L.-33004/99 सी.जी.-डी.एल.-अ.-25112022-240584 xxxGIDHxxx CG-DL-E-25112022-240584 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 756] नई ददल्ली, िुक्वार, नवम्ब र 25, 2022/अग्रहायण 4, 1944 No. 756] NEW DELHI, FRIDAY, NOVEMBER 25, 2022/AGRAHAYANA 4, 1944 गहृ मत्रं ालय अजधसचू ना नई ददल्ली, 25 नवम् बर, 2022 सा.का.जन. 847(अ).—केंद्रीय सरकार, भारत-जतब्बत सीमा पुजलस बल अजधजनयम, 1992 (1992 का 35) की धारा 156 की उप-धारा (2) के खंड (ख) द्वारा प्रदत्त िजियों का प्रयोग करते हुए और भारत-जतब्बत सीमा पुजलस बल, साधारण ड्यूटी काडर (समूह ‘ख’ एवं ‘ग’ पद) भती जनयम, 2012 को, जहॉं तक दक उनका संबंध सहायक उप-जनरीक्षक (साधारण ड्यूटी), हडै कांस्ट् टेबल (साधारण ड्यूटी) और कांस्ट्ट ेबल (साधारण ड्यूटी) के पद स े ह,ै उन बातों के जसवाय अजधक्ांत करत े हुए जजन् ह ें ऐसे अजधक्मण से पहल े दकया गया ह ैया करने का लोप दकया गया ह,ै भारत-जतब् बत सीमा पुजलस बल म ें सहायक उप-जनरीक्षक (साधारण ड्यूटी), हडै कांस्ट् टेबल (साधारण ड्यूटी) और कांस्ट् टेबल (साधारण ड्यूटी) पदों पर भती की पद्धजत का जवजनयमन करने के जलए जनम्न जलजखत जनयम बनाते ह,ं अथाात ् :- 1. संजक्षप्त नाम और प्रारंभ.— (1) इन जनयमों का संजक्षप् त नाम भारत-जतब्बत सीमा पुजलस बल, साधारण ड्यूटी काडर (समूह ‘ग’ पद) भती जनयम, 2022 ह।ै (2) ये राजपत्र म ेंप्रकािन की तारीख को प्रवृत्त होंगे। 2. लाग ूहोना.—ये जनयम, इन जनयमों से उपाबद्ध अनुसूची के स्ट् तंभ (1) में जवजनर्ददष् ट पदों पर लागू होंगे। 3. पद-सख्ं य ा, वगीकरण और वते न मट्रै रक्स म ें स्ट्तर.—पदों की संख्या, उनका वगीकरण और उनका वेतन मैट्ररक्स म ें स्ट्तर वे होंग ेजो इन जनयमों स ेउपाबद्ध अनुसूची के स्ट् तंभ (2) से स्ट् तंभ (4) में जवजनर्ददष्ट ह ं। 4. भती की पद्धजत, आय-ु सीमा और अन्य अहता ाएं, आदद.—भती की पद्धजत, आय-ु सीमा, अहता ाएँ और उससे संबंजधत अन्य बात ें वे होंगी जो उक्त अनसु ूची के स्ट् तंभ (5) से स्ट् तंभ (13) में जवजनर्ददष्ट ह।ं 7863 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 5. जनरहता ा.—वह व्यजि- (क) जजसने ऐसे व्यजि से जजसका पजत या जजसकी पत् नी जीजवत है, जववाह दकया है; या जववाह की संजवदा की ह ैया (ख) जजसने अपने पजत या अपनी पत्न ी के जीजवत रहते हुए दकसी व्यजि से जववाह दकया है, या जववाह की संजवदा की ह।ै उि पद पर जनयुजि का पात्र नहीं होगा: परन् त ु यदद केंद्रीय सरकार का यह समाधान हो जाता ह ै दक ऐसा जववाह उस व् यजि और जववाह के अन् य पक्षकार को लागू स्ट् वीय जवजध के अधीन अनञेयु ेय ह ै और ऐसा करने के जलए अन् य आधार ह ं तो वह दकसी व् यजि को इस जनयम के प्रवतना से छूट दे सकेगी । 6. जचदकत् सक दष्ृ ट या यो्‍य ता.— इन जनयमों में अंतर्ववष्ट दकसी बात के होते हुए भी, केवल वे व् यजि जो केन् द्रीय सिस्ट् त्र पुजलस बल म ें स्ट् वास्ट् ् य देखभाल पद्धजत म ें यथाजवजनर्ददष् ट जचदकत् सा प्रवग ा िेप-1 म ें ह,ं इन जनयमों के उपबंधों के अधीन जनयुजि और प्रोन् नजत, जजसके अंतगात प्रजतजनयुजि या पुनर्वनयोजन द्वारा जनयुजि भी है, के जलए पात्र होंगे । 