L.-33004/99 सी.जी.-डी.एल.-अ.-22112023-250197 CG-DxLx-xEG-I2D2H1x1x2x0 23-250197 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 673] नई दिल्ली, मगं लवार, नवम्ब र 21, 2023/कार्तकक 30, 1945 No. 673] NEW DELHI, TUESDAY, NOVEMBER 21, 2023/KARTIKA 30, 1945 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 21 नवंबर,2023 सा.का.जन. 856(अ).—केंद्रीय सरकार, भारत-जतब्बत सीमा पुजलस बल अजधजनयम, 1992 (1992 का 35) की धारा 156 की उप-धारा (2) के खंड (ख) द्वारा प्रित्त िजियों का प्रयोग करते हुए और भारत-जतब्बत सीमा पुजलस बल, िल स्ट् कंध (समूह ‘क’, समूह ‘ख’ तथा समूह ‘ग’ तकनीकी पि) भती जनयम, 2012, को िहां तक उनका संबंध हडै कांस्ट् टेबल (मास्ट् टर), हडै कांस्ट् टेबल (वकक िॉप), हडै कांस्ट् टेबल (इंिन ड्राइवर), कांस्ट् टेबल (वकक िॉप) तथा कांस्ट् टेबल (कमीिल) के पिों से ह,ै उन बातों के जसवाय अजधक्ांत करत े हुए, जिन् ह ें ऐस े अजधक्मण से पूव क दकया गया ह ै या करने का लोप दकया गया है, गृह मंत्रालय, भारत-जतब् बत सीमा पुजलस बल के िल स्ट् कंध म ें समूह ‘ग’ तकनीकी पिों पर भती की पद्धजत का जवजनयमन करने के जलए जनम्न जलखत जनयम बनाती ह,ै अथाकत ् :- 1. सजं िप्त नाम और प्रारंभ- (1) इन जनयमों का संजिप् त नाम गहृ मंत्रालय, भारत-जतब्बत सीमा पुजलस बल, िल स्ट् कंध समूह ‘ग’ तकनीकी पि) भती जनयम, 2023 ह।ै (2) य ेरािपत्र म ें उनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. पि-सख्ं य ा, वगीकरण और वते न मट्रै रक्स म ें स्ट्तर: पिों की संख् या उनका वगीकरण और वेतन मैट्ररक् स में उनका स्ट् तर वह होगा, िो इन जनयमें से उपाबद्ध अनुसूची के स्ट्त ंभ (2) से स्ट्त ंभ (4) म ेंजवजनर्िकष् ट ह ैं। 3. भती की पद्धजत, आय-ु सीमा अहतक ाएं, आदि : भती की पद्धजत, आय-ु सीमा, अहतक ाएं और उससे संबंजधत अन्य बातें व े होंगी िो उक्त अनुसूची के स्ट् तभं (5) से स्ट्त ंभ (13) में जवजनर्िष्टक ह।ैं 7275 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. जनरहतक ा: वह व्यजि - (क) जिसने ऐस े व्यजि से, जिसका पजत या जिसकी पत् नी िीजवत ह,ै जववाह दकया ह ै या जववाह की संजविा की ह;ै या (ख) जिसने अपने पजत या अपनी पत्न ी के िीजवत रहत े हुए दकसी व्यजि से जववाह दकया ह ैया जववाह की संजविा की ह ै उक्त पिों पर जनयुजि का पात्र नहीं होगा : परन् तु यदि केंद्रीय सरकार का यह समाधान हो िाता ह ै दक ऐसा जववाह ऐसे व् यजि और जववाह के अन् य पिकार को लाग ू स्ट् वीय जवजध के अधीन अनुज्ञेय ह ै और ऐसा करन े के जलए अन् य आधार ह ैं तो वह दकसी व् यजि को इस जनयम के प्रवतकन से छूट िे सकेगी । 5. जचदकत्स क िष्ृ ट या योग्य ता.- इन जनयमों अतं र्वकष्ट दकसी बात के होते हुए भी, केवल वही व्य जि, िो केंद्रीय सिस्ट् त्र पुजलस बल म ें स्ट् वास्ट् ् य िेखरेख प्रणाली म ें यथाजवजनर्िकष् ट जचदकत् सक प्रवगक िेप-1 म ें ह,ैं इन जनयमों के उपबंधों के अधीन पात्र होंगे। 6. अजधवर्षतक ा.- (1) इन जनयमों के अधीन जनयुक्त प्रत् येक व् यजि, उस मास के अंजतम दिन के अपराह्न में, जिसमें वह साठ वषक की आय ुप्राप् त करता ह,ै सेवा से सेवाजनवृत्त हो िाएगा: परन् त ु यह दक वह व् यजि जिसकी िन् म की तारीख मास के पहल े दिन पर ह,ै वह साठ वषक की आयु प्राप् त करने पर, पूवकवती मास के अंजतम दिन के अपराह्न में सेवा से सेवाजनवृत्त हो िाएगा। 