the spot at around 03:30 pm by observing formalities. From his possession one mobile hand set marked as “MPT” white in colour and two SIM Cards of Vodafone and MPT was seized. The affidavit affirmed by PW-2, the Investigating Officer of the case in question, has been exhibited as Ex.PW-2/1 and attested copies of the said FIR, report, seizure memo and reseizure memo relating to the said case, as submitted to this Tribunal, have been exhibited as Ex.PW- 2/6, Ex. PW-2/7, Ex. PW-2/8 and Ex.2/9 respectively. 3) In the third FIR No..79(12) 2018 MRH-PS registered u/s 20 UA(P) Act dated 02/12/2018, it was stated by Inspector N Jatishwar Singh that at around 9:30 am, he received a reliable information input regarding the movement of some hard core cadre of banned outfit KYKL in and around Nongpok panthoibi temple, Moreh. Immediately a team CDO/Moreh conducted frisking and checking at that area. While conducting the frisking and checking their team saw an unknown youth moving around the frisking zone in a suspicious manner. On seeing the team, unknown youth tried to flee away but they managed to overpower him for verification. On the spot verification, he identified himself as Longjam¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 23 Kala @ Soman. His rank was Sergeant Major with Army No. 33. He joined the organization in June, 2002 and received Basic Training at Khoupum camp of KYKL at Noney district for around 3 months. After the completion of training he was deployed in Chandel. From Chandel he moved to Tanan camp battalion of KYKL at Myanmar where he stayed for two years. Then for the next seven years he was deployed at Eastern Nagaland. He revealed that he joined the organization through one overground worker of the organization namely(L) Thangjam Inao of Moreh Ward No. 7. Hence he was arrested at the spot at around 10.30 am by observing formalities. The affidavit affirmed by PW-2, the Investigating Officer of the case in question, has been exhibited as Ex.PW-2/1 and attested copies of the said FIR and Report as submitted to this Tribunal, have been exhibited as Ex.PW- 2/10 and Ex.PW-2/11 respectively. 21. PW-3 (namely, Mr. Shankerjit Loitongbam, SDPO – Porompat, Imphal East District, Manipur) exhibited 3 FIRs being PW-3/2, PW-3/8 and PW-3/14. 1) In the First FIR No. 40(2) 016 PRT-PS registered U/s 20 UA(P) Act and 25(1-B) A. Act and 5 Expl. Sub. Act dated 22nd February 2016, it was stated that at about 12:20 pm, a reliable information was received about the presence of one active cadre of the proscribed United National Liberation Front (UNLF in short) organization at Hatta Minuthong area to commit pre-judicial activities like extortion of money from the general public. Accordingly, a team rushed to the said area to launch a search operation. During the search operation, one suspected person was detained at Hatta Minuthong for verification. On spot verification of his identity the detainee identified himself as Thokchom Brendy Meetei @ Leiren @Athouba. On verification, he stated that he is an active cadre of UNLF outfit; he joined the outfit in January 2007 through one S/s Lieutenant Mr. Apabi of UNLF and he underwent basic military training at Mewtit, Myanmar in the same year from February to April 2007 under Army No. 2330 of 33rd batch of the UNLF outfit. He further stated that he was working for the said UNLF outfit under the command of one S/S Director, Finance Department of UNLF Mr. Munal. So, he was arrested from the spot i.e. eastern side Minuthong at 1:30 p.m. and 2 mobile phones: one SAMSUNG Duos with one SIM card each of Airtel and Vodafone and another LEMON GC 359 with one SIM card each of Reliance and Airtel were seized. On questioning, the arrestee stated that he has kept concealed one small arm, ammunition and 6 hand granades at a carpentry house at Langthabal Kunja. The carpentry house was searched and one black polythene containing (i) 1 (one). 38 pistol with one magazine loaded with 8 live rounds, (ii) 1 (one) magazine loaded with 7 live rounds, (iii) 4 (four) Chinese hand grenades, which were contained inside 4 tin fish boxes, (iv) 2(two) 36 HE hand grenades, and (v) 10 (ten) detonators, which were contained inside a white polythene were recovered above the ceiling of the carpentry house. The recovered items along with one mobile phone were seized from his possession. The affidavit affirmed by PW-3, the Investigating Officer of the case in question, has been exhibited as Ex.PW-3/1 and attested copies of the said FIR, Report, 2 seizure memos and 2 re-seizure memos relating to the said case, as submitted to this Tribunal, have been exhibited as Ex.PW- 3/2, Ex. PW-3/3, Ex.PW-3/4-Ex.PW-3/5 and Ex.PW-3/6-3/7 respectively. 