7. अजधवर्विता.— (1) इन जनयमों के उपबधं ों के अधीन जनयुक्त दकया गया प्रत् येक व् यजि उस मास के, जजसमें वह साठ विा या केन् द्रीय सरकार द्वारा समय-समय पर यथाजवजहत आयु प्राप् त करता ह,ै अंजतम ददन के अपराह्न में सेवाजनवृत्त होंगे । परन् तु कोई अजधकारी जजसके जन्म की तारीख दकसी मास की पहली तारीख ह,ै साठ विा की आयु प्राप् त करने के पूवावती मास के अंजतम ददन के अपराह्न में सेवाजनवृत्त होगा। 8. जिजथल करन े की िजि.—जहॉं केन् द्रीय सरकार की यह राय ह ै दक ऐसा करना आव यक या समीचीन ह,ै वहां वह उसके जलए जो कारण ह,ं उन् ह ें लेखबद्ध करके, इन जनयमों के दकसी उपबंध को दकसी वग ा या प्रवगा के व् यजियों की बाबत, आदेि द्वारा जिजथल कर सकेगी। 9. व्य ावृजत.— इन जनयमों की कोई बात, ऐसे आरक्षण, आय-ु सीमा में छूट और अन्य ट्ररयायतों पर प्रभाव नहीं डालगे ी, जजनका केन्द्रीय सरकार द्वारा इस संबंध म ें समय-समय पर जारी दकए गए आदेिों के अनुसार अनुसूजचत जाजतयों, अनुसूजचत जनजाजतयों, अन्य जपछडे वगों, भूतपूवा सैजनकों और अन्य जविेि प्रवग ा के व्यजियों के जलए उपबंध करना अपेजक्षत ह।ै अनसु चू ी पद का नाम। पदों सख्ं या। पद का वगीकरण। वते न मट्रै रक्स म ें चयन पद ह ैया अचयन स्ट्तर। पद। (1) (2) (3) (4) (5) 1. सहायक उप- 4235*(2022) साधारण केन् द्रीय वेतन मैट्ररक् स में अचयन पद । जनरीक्षक *कायाभार के आधार पर पट्ररवतान सेवा, समूह 'ग', अराजपजत्रत, स्ट्तर-5 (साधारण ड्यूटी)। दकया जा सकता ह।ै अनुसजचवीय। (29200– 92300/-रू.) सीध ेभती दकए सीध ेभती दकए जान े सीध े भती दकए जान े वाल े पट्ररवीक्षा की भती की पद्धजत: भती सीधी होगी या जान ेवाल े वाल ेव्य जियों के जलए व्यजियों के जलए जवजहत आय ु अवजध, यदद प्रोन्नजत द्वारा या प्रजतजनयजुि/ व् यजियों के जलए अपजे क्षत िजै क्षक और और िजै क्षक अहताएा ँ प्रोन्नत कोई हो। आमले न द्वारा तथा जवजभन्न पद्धजतयों आय-ु सीमा। अन्य अहताएा ँ। व्यजियों की दिा में लाग ू द्वारा भरी जान े वाली ट्ररजियों की होंगी या नहीं। प्रजतितता। (6) (7) (8) (9) (10) लागू नहीं होता। लागू नहीं होता। लागू नहीं होता। लागू नहीं प्रोन् नजत द्वारा जजसके न हो सकने पर होता। प्रजतजनयुजि द्वारा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 प्रोन्नजत /प्रजतजनयजुि /आमेलन द्वारा भती की दिा में व ेश्रजे णया ंजजनस ेप्रोन्न जत /प्रजतजनयजुि /आमेलन दकया जाएगा। (11) प्रोन्न जत द्वारा: वेतन मैट्ररक् स के स्ट्त र 4 (25500-81100/-रू) में भारत-जतब् बत सीमा पुजलस बल के ऐसे हडै कांस्ट् टेबल (साधारण ड्यूटी) में से, जजन् होंने पांच विा की जनयजमत सेवा की ह ैऔर यथाजवजहत पूवा-प्रोन् नजत प्रजिक्षण पा्यकक्म सफलतापूवाक पूरा दकया ह।ै ट्रटप्प ण .