जबना भारत म ें दकसी भी क्षेत्र में प्रवेि करता ह,ै वह कारावास से, िो पांच वषि तक का हो सकेगा या िुमािन े से, िो पांच लाख रुपए तक का हो सकेगा या िोनों से िंडनीय होगा। 2. 23. िो कोई, - (क) जविेिी होते हुए, भारत के दकसी क्षेत्र में उस अवजध से अजधक अवजध के जलए रहता ह ै जिसके जलए उसे वीिा िारी दकया गया था या धारा 3 के उपबंधों का उल्लंघन करते हुए जवजधमान्य पासपोर्ि या अन्य जवजधमान्य यात्रा िस्ट्तावेि के जबना भारत में रहता ह ै या भारत या उसके अधीन दकसी भाग में प्रवेि और प्रवास के जलए उसे िारी दकए गए जवजधमान्य वीिा की ितों का उल्लंघन करते हुए कोई कायि करता ह,ै (ख) इस अजधजनयम की धारा 17 और 19 से जभन्न दकसी अन्य उपबंध या उसके अधीन बनाए गए दकसी जनयम या आिेि या इस अजधजनयम के अनुसरण में दिए गए जनिेि या अनुिेि का उल्लंघन करता ह ै या ऐसा आिेि या जनिेि या अनुिेि, जिसके जलए इस अजधजनयम के अधीन कोई जवजनर्ििष्ट िंड का उपबंध नहीं है, कारावास से, िो तीन वषि तक का हो सकेगा या िुमािने से, िो तीन लाख रुपए तक का हो सकेगा या िोनों से िंडनीय होगा। (i) जविेजियों द्वारा वीजा अवजध की अजधक ठहरने िमन की िाने वाली राजि जविेिी क्षेत्रीय जवजधमान्यता से अजधक समय तक की अवजध (रकम) रजिस्ट्रीकरण रुकना। अजधकारी। तीस दिन तक (क) नीचे दिए गए (ख) और (ग) में उजल्लजखत अजधक रुकने की जविेजियों को छोड़ कर : ििा में, बौद्ध जभक्षु और पादकस्ट्तान, बांग्लािेि और अफगाजनस्ट्तान के नागररक िो िीघिकाजलक वीजा अनुित्त होने के जलए पात्र ह:ैं 1 दिन से 30 दिन पचास रुपये तक 31 दिन से 90 दिन एक सौ रूपये तक 91 दिन से 180 दिन िो सौ रूपये तक 181 दिन से एक वषि तीन सौ रुपये तक एक वषि से अजधक अजधकतम तीन लाख रुपए के अधीन रहते हुए पांच सौ रुपये तथा प्रत्येक अजतररि वषि के जलए पचास रुपये। (ग) ऊपर (ख) के अंतगित न आने वाले अफगाजनस्ट्तान के नागररक: दकसी भी अवजध के एक हिार रुपये जलए (ii) अजधजनयम की धारा 3 के उपबंधों समाप्त हुए पासपोर्ि िमन की िाने वाली जविेिी क्षेत्रीय या अन्य यात्रा राजि (रकम) रजिस्ट्रीकरण का उल्लंघन करते हुए जवजधमान्य िस्ट्तावेि की अवजध। अजधकारी। पासपोर्ि या अन्य यात्रा िस्ट्तावेि के जबना भारत में प्रवास करने वाला कोई (क) नीचे दिए गए (ख) में उजल्लजखत जविेजियों जविेिी। को छोड़ कर :4 THE GAZETTE OF रजिस्ट्रीकरण अधीन बनाए गए जनयम या आिेि के अजधकारी। उपबंधों का उल्लंघन करते हुए (क) नीचे (ख) में उजल्लजखत से जभन्न जविेजियों जविेजियों द्वारा रजिस्ट्रीकरण न तीस दिन तक को छोड़ कर : कराना। रजिस्ट्रीकरण न 1 दिन से 30 दिन तक िस हिार रुपये कराने की ििा में, अप्रवास 31 दिन से 90 दिन बीस हिार रुपये चौकी पर तक आप्रवास 91 दिन से 180 दिन पचास हिार रुपये अजधकारी या तक जविेिी क्षेत्रीय रजिस्ट्रीकरण 181 दिन से एक वषि एक लाख रुपये अजधकारी । तक[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 एक वषि से अजधक अजधकतम तीन लाख रुपये के अधीन रहते हुए, िो लाख रुपये तथा गैर-रजिस्ट्रीकरण के प्रत्येक वषि के जलए पचास हिार रुपये। (ख) जतब्बत, मंगोजलया के बौद्ध जभक्षु और पादकस्ट्तान, बांग्लािेि