7. अन्य िेिीय की अपात्रता.- भारतीय नागट्ररक से जभन् न कोई भी व् यजि, केंद्रीय सरकार की जलजखत पूवक अनुज्ञा के जसवाय, इन जनयमों के अधीन भती नहीं होगा: परंत ु यह दक इन जनयमों में अतं र्वकष्ट कोई भी बात, बल में नेपाल या भूटान के नागट्ररक को भती से वर्िकत नहीं करेगी। 8. जिजथल करन े की िजि: िहां केन् द्रीय सरकार की यह राय ह ै दक ऐसा करना आवश् यक या समीचीन ह,ै वहां वह उसके जलए िो कारण हैं उन् ह ें लेखबद्ध करके इन जनयमों के दकसी उपबंध को दकसी वगक या प्रवगक के व् यजियों की बाबत, आििे द्वारा जिजथल कर सकेगी । 9. व्य ावृजत्त: इन जनयमों की कोई बात, ऐस े आरिणों, आय-ु सीमा में छूट और अन्य ट्ररयायतों पर प्रभाव नहीं डालगे ी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर िारी दकए गए आिेिों के अनसु ार अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों, अन्य जपछड े वगों, भूतपूवक सैजनकों और अन्य जविेष प्रवगक के व्यजियों के जलए उपबंध करना अपेजित ह।ै अनसु चू ी पि का पिों की संख्या। वगीकरण। वेतन मैट्ररक्स में स्ट्तर। चयन अथवा नाम। अचयन पि। (1) (2) (3) (4) (5) 1. हडै 20* (2023) साधारण केन् द्रीय सेवा, वेतन मैट्ररक् स में स्ट्तर-4 लाग ूनहीं कांस्ट् टेबल *कायकभार के आधार पर समूह 'ग', अरािपजत्रत (25500– 81100 रू.) होता । (मास्ट् टर) पट्ररवतकन दकया िा सकता ह।ै अननुसजचवीय। सीधे भती दकए िाने वाले व् यजियों के जलए आयु- सीमा। (6) 18 से 25 वष क के बीच। (केंद्रीय सरकार द्वारा समय-समय पर िारी दकए गए अनुििे ों या आिेिों के अनुसार जवभागीय अभ् यर्थकयों की ििा म ें जिजथल करके 40 वषक तक की िा सकती ह।ै ) ट्रटप्प ण : आय-ु सीमा अवधाट्ररत करने के जलए जनणाकयक तारीख भारत में अभ् यर्थकयों से आविे न प्राप् त करने दक जलए जनयत[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 की गई अंजतम तारीख होगी । (न दक वह अंजतम तारीख िो असम, मेघालय, अरूणाचल प्रिेि, जमिोरम, मजणपुर, नागालडैं , जत्रपुरा, जसदिम, जहमाचल प्रिेि के लाहोल और स्ट् पीजत जिले तथा चम् बा-जिल े के पागं ी उपखडं , लद्दाख, अंिमान और जनकोबार द्वीप या लिद्वीप संघ राज्य िेत्र के अभ् यर्थकयों के जलए जवजहत की गई ह।ै ) सीधे भती दकए िाने वाले व् यजियों के जलए अपेजित िैजिक और अन्य अहतक ाएं। (7) (1) मान् यता प्राप् त बोड कसे िसवीं उत्तीणक या समतुल् य; (घ) पूवोत्तर राज्य ों अरूणाचल प्रििे , मजणपरु , मघे ालय, जमिोरम, 162.5 स.ें मी. 152.2 सें.मी. 77-82 सें.मी. नागालडैं , जसदिम तथा जत्रपुरा से संबंजधत अभ् यथी के जलए तथा िार्िकललंग जिले के तीन उपमडं लों स े जमलकर बन े गोरखा िेत्रीय प्रिासन से आन े वाले अभ् यथी (ङ) पूवोत्तर राज्य ों अरूणाचल प्रििे , मजणपरु , मघे ालय, जमिोरम, 160 सें.मी. 147.5 सें.मी. 76-81 सें.मी. नागालडैं , जसदिम तथा जत्रपुरा और वामपंथी चरमपंथ स े प्रभाजवत जिलों से आए अनसु ूजचत िनिाजतयों से संबंजधत अभ् यथी ट्रटप्प ण – छाती का मानक मजहला अभ् यर्थकयों पर लागू नही होता ह।