2) In the Second FIR No. 9(02) 2018 IBG-PS U/S 17/20 UA(P) Act, 25(1-C) A. Act & 5, Expl. Subs. Act dated 7th February 2018 it was stated that at about 4.30 p.m., a reliable information was received from secret source regarding the presence of some active members of valley based outfit in and around Langdum Makha Leikai. Acting on said credible information, a team of CDO/IE rushed to the said area and launched a search operation. In that, a suspected person was detained for verification in front of Langdum High School. On spot verification, the detainee identified himself as Nandeibam Saratjoy Singh @ Sanjoy, an active member of the outfit Kangleipak Communist Party (Peoples’ War Group) who joined through one active member of the said outfit namely Mr. Wahengbam John @ Thoi in the year 2015, and was working under his command. Thus, he was arrested from the spot i.e. Langdum Makha Leikai along with one mobile phone (Samsung) along with one Airtel SIM card. On further interrogation, the arrestee revealed that he had kept concealed one pistol at his residence and one bomb at Awang Khunou, Imphal-West District. On the disclosure and pointing of the arrestee, a 9mm pistol along with magazine loaded with 2 rounds was recovered from his residence. Thereafter, the arrestee24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] was taken to Awang Khunou and on the pointing of the arrestee there, a black polythene bag containing one IED weighing about 5 kilogram, wire about 1 metre in length and one modified mobile phone which could be used as trigger and one detonator which was kept concealed beneath the soil was found from the back yard of Chain of Freedom Foundation Rehabilitation Centre, Awang Khunou, Imphal West District. The above said items were seized. The arrestee further revealed that the above recovered items were handed over to him by Mr. John @ Thoi through one unknown person on 04.02.2018 and he was instructed to plant the recovered IED at Little Flower School as soon as possible. He further stated that recently he had collected a sum of Rs. 24,000/- which was extorted from KM Blooming School, Khangabok from Canchipur in front of Standard Robart English School on the instruction of said Mr. John @ Thoi. The affidavit affirmed by PW-3, the Investigating Officer of the case in question, has been exhibited as Ex.PW-3/1 and attested copies of the said FIR, Report, 3 seizure memos and 1 re-seizure memo relating to the said case, as submitted to this Tribunal, have been exhibited as Ex.PW- 3/8, Ex.PW-3/9, Ex.PW-3/10, Ex.PW-3/11, Ex.PW-3/12 and Ex.PW-3/13 respectively. 3) In the Third FIR No. 57(11)2018 IBG-PS U/S 20 UA (P) Act & 5 Expl. Subs. Act. dated 14th November 2018, it was stated that at about 06:45 p.m., a reliable information from was received from their source that some active member of PREPAK (PRO) were loitering in and around Keirao Awang Leikai area for their pre-judicial activities like planting of IED/Bomb and attacking on security forces at any opportune time. A team of CDO/IE unit was organized and rushed to the area. After reaching the said area it was cordoned and one suspected house was searched. During the search operation, a suspected individual was detained at the residence of one Ningthoujam Deban Singh of Keirao Awang Leikai. On spot verification, he identified himself as Ningthoujam Yamba Singh @ Sanayamba and on spot body search, one mobile phone (Samsung) along with Airtel SIM card, another mobile phone (Samsung) along with another Airtel SIM card, one Identity Card bearing no. E060787 of Indian Army was recovered from his possession. On examination he disclosed that he is in the Indian Army at ASC (AT) Paharpur, Gaya, Bihar and he was arrested twice before, once in 2017 and again recently about two months back in connection with crime against women. While in jail he met one Mangdengbam Shamu Singh, who was a cadre of PREPAK (PRO). After his arrest and release from jail, Yamba Singh went to the house of Shamu and he requested Shamu to make arrangement for Yamba’s joining underground