corruption against Sri Ganta Venkata Rama Adi Sesha Rao, formerly Junior
Assistant, Office of the C.E.O., ZPP, Guntur , Guntur district – Sanction of
Prosecution – Under the provisions of the prevention of corruption Act, 1988 -

ORDER:
WHEREAS, Sri Ganta Venkata Rama Adi Sesha Rao, S/o Eswara Rao,
worked as Junior Assistant in the Office of the Chief Executive Officer, Zilla
Praja Parshid Guntur, Guntur District from 09.07.2010 and by virtue of the post
held by him, he falls under the category of a Public Servant as defined under
clause (c) of section 2 of the Prevention of Corruption Act, 1988. (Act 49 of
1988)
2. AND WHEREAS, Sri Vankudavath Srinu Naik, S/o Sri Bhimudu Naik is
working as Junior Assistant, in the Office of the Chief Executive Officer, Zilla
Praja Parishad, Guntur, Guntur District.
3. AND WHEREAS, it is alleged that Sri Vankudavath Srinu Naik is a
resident of Akulavari Thota, Guntur and working as Junior Assistant in the Office
of Chief Executive Officer, Zilla Praja Parishad, Guntur, Guntur District, and looks
after Provident fund (F5) seat. One Sri S.Vijaya Ratnam a Retd. Secondary Gr.
Teacher from MPP School, Appikatla, Bapatla Mandal complained that he had
faced lot of inconvenience in connection with the receipt of pensionary benefits
because of tampering of GPF account number by Sri Vankudavath Srinu Naik
and the Accounts Officer, Zilla Praja Parishad, Guntur was appointed as Enquiry
Officer in this issue. The Enquiry Officer served an Urgent Office Note on Sri
Vankudavath Srinu Naik directing him and the Office Superintendent to attend
the enquiry and submitted his explanation. Sri Ganta Venkata Rama Adi Sesha
Rao, formerly Junior Assistant, Office of Chief Executive Officer, Zilla Praja
Parishad, Guntur, looks after the connected file. Sri Vankudavath Srinu Naik met
him about 4 or 5 times and enquired about his file. Sri Ganta Venkata Rama Adi
Sesha Rao informed him that he would talk to the Chief Executive Officer and get
the things done. On 17.8.2010 around 11 am Sri Vankudavath Srinu Naik met Sri
Ganta Venkata Rama Adi Sesha Rao in his office and enquired about his file. Sri
Ganta jVenkata Radma Adi Sesha Rao demanded Rs.12,000/- to process the file
and to see that there would not be any action by the Chief Executive Officer in
this regard. Sri Vankudavath Srinu Naik pleaded his inability to pay such huge
amount and Sri Ganta Venkata Rama Adi Sesha Rao reduced his demand to
Rs.10,000/- and categorically stated that he would process the file and see that
there would not be any problem to Sri Vankudavath Srinu Naik from the Chief
Executive Officer, Zilla Praja Parishad, Guntur, and would get the file closed only
if he paid the demanded bribe amount Sri Vankudavath Srinu Naik reluctantly
agreed to pay the bribe and Sri Ganta Vekata Rama Adi Sesha Rao directed
him to pay the said bribe of Rs.10,000/- in his office on 18-8-2010 A/N. as Sri
Vankudavath Srinu Naik was unwilling to pay the bribe to Sri Ganta Venkata
Rama Adi Sesha Rao, on 17-8-2010, he gave a report against him to the DSP,
ACB, Vijayawada Range and requested for necessary action. The DSP received
report from Sri Vankudavath Srinu Naik and instructed the District Inspector,

