Explanation of Sri Ch.Anand Prasad, DlPO (Retired) Dated.14.3.2012 *** In the reference 1st read above, the CPR has reported that Sri Ch.Anand Prasad, DLPO (Retired) has committed certain irregularities by non-conducting of inquiry on misappropriation of fund for an amount of Rs.9,71,980/- by the Panchayat Secretary, GP, Mandavally, Krishna District and requested the Government to accord permission to initiate disciplinary action against the individual. 2. In reference 2nd read above, Government have accorded permission under sub-clause (i) of clause (b) of sub rule (2) of rule 9 of the A.P. Revised Pension Rules, 1980 to initiate departmental proceedings against Sri Ch.Anand Prasad, DLPO (Retired) and directed that the said departmental proceedings shall be conducted in accordance with the procedure laid down in Rule 20 of the A.P. Civil Services (CCA) Rules, 1991 by the CPR and submit final recommendation to Government. 3. In the reference 3rd read above the CPR has framed charges against Sri Ch.Anand Prasad, DLPO and after examination of the statement of defense, the CEO, ZP, West Godavari was appointed as EO to conduct regular enquiry. The EO has submitted the enquiry report. While enclosing the enquiry report of the CEO, ZP, West Godavari, the CPR has requested the Government to issue necessary orders as the individual has retired from the service on 31.5.2009 on attaining the age of superannuation.:: 2 :: 4. After careful examination of the matter, the Government have taken a provision decision to impose 2% cut in pension for his dereliction of duty and negligence. 5. Accordingly in the reference 4th read above, a show cause notice was issued to the individual directing to show cause as to why a penalty of 2% cut in pension should not be imposed on him as per APRPRs, 1980 for his dereliction of duty and negligence. 6. In the reference 5th read above, the individual has submitted his explanation. 7. After examination of the explanation of the individual, the Government have confirmed the provisional decision and in the reference 6th read above, the APPSC, Hyderabad has been requested their advice on the proposed punishment and the APPSC has advised that before issuing the final orders a final show-cause notice be issued to the Charged Officer, specifying the duration of punishment and the reasons for disagreeing with the EO in the reference 7th read above. 8. Accordingly in the reference 8th read above, a final show cause notice was issued to the Charged officer specifying the duration of punishment i.e. 2% cut in pension permanently and stating the reasons for disagreeing with the Enquiry Officer. 9. In the reference 9th read above, the individual has submitted his explanation. 10. After careful examination of the matter and the explanation submitted by the individual to the final show notice, Government hereby confirm the provisional decision already taken and impose a penalty of 2% cut in pension permanently on Sri Ch.Anand Prasad, DLPO (Retired) for his dereliction of duty and negligence as per APRPRs, 1980. 11.
