PART IV-B Rules and Orders (Other than those published in Parts I, I-A, and I-L) made by the Government of Gujarat under the Gujarat Acts HOME DEPARTMENT ORDER Sachivalaya, Gandhinagar, 20th December, 2025 GUJARAT PROHIBITION ACT, 1949. No. GHG/165/2025/VDR/102020/977/E.1:- In exercise of the powers conferred by clause (c) read with clauses (b) and (f) of sub-section (1) and sub-section (2) of section 139 of the Gujarat Prohibition Act, 1949 (Bom. XXV of 1949), the Government of Gujarat hereby amends the Government Order, Home Department No. GHG/204/VDR/102020/977/E-1, dated the 30th December, 2023 and subsequent amendment order No. GHG/51/2025/VDR/102020/977/E-1, dated the 15th April, 2025, as under:- In the Said Order,- (A) For Exempts No. (1) and (2), the following exemptions respectively shall be substituted, namely :- “(1) The person working at or visiting the area of Gujarat International Finance Tec-City (Gift City), from the provisions of the section 22, 40, 40A, 40B and 43 of the Gujarat Prohibition Act, 1949; and IV-B Ex.-575 575-1575-2 GUJARAT GOVERNMENT GAZETTE, EX., 20-12-2025 [ PART IV-B (2) The F.L. III Licensees, from the provisions of Sections 22, 24, 33, 34, 43, 44 and 58-A of the Gujarat Prohibition Act, 1949 (hereinafter referred to as the Act) and from the provisions of rules 5, 15, 16, 18, 63, 64, 64-A and 64-B of the Bombay Foreign Liquor Rules, 1953,”. (B) In the Condition,- (i) condition No. (16) shall be deleted; (ii) for condition Nos. (2), (3), (9), (10), (11), and (12), the following conditions respectively shall be substituted, namely :- “(2) The Licensee shall serve liquor for consumption in the approved Wine and Dine facility area as well as any area of Hotel/Restaurant Premises (Restaurant, Lawn Area, Pool Side, Terrace, F & B etc.). (3) The Licensee shall serve liquor only to Liquor Access Permit holders/Temporary Permit holders/External persons. (9) The licensee/Liquor Access Permit holders/Temporary Permit holders/External Person shall comply with the provisions of the Gujarat Prohibition Act, 1949. (10) The employee desiring to obtain Liquor Access Permit Shall send the Form-A-1 to the Authorized Person. The Authorized Person, verifying the details of the concerned employee’s ID card, the Authorized Person will issue the Liquor Access Permit card. The Authorized Person shall send the approved Liquor Access Permit details to the Authorized Officer and Superintendent of Prohibition and Excise. (11) The Liquor Access Permit holder shall prepare a list of Visitor(s) (Maximum 25 persons) as per FORM-A-2, desiring to obtain Temporary Permit. The Liquor Access Permit holder of the concerned Company/ Organization/Unit shall be required to accompany such Visitor(s). (12) The Liquor Access Permit holders/Temporary Permit holders/External Person must have attained the age of 21 years.”; (iii) in Condition No.(17), the following shall be added at the end, namely :- “Such Group Permit shall be issued by the Authorized Officer in the GIFT City."; (iv) after Condition No.(17), the following conditions shall be added, namely :- “(18) The External Person is allowed to consume liquor in Wine and Dine facility area as well as any area of Hotel/Restaurant Premises (Restaurant, Lawn Area, Pool Side, Terrace, F & B etc.) by showing his/her valid photo ID card. (19) Any person coming for food and dining purpose shall be allowed in Wine & Dine area of the restaurant. (20) The Liquor Access Permit holders/Temporary Permit holders/External Person can use wine and dine services in any other premises of the hotel/restaurant (such as the restaurant, lawn area, poolside, terrace, F & B etc.). (21) The Liquor Access Permit holders/Temporary Permit holders/External Person can order liquor from FL-3 and consume it in the hotel room.”. (C) In the Explanation,- (a) For serial nos.(9) and (12), the following explanations respectively shall be substituted, namely :- “(9) “Liquor Access Permit” means the permit given to employees(s) of the Company/Organization/Unit situated in the area of Gift City and duly approved by Authorized Person.”; “(12) “Visitor” means a person coming to the Company/Organization/Unit of the Gift city.”; After serial no. (19), the following explanation shall be added, namely :- "(20) "External Person" means A person who is not from the State of Gujarat, who holds a photo ID card of another state, or who is a foreign national.”. Licence is hereby granted under and subject to the provisions of the Gujarat Prohibition Act, 1949 (Bom. After serving the Liquor to customer, any liquor remaining unconsumed shall be destroyed. 3. No liquor other than that served by the licensee shall be allowed to be consumed in the Wine and Dine facility area as well as any area of Hotel/Restaurant Premises (Restaurant, Lawn Area, Pool Side, Terrace, F & B etc.). 4. The licensee shall maintain daily accounts of liquor purchased and served in a prescribed format as well as a register approved by the Superintendent of Prohibition and Excise. These books shall always be open to inspection by any Officer of Prohibition and Excise not below the rank of Sub-Inspector. Monthly accounts shall be sent to Superintendent of Prohibition and Excise. 5. The licensee shall at all times keep the Wine and Dine facility in a clean and decent condition and the licensee shall comply with all the directions issued by the Director or the Superintendent of Prohibition and Excise in that behalf. 6. The licensee shall furnish such information in connection with his/her business under the license as may be required by the Director or the Superintendent of Prohibition and Excise, from time to time. 7. The licensee shall comply with all lawful orders and instructions issued to him/her by the Prohibition and Excise Officer not below the rank of Sub-Inspector. 8. This license shall be subject to suspension or cancellation under the provisions of section 54 or 56 of the Gujarat Prohibition Act, 1949. 9. In case this license is cancelled or suspended during the currency of the license period or is not renewed on its expiry, the licensee shall surrender the whole stock of unsold liquor forthwith to the Superintendent of Prohibition and Excise. The stock of liquor so surrendered shall be sold by the Superintendent of Prohibition and Excise and the proceeds of the sale shall after deducting the expenses and any sum due to the State Government, be returned to the licensee. 10. As this license is granted only for the period specified above, it shall not give the licensee, his/her heirs, legal representatives or assignees, any claim whatsoever to the continuance or renewal thereof beyond the said period. 11.
