का.अ. 1115(ऄ).— ईमर फारूक की ऄध्यक्षता वाली अवामी एक्िन कमेटी (जजसे आसम ें आसके पश्चात एएसी
कहा गया ह)ै जवजधजवरुद्ध दियाकलापों म ें जलप्त ह,ै जो दक दिे की ऄखंडता, संप्रभुता और सुरक्षा के जलए हाजनकर ह;ै
और, एएसी के सदस्ट्य जम्म ू और कश्मीर म ें अतंकवादी गजतजवजधयों का समथचन करने और पथृ कतावाद का बढावा
देने के जलए भारत जवरोधी प्रचार म ें सजम्मजलत ह;ैं
और, एएसी के नेता और सदस्ट्य जम्मू और कश्मीर म ेंपथृ कतावादी, ऄलगाववादी और अतंकवादी गजतजवजधयों का
समथचन करने सजहत जवजधजवरुद्ध गजतजवजधयों को ऄंजाम देन ेके जलए धन जुटाने म ें ,सजम्मजलत रह ेह;ैं
और, एएसी और आसके सदस्ट्य ऄपनी गजतजवजधयों से देि के संवैधाजनक सत्ता और संवैधाजनक व्यवस्ट्था के प्रजत
सरासर ऄनादर ददखात े ह;ैं
और, एएसी राष्ट्र जवरोधी और जवध्वंसक गजतजवजधयों में-सजम्मजलत होकर जम्मू और कश्मीर के भारत से पथृ क्करण
को ईकसाने और बढावा देन;े लोगों म ें वैमनस्ट्य का बीज बोने; लोगों को कानून और व्यवस्ट्था को ऄजस्ट्थर करने के जलए प्रेररत
करन;े जम्मू और कश्मीर को भारत संघ से ऄलग करन े के जलए िस्त्र ईठाने और स्ट्थाजपत सरकार के जवरुद्ध घृणा को बढावा
देने म ेंसजम्मजलत ह;ै

और, केन्द्रीय सरकार की राय ह ै की एएसी ऐसी गजतजवजधयों म ें जलप्त ह ै जो देि दक ऄखंडता और सुरक्षा के प्रजतकूल ह,ैं जो
ऄन्द्य बातों के साथ, जनम्नजलजखत पर अधाररत ह,ै ऄथाचत:
(1) राष्ट्रीय जांच एजेंसी न े 18 जनवरी, 2018 को एनअइए जविेष न्द्यायालय, परटयाला हाईस, नइ ददल्ली के
समक्ष अफताब ऄहमद िाह ईफच िाजहद-ईल-आस्ट्लाम (एएसी के प्रवक्ता और मीजडया सलाहकार) और 11 ऄन्द्य के जवरुद्ध
अरसी 10/2017 म ें भारतीय दडं संजहता की धारा 120 ख, 121, 121 क और 124 क और जवजधजवरुद्ध दियाकलाप
(जनवारण), ऄजधजनयम की धारा 13, 16, 17, 18, 20, 39 और 40 के ऄधीन अरोप पत्र दायर दकया ह;ै
(2) ईमर फारूक के जवरुद्ध, भारत सरकार के जवरुद्ध भाषण दने े और लोगों स े चुनाव आत्यादद म ें बजहष्कार करन े के
जलए जोर दने े के अरोप म ें नौहट्टा पुजलस स्ट्टेिन, श्रीनगर म ें धारा 120 ख और 153 रणबीर दडं संजहता और जवजधजवरुद्ध
दियाकलाप (जनवारण) ऄजधजनयम, 1967 की धारा 13 के ऄधीन मामला ऄपराध संख्या 96/2008 पंजीकृत दकया गया ह;ै
(3) ईमर फारूक और ऄन्द्य लोगों के जवरुद्ध, सरकार के जवरुद्ध भाषण दने े और लोगों को भड़काने तथा राष्ट्र
जवरोधी नारे लगाने के जलए सफाकदल पुजलस स्ट्टेिन, श्रीनगर में जवजधजवरुद्ध दियाकलाप (जनवारण) ऄजधजनयम, 1967 की
धारा 13 के ऄधीन मामला ऄपराध संख्या 128/2010 दजच दकया गया ह;ै
(4) ईमर फारूक, मुश्ताक-ईल-आस्ट्लाम, जनसार ऄहमद राठेर और जनसार ऄहमद भट के जवरुद्ध, भारत की
ऄखंडता के जवरुद्ध नारे लगान े तथा भाषण दने े के जलए, जजसम ें ईन्द्होंन े कहा था दक वे तब तक संघष च करेंग े जब तक जम्म ू
और कश्मीर भारत संघ स े ऄलग नहीं हो जाता और पथराव भी करने के जलए, कोठीबाग पुजलस स्ट्टेिन, श्रीनगर म,ें रणबीर
दडं संजहता की धारा 436, 153 (क), 109, 147, और 336, तथा जवजधजवरुद्ध दियाकलाप (जनवारण) ऄजधजनयम, 1967
की धारा 13 के ऄधीन ऄपराध संख्या 60/2010 पंजीकृत दकया गया ह;ै
(5) ईमर फारूक के जवरुद्ध जवजधजवरुद्ध दियाकलाप (जनवारण) ऄजधजनयम, 1967 की धारा 13 के ऄधीन कोठी
बाग पुजलस स्ट्टेिन, श्रीनगर म ें मामला ऄपराध संख्या 56/2011 दज च दकया गया ह,ै जजसमें ईसन े 03 ऄगस्ट्त, 2011 को
सैयद ऄली िाह जगलानी द्वारा ददए गए हड़ताल के अह्वान का समथचन दकया और भारत की संप्रभुता के जवरुद्ध घाटी के
अम लोगों और युवाओं को युद्ध छेड़न े के जलए ईकसाया;
और, केन्द्रीय सरकार की यह भी राय ह ै दक यदद अवामी एक्िन कमेटी (एएसी) के जवजधजवरुद्ध दियाकलापों पर
तत्काल ऄंकुि या जनयंत्रण नहीं दकया जाता ह,ै तो वह आस ऄवसर का ईपयोग जनम्नजलजखत के जलए करेगा –
