From the District Collector, Ananthapur, Lr.No.RC/DT(W) 12788/I1, Dated 25.11.2011 * * * ORDER: In the reference 2nd and 7th read above, the District Collector, Ananthapur has sent a proposal for up-gradation of Kalayanadurgam Gram Panchayat as Nagar Panchayat / Municipality duly merging the surrounding Gram Panchayats i.e., Ontimiddhi, Mudhigallu and Dodagatta in Ananthapur District. All the above Gram Panchayats have accepted the proposals except Gram Panchayat Dodagatta. The criteria are satisfied to constitute Gram Panchayat Kalayandurgam as Municipality duly merging with said surrounding Gram Panchayat. 2) In the reference 4th read above, a show-cause notice has been issued to the Gram Panchayat, Dodagatta asking as to why the resolution passed by the Gram Panchayat, Dodagatta cannot be cancelled. In response to the show cause notice, the District Collector, Ananthapur has obtained the views of the Gram Panchayat, Dodagatta vide reference 5th read above and submitted the Government stating that the Gram Panchayat, Dodagatta has opposed the proposal mentioning various reasons in their resolution. 3) Government have examined the objections raised by the above Gram Panchayat, Dodagatta and found that the objections are mere apprehensions without any basis and that there is no substance in any of the objections put forth by the Gram Panchayat. The decision of merging the surrounding Gram Panchayats into Municipality has been taken in the larger interests of the people of the area keeping in view of its over all development and to provide better amenities to the public and hence the Government have felt that the objections raised by the above Gram Panchayat, Dodagatta are not maintainable and do not deserve consideration. Therefore, the Government have decided to cancel the resolution passed by the Gram Panchayat, Dodagatta and also decided to upgrade the Gram Panchayat, Kalyanaduram as Municipality duly merging the surrounding Gram Panchayats i.e., Ontimiddhi, Mudhigallu and Dodagatta in Ananthapur District. P.T.O :: 2 ::4) Government, after careful examination have decided to cancel the Notification issued, declaring the Kalyanadurgam, Ontimiddhi, Mudhigallu and Dodagatta as Gram Panchayat, so as to upgrade the Gram Panchayat Kalyanadurgam as Municipality duly merging surrounding Gram Panchayats i.e., Ontimiddhi, Mudhigallu and Dodagatta. 5) Therefore, the following Notification shall be published in an Extraordinary Issue of the Andhra Pradesh Gazette dated: 07.02.2012. 6) The Commissioner of Printing, Stationary & Stores Purchase, Hyderabad is requested to publish the following Notification in the Andhra Pradesh Gazette and furnish (30) copies of the same to the Government immediately. NOTIFICATION-I In exercise of the powers conferred under sub section (1) of section 246 of the Andhra Pradesh Panchayat Raj Act, 1994 (Andhra Pradesh Act. No.13 of 1994) the Governor of Andhra Pradesh hereby cancel the Resolution No. Nil, dated 31.07.2009 passed by the Gram Panchayat, Dodagatta, Ananthapur District opposing for upgrading the Gram Panchayat as Municipality. NOTIFICATION-II In exercise of the powers conferred under clause (f) of sub-section (2) of Section 3 of the Andhra Pradesh Panchayat Raj Act, 1994 (Andhra Pradesh Act No.13 of 1994) read with clause (i) of sub-rule (1) of rule 12 of the Andhra Pradesh Gram Panchayats (Declaration of Villages) Rules,2007 issued in the G.O.Ms.No. 542, Panchayat Raj and Rural Development (Pts.IV) Department dt.3-12-2007, the Governor of Andhra Pradesh hereby cancels the Notifications issued declaring the Villages i.e., Kalyanadurgam, Ontimiddhi, Mudhigallu and Dodagatta as Gram Panchayat, so as to upgrade the Gram Panchayat Kalyanadurgam as Nagar Panchayat duly merging surrounding Gram Panchayats i.e., Ontimiddhi, Mudhigallu and Dodagatta.
