(cid:16)ािधकरण के नाम पर जारी (cid:7)कए गए सभी (cid:16)मुख िविनयम; के िलए शासी बोड(cid:13) के अनुमोदन क( आव_यकता होगी और पारद^श(cid:13)ता के िहत म(cid:15) एक साव(cid:13)जिनक परामश(cid:13) माग(cid:13) का अनुसरण (cid:7)कया जाएगा, v. शासी बोड(cid:13) एनएचए के सीईओ को उपयुY समझे जाने वाले अिधकार सaप सकता ह,ै vi. शासी बोड(cid:13) पीएमजेएवाईके सुचा(cid:31) काय(cid:13)करण के िलए उपयुY 8े(cid:4); के िलए उप सिमितय; का गठन कर सकता ह,ै vii. (cid:16)ािधकरण के सीईओ 9ारा उठाए गए मुb;, (cid:16)(cid:26)ताव; का िनण(cid:13)य करने के िलए शासी बोड(cid:13) एक ितमाही म(cid:15) कम से कम एक बार बैठक करेगा, viii. शासी बोड (cid:13) समय-समय पर ऐसे मानदडं ; पर (cid:16)ािधकरण के (cid:16)दश(cid:13)न क( समी8ा करेगा, िज(cid:23)ह (cid:15) बोड (cid:13) 9ारा समीचीन माना जाता हऔै र इसम(cid:15) आवं#टत बजट का ?य भी शािमल ह,ै ix. इसे आवं#टत (cid:7)कए गए कायe को (cid:16)भावी ढंग से करने के िलए, रा(cid:25)ीय (cid:26)वा(cid:26)(cid:27)य (cid:16)ािधकरण, शासी बोड(cid:13) के मा7यम से, िन-िलिखत के िलए िज/मेदार होगा: क) (cid:16)ािधकरण के (cid:16)बंधन और (cid:16)शासन के िलए और (cid:16)ािधकरण क( गितिविधय; के सचं ालन के िलए संसाधन; के िनयोजन / (cid:16)ितधारण / उपयोग / संघटन, िविभi कायe क( आउटसोjसग& , बजटीय सहायता और बkक खात; (ए(cid:26)]ौ / अ(cid:23)य (cid:16)कार के बkक खाते, जैसा भी मामला हो) के िलए (cid:7)दशा- िनदश\ ; सिहत िनिधय; को जारी करने स े सबं ंिधत नीितय; और (cid:16)शासिनक और िव4ीय (cid:16)(cid:7)]याE को तैयार, संशोिधत और िनर(cid:26)त करना, ख) (cid:16)ािधकरण के उbे_य; को परू ा करने के िलए आव_यकतानुसार चल या अचल संपि4 का अिधlहण करना,(cid:7)कराए या पmे पर लेना, िनमा(cid:13)ण करना और उसके अनुर8ण का (cid:16)ावधान करना, ग) (cid:16)ािधकरण के िनधा(cid:13)#रत उb_े य; को हािसल करने के िलए संिवदाE और (cid:7)कसी भी नाम से अ(cid:23)य ऐस े िवलेख; को (cid:16)व^तत(cid:13) और िनnपा(cid:7)दत करना, घ) भारत सरकार स े बजटीय सहायता (cid:16)ाo करना। इसके अलावा, य(cid:7)द संभव हो तो (cid:16)ािधकरण के िलए धन सृिजत करना,¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 3 ङ) (cid:16)धान मं(cid:4)ी जन आरो(cid:22)य योजना के उb_े य; से संबिं धत संगत 8े(cid:4); म(cid:15) क(cid:15)p और राQय सरकार;, अ(cid:23)य साव(cid:13)जिनक और िनजी स(cid:26)ं थान, िजनम(cid:15) गरै फ़ायदमे ंद सं(cid:26)थान, बkक, बीमा कंपिनया,ं शै8िणक सं(cid:26)थान, िवsिवtालय, िमशन, uथंक टkक और अ(cid:23)य (cid:16)ितिvत रा(cid:25)ीय और अतं ररा(cid:25)ीय िनकाय शािमल ह,k के साथ रणनीितक साझेदारी और सहयोग िवकिसत करना, और च) अपने उb_े य; तक (cid:16)भावी (cid:31)प से पwचं ने के िलए अपेि8त (cid:7)कसी अ(cid:23)य भूिमका का िनवा(cid:13)ह। 2.5 इसके अलावा, मानक उपचार (cid:7)दशािनदश\ ; को िवकिसत करन,े नई तकनीक; और लाभ पैकेज; क( लागत (cid:16)भािवता और उनके मू.य; के िलए, (cid:16)ािधकरण अिनवाय(cid:13) (cid:31)प से (cid:26)वा(cid:26)(cid:27)य अनुसंधान िवभाग, (cid:26)वा(cid:26)(cid:27)य सवे ा महािनदशे ालय और अ(cid:23)य संबंिधत िहतधारक; स े इनपुट मांगेगा। 3. शासी बोड(cid:13) (जीबी), सीईओ 9ारा (cid:16)ािधकरण के सम8 रखे गए मुb;, (cid:16)(cid:26)ताव; का िनण(cid:13)य करने के िलए 3 महीने म(cid:15) कम-स-े कम एक बार बैठक करेगा। 4. शासी िनकाय के दो िवषय िवशेषJ (सद(cid:26)य 4 और सद(cid:26)य 5) (cid:26)वा(cid:26)(cid:27)यबीमा, शासन, कानून, अथ(cid:13)शाG, िव4, (cid:16)बंधन, साव(cid:13)जिनक मामल; पर ऐसी सभी (cid:16)शासिनक शिYय; का (cid:16)योग कर(cid:15)गे जो शासी बोड(cid:13) (जीबी) 9ारा उ(cid:23)ह (cid:15) सaपी गy ह;, ii. सीईओ भारत सरकार के जीएफआर और िव4ीय िनयम; और िविनयम; के तहत यथा-प#रकि.पत भारत सरