और, ईक्त ऄजधजनयम की धारा 35 की ईपधारा (1) का खडं (क)और ईपधारा (2), केंद्रीय सरकार को ईक्त ऄजधजनयम की चौथी ऄनुसूची में दकसी व् यजि के नाम को िो़नने के जलए सिक्त करता है,यदद ईसका यह जवश्वास ह ै दक वह अतंकवाद में सज‍ मजलत ह ै; और, मुह‍मद ऄमीन खुबैऄब ईर्फ ऄबू खुबैऄब ईर्फ जपन्ना ईर्फ मुह‍मद ऄमीन बट पुत्र दाउद भट, गांव कठवा, तहसील र्ग्स,ू जिला डोडा, ि‍मू का जनवासी ह,ै िो वतफमान में पादकस्ट्तान में रहकर लश्कर-ए-तैयबा (एलइटी)के लांजचग कमांडर के रूप में कायफ कर रहा ह ै ; और,लश्कर-ए-तैयबा ईक्त ऄजधजनयम की पहली ऄनुसूची के िम सं.5 पर अतंकवादी सगं ठन के रूप म ें सूचीबद्ध ह ै ; और, ईक्त मुह‍मद ऄमीन खुबऄै ब ईर्फ ऄबू खुबैऄब ईर्फ जपन्ना ईर्फ मुह‍मद ऄमीन बट ने सीमापार एिेंजसयों से गहरे संबंध जवकजसत दकए ह ैंऔर संघ राज्यक्षेत्र,ि‍मू और कश्मीर के ि‍म ू क्षेत्र म ें एलइटी की अतंकवादी गजतजवजधयों को सदिय करने और बढाने म ेंमहत्वपूणफ भूजमका जनभा रहा ह ै; और,केंद्रीय सरकार का यह जवश्वास ह ै दक मुह‍मद ऄमीन खुबऄै ब ईर्फ ऄबू खुबैऄब ईर्फ जपन्ना ईर्फ मुह‍मद ऄमीन बट अतंकवाद में िाजमल ह ै और ईक्त मुह‍मद ऄमीन खुबैऄब ईर्फ ऄबू खुबैऄब ईर्फ जपन्ना ईर्फ मुह‍मद ऄमीन बट को ईक्त ऄजधजनयम के ऄधीन एक अतकं वादी के रूप म ेंिो़ना िाना ह ै; ऄतः,ऄब,केंद्रीय सरकार,जवजधजवरूद्ध दियाकलाप(जनवारण)ऄजधजनयम,1967 की धारा 35 की ईपधारा (1 के खंड(क) द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए,ईक्त ऄजधजनयम की चौथी ऄनुसूची में जनम्नजलजखत संिोधन करती है, ऄथाफत ्:- ईक्त ऄजधजनयम की चौथी ऄनसु ूची में िम सं.49 और ईससे संबंजधत प्रजवजियों के पश्चात्, जनम्नजलजखत िम सं.और प्रजवजियां ऄंतः स्ट्थाजपत की िाएगी,ऄथाफत् :- “50. मुह‍मद ऄमीन खुबैऄब ईर्फ ऄबू खुबैऄब ईर्फ जपन्ना ईर्फ मुह‍मद ऄमीन बट”। [र्ा.सं.11034/09/2022-सीटी-I] प्रवीण वजिि, ऄपर सजचव टटप्पण : जवजधजवरूद्ध दियाकलाप (जनवारण)ऄजधजनयम,1967 की चौथी ऄनुसूची का ऄंजतम संिोधन ऄजधसूचना संखयाकं का.अ.29(ऄ), तारीख 4 िनवरी,2023 द्वारा दकया गया था । MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 5th January, 2023 S.O. 39(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith; And whereas, clause (a) of sub-section (1) and sub-section (2) of section 35 of the said Act empowers the Central Government to add the name of an individual in the Fourth Schedule to the said Act, if it believes that he is involved in terrorism; And whereas, Mohammed Amin Khubaiab @Abu Khubaiab @Pinna @Muhammed Amin Butt son of Dawood Bhat beloging to Village Kathawa, Tehsil Phagsoo, District Doda, Jammu presently based in Pakistan is acting as launching commander of Lashkar-E-Taiba (LeT); And whereas, Lashkar-E-Taiba is listed as a terrorist organisation at serial No. 5 of the First Schedule to the said Act; And whereas, the said Mohammed Amin Khubaiab @Abu Khubaiab @Pinna @Muhammed Amin Butt has developed a deep association with the cross border agencies and is playing a vital role to revive and accelerate terrorist activities of LeT in the Jammu Region of the Union Territory of Jasmmu and Kashmir; And whereas, the said Mohammed Amin Khubaiab @Abu Khubaiab @Pinna @Muhammed Amin Butt has been involved in coordinating terrorists attacks, supply of arms or weapons and explosives, terror financing in Jammu and Kashmir from across the border;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : ऄसाधारण 3 And whereas, the Central Government believes that Mohammed Amin Khubaiab @Abu Khubaiab @Pinna @Muhammed Amin Butt is involved in terrorism and the said Mohammed Amin Khubaiab @Abu Khubaiab @Pinna @Muhammed Amin Butt is to be added as a terrorist under the said Act; Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following amendment in the Fourth Schedule to the said Act, namely:- In the Fourth Schedule to the said Act, after serial number 49 and entries relating thereto, the following serial number and entries shall be inserted, namely:- “50.