(i) राष्ट्र जवरोधी गजतजवजधयों को जारी रखन े के जलए; जो दक दिे की क्षेत्रीय ऄखडं ता, सुरक्षा और संप्रभुता
के जलए हाजनकर ह;ैं
(ii) भारत संघ में आसके जवलय पर जववाद खड़ा करते हुए जम्मू और कश्मीर को भारत संघ स ेऄलग करने की
लगातार वकालत जारी रखन ेके जलए;
(iii) भारत के जवरुद्ध ऄसंतोष पैदा करने और लोक व्यवस्ट्था को बाजधत करने के आरादे से जम्मू और कश्मीर के
लोगों के बीच जमथ्या कथन गढने और राष्ट्र जवरोधी भावनाओं का प्रचार जारी रखन े के जलए; और
(iv) दिे म ेंऄलगाववादी गजतजवधयों को बढावा देना, ईग्रवाद का समथचन करना और हहसा भड़काने के जलए;
और, ईपयुचक्त कारणों स े केन्द्रीय सरकार का दढृ मत ह ै दक अवामी एक्िन कमेटी (एएसी) की गजतजवजधयों को
देखते हुए, अवामी एक्िन कमटे ी (एएसी) को तत्काल प्रभाव से एक जवजधजवरुद्ध संगम घोजषत करना अवश्यक ह;ै
ऄतः, ऄब, केन्द्रीय सरकार जवजधजवरुद्ध दियाकलाप (जनवारण) ऄजधजनयम, 1967 (1967 का 37) की धारा 3
की ईप-धारा (1) द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए, अवामी एक्िन कमेटी (एएसी) को जवजधजवरुद्ध संगम घोजषत
करती ह;ै[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3
ईपयुचक्त पररजस्ट्थजतयों को देखत े हुए, केन्द्रीय सरकार का दढृ मत ह ै दक अवामी एक्िन कमेटी (एएसी) को तत्काल
प्रभाव स े एक जवजधजवरुद्ध संगम घोजषत करना अवश्यक ह,ै और तदनुसार, ईक्त ऄजधजनयम की धारा 3 की ईपधारा (3) के
परंतुक द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, केन्द्रीय सरकार जनदेि दते ी ह ै दक यह ऄजधसूचना, ईक्त ऄजधजनयम की
धारा 4 के ऄधीन दकए जा सकने वाले दकसी अदिे के िताधच ीन, राजपत्र म ें आसके प्रकािन की तारीख स े पांच वषच की
ऄवजध के जलए प्रभावी रहगे ी।

NOTIFICATION
New Delhi, the 11th March, 2025
S.O. 1115(E).—Whereas, the Awami Action Committee (hereinafter referred to as the AAC), chaired by Umar
Farooq is indulging in unlawful activities, which are prejudicial to the integrity, sovereignty and security of the country;
And, whereas, members of the AAC have remained involved in supporting terrorist activities and anti-India
propaganda for fuelling secessionism in Jammu and Kashmir;
And, whereas, the leaders and members of AAC have been involved in mobilising funds for perpetrating
unlawful activities, including supporting secessionist, separatist and terrorist activities in Jammu and Kashmir;
And, whereas, the AAC and its members by their activities show sheer disrespect towards the constitutional
authority and constitutional set up of the country;
And, whereas, AAC is involved in promoting and aiding the secession of Jammu and Kashmir from India by
involving in anti-national and subversive activities; sowing seeds of dis-affection amongst people; exhorting people to
destabilise law and order; encouraging the use of arms to separate Jammu and Kashmir from the Union of India and
promoting hatred against established Government;
And, whereas, the Central Government is of the opinion that AAC is indulging in the activities which are
prejudicial to the integrity and security of the country, inter alia, on the following grounds, namely: -
(1) National Investigation Agency has filed charge sheet against Aftab Ahmad Shah @ Shahid-ul-Islam
(spokesman and media advisor of AAC) and 11 others before the NIA Special Court, Patiala House, New Delhi in RC
10/2017 on January 18, 2018 under sections 120B, 121, 121A and 124A of Indian Penal Code and sections 13, 16, 17,
18, 20, 39 and 40 of the Unlawful Activities (Prevention) Act, 1967;