organization. Thereafter, both went to Tamu in Myanmar and met Irei of PREPAK (PRO). While Shamu left for Imphal, Yamba stayed back and learnt preparation of IED from PREPAK (PRO) cadres under Irei. He came back with one IED on 11th November, 2018 and assembled at the house of Shamu by himself and Shamu on 12th November 2018 and kept at the house of Shamu. Further, he also stated that from he communicated from his mobile with one s/s 2nd Lieutenant Irei of PREPAK (PRO) who instructed him to plant the said IED at Pheidinga area to attack the security forces. Hence, he was arrested at the spot at 9:20 p.m, and seized the above recovered items at 9.30 p.m. At his instance, the police team proceeded to Shamu’s house and arrested him along with one mobile handset along with two SIM cards of Airtel and Vodaphone. On examination of Shamu he revealed that he had kept concealed one assemble IED which was assemble by him and Yamba at the front left corner of his common room. He further disclosed that he was working under one s/s 2nd Lieutenant Irei of PREPAK (PRO). Thereafter, the nearby villagers were evacuated to the safe area and personnel of the team tactically cordoned the area. The bomb disposal squad disassemble the said IED and seized the components of IED including one remote control along with battery, one C-4 TNT weighing about 186 gram, one detonator, one Dulux-1L enamel paint container filled with some iron nail and iron screw and circuit having one battery. The affidavit affirmed by PW-3, the Investigating Officer of the case in question, has been exhibited as Ex.PW-3/1 and attested copies of the said FIR, Report, 3 seizure memos and 1 reseizure relating to the said case, as submitted to this Tribunal, have been exhibited as Ex.PW- 3/14, Ex.PW-3/15, Ex.PW-3/16, Ex.PW-3/17, Ex.PW-3/18, Ex.PW-3/19 and Ex. PW-3/20 respectively. 22. PW-4 (namely, Mr. Athokpam Romendro Singh, SDPO – Singjamei, Imphal West District, Manipur) was examined both in Shillong and Gangtok. He exhibited three FIRs being PW-4/2, PW-4/7 and PW-4/16.¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 25 1) In the first FIR bearing No. 38(2) 2018 SJM PS U/S 17/20 UA(P) Act & 25(1-C) Arms Act dated 11/2/2018, it was stated that at about 12:20 pm on receipt of specific information about the presence of some active cadres of KYKL organization in and around Canchipur area with a view to commit prejudicial activities like extortion of money from General Public, businessmen etc. and on acting on the information a combined team of CDO/IW and a column of 6th Assam Rifle rushed to the said area and conducted frisking and checking at Canchipur near Standard Robert School. While doing so, two unknown persons were coming towards frisking zone in a very suspicious manner. Hence on suspicion they were detained for spot verification and identification. On spot body search, two pistol, one mobile phone and two ID cards were recovered from their possession. On spot verification they identified themselves as Pukhrambam Rupa @ Kiran and Khariban Sanjoy @ Naocha @ Bheem. On questioning of Pukhrambam Rupa @ Kiran, he disclosed that he was an active cadre of KYKL organization working under the command of s/s Vice Chairman Ibo of KYKL organization and he joined the said organization in the year 2006 through one Birjit of KYKL recruiter from Moirang. He further disclosed that he got basic military training at Tanal, Myanmar in the year 2006 under Army No. 407 of 24th batch and holding the rank of Corporal of KYKL organization. On questioning of Kharibam Sanjoy @ Naocha @ Bheem, he revealed that he is an active cadre of KYKL organization working under the command of s/s Vice Chairman Ibo of KYKL organization and he joined the said organization in 2007 through one Santa of KYKL and completed basic military training at Tanal, Myanmar in the year 2007 under Army No. 571 of 25th batch and holding the rank of Corporal of KYKL organization. Hence, they were arrested on the spot. The recovered items, one Beretta pistol marked as made in U.S.A along with one magazine marked as made in U.S.A, 4(four) live rounds of 9mm ammunition, one ID card of Myanmar bearing Z506094 and one Lemon mobile handset bearing model no. B159 along with one MPT SIM Card were seized from the possession of Pukhrambam Rupa @ Kiran and one M-20 pistol along with one magazine marked as 5020, 2(two) live rounds of M-20 pistol ammunition and one ID card of Myanmar bearing no. Z064079 were seized at 1.25 p.m. from possession of Kharibam Sanjoy @ Naocha @ Bheem. The affidavit affirmed by PW-4, the Investigating Officer of the case in question, has been exhibited as Ex.PW-4/1 and attested copies of the said FIR, Report, 2 seizure memos and 1 re-seizure memo relating to the said case, as submitted to this Tribunal, have been exhibited as Ex.PW- 4/2, Ex.PW-4/3, Ex.PW- 4/4-Ex.PW-4/5, and Ex.PW-4/6 respectively. 