L.-33004/99 सी.जी.-डी.एल.-अ.-11062024-254648 CG-DxLx-xEG-I1D1H0x6x2x0 24-254648 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 298] नई दिल्ली, सोमवार, िनू 10, 2024/ज्य ष्े ठ 20, 1946 No. 298] NEW DELHI, MONDAY, JUNE 10, 2024/JYAISHTHA 20, 1946 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 10 िून, 2024 सा.का.जन. 319(अ).—केंद्रीय सरकार, भारत-जतब्बत सीमा पुजलस बल अजधजनयम, 1992 (1992 का 35) की धारा 156 की उप-धारा (2) के खंड (ख) द्वारा प्रित्त िजियों का प्रयोग करत े हुए और भारत जतब्बत सीमा पुजलस बल, जिक्षा और तनाव परामिशिाता काडर, समूह ‘क’, ‘ख’ और ‘ग’ पि, भती जनयम, 2012, को िहां तक उनका संबंध जनरीक्षक (जिक्षा और तनाव परामिशिाता) और उप-जनरीक्षक (जिक्षा और तनाव परामििश ाता) के पिों से ह,ै उन बातों के जसवाय अजधक्ांत करत े हुए, जिन् ह ें ऐसे अजधक्मण स े पूव श दकया गया ह ै या करन े का लोप दकया गया है, गृह मंत्रालय, भारत-जतब् बत सीमा पुजलस बल में जनरीक्षक (जिक्षा और तनाव परामििश ाता) और उप-जनरीक्षक(जिक्षा और तनाव परामिशिाता) के पिों पर भती की पद्धजत का जवजनयमन करन े के जलए जनम्नजलजखत जनयम बनाते ह,ैं अर्ाशतः- 1. सजं क्षप्त नाम और प्रारंभ.—(1) इन जनयमों का संजक्षप् त नाम गहृ मंत्रालय, भारत-जतब्बत सीमा पुजलस बल, जिक्षा और तनाव परामिशिाता काडर, जनरीक्षक (जिक्षा और तनाव परामििश ाता) और उप-जनरीक्षक (जिक्षा और तनाव परामिशिाता), समूह ‘ख’ पि, भती जनयम, 2024 ह।ै (2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. लाग ूहोना.— इन जनयमों से उपाबद्ध अनुसूची के स्ट्तम्भ (1) म ेंयर्ा जवजनर्िशष्ट पिों को ये जनयम लागू होंगे। 3. पिों की सख्ं या, वगीकरण और वते न मट्रै रक्स म ें स्ट्त र.— उि पिों की संख्या, उनका वगीकरण और वेतन मैट्ररक्स में उनका स्ट्तर वह होगा, िो इन जनयमों से उपाबद्ध उक्त अनसु ूची के स्ट्तंभ (2) से स्ट्तंभ (4) में जवजनर्िशष्ट ह।ैं 3462 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. भती की पद्धजत, आय-ु सीमा, अहतश ाएं आदि.— उि पिों पर भती की पद्धजत, आयु-सीमा, अहतश ाएं और उनस े संबंजधत अन्य बातें वे होंगी िो उक्त अनुसूची के स्ट्तंभ (5) स ेस्ट्तंभ (13) म ेंजवजनर्िशष्ट ह।ैं 5. जनरहतश ा.— वह व्यजि,- (क) जिसने ऐसे व्यजि स े जिसका पजत या जिसकी पत्नी िीजवत ह,ै जववाह दकया ह,ै या जववाह की संजविा की ह;ै या (ख) जिसने अपन े पजत या अपनी पत्नी के िीजवत रहत े हुए दकसी व्यजि से जववाह दकया ह ै या जववाह की संजविा की ह,ै उि पिों पर जनयुजि का पात्र नहीं होगा: परन्त ु यदि केंद्रीय सरकार का यह समाधान हो िाता ह ै दक ऐसा जववाह ऐसे व्यजि और जववाह के अन्य पक्षकार को लागू स्ट्वीय जवजध के अधीन अनुज्ञेय ह ै और ऐसा करने के जलए अन्य आधार ह ैं तो वह दकसी व्यजि को इस जनयम के प्रवतशन से छूट िे सकेगी। 6. जचदकत्सक िष्टृ या योग्यता.—इन जनयमों म ें अंतर्वशष्ट दकसी बात के होते हुए भी, केवल वे व्यजि िो केंद्रीय सिस्ट् त्र पुजलस बलों के जचदकत् सीय िेखरेख पद्धजत में यर्ाजवजनर्िशष् ट जचदकत् सा प्रवगश िेप-I में ह,ैं इन जनयमों के उपबंधों के अधीन प्रोन्नजत और जनयुजि के जलए पात्र होंगे। 7. अजधवर्षतश ा.— पि धारण करने वाले ऐसे अजधकारी, उस मास के जिसमें वह साठ वषश की आयु प्राप् त करता ह,ै अंजतम दिन के अपराह्न से सेवाजनवृत्त हो िाएगा; या (ii) जिन् होंने मलू काडर या जवभाग में वते न मैट्ररक् स के स्ट्त र-6 (35400-112400 रू.) म ें या समतल्ु य म ें पि पर जनयजमत आधार पर जनयुजि के पश् चात ् पांच वष श सेवा की हो; (ख) जिसके पास मान् यताप्राप् त जवश् वजवद्यालय या समतुल् य से मनोजवज्ञान जवषय के सार् स्ट्न ातक जडग्री हो; या जिक्षा स्ट् नातक या जिक्षण स्ट् नातक या समतुल् य के सार् मान् यताप्राप् त जवश् वजवद्यालय से जडग्री हो। ट्रटप्पण 1: पोषक प्रवगश के ऐस े जवभागीय अजधकारी, िो प्रोन्न जत की सीधी पंजि में ह,ैं प्रजतजनयुजि पर जनयुजि के जलए जवचार दकए