(2) Case Crime No. 96/2008 has been registered at Nowhatta Police Station, Srinagar under section 120B
and 153 Ranbir Penal Code and section 13 of the Unlawful Activities (Prevention) Act, 1967 against Umar Farooq for
delivering a speech against the Government of India and for stressing upon the people for elections boycott etc;
(3) Case Crime No. 128/2010 has been registered at Safakadal Police Station, Srinagar under section 13 of the
Unlawful Activities (Prevention) Act, 1967 against Umar Farooq and others for delivering a lecture and provoking the
people against the Government and for raising anti-national slogans;
(4) Case Crime No. 60/2010 has been registered at Kothi Bagh Police Station, Srinagar under section
436,153A, 109,147, and 336 of Ranbir Penal Code and section 13 of the Unlawful Activities (Prevention) Act, 1967
against Umar Farooq, Mushtaq-ul-Islam, Nisar Ahmad Rather and Nisar Ahmad Bhat for shouting slogans against the
integrity of India and for delivering a speech stating that they would struggle till Jammu and Kashmir is not separated
from Union of India, and for also pelting stones;
(5) Case Crime No. 56/2011 has been registered at Kothi Bagh Police Station, Srinagar under section 13 of
the Unlawful Activities (Prevention) Act, 1967 against Umar Farooq, wherein, he supported the Hartal call given by
Syed Ali Shah Geelani for 03 August, 2011 and for instigating the general people and the youth of valley for waging war
against the sovereignty of India;
And, whereas, the Central Government is further of the opinion that if there is no immediate curb or control of
unlawful activities of the Awami Action Committee (AAC), it will use this opportunity to –
(i) continue with the anti-national activities which are detrimental to the territorial integrity, security
and sovereignty of the country;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) continue advocating the secession of Jammu and Kashmir from the Union of India while disputing
its accession to the Union of India;
(iii) continue propagating false narrative and anti-national sentiments among the people of Jammu and
Kashmir with the intention to cause disaffection against India and disrupt public order; and
(iv) escalate secessionist movements, support militancy and incite violence in the country;
And, whereas, the Central Government for the above mentioned reasons is firmly of the opinion that having
regard to the activities of the Awami Action Committee (AAC), it is necessary to declare the Awami Action Committee
(AAC) as an unlawful association with immediate effect;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful Activities
(Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the Awami Action Committee (AAC) as
an unlawful association;
The Central Government, having regard to the above circumstances, is of firm opinion that it is necessary to
declare the Awami Action Committee (AAC) as an unlawful association with immediate effect, and accordingly, in
exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, the Central Government
hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have
effect for a period of five years from the date of its publication in the Official Gazette.