2) In the second FIR No. 252(8) 2017 SJM PS, U/S – 307/506/427/ 34-IPC , 20 UA(P) Act, 3 Expl. Sub. Act. dated 13th August 2017, it was stated that at about about 9.40 a.m., one IED exploded near the Electric Transformer located Naorem Leikai in front of Naorem Leikai Lairembi along the road side of NH-2 which was planted by some unknown persons suspected to be members of outlawed organization with an intent to kill the general public as well as Security forces and cause damage to the properties. However no casualty occurred but some parts of wiring wall of Electric Transformer and CI-sheet roof of the waiting shed located near the spot were partly damaged. Hence, suo motu FIR in the matter was registered. The affidavit affirmed by PW-4, the Investigating Officer of the case in question, has been exhibited as Ex.PW-4/1, attested copies of the said FIR, Report, 5 seizure memos and one reseizure memo relating to the said case, as submitted to this Tribunal, have been exhibited as Ex.PW- 4/7, Ex.PW-4/8, Ex.PW-4/9, Ex.PW-4/10, Ex.PW-4/11, Ex.PW-4/12, Ex.PW-4/13 and Ex.PW- 4/14 respectively. 3) In the third FIR No. 341(11) 2017 SJM PS, U/S 302/34-IPC & 25(1-C) Arms Act dated 20/11/2017, it was stated that at 07.35 pm an information was received to the effect that at about 7:00pm, one unknown person suspected to be a non-Manipuri man aged about 49 years was shot dead by some unknown armed persons at the gate one Laishram Denny Meitei. The unknown culprits fled away towards unknown direction after commission of the crime. Hence, a suo motu FIR was registered in the matter. The additional affidavit affirmed by PW-4, the Investigating Officer of the case in question, has been exhibited as Ex.PW-4/1A and attested copies of the said FIR, Report, seizure memo and reseizure memo26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] relating to the said case, as submitted to this Tribunal, have been exhibited as Ex.PW- 4/15, Ex.PW-4/18, Ex.PW-4/16 and Ex. PW-4/17 respectively. 4) PW-4 was present before the Tribunal at Gangtok on 26.04.2019. He wished to place additional affidavit on record. He submitted that the same may be read in continuation of his earlier affidavit Ex. PW-4/1. The same was taken on record. The additional affidavit was exhibited as Ex. PW-4/1A. His further statement to this effect was also recorded separately. The third FIR No. 341(11) 2017 SJM PS, U/S 302/34-IPC & 25(1-C) Arms Act dated 20/11/2017 in original was produced before the Tribunal on this date. EVIDENCE OF TH. CHARANJEET SINGH, DEPUTY SECRETARY(HOME), GOVERNMENT OF MANIPUR. 23. An application was moved by the Learned Counsel for the State of Manipur, seeking leave to place on record a better and comprehensive affidavit dated 24th April 2019 by way of evidence on behalf of State of Manipur. The prayer was allowed and leave was granted to place a better and comprehensive affidavit on record. The same was taken on record. The earlier affidavit dated 2nd March 2019 was returned, as prayed. 24. PW-5 [namely Mr. Dr. Th. Charanjeet Singh, Deputy Secretary(Home), Government of Manipur, has tendered, in evidence, his affidavit, Ex. PW-5/1, has deposed that the State of Manipur has been facing problem of insurgency since the 1970s. All the Valley based insurgent groups or the Meitei Extremist Organizations namely RPF/PLA, UNLF, PREPAK, KYKL, KCP, CorCom and ASUK have been continuing their subversive activities adversely affecting the law and order situation in the State and posing serious threat to the internal security of the nation. 