ै भार मानक: जचदकत् सीय मानकों के अनुसार ऊंचाई तथा आयु के तत्स्ट् थानी (परुु षों और मजहलाओं के जलए) (ii) जचदकत् सीय मानक : (क) जबना सुधार दकए हुए या जबना चश्म ा पहने िोनों आंखों का जनम्न तम िरू ी स े िकृ िजि 6/6 और 6/9 हो। (ख) (i) अभ् यर्थकयों को अतं वकक िानु, सपाट पांव, वक् िजृ ष्ट का नहीं होना चाजहए और उनकी उच् च रंग िजृष्ट होनी चाजहए । (ii) अभ् यथी मानजसक और िारीट्ररक रूप स े स्ट् वास्ट् ् य होना चाजहए और ऐस े िारीट्ररक िोषों स े मुक् त होना चाजहए, जिससे कतकव् यों के िि जनष्प ािन में व् यवधान की संभावना हो। सीधे भती दकए िाने वाले पट्ररवीिा की अवजध, यदि कोई हो। भती की पद्धजत: भती सीध े होगी या प्रोन्नजत व्यजियों के जलए जवजहत आय ु द्वारा या प्रजतजनयुजि/आमेलन द्वारा तथा और िैजिक अहतक ाएं प्रोन्नत जवजभन्न पद्धजतयों द्वारा भरी िाने वाली व्यजियों की ििा म ें लाग ू ट्ररजियों की प्रजतितता। होंगी या नहींं। (8) (9) (10) लाग ूनही होता। सीधे भती दकए िाने वाले व्य जियों के (i) सत्तर प्रजतित प्रोन् नजत द्वारा जिसके जलए िो वषक। न हो सकने पर प्रजतजनयुजि द्वारा; ट्रटप्प ण: केंद्रीय सरकार द्वारा और यथाजवजनर्िकष्ट पट्ररवीिा के (ii) तीस प्रजतित सीधी भती द्वारा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] सफलतापूवकक पूरा करन े के जलए जनम्न तम िो सप् ताह की अवजध का अजनवायक प्रवेि प्रजििण होगा । प्रोन्नजत या प्रजतजनयुजि या आमेलन द्वारा भती की ििा में व े श्रेजणयां जिनस े प्रोन् नजत या प्रजतजनयुजि या आमले न दकया िाएगा। (11) प्रोन् नजत द्वारा: वेतन मैट्ररक् स, स्ट् तर-3 (21700-69100 रु.) में, कांस्ट् टेबल (कमीिल) न े जनयजमत आधार पर जनयुजि के पश् चात ् दिए गए ग्रडे म ें 5 वषक की जनयजमत सेवा की हो तथा यथाजवजनर्िकष् ट प्रोन् नजत-पूव क पाठ्यक्म सफलतापूवकक परू ा दकया हो। ट्रटप्प ण :- िहा ंऐसे कजनष्ठ व् यजियों के संबंध म,ें जिन् होंन े अपनी अहकक या पात्रता सेवा पूरी कर ली है, प्रोन् नजत के जलए जवचार दकया िा रहा हो, वहां उनके ज्य ष्े ठ व् यजियों के संबंध में भी जवचार दकया िाएगा परंतु यह तब िब दक उनके द्वारा की गई ऐसी अहकक या पात्रता सेवा, अपेजित अहकक या पात्रता सेवा के आधे से अजधक स ेया िो वषक से, इनम ेंसे िो भी कम हो, कम न हो और उन् होंने अपने ऐसे कजनष्ठ व् यजियों सजहत, जिन् होंने ऐसी अहकक या पात्रता सेवा पहले ही पूरी कर ली ह,ै अगली उच् चतर श्रेणी में प्रोन्न जत के जलए अपनी पट्ररवीिा की अवजध सफलतापूवकक पूरी कर ली हो। प्रजतजनयुजि द्वारा: केन् द्रीय सरकार या राज्य सरकार या संघ राज्य िेत्र प्रिासन या केन्द्र ीय पजु लस सगं ठन या राज्य सरकार पुजलस संगठन या संघ राज्य ित्रे पुजलस सगं ठन या तटरिक िल के अजधकारी,- (क) (i) जिन् होंन े मूल काडर या जवभाग में जनयजमत आधार पर सििृ पि धारण दकया हो; या (ii) जिन् होंन े वेतन मैट्ररक् स, स्ट् तर-3 (21700-69100 रु.) म ें जनयजमत आधार पर जनयुजि के पश् चात ् दिए गए ग्रेड म ें 5 वषक की जनयजमत सेवा की हो; और (ख) जिसके पास स्ट् तंभ (7) के अधीन सीधी भती दकए िान े वाले व् यजियों के जलए यथाजवजनर्िकष् ट िैजिक अहतक ाए ंहों। ट्रटप्प ण 1:- पोषक प्रवगक के ऐसे जवभागीय अजधकारी, िो प्रोन् नजत की सीधी पंजि में ह,ै प्रजतजनयुजि पर जनयुजि