और अफगाजनस्ट्तान के नागररक िो िीघिकाजलक वीजा के अनुित्त होने के जलए पात्र ह:ैं 1 दिन से 30 दिन तक पचास रुपये 31 दिन से 90 दिन एक सौ रूपये तक 91 दिन से 180 दिन िो सौ रूपये तक 181 दिन से एक वषि तीन सौ रुपये तक एक वषि से अजधकतम तीन लाख अजधक रुपये के अधीन रहते हुए, पांच सौ रुपय े और गैर-रजिस्ट्रीकरण के प्रत्येक वषि के जलए पचास रुपये। (iv) जविेिी को िारी जवजधमान्य प्रत्येक मामले में पचास हिार रुपये। जविेिी क्षेत्रीय रजिस्ट्रीकरण वीजा की ितों का उल्लंघन, अजधकारी। (क) दकसी भी प्रवगि के वीजा पर (पयिर्क वीजा को छोड़ कर) ऐसे दक्रयाकलापों में िाजमल पाया गया हो [रोिगार लेने को छोड़ कर] िो जवजिष्ट वीजा प्रवगि के अधीन अनुज्ञात नहीं ह:ैं (ख) पयिर्क वीजा पर ऐसे प्रत्येक मामले में पचास हिार रुपये। जविेिी क्षेत्रीय रजिस्ट्रीकरण दक्रयाकलापों में संजलप्त पाया गया हो अजधकारी। [रोिगार लेने को छोड़ कर] िो पयिर्क वीजा के अधीन अनुज्ञात नहीं ह;ै (ग) रोिगार वीजा को छोड़ कर प्रत्येक मामले में तीन लाख रुपये। जविेिी क्षेत्रीय रजिस्ट्रीकरण दकसी अन्य वीजा पर दकसी संगठन या अजधकारी। संस्ट्थान में रोिगार लेना; (घ) दकसी भी प्रवगि के वीजा पर या प्रत्येक मामले में तीन लाख रुपये। जविेिी क्षेत्रीय रजिस्ट्रीकरण भारत के काडिधारक जविेिी नागररक, अजधकारी। केन्द्रीय सरकार द्वारा जवजनर्ििष्ट प्राजधकारी की पूवि अनुमजत के जबना6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] तबलीगी दक्रयाकलापों, पत्रकाररता दक्रयाकलापों और जमिनरी दक्रयाकलापों में संजलप्त पाया गया हो; और (ङ) वीजा ितों का कोई अन्य उल्लंघन प्रत्येक मामले में पचास हिार रुपये। जविेिी क्षेत्रीय रजिस्ट्रीकरण िो ऊपर जवजनर्ििष्ट नहीं ह।ै अजधकारी। (v) कोई जविेिी व्यजि, अजधजनयम जबना परजमर् के रहने िमन की िाने वाली जविेिी क्षेत्रीय की अवजध. राजि (रकम) रजिस्ट्रीकरण की धारा 11 या उसके अधीन दकए अजधकारी। गए दकसी आिेि के उपबंधों का 1 दिन से 30 दिन तक पचास हिार रुपये उल्लंघन करते हुए प्राजधकारी से जविेष अनुमजत के जबना दकसी संरजक्षत 31 दिन से 90 दिन पचहत्तर हिार रुपये क्षेत्र या जनबंजधत क्षेत्र या प्रजतजषद्ध 91 दिन से 180 दिन एक लाख रुपये स्ट्थान पर िाता ह ैया रहता ह।ै 181 दिन से एक वषि िो लाख रुपये एक वषि से अजधक तीन लाख रुपये (vi) अजधजनयम की धारा 8 या प्रत्येक मामले में पचास हिार रुपये। जविेिी क्षेत्रीय रजिस्ट्रीकरण आप्रवास और जविेजियों जवषयक अजधकारी। जनयम, 2025 के जनयम 17 के उपबंधों का उल्लंघन करते हुए आवास के रखवाले द्वारा दकसी आवास में जविेजियों के आवास के संबंध में िानकारी प्रस्ट्तुत न करना। (vii) अजधजनयम की धारा 9 या प्रत्येक मामले में एक लाख रुपये। जविेिी क्षेत्रीय रजिस्ट्रीकरण आप्रवास और जविेजियों जवषयक अजधकारी। जनयम, 2025 के जनयम 16 के उपबंधों का उल्लंघन करते हुए, जवश्वजवद्यालय या िैजक्षक संस्ट्थान या जिक्षा के जलए जविेजियों को प्रवेि िेने वाली दकसी अन्य संस्ट्था द्वारा प्रवेि दिए गए जविेजियों के संबंध में सूचना प्रस्ट्ततु न करना। (viii) अजधजनयम की धारा 10 या प्रत्येक