25. PW-5 has further deposed that the main objective of the Meitei Extremist Organizations is to secede Manipur from the Union of India and for the formation of an independent Sovereign Country. In other words, the liberation of the State of Manipur from the dominion of India is the objective of these organizations. While giving a brief reference to the operational activities of these Organizations, as set out further in paragraph 3 of his affidavit, it has been deposed by PW-5 that these Organizations do not consider themselves as part of the State of Manipur or the Union of India. The main activities of these groups include attack, ambush etc on Security Forces to cause loss of life and snatching of arms and ammunitions, carry out bomb/blasts, attacks with a view to cause damage to life and property of Security Forces(SFs), Government and General public, ensuring a steady source of income for the sustenance of the organization and its cadres, and securing sympathy and support of the local population. It has further been deposed that for ensuring a steady source of income, they indulge in all kinds of violent activities to terrorize Government employees, businessmen and General Public to make them amenable to their extortion demand. The extortion is carried out in the following manner: a) Levying illegal tax from the salaries of the employees both Government and private enterprises at fixed percentage; b) Levying of illegal taxes on all development work at various stages- at the time of award of the work, payment of bills etc: c) Levying illegal monthly/annual taxes on commercial establishments/enterprises like hotel, restaurant, medical clinics etc: and d) Levying illegal taxes on transport of goods, passengers, etc. For securing sympathy and support of the local population, they indulge in moral policing, harp on imaginary past glories, resort to instant justice to wrong doers. The press release further appealed the general public to support the ban to show their will to survive against Indian machinations geared up to obliterate their ethnic existence. 25.2 The UG organization Alliance for Socialist Unit, Kangleipak (ASUK), a conglomerate UG group of KYKL and KCP in a press release issued by its Convenor, Publicity Committee, ASUK, S. Mangal on 12/10/2018 announced 12 hours Total Shut Down in the State of Manipur from 6 am to 6 pm on 15/10/2018 by observing this day as “Amamba Numit” (Black Day) in protest against the alleged forcible merger/annexation of Manipur State by the Indian Government on 15/10/1949. 25.3 PW-5 has further deposed that during the period 04/06/2014 to 31/08/2018 as many as 1124 FIRs cases were registered against People’s Liberation Army (PLA), the United National Liberation Front (UNLF), People’s Revolutionary Party of Kangleipak (PREPAK), Kangleipak Communist Party(KCP), Kanglei Yaol Kanna Lup(KYKL). . 25.4 That between 04.06.2014 to 31.08.2018 as many as 203 (two hundred and three) FIRs were registered against the members of the said PLA/RPF. The list of 203 FIRs along with sections of law against PLA/RPF maintained by the Government of Manipur have been annexed herewith as EXHIBIT-PW-5/1 (Page no. 18-22). The statement showing the brief of the said 203 FIRs against PLA/RPF maintained by the Government of Manipur is annexed as EXHIBIT-PW-5/2. The Newspaper clippings and press notes released by PLA/RPF between 04.06.2014 to 31.03.2018 have been annexed as EXHIBIT-PW-5/3. 25.5 That between 15/06/2014 to 27/03/2018 as many as 217 (two hundred and seventeen) FIRs were registered against the members of the said UNLF. The list of 217 FIRs along with the sections of law against UNLF maintained by the Government of Manipur have been annexed as EXHIBIT-PW-5/4. 25.6 The statement showing the brief of the said 203 FIRs against UNLF maintained by the Government of Manipur has been annexed as EXHIBIT-PW-5/5. 25.7 The Newspaper clippings and press notes released by UNLF between 04-06-2014 to 31-03-2018 have been annexed as EXHIBIT-PW-5/9. 25.8 A copy of monetary demand letter issued by PREPAK dated 15.08.2015 has been annexed herewith and marked as EXHIBIT-PW-5/10. 25.9 That, between 06/06/2014 to 27/03/2018 as many as 270(two hundred and seventy) FIRs were registered against the members of the said KCP. 25.10 The list of 270 FIRs along with the sections of law against KCP maintained by the Government of Manipur have been annexed as EXHIBIT-PW-5/11. 25.11 The statement showing the brief of the said 270 FIRs against KCP maintained by the Government of Manipur has been annexed as EXHIBIT-PW-5/12. 