िाने के पात्र नहीं होंगे। इसी प्रकार प्रजतजनयुजि व् यजि प्रोन् नजत द्वारा जनयुजि के जलए जवचार दकए िाने के पात्र नहीं होंगे। ट्रटप्पण 2: प्रजतजनयुजि की अवजध, जिसके अंतगश त केंद्रीय सरकार के उसी या दकसी अन्य संगठन या जवभाग में इस जनयुजि से ठीक पहल े धाट्ररत दकसी अन्य काडर बाह्य पि पर प्रजतजनयजु ि की अवजध ह ैसाधारणतया 3 वषश से अजधक नहीं होगी। ट्रटप्पण 3: प्रजतजनयुजि द्वारा जनयुजि के जलए अजधकतम आय ु सीमा आवेिन प्राप्त करन े की अंजतम तारीख को 56 वष श स े अजधक नहीं होगी। यदि जवभागीय प्रोन् नजत सजमजत ह,ै तो उसकी संरचना। भती करन ेमें दकन पट्ररजस्ट्र्जतयों म ेंसंघ लोक सेवा आयोग से परामि शदकया िाएगा। (12) (13) समूह 'ख' जवभागीय प्रोन्नजत सजमजत (प्रोन् नजत के संबंध में जवचार करने के जलए) जिसमें लाग ूनहीं होता।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] जनम्न जलजखत होंग े: - 1. महाजनरीक्षक, भारत-जतब्बत सीमा पुजलस बल - अध्यक्ष; 2. उप-महाजनरीक्षक, भारत-जतब्बत सीमा पुजलस बल - सिस्ट् य; 3. कमांडेंट, भारत-जतब्बत सीमा पुजलस बल - सिस्ट् य। (1) (2) (3) (4) (5) 2. उप-जनरीक्षक 85*(2024) साधारण केन् द्रीय वेतन मैट्ररक् स में चयन । (जिक्षा और तनाव स्ट्तर-6 *कायशभार के आधार सेवा, समूह 'ख' परामििश ाता) पर पट्ररवतशन दकया िा अरािपजत्रत, (35400– सकता ह।ै अननुसजचवीय। 112400 रू.)। (6) 30 वषश से अनजधक। ( केंद्रीय सरकार द्वारा समय-समय पर िारी दकए गए अनुिेिों या आिेिों के अनुसार सरकारी सेवकों के जलए 5 वषश तक जिजर्ल की िा सकती ह।ै ) ट्रटप्प ण.— आय ु सीमा अवधाट्ररत करने के जलए जनणाशयक तारीख भारत में अभ् यर्र्शयों से आविे न प्राप् त करने के जलए जनयत की गई अंजतम तारीख होगी। (न दक वह अंजतम तारीख िो असम, मेघालय, अरूणाचल प्रिेि, जमिोरम, मजणपुर, नागालडैं , जत्रपरु ा, जसदिम, जहमाचल प्रिेि के लाहोल और स्ट्प ीजत जिले तर्ा चम् बा जिले के पांगी उपखंड, लद्दाख, अंडमान और जनकोबार द्वीप तर्ा लक्षद्वीप के संघ राज्य क्षेत्र के अभ् यर्र्शयों के जलए जवजहत की गयी ह।ै ) (7) (8) (9) (10) मान् यताप्राप् त लाग ूनही होता। सीधे भती दकए िाने वाले (i) नब् बे प्रजतित प्रोन्न जत द्वारा; और जवश् वजवद्यालय या व् यजियों के जलए िो वष श । (ii) िस प्रजतित सीधी भती द्वारा, संस्ट् र्ान से मनोजवज्ञान में ट्रटप्प ण.— सीधी भती के जिसके न हो सकने पर प्रोन् नजत स्ट् नातकोत्तर जडग्री । आधार पर जनयुक्त द्वारा । अभ् यर्र्शयों की पुजष्ट के जलए, कम से कम िो सप् ताह की अवजध का अजनवायश प्रवेि प्रजिक्षण सफलतापूवशक पणू श करना, अपेजक्षत ह।ै (11) प्रोन्न जत: भारत-जतब् बत सीमा पुजलस बल के सहायक उप-जनरीक्षक (जिक्षा और तनाव परामिशिाता), जिन् होंने वेतन मैट्ररक्स स्ट् तर-5 (29200-92300 रू.) म ें ग्रडे में छह वष श जनयजमत सेवा की हो तर्ा यर्ाजवजहत प्रोन्न जत-पूव श पाठ्यक्म या पाठ्यक्मों को सफलतापूवशक पणू श दकया हो। ट्रटप्प ण.— िहां ऐस े कजनष्ठ व्य जियों के संबंध म,ें जिन् होंने अपनी अहकश या पात्रता सेवा पूरी कर ली है, प्रोन्न जत के जलए जवचार दकया िा रहा हो, वहां उनके ज्य ेष्ठ व् यजियों के संबंध में भी जवचार दकया िाएगा परंतु यह तब िब दक उसके द्वारा[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 की गई अहकश या पात्रता सेवा, अपेजक्षत अहकश या पात्रता सेवा के आधे से अजधक से या िो वषश से, इनमें से िो भी कम हो, कम न हो और उन् होंने अपने ऐसे कजनष्ठ व् यजियों सजहत, जिन् होंने ऐसी अहकश या पात्रता सेवा पहले ही पूरी कर ली है, अगली उच् चतर श्रेणी में प्रोन्न जत के जलए अपनी पट्ररवीक्षा की अवजध सफलतापूवशक पूरी कर ली हो। (13) (12) समूह 'ख' जवभागीय प्रोन्नजत सजमजत (प्रोन् नजत के संबंध में जवचार करने के जलए) जिसमें लाग ूनहीं होता। जनम्न जलजखत होंग े: - 1. उप-महाजनरीक्षक, भारत-जतब्बत सीमा पुजलस बल - अध्यक्ष; G.S.R. 319(E).