— जहां ऐसे कजनष् ठ व् यजियों के संबंध में, जजन् होंने अपनी अहका या पात्रता सेवा पूरी कर ली है, प्रोन् नजत के जलए जवचार दकया जा रहा हो, वहां उनके ज्य ेष् ठ व् यजियों के संबंध में भी जवचार दकया जाएगा परंतु यह तब जब दक उसके द्वारा की गई ऐसी अहाक या पात्रता सेवा, अपेजक्षत अहका या पात्रता सेवा के आधे से अजधक से या दो विा से, इनमें से जो भी कम हो, कम न हो और उन् होंने अपने ऐसे कजनष् ठ व् यजियों सजहत, जजन् होंने ऐसी अहका या पात्रता सेवा पहले ही पूरी कर ली ह ै अगली उच चतर श्रेणी में प्रोन् नजत के जलए अपनी पट्ररवीक्षा की अवजध सफलतापूवाक पूरी कर ली हो। प्रजतजनयजु ि द्वारा : केंन् द्रीय सरकार, राज्य सरकार या संघ राज्य क्षेत्रों के ऐसे अजधकारी जो मूल काडर या जवभाग में जनयजमत आधार पर सदिृ पद धारण दकए हुए हं । ट्रटप्प ण 1 : पोिक प्रवगा के ऐसे जवभागीय अजधकारी, जो प्रोन् नजत की सीधी पंजि में है, प्रजतजनयुजि पर जनयुजि के जलए जवचार दकए जाने के पात्र नहीं होंगे। इसी प्रकार प्रजतजनयुक्त व् यजि प्रोन् नजत द्वारा जनयुजि के जलए जवचार दकए जाने के पात्र नहीं होंगे। ट्रटप्प ण 2 : प्रजतजनयजु ि की अवजध, जजसके अंतगात केन् द्रीय सरकार के उसी या दकसी अन् य संगठन या जवभाग में इस जनयुजि से ठीक पहले धाट्ररत दकसी अन् य काडार बा्य पद पर प्रजतजनयुजि की अवजध ह ैसधारणतया 5 विा से अजधक नहीं होगी। ट्रटप्प ण 3 : प्रजतजनयुजि द्वारा जनयजु ि के जलए अजधकतम आयु-सीमा आवेदन प्राप्त करने की अंजतम तारीख को 56 विा से अजधक नहीं होगी। भतू पूव ा सजै नकों के जलए प्रजतजनयजुि/पनु र्वनयोजन : सिस्ट् त्र बल के ऐसे कर्वमकों के संबंध में भी जवचार दकया जाएगा, जो एक विा की अवजध के भीतर सेवाजनवृत्त होने वाले ह ं या ट्ररजवा में स्ट् थानांतट्ररत दकए जाने वाले ह ं और जजनके पास प्रोन् नजत के जलए उपरोक् त यथाजवजहत अहता ाएं ह ैऔर जो जचदकत् सीय प्रवगा िेप-1 में आते हं, ऐसे व् यजियों को उस तारीख तक प्रजतजनयजु ि के जनबबंधधनों पर रखा जाएगा जजस तारीख से उन् हें सिस्ट् त्र बल से जनमुाक् त दकया जाना है; तत् प चात् उन् ह ेंपुनर्वनयोजन पर बने रहने ददया जा सकता है। यदद जवभागीय प्रोन्न जत सजमजत ह,ै तो उसकी सरं चना। भती करन ेम ेंदकन पट्ररजस्ट्थजतयों म ें सघं लोक सवे ा आयोग स ेपरामि ा दकया जाएगा। (12) (13) समूह 'ग' जवभागीय प्रोन्नजत सजमजत (प्रोन् नजत के संबंध में जवचार करने के जलए) जजसमें लागू नहीं होता। जनम् नजलजखत होंगे: - 1. उप-महाजनरीक्षक, भारत-जतब्बत सीमा पुजलस बल - अध्यक्ष; व् यजियों के जलए दो विा। (ii) अनुचर समूह ‘ग’ (योधक) की पुन: भती द्वारा जजसके न हो सकने पर प्रजतजनयुजि द्वारा, इन दोनों के न हो सकने पर सीधी भती द्वारा - 5% । (11) कास्ट्ं ट ेबल अनचु र समूह ‘ग’ (योधक) की पनु : भती द्वारा : भारत-जतब् बत सीमा पुजलस बल के ऐसे कांस्ट् टेबल अनुचर (योधक) समूह ‘ग’ के पॉंच प्रजतित पद के जलए स्ट्थ ानांतरण द्वारा जजन् होंने उक् त बल में तीन विा की जनयजमत सेवा की ह ैऔर जो जनम् नजलजखत अहता ाएं रखते ह:ं- (क) दकसी मान् यताप्राप्त बोडा से मैट्ररककुलेिन उत्तीणा या समतुल् य; (ख) सीधी भती के जलए अनुमोददत स्ट् कीम में यथाजवजहत िारीट्ररक मापदडं ों को पूरा करना होगा। (ग) 35 विा की आयु तक (केन् द्रीय सरकार द्वारा समय-समय पर जारी दकए गए आदिे ों के अनुसार अनुसूजचत जाजत या अनुसूजचत जनजाजत के जलए पांच विा और अन् य जपछडे वगों और अन् य जविेि प्रवगा के व् यजियों के जलए तीन विा तक जिजथल की जा सकती है। प्रजतजनयजु ि द्वारा : केंन् द्रीय सरकार, राज्य सरकार या संघ राज्य क्षेत्रों के ऐसे अजधकारी जो मूल काडर या जवभाग में जनयजमत आधार पर सदिृ पद धारण दकए हुए हं ; I-12022/10/2021-संगठन] पी. एस. डंगवाल, उप सजचव6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 25th November, 2022 G.S.R. 847(E).