L.-33004/99 सी.जी.-डी.एल.-अ.-04012023-241667 xxxGIDHxxx CG-DL-E-04012023-241667 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 26] नई दिल्ली, बुधवार, िनवरी 4, 2023/पौष 14, 1944 No. 26] NEW DELHI, WEDNESDAY, JANUARY 4, 2023/PAUSHA 14, 1944 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 4 िनवरी, 2023 का.आ. 29(अ).—जवजधजवरूद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) (जिसे इसम ें इसके पश्चात् उक्त अजधजनयम कहा गया ह)ै को व्यजियों और संगमों के कजतपय जवजधजवरूद्ध दियाकलापों के अजधक प्रभावी जनवारण करन े के जलए तथा आतंकवािी दियाकलापों और उससे संबंजधत जवषयों स े जनपटने के जलए अजधजनयजमत दकया गया ह ै; और, उक्त अजधजनयम की धारा 35 की उपधारा (1) का खंड (क) और उपधारा (2), केंद्रीय सरकार को उक्त अजधजनयम की चौथी अनुसूची म ें दकसी व्यजि के नाम को िोड़ने के जलए सिक्त करता ह,ै यदि उसका यह जवश्वास ह ै दक वह आतंकवाि म ें सज‍ मजलत ह ै; और, एजाि अहमि अहगं र उर्फ अब ू उस्ट्मान अल-कश्मीरी पुत्र मुह‍मि अब्िल्ु लाह अहगं र, जिसका िन्म 1974 म ें नवाकिल, श्रीनगर म ें हुआ, िो वतफमान म ें अर्गाजनस्ट्तान म ें रह रहा ह,ै इस्ट्लाजमक स्ट्टेट ि‍मू-कश्मीर (आईएसिेके) का मुख्य भतीकर्त्ा फ ह ै; और, उक्त एजाि अहमि अहगं र का अल-कायिा और अन्य वैजश्वक आतंकी समूहों स े जनकट संबंध ह ै और वह भारत म ेंइस्ट्लाजमक स्ट्टेट (आईएस) चैनलों को पनु :प्रारंभ करने म ेंलगा हुआ ह ै; 47 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, उक्त एजाि अहमि अहगं र, कश्मीर को आतंकवाि की ओर झोंकन े म ें लगा हुआ ह ै और उसन े अपन े कश्मीर आधाररत तंत्र म ेंिाजमल करन ेके जलए लोगों की पहचान करन े की प्रदिया आरंभ की ह ै; और, उक्त एजाि अहमि अहगं र को भारत म ें इस्ट्लाजमक स्ट्टेट (आईएस) भती सलै का प्रमुख जनयुक्त दकया गया ह ै और वह ऑन-लाइन भारत-केंदद्रत आईएसआईएस िष्प्ु प्रचार पजत्रका प्रारंभ करन े म ें सहायक रहा ह ै; और, उक्त एजाि अहमि अहगं र, ि‍मू-कश्मीर म ें िो ििकों स े अजधक स े वांजित आतंकवािी ह ै और उसन े जवजभन्न आतंकवािी संगठनों के मध्य समन्वय चैनल बनाकर ि‍मू-कश्मीर म ेंआतंक संबद्धी रणनीजत बनानी आरंभ कर िी ह ै; और, केंद्रीय सरकार का यह जवश्वास ह ै दक एजाि अहमि अहगं र उर्फ अब ू उस्ट्मान अल-कश्मीरी आतंकवाि म ें िाजमल ह ै और उक्त एजाि अहमि अहगं र उर्फ अब ू उस्ट्मान अल-कश्मीरी को उक्त अजधजनयम के अधीन एक आतंकवािी के रूप म ेंिोड़ा िाना ह ै; अतः, अब, केंद्रीय सरकार, जवजधजवरूद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 35 की उपधारा (1) के खंड (क) द्वारा प्रिर्त् िजक्तयों का प्रयोग करते हुए, उक्त अजधजनयम की चौथी अनुसूची म ें जनम्नजलजखत संिोधन करती ह,ै अथाफत ् :- उक्त अजधजनयम की चौथी अनसु ूची म ें िम स.ं 48 और उससे संबंजधत प्रजवजियों के पश्चात,् जनम्नजलजखत िम स.ं और प्रजवजियां अतं ः स्ट्थाजपत की िाएगी, अथाफत ्:- “49. एजाि अहमि अहगं र उर्फ अब ू उस्ट्मान अल-कश्मीरी ” । [र्ा. स.ं 11034/09/2022-सीटी-I] प्रवीण वजिि, अपर सजचव रटप्पण :- जवजधजवरूद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की चौथी अनुसूची का अंजतम संिोधन अजधसूचना संख्यांक का.आ. 4679 (अ), तारीख 4 अक्त ूबर, 2022 द्वारा दकया गया था । MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 4th January, 2023 S.O. 29(E).— Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith; And whereas, clause (a) of sub-section (1) and sub-section (2) of section 35 of the said Act empowers the Central Government to add the name of an individual in the Fourth Schedule to the said Act, if it believes that he is involved in terrorism; And whereas, Aijaz Ahmad Ahanger @ Abu Usman Al-Kashmiri son of Mohd. Abdullah Ahanger born in Nawakadal, Srinagar in 1974 presently based in Afghanistan is one of the chief recruiters of Islamic State Jammu and Kashmir (ISJK); And whereas, the said Aijaz Ahmad Ahanger has close contacts with Al- Qaida and other Global Terrorist Groups and is engaged in restarting the Islamic State (IS) channels in India; And whereas, the said Aijaz Ahmad Ahanger is working towards providing traction to militancy in Kashmir and has started the process of identifying people for inclusion in his Kashmir based network;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 And whereas, the said Aijaz Ahmad Ahanger was appointed as head of Islamic State (IS) recruitment cell for India and had been instrumental in initiating an online India-centric ISIS Propaganda Magazine; And whereas, the said Aijaz Ahmad Ahanger is a wanted terrorist in Jammu and Kashmir for more than two decades and has started planning terror related strategies in Jammu and Kashmir by building coordination channels between various terrorist organisations; And whereas, the Central Government believes that Aijaz Ahmad Ahanger @ Abu Usman Al-Kashmiri is involved in terrorism and the said Aijaz Ahmad Ahanger @ Abu Usman Al-Kashmiri is to be added as a terrorist under the said Act; Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following amendment in the Fourth Schedule to the said Act, namely:- In the Fourth Schedule to the said Act, after serial number 48 and entries relating thereto, the following serial number and entries shall be inserted, namely:- “49.