ACB, Vijayawada Range Guntur to verify the contents of the complaint and
antecedents of Sri Ganta Venkata Rama Adi Sesha Rao as well as there of Sri
Venkudavath Srinu Naik. After receipt of the verification report, the DSP
registered a case in Cr. NO. 15/RCT-ACB-VJA/2010 under section 7 of the
Prevention of Corruption Act, 1988 on 18-08-2010 at 9.45 am, after due process
and made arrangements for laying trap.
4. AND WHEREAS, it is further alleged that, after completion of proceedings
drafted under a cover of Mediators Report-1, the Deputy Super indents of Police
along with Sri Vankudavath Srinu Naik, mediators, Inspectors and other
members of the trap party left the ACB office, Guntur on 18-08-2010 at 3.50pm in
Government vehicles and reached the vicinity of the office of Sri Ganta Venkata
Rama Adi Sesha Rao at 4.05pm. as per the instructions of the DSP Sri
Vankudavath Srinu Naik went straight away to Sri Ganta Venkata Rama Adi
Sesha Rao, who was sitting alone in the office room. Sri Vankudavath Srinu
Naik, requested Sri Ganta Venkata Rama Sesha Rao to help him by processing
his file and Sri Ganta Venkata Rama Adi Sesha Rao asked him whether he had
brought the demanded bribe amount of Rs.10,000/- for which he replied
affirmative. Sri Ganta Venkata Rama Adi Sesha Rao asked Sri Vakudavath Srinu
Naik to pay the demanded bribe amount. Then he took out the wad of tainted
currency notes from his left front upper shirt pocket with his right hand and gave
the same to Sri Ganta Venkata Rama Adi Sesha Rao, who received the same
with his left hand and put it in his left side pant pocket. Then Sri Vankudavath
Srinu Naik requested Sri Ganta Venkata Rama Adi Sesha Rao to help him and
Sri Ganta Venkata Rama Adi Sesha rao assured that he would put up the same
to the Chief Executive Officer and said that he would somehow ensure and see
that the Chief Executive Oficer takes a lenient view of the act done by Sri
Vankudavath Srinu Naik and finalize the issue with a warning memo to him that
would not in any way affect his career. Sri Vankudavath Srinu Naik came out of
the office and gave the pre-arranged signal. Immediately, the DSP and other
members of the trap party including mediators rushed into the office room of Sri
Ganta Venkata Rama Adi Sesha Rao and the DSP disclosed his identity to Sri
Ganta Venkata Rama Adi Sesha Rao conducted Sodium Carbonate solution
tests on both hand fingers of Sri Ganta Venkata Rama Adi Sesha Rao and the
left hand fingers proved positive. As per the directions of the DSP, Sri Ganta
Venkata Rama Adi Sesha Rao produced the tainted amount from his left side
pant pocket and as per the instructions of the DSP, one of the mediators took the
tainted currency notes and the serial numbers when compared with pre-trap
proceedings found tallied. The chemical test conducted on the inner linings of the
left side pant pocket of Sri Ganta Venkata Rama Adi Sesha Rao proved positive.
The resultant solutions were seized. The DSP seized the tainted amount of
Rs.10,000/- for the purpose of further investigation.
5. AND WHEREAS, the said acts of the said Sri Ganta Venkata Rama Adi
Sesha Rao, formerly Junior Assistant, Office of Chief Executive Officer, Zilla
Praja Parishad, Guntur, Guntur district constitute offences punishable under
sections 7 & 13(2) read with section 13(1)(d) of the Prevention of Corruption Act,
1988.
6. AND WHEREAS, the Government of Andhra Pradesh being the
competent authority to remove Sri Ganta Venkata Rama Adi Sesha Rao,
formerly Junior Assistant, Office of Chief Executive Officer, Zilla Praja Parishad,
Guntur, Guntur district from Government service after fully and carefully
examining the material (i.e. Final Report, F.I.R., mediator names, Gist of
statement of witnesses etc.,) placed before them in respect of the said
allegations and having regard to the facts and circumstances of the case,
consider that the said Sri Ganta Venkata Rama Adi Sesha Rao, formerly Junior
Assistant, Office of Chief Executive Officer, Zilla Praja Parishad, Guntur, Guntur
District should be prosecuted in a court of Law for the afore said offences.

7. NOW THEREFORE, in exercise of the powers conferred by clause (b) of
sub-section (1) of Section 19 of the Prevention of Corruption Act, 1988, (Act 49 of
1988) the Government of Andhra Pradesh hereby accord sanction for
prosecution of the above said Sri Ganta Venkata Rama Adi Sesha Rao, formerly
Junior Assiatant, Office of Chief Executive Officer, Zilla Praja Padrishad, Guntur,
Guntur District for the offences punishable under section 7 and sub-section (2) of
section 13 read with clause (d) of sub- section (1) of section 13 of the Prevention
of Corruption Act, 1988 (Act 49 of 1988) and for any other cognate offences
punishable under any other provisions of Law for the time being in force in
respect of the aforesaid allegation and for taking cognizance of the said offences
by a court of competent jurisdiction.