—In exercise of the powers conferred by clause (b) of sub-section (2) of section 156 of the Indo-Tibetan Border Police Force Act, 1992 (35 of 1992), and in supersession of the Indo-Tibetan Border Police Force, General Duty Cadre, (Group ‘B’ and ‘C’ Posts) Recruitment Rules, 2012, in so far as it relate to the posts of Assistant Sub-Inspector(General Duty), Head Constable(General Duty) and Constable(General Duty) except things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Assistant Sub-Inspector(General Duty), Head Constable(General Duty) and Constable(General Duty), in the Indo-Tibetan Border Police Force, namely :— 1. Short title and commencement.— (a) These rules may be called the Indo-Tibetan Border Police Force, General Duty Cadre (Group ‘C’ Posts), Recruitment Rules, 2022. (b) They shall come into force on the date of their publication in the Official Gazette. 2. Application.- These rules shall apply to the posts specified in column (1) of the schedule annexed to these rules. 3. Number of posts, classification and level in the pay matrix.— The number of posts, their classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule. 4. Method of recruitment, age-limit and other qualifications, etc..— The method of recruitment, age- limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule. 5. Disqualification.— No person,— (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts : Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 6. Medical Fitness.— Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, as specified in Health Care System in Central Armed Police Forces, shall be eligible for appointment and promotion including appointment by deputation or re-employment under the provisions of these rules. 7. Superannuation. — (1) Every person appointed under these rules shall retire from service in the afternoon of the last day of month in which he or she attains the age of sixty years or as prescribed by the Central Government from time-to-time : Provided that an officer whose date of birth is on the first day of a month shall retire from service in the afternoon of the last day of the preceding month on attaining the age of sixty years. 8. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect of any class or category of persons. 9.