25.12 The Newspaper clippings and press notes released by KCP between 04-06-2014 to 31-03-2018 have been annexed herewith as EXHIBIT-PW-5/13..Copies of the monetary demand letter issued by KCP are annexed and marked as EXHIBIT-PW-5/14(COLLY).28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 25.13 That, between 15/06/2014 to 27/03/2018 as many as 193 (One hundred and ninety three) FIRs were registered against the members of the said KYKL. U/S 16/20 UA(P) ACT, 25(1-B) Arms Act 19-09-2015 is annexed herewith as EXHIBIT-PW-5/25. A Certified to be true copy of the Complaint of the said FIR 386(9) 2015 of IPS dated 19.09.2015 is annexed as EXHIBIT-PW-5/26. A Certified to be true copies of the seizure Memos of the said FIR 386(9) 2015 of IPS has been annexed as EXHIBIT-PW-5/27. 25.21 A Certified to be true copies of the FIR no. 2(5) 2016 of MCM PS U/s 120-B/302/427 IPC 6/20 UA(P) ACT, 25 (1-C) Arms Act dated 22.05.2016 has been annexed as EXHIBIT-PW-5/28. 25.22 The Newspaper clippings and press notes released by the said CorCom between 04-06-2014 to 31-03-2018 has been annexed as EXHIBIT-PW-5/29(Colly). 25.23 That, the official communication relating to the unlawful activities of the said ASUK (Alliance of Social Unity Kangleipak) from the State intelligence department i.e. from the office of the Superintendent of Police (CID)(SB) Manipur along with its annexures are annexed herewith as EXHIBIT-PW-5/30 (Colly). EVIDENCE OF DEPUTY SECRETARY, MINISTRY OF HOME AFFAIRS, GOVERNMENT OF INDIA 26. PW-6 [namely Mr. R. K. Pandey, Deputy Secretary(Home), Government of India, has tendered, in evidence, his affidavit dated 05th March 2019, which is exhibited as Ex. PW-6/1, which is signed by him at points ‘A” and ‘B’ at page 7 of the said affidavit. Sh. R.K.Pandey, PW-6 has deposed that militant activities are mainly carried out, in the valley are of Manipur, by the Meitei Extremist Organizations which include Peoples’ Liberation Front (UNLF) and its armed wing the Manipur Peoples’ Army (MPA), People’s Revolutionary Party of Kangleipak (PREPAK) and its armed wing- the Red Army, Kangleipak Communist Party (KCP) and its armed wing – also called the Red Army, Kanglei Yaol Kanba Lup (KYKL), Coordination Committee (CorCom) and Alliance for Socialist Unity Kangleipak (ASUK). In view of the prevailing security situation in Manipur, the entire State excluding Imphal Municipal Area has been declared as ‘disturbed area’ under the Armed Forces (Special Powers) Act, 1958, from time to time, and is valid upto 30th November 2019. 26.1 PW-6 has further deposed that the main objective of the Meitei Extremist Organizations, is to secede from India and regain the ‘lost sovereignty’ of Manipur State through armed struggle and towards this end they have been engaging in unlawful activities. These outfits have been actively involved in a strident campaign against non-Manipuri residents and have repeatedly been issuing directives to them, to leave the State. These¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 29 outfits have also been maintaining links with the National Socialist Council of Nagaland (Khaplang) {NSCN(K)}, Manipur Naga People’s Front (MNPF), Manipur Naga Revolutionary Front (MNRF), Zeliangrong United Front (Kamson Group), United Liberation Front of Asom (Independent) ULFA(I), Hynniewtrep National Liberation Council (HNLC), National Liberation Front of Twipra (NLFT), People’s Democratic Council of Karbilongri (PDCK), Garo National Liberation Army (GNLA) and Maoist Communist Party of Manipur (MCPM) with a view to secure their assistance for procurement of arms as also for training of their cadres, so as to achieve their secessionist objectives. 26.2 The law and order situation in the State of Manipur is fragile and remains a cause of concern. The details of incidents of violence propagated and committed by these Meitei Extremist Organizations outfits and their activities, relations and close links with other extremist organizations and foreign army officials, are stated in paras 6,7, 9, 10 of the affidavit dated 05th March, 2019. A brief regarding Aims/Objectives and Violent Activities of the said Meitei Extremist Organizations outfits has been annexed to the affidavit. PW-6 also affirmed the correctness of the same and is accordingly exhibited the same as Ex. PW-6/2. 