—In exercise of the powers conferred by clause (b) of sub-section (2) of section 156 of the Indo-Tibetan Border Police Force Act, 1992 (35 of 1992), and in supersession of the Indo-Tibetan Border Police Force, Education and Stress Counsellor Cadre, Group ‘A’, ‘B’ and ‘C’ posts, Recruitment Rules, 2012, in so far as they relate to the posts of Inspector (Education and Stress Counsellor) and Sub-Inspector (Education and Stress Counsellor), except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Inspector (Education and Stress Counsellor) and Sub-Inspector (Education and Stress Counsellor) in the Indo-Tibetan Border Police Force, Ministry of Home Affairs, namely :- 1. Short title and commencement.— (1) These rules may be called the Ministry of Home Affairs, Indo-Tibetan Border Police Force, Education and Stress Counsellor Cadre, Inspector (Education and Stress Counsellor) and Sub- Inspector (Education and Stress Counsellor), Group ‘B’ Posts, Recruitment Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application.— These rules shall apply to the posts as specified in column (1) of the Schedule annexed to these rules. 3. Number of posts, classification and level in pay matrix.— The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule. 4. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in column (5) to (13) of the said Schedule.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 5. Disqualification.—No person,- (a) who, has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 6. Medical fitness.— Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, as specified in Health Care System in the Central Armed Police Forces, shall be eligible for promotion and appointment under the provisions of these rules. 7. Superannuation.- The officers holding posts shall retire from the service on the afternoon of the last day of month in which they attain the age of sixty years: Provided that a person whose date of birth is on the first of a month, shall retire from service on the afternoon of the last day of the preceding month on attaining the age of superannuation. 8. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons. 9. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. Note 2.- Where juniors who have completed their qualifying or eligibility service are being considered for promotion their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service. Deputation: Officers of the Central Government or State Governments or Union territory Administrations,- (a) (i) holding analogous post on a regular basis in the parent cadre or department; or (ii) with five years service rendered after appointment to post on a regular basis in level-6 in the pay matrix (Rs. 35400-112400) or equivalent in the parent cadre or department; (b) possessing Bachelor degree from a recognised University or equivalent with Psychology as a subject; or Degree from a recognised University with Bachelor of Education or Bachelor of Teaching or equivalent. Note 1.- The departmental officers in the feeder categories who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion. Note 2.- The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in same or some other organisation or department of the Central Government shall ordinarily not exceed three years. Note 3.-The maximum age-limit for appointment by deputation shall not be exceeding fifty-six years as on the closing date of receipt of application.