मामले में एक लाख रुपये। जविेिी क्षेत्रीय रजिस्ट्रीकरण आप्रवास और जविेजियों जवषयक अजधकारी। जनयम, 2025 के जनयम 18 के उपबंधों का उल्लंघन करते हुए, ऐसी जचदकत्सा सुजवधा प्रिान करने वाला कोई अन्य संस्ट्थान इनडोर जचदकत्सा उपचार ले रह े जविेजियों या उनके पररचारक के संबंध में िानकारी प्रस्ट्तुत न करना, जिनके जलए अस्ट्पताल, नर्संग होम या दकसी अन्य जचदकत्सा संस्ट्थान द्वारा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 आवास या सोने की सुजवधा प्रिान की गई है। 24. (1) िो कोई धारा 21, 22 या वही राजि (रकम) िो िष्प्ु प्रेररत अपराध की होती है जविेिी क्षेत्रीय रजिस्ट्रीकरण 23 के अधीन िण्डनीय दकसी अपराध अजधकारी। का िष्प्ु प्रेरण करता है, यदि िष्प्ु प्रेररत कायि िष्प्ु प्रेरण के पररणामस्ट्वरूप दकया गया हो, तो वह उसी िण्ड से िण्डनीय होगा िो उन अपराधों के जलए उपबजन्धत है। (2) इस धारा के प्रयोिनों के जलए,- (i) दकसी कायि या अपराध, िष्प्ु प्रेरण के पररणामस्ट्वरूप दकया गया तब कहा िाता ह,ै िब वह उकसावे के पररणामस्ट्वरूप, या षडयंत्र के अनुसरण में, या उस सहायता से दकया िाता ह ै जिससे अपराध गरठत होता ह;ै (ii) "िष्प्ु प्रेरण" अजभव्यजि का वही अथि होगा िो भारतीय न्याय संजहता, 2023 (2023 का 45) की धारा 45 के अधीन दिया गया ह।ै 2. यह अजधसूचना रािपत्र म ेंप्रकािन की तारीख को प्रवृत्त होगी। [फा. सं. 25022/11/2025-एफ.I] जनतेि कुमार व्यास, अपर सजचव MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 1st September, 2025 S.O. 3999(E).—In exercise of the powers conferred by sub-section (1) of section 25 of the Immigration and Foreigners Act, 2025 (13 of 2025), the Central Government hereby specifies the officer or authority as mentioned in column (4) of the Table, who may, before institution of any prosecution under the said Act or during trial, compound the offences under the said Act as specified in column (2) of the said Table, on payment of the sum (amount) as specified in column (3) of the said Table TABLE Sl. Whoever, — (a) being a foreigner, remains in any area in India for a period exceeding the period for which the visa was issued to him or stays in India without a valid passport or other valid travel document in contravention of provisions of section 3 or does any act in violation of the conditions of the valid visa issued to him for his entry and stay in India or any part thereunder; (b) contravenes any other provisions of this Act, other than sections 17 and 19, or of any rule or order made thereunder or any direction or instruction given in pursuance of this Act or such order or direction or instruction for which, no specific punishment is provided under this Act, shall be punishable with an imprisonment for a term which may extend to three years or with a fine which may extend to three lakh rupees or with both.