26.3 The details of major incidents of violence committed by the said Meitei Extremist Organizations outfits during the period major crimes committed by them and the list of cases registered against them, during the period 01.01.2017 to 15.02.2018, have been filed and PW-6 has deposed that the contents therein are true and correct. The details of the major violent incidents perpetrated by Valley based UG groups during 2017, 2018 and current year (till February 15)” have been exhibited as Ex. PW-6/3. Details of subversive activities committed by Meitei Extremist Organizations during the period 01.01.2017 to 15.02.2018 is exhibited as Ex. PW-6/4. A statement showing the number of charge sheets filed and the number of activists prosecuted from 04.06.2014 to 31.03.2018 is exhibited as Ex. PW-6/5. A statement showing list of cases registered against the Meitei Extremist Organisations during the period from 04.06.2014 to 31.03.2018 is exhibited as Ex. PW-6/6. A statement showing brief cases registered against the Meitei Extremist Organizations from 04.06.2014 to 31.03.2018 is exhibited as Ex.PW-6/7. 26.4 The Gazette Notification dated 13th November, 2018 issued by the Ministry of Home Affairs, thereby declaring the said Meitei Extremist Organizations outfits as unlawful associations w..e..f the date of the Notifications, has been filed, both in Hindi and English languages, along with the affidavit dated 05th March, 2019 and the same is at pages 143 to 146 of the said affidavit. The said Notification is exhibited as Ex. PW- 6/8. The grounds and reasons for declaring these Meitei Extremist Organizations outfits and their factions as unlawful associations are stated in para 15 of the affidavit dated 05th March, 2019. I may notice here that neither the evidence led by and on behalf of the Government of Manipur and the Union of India has been controverted, nor is there anything on record to contradict the same. None has chosen to appear in the proceedings. Thus, in the absence of rebuttal of evidence adduced by way of the statements made by various witnesses examined by and on behalf of the Union of India and the Government of Manipur, as also the documentary evidence, which has been submitted in support of their respective testimonies and the evidence by way of affidavit(s), there is no reason to either disbelieve or ignore the same. 27. Taking into consideration the evidence led by and on behalf of the Union of India and the Government of Manipur; and keeping in view the definitions of the expressions ‘unlawful activity’ and ‘unlawful association’ as contained in Sections 2(o) and 2(p) of the said Act; in my opinion, the activities being carried on by the Meitei Extremist Organizations can safely be termed as subversive in nature, apart from being secessionist, terrorist and violent activities. The activities being carried on by the Meitei Extremist Organizations are also likely to disturb the public tranquillity, apart from being able to cause fear or alarm or a feeling of insecurity amongst citizens. From the illegal and violent activities of the Meitei Extremist Organizations of Manipur, their main objective, i.e., to secede Manipur from the Union of India and to form an independent sovereign country by liberating the State of Manipur from the dominion of India, is clearly discernable. Thus, their activities are detrimental not only to the territorial integrity, but also the sovereignty of India. 28. In view of the aforesaid and on the basis of the entire evidence as also the material placed on record, I am of the considered view that there was sufficient cause for declaring the Meitei Extremist Organizations of30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Manipur, namely, 1) The Peoples’ Liberation Army generally known as PLA, and its political wing; 2) The Revolutionary Peoples’ Front (RPF), 3) The United National Liberation Front (UNLF) and its armed wing, 4) The Manipur People’s Army(MPA); 5) The Peoples’ Revolutionary Party of Kangleipak (PREPAK) and its armed wing, the “Red Army”; 6) The Kangleipak Communist Party (KCP) and its armed wing also called the “Red Army”; 7) The Kanglei Yaol Kanba Lup (KYKL); 8) Co-ordination Committee (CorCom); and 9) The Alliance for Socialist Unity Kangleipak (ASUK) along with all their factions, wings and front organizations as unlawful associations. Therefore, the declaration made by the Central Government in the Gazette Notification No. 5681(E) dated 13th November, 2018 under Section 3(1) of the said Act, stands confirmed. 29. The reference is, accordingly, answered in the aforesaid terms. (JUSTICE G.S.