के जलए जवचार दकए िाने के पात्र नहीं होंगे। इसी प्रकार प्रजतजनयुक्त व् यजि प्रोन्न जत द्वारा जनयुजि के जलए जवचार दकए िाने के पात्र नहीं होंगे। ट्रटप्प ण 2: प्रजतजनयुजि की अवजध, जिसके अतं गतक केन् द्रीय सरकार के उसी या दकसी अन् य संगठन या जवभाग म ें इस जनयुजि से ठीक पहल े धाट्ररत दकसी अन्य काडर बाह्य पि पर प्रजतजनयजु ि की अवजध ह ैसाधारणतया 5 वषक से अजधक नही होगी। ट्रटप्प ण 3: प्रजतजनयुजि द्वारा जनयुजि के जलए अजधकतम आय ु सीमा आवेिन प्राप् त करन े की अंजतम तारीख को 56 वषक से अजधक नहीं होगी। यदि जवभागीय प्रोन् नजत सजमजत ह,ै तो उसकी संरचना। भती करन ेमें दकन पट्ररजस्ट्थजतयों में संघ लोक सेवा आयोग से परामिक दकया िाएगा। (12) (13) 1. समूह 'ग' जवभागीय प्रोन्न जत सजमजत (प्रोन् नजत के संबंध म ें जवचार करने के लाग ूनहीं होता। जलए), जिसमें जनम् नजलजखत होंगे :- (1) समािेष्ट ा, भारत-जतब्बत सीमा पुजलस बल - अध्यि; (2) जद्वतीय पंजि का समािेष्ट ा या उप समािेष्ट ा, भारत-जतब्बत सीमा पुजलस बल - सिस्ट्य; और (3) सहायक समािेष्ट ा, भारत-जतब्बत सीमा पुजलस बल - सिस्ट् य। 2. समूह 'ग' जवभागीय पुजष्ट सजमजत (पुजष्ट के संबंध में जवचार करने के जलए), जिसमें जनम् नजलजखत होंग े:- (1) समािेष्ट ा, भारत-जतब्बत सीमा पुजलस बल - अध्यि; Short title and commencement.— (1) These rules may be called the Ministry of Home Affairs Indo-Tibetan Border Police Force, Water Wing (Group ‘C’ Technical Posts) Recruitment Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of posts, classification and level in the pay matrix.— The number of posts, their classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule. 3. Method of recruitment, age-limit and other qualifications, etc.— The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule. 4. Disqualification.— No person,— (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Medical fitness.— Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, as specified in the Health Care System in Central Armed Police Forces, shall be eligible under the provisions of these rules. 6. Superannuation.- (1) Every person appointed under these rules, shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years: Provided that the person whose date of birth is the first day of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty. 7. Ineligibility of aliens- No person other than a citizen of India shall, except with the prior permission of the Central Government in writing, be recruited under these rules: Provided that nothing contained in these rules shall bar the recruitment of a subject of Nepal or Bhutan in the Force.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 8. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 9. Saving.— Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other backward classes, the ex-servicemen and the other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
