L.-33004/99 सी.जी.-डी.एल.-अ.-09072024-255286 CG-DxLx-xEG-I0D9H0x7x2x0 24-255286 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2525] नई दिल्ली, , मगं लवार, िुलाई 9, 2024/आषाढ 18, 1946 No. 2525] NEW DELHI, TUESDAY, JULY 9, 2024/ASHADHA 18, 1946 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 8 िुलाई, 2024 का.आ. 2660(अ).— िबदक जसख्स फॉर िजस्ट्िस (जिसे इसम ें इसके पश्चात एसएफिे कहा गया ह)ै , ऐस े दियाकलापों म ें जलप्त रहा ह,ै िो भारत की आतं ररक सुरक्षा और लोक व्यवस्ट्था पर प्रजतकूल प्रभाव डालन े वाल े ह,ैं और ििे की िांजत, एकता और अखंडता को बाजधत करन े की क्षमता रखते ह;ैं और, िबदक, केंद्र सरकार की यह राय ह ै दक एसएफिे उन दियाकलापों म ें जलप्त ह ै िो ििे की अखडं ता और सुरक्षा के प्रजतकूल ह;ैं और, िबदक, केंद्र सरकार की राय ह ै दक एसएफि े जनम्नजलजखत ऐस े जवजधजवरुद्ध दियाकलापों म ें िाजमल ह,ै िो जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा (2) की उप-धारा (1) के खंड (ण) और (त) के अंतगगत आत े ह,ैं अथागत ् :- (i) एसएफिे पंिाब और अन्य िगहों पर राष्ट्र-जवरोधी और जवध्वंसक गजतजवजधयों म ें िाजमल ह,ै जिसका उद्देश्य भारत की संप्रभुता और क्षेत्रीय अखंडता को बाजधत करना ह;ै (ii) एसएफिे उग्रवािी संगठनों और कायगकतागओं के जनकि संपकग म ें ह,ै और भारत संघ के राज्य क्षत्रे स े एक संप्रभु खाजलस्ट्तान बनाने के जलए पंिाब और अन्य िगहों पर चरमपंथ और उग्रवाि स े हहसं क समथगन कर रहा ह;ै और 4090 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) एसएफिे भारतीय क्षत्रे के एक जहस्ट्स े को भारत संघ स े अलग करन े के दियाकलापों को प्रोत्साजहत और सहायता कर रहा ह ै तथा भारत और अन्य िगहों पर इस प्रयोिन के जलए लड़ रह े अलगाववािी समूहों को ऐसी गजतजवजधयों और बयानों म ें िाजमल होकर समथनग ि े रहा ह ै जिनका उद्देश्य भारत की संप्रभुता और क्षेत्रीय अखंडता को बाजधत करना ह।ै और, िबदक, केंद्र सरकार की यह और राय ह ै दक यदि एसएफिे के जवजधजवरुद्ध दियाकलापों पर तुरंत अंकुि नहीं लगाया गया और उन्ह ें जनयंजत्रत नहीं दकया गया, तो इसकी सभं ावना ह ैदक - (क) जवजध द्वारा स्ट्थाजपत सरकार को अजस्ट्थर करके भारत सघं के क्षत्रे स े खाजलस्ट्तान को अलग करने के प्रयासों सजहत अपनी जवध्वंसक गजतजवजधयों को बढावा िेगा; (ख) पंिाब को भारत संघ स ेअलग करने और खाजलस्ट्तान के गठन की वकालत िारी रखेगा; (ग) राष्ट्र जवरोधी और अलगाववािी भावनाओं का प्रचार करेगा िो ििे की क्षेत्रीय अखंडता और सुरक्षा के जलए हाजनकारक ह;ैं और (घ) अलगाववािी आंिोलनों को बढाएगा, उग्रवाि का समथगन करेगा और ििे म ें हहसं ा भड़काएगा; और िबदक, केंद्र सरकार की यह भी राय ह ै दक एसएफिे की गजतजवजधयों को ध्यान म ें रखत े हुए यह आवश्यक ह ै दक एसएफि े को एक जवजधजवरुद्ध संगम घोजषत दकया िाएI अतः, अब, केंद्र सरकार, जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) की धारा 3 की उपधारा (1) और उपधारा (3) द्वारा प्रित्त िजियों का प्रयोग करत े हुए, जसख्स फॉर िजस्ट्िस (एसएफिे) को एक जवजधजवरुद्ध संगम घोजषत दकए िाने की अवजध को जवस्ट्ताररत करती ह ै और जनिेि िेती ह ै दक यह अजधसूचना, उि अजधजनयम की धारा 4 के अधीन दकए गए दकसी भी आििे के अध्यधीन 10 िुलाई, 2024 स ेअगल े पांच वष ग की अवजध के जलए प्रभावी होगी। [फा. सं. 17014/21/2024 – आं.स.ु -VII] अजनल सुब्रमण्यम, संयुि सजचव MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 8th July, 2024 S.O. 2660(E).—Whereas, the Sikhs For Justice (hereinafter referred to as the SFJ), has been indulging in activities, which are prejudicial to the internal security of India and public order, and have the potential of disrupting peace, the unity and integrity of the country; And, Whereas, the Central Government is of the opinion that the SFJ is indulging in the activities which are prejudicial to the integrity and security of the country; And, Whereas, the Central Government is of the opinion that following unlawful activities indulged by the SFJ falls within the meaning of clauses (o) and (p) of sub-section (1) of section 2 of the Unlawful Activities (Prevention) Act, 1967, namely: - (i) SFJ is involved in anti-national and subversive activities in Punjab and elsewhere, intended to disrupt the sovereignty and territorial integrity of India; (ii) SFJ is in close touch with the militant outfits and activists, and is supporting violent form of extremism and militancy in Punjab and elsewhere to carve out a sovereign Khalistan out of territory of Union of India; and (iii) SFJ is encouraging and aiding the activities for secession of a part of the Indian territory from the Union of India and supporting separatist groups fighting for this purpose in India and elsewhere by indulging in activities and articulations intended to disrupt the sovereignty and territorial integrity of India; And, Whereas, the Central Government is further of the opinion that if the unlawful activities of the SFJ are not curbed and controlled immediately, it is likely to –[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (a) escalate its subversive activities including attempts to carve out Khalistan Nation out of the territory of Union of India by destabilising the Government established by law; (b) continue advocating the secession of Punjab from the Union of India and formation of Khalistan; (c) propagate anti-national and separatist sentiments prejudicial to the territorial integrity and security of the country; and (d) escalate secessionist movements, support militancy and incite violence in the country; And, Whereas, the Central Government is also of the opinion that having regard to the activities of the SFJ, it is necessary to declare the SFJ to be an unlawful association. Now, therefore, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby extends the declaration of the Sikhs For Justice (SFJ) as an unlawful association and directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect for a further period of five years from 10th day of July, 2024.
