Judgment dt. 25.11.2003 in C.C.No.9/1999 of Hon’ble Special Judge for SPE & ACB cases, Nellore. 4. From the D.G., ACB, Hyderabad Lr.Rc.No.178/RCT-NNL/1998, dt. 03.01.2004. 5. Govt. Memo No.1042/VS-I/A2/03-2, PR&RD (VS.I) Dept., dt. 07.02.2004. 6. From the D.G., ACB, Hyderabad Lr.Rc.No.178/RCT-NNL/1998, dt. 12.09.2011. 7. Representation dt. 18.05.2011 from Sri K. Venkataratnam, Dy.EE, PR (Retd.), Podalakur, Nellore District. *** ORDER: It was brought to the notice of the Government that Sri K. Venkataratnam, Dy. Executive Engineer, Panchayat Raj, Podalakur, Nellore District was trapped by the ACB officials on 06.11.1998 when he demanding and accepting a bribe of Rs.800/- from the complainant Sri P. Chenchurami Reddy, Contractor, for doing official favour. 2. After examining the final report furnished by the D.G., ACB, Hyderabad in the reference 1st read above, sanction was accorded for prosecution of Sri K. Venkataratnam, Dy. Executive Engineer, Panchayat Raj, Podalakur, Nellore District, in a Court of Law, vide reference 2nd read above. Accordingly, the Bureau filed charge sheet against the A.O. on 14.06.1999 in the Court of Spl.Judge for SPE & ACB cases, Nellore. 3. In the reference 3rd read above, the Hon’ble Special Judge for SPE & ACB cases, Nellore pronounced judgement on 25.11.2003 in C.C.No.9/1999 finding that the accused officer is not guilty of the charges framed u/s 7 & 13 (2) r/w 13 (1) (d) of P.C. Act and accordingly acquitted him under section 248 (1) Cr.P.C. 4. In the reference 4th read above, the D.G, ACB requested the Government to accord permission to file an appeal against the orders of Special Judge for SPE & ACB cases, Nellore. In the reference 5th read above, Government accorded permission to the D.G.,ACB to file an Appeal before the High Court of A.P. against the acquittal judgement of the trial court dt. 25.11.2003 in C.C.No.9/1999 and accordingly, the Bureau filed Criminal Appeal No.659/2004 before the Hon’ble High Court. 5. In the reference 6th read above, the D.G., ACB while furnishing the copy of the judgment of High Court of A.P., has informed that the Hon’ble High Court dismissed the Criminal Appeal No.659/2004 and also stated that there are no sufficient grounds to prefer an appeal in the matter. (PTO)::2:: 6. In his representation 7th read above, Sri K. Venkataratnam, Dy.EE, PR (Retd.), Podalakur, Nellore District has stated that the Spl. Judge for SPE & ACB cases acquitted him on 25.11.2003 in C.C.No.9/1999 and also the Hon’ble High Court in Criminal Appeal No.659/2004, dt. 28.04.2011 dismissed the appeal filed by the ACB against the acquittal Judgement. He has, therefore, requested to drop further action against him in the light of the above judgments. 7. Government, after careful examination of the matter in detail, have decided to drop further action against Sri K. Venkataratnam, Dy.Executive Engineer, Panchayat Raj (Retd.), Podalakur, Nellore District keeping inview judgement of Trial Court/High Court and accordingly hereby drop further action against him. 8.
