Gram Panchayats – Srikakulam District – Cancellation of resolutions passed by
certain Gram and De-notification of certain Gram Panchayats in Srikakulam
District - Notifications – Issued.

ORDER:
In the reference 2nd read above, the District Collector, Srikakulam District
has sent a proposal for inclusion of surrounding (7) Gram Panchayats i.e., 1)
Peddapadu; 2) Kusalapuram (Etcherla Mandal); 3) Thotapalem; 4) Killipalem; 5)
Chapuram; 6) Khazipet and 7) Pathrunivalasa into the Municipal limits of
Srikakulam Municipality through Commissioner & Director of Municipal
Admisnstration, Hyderabad vide reference 3rd read above. All the above Gram
Panchayats except Peddapadu Gram Panchayat, has opposed the proposal.
2) In the reference 4th read above, the show-cause notices to the (6) Gram
Panchayats have been issued asking them as to why the above Gram
Panchayats could not be included into the Srikakulam Municipality. In response
to the show cause notices, the District Collector, Srikakulam has obtained the
views of all the six Gram Panchayats vide reference 5th read above and
submitted to the Government stating that all the six Gram Panchayats have
opposed the proposed merger mentioning various reasons in their respective
resolutions.
3) Government have examined the objections raised by the above Gram
Panchayats and found that the objections are mere apprehensions without any
basis and that there is no substance in any of the objections put forth by the
Gram Panchayats. The decision of merging the surrounding Gram Panchayats
into Municipality has been taken in the larger interests of the people of the area
keeping in view of its over all development and to improve better amenities to the
public and hence the Government have felt that the objections raised by the
above Gram Panchayats are not maintainable and do not deserve consideration.
Therefore, the Government have decided to cancel the resolutions passed by the
respective said six Gram Panchayats and also decided to merge the surrounding
(7) Gram Panchayats into Srikakulam Municipality of Srikakulam District.
4) Government, after careful examination have decided to cancel the
Notifications issued, declaring the 1)Kusalapuram (Etcherla Mandal); 2)
Thotapalem; 3) Killipalem; 4) Chapuram; 5) Khazipet 6) Pathrunivalasa and 7)
Peddapadu as Gram Panchayats, so as to include the areas into Srikakulam
Municipality.

5) Therefore, the following Notifications will be published in an Extraordinary
Issue of the Andhra Pradesh Gazette dated: 07.02.2012.
6) The Commissioner of Printing, Stationary & Stores Purchase, Hyderabad
shall publish the following Notifications in the Andhra Pradesh Gazette and
furnish (30) copies of the same to the Government immediately.
NOTIFICATION-I
In exercise of the powers conferred under sub section (1) of section 246 of
the Andhra Pradesh Panchayat Raj Act, 1994 (Andhra Pradesh Act. No. 13 of
1994) the Governor of Andhra Pradesh hereby cancels the following resolutions
passed by the respective Gram Panchayats of Srikakulam District opposing for
merging the surrounding villages into Srikakulam Municipality.
1. Resolution dated 01.12.2009 of Kusalapuram;
2. Resolution No. 125, dated 01.12.2009 of Thotapalem;
3. Resolution dated 02.12.2009 of Killipalem;
4. Resolution dated 03.12.2009 of Chapuram;
5. Resolution dated 30.11.2009 of Khazipet and
6. Resolution No.1, dated 04.12.2009 of Pathrunivalasa,
NOTIFICATION-II
In exercise of the powers conferred under clause (f) of sub-section (2) of
Section 3 of the Andhra Pradesh Panchayat Raj Act, 1994 (Andhra Pradesh Act
No.13 of 1994) read with clause (i) of sub-rule (1) of rule 12 of the Andhra
Pradesh Gram Panchayats (Declaration of Villages) Rules,2007 issued in the
G.O.Ms.No. 542, Panchayat Raj and Rural Development (Pts.IV) Department,
dt.03-12-2007, the Governor of Andhra Pradesh hereby cancels the Notifications
issued declaring the (7) Villages i.e., 1) Peddapadu; 2) Kusalapuram (Etcherla
Mandal); 3) Thotapalem; 4) Killipalem; 5) Chapuram; 6) Khazipet and 7)
Pathrunivalasa, so as to include the areas into Srikakulam Municipality in
Srikakulam District.
