अतः, अब, केंद्रीय सरकार, िडं प्रदिया संजहता, 1973 (1974 का 2) की धारा 105 की उपधारा (1) के खंड (ii)
के अनुसरण म ेंयह जवजनर्िष्टि करती ह ैदक -
(क) दकसी अजभयुि व्यजि को समन, या
(ख) दकसी व्यजि स े यह अपेक्षा करने वाला ऐसा कोई समन दक वह कोई िस्ट्तावेि या अन्य चीि को पेि करे या
हाजिर हो और उसे पेि करे, या
(ग) तलािी वारंट
1. भारत म ें दकसी न्यायालय द्वारा िो प्रजतयों म ें ककंगडम ऑफ़ बेजल्ियम म ें तत्समय प्रवृत्त जवजध के अधीन प्राजधकार
रखन े वाल े उस ििे के दकसी न्यायालय, न्यायाधीि या मजिस्ट्रेट को सक्षम प्राजधकारी द्वारा अथाित ककंगडम ऑफ़ बेजल्ियम
में सरकार के संघीय लोक सेवा न्याय कायािलय स े उसम े नाजमत व्यजि या स्ट्थान पर ऐसे समन की तामील या ऐसे तलािी
वारंट के जनष्पािन के जलए िारी दकया िा सकेगा।

सं. 25016 /52 /2019-एल सी तारीख 04 दिसंबर, 2019 द्वारा िारी दकय े गए व्यापक मागििििक जसद्ांतों का अनुपालन
करना अपेजक्षत ह।ै
3. ऐसा समन या वारंट सक्षम प्राजधकारी अथाित ककंगडम ऑफ़ बेजल्ियम की सरकार के संघीय लोक सेवा न्याय
कायािलय को पारेजषत करन े के जलए आई एस -2 प्रभाग, गृह मत्रं ालय, भारत सरकार नई दिल्ली को भेिा िाएगा।

New Delhi, the 21st June, 2023
S.O. 2742(E).—Whereas arrangements have been made by the Central Government with the Government of
the Kingdom of Belgium for service or execution of summons or search warrant in relation to criminal matters, on any
person in Kingdom of Belgium;
Now, therefore, in pursuance of clause (ii) of sub-section (1) of section 105 of the Code of Criminal
Procedure, 1973 (2 of 1974), the Central Government hereby specifies that –
(a) a summons to an accused person, or
(b) a summons to any person requiring him to attend and produce a documents or other thing, or to
produce it, or
(c) a search-warrant,
may be issued by a Court in India in duplicate to the Court, Judge or Magistrate in the Government of the Kingdom of
Belgium, having authority under the law for the time being in force in that country, through the Competent Authority,
that is, the Federal Public Service Justice of the Government of the Kingdom of Belgium to serve such summons or
execute such warrant on the person or place named therein.
2. The concerned Court, Judge or Magistrate in India, while issuing summons are required to comply with the
comprehensive guidelines issued by Ministry of Home Affairs, vide letter No.25016/52/2019-LC, dated the 4th
December, 2019.
3. Such summons or warrant shall be sent to the IS-II Division of the Ministry of Home Affairs, Government of
India, New Delhi, for transmission to the Competent Authority, that is, the Federal Public Service Justice of the
Government of Kingdom of Belgium.

वाले दकसी न्यायालय, न्यायाधीि या मजिस्ट्रेट स े प्राप्त हुआ ह ैवहा ं तलािी म ें पेि दकय े गए िस्ट्तावेि या चीि े या पाई गई
चीिें ऐसे समन या तलािी वारंट िारी करन े वाल े न्यायालय को आई एस -2 प्रभाग, गृह मंत्रालय, भारत सरकार नई

Now, therefore, in pursuance of the proviso to sub-section (2) of section 105 of the Code of Criminal
Procedure, 1973 (2 of 1974), the Central Government hereby specifies that in case where a Court in India executes
any summons or search warrant received from a Court, Judge or Magistrate in the Government of the Kingdom of
Belgium, having authority under the law for the time being in force in that country, the documents or things produced
or things found in the search shall be forwarded to the Court issuing such summons or search warrant through IS-II
Division of the Ministry of Home Affairs, Government of India, New Delhi.

S.O. 2744(E).—Whereas arrangements have been made by the Central Government with the Government of
the Kingdom of Belgium, for services or execution of summons in relation to criminal matters on any person in
Sultanate of Belgium;
Now, therefore, in pursuance of sub-section (2) of section 105B of the Code of Criminal Procedure, 1973
(2 of 1974), the Central Government hereby specifies that a summons for attendance of a person in the course of an
investigation or inquiry in any criminal case, to be served or executed in any place in the Kingdom of Belgium, shall
be issued in the form annexed hereto, and such summons shall be sent to IS-II Division of the Ministry of Home
Affairs, Government of India, New Delhi, for transmission to the Competent Authority, that is, the Federal Public
Service Justice or of the Government of the Kingdom of Belgium as per the guidelines issued by Ministry of Home
Affairs, vide letter No.25016/52/2019-LC dated the 4th December, 2019.

बेजल्ियम के दकसी सक्षम िांजडक न्यायालय को िारी दकया िाएगा; और[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
(ख) ऐसा कमीिन, सक्षम प्राजधकारी अथाित ककंगडम ऑफ़ बेजल्ियम की सरकार के संघीय लोक सेवा न्याय

S.O. 2745(E).—Whereas arrangements have been made by the Central Government with the Government of
Kingdom of Belgium for taking the evidence of witnesses residing in Kingdom of Belgium in relation to criminal
matters in Courts in India;
Now, therefore, in pursuance of sub-section (3) of section 285 of the Code of Criminal Procedure, 1973 (2 of
1974), the Central Government hereby specifies that -
(a) commission for examination of witnesses in Kingdom of Belgium shall be issued by the Courts in
India in the from annexed hereto, to any competent criminal court of Kingdom of Belgium having
authority under the law for the time being in force in the Kingdom of Belgium; and
(b) such Commission shall be sent to IS-II Division of the Ministry of Home Affairs, Government of
India, New Delhi for transmission to the Competent Authority, that is, the Federal Public Service
Justice of the Government of the Kingdom of Belgium.

करती ह ै, जिनके द्वारा भारत म ें जनवास कर रह े साजक्षयों की परीक्षा के जलए कमीिन िारी दकया िा सकेगा।

Procedure, 1973 (2 of 1974), the Central Government hereby specifies that all Courts, Judges or Magistrates
exercising jurisdiction in the Kingdom of Belgium having authority under the law in force in the Kingdom of Belgium
as the Courts by which the Commission for the examination of witnesses residing in India may be issued.

1974), the Central Government hereby directs that the provisions of Chapter VIIA of the said Code shall apply without any
condition, exception or qualification in relation to Kingdom of Belgium with effect from the date of publication of this notification
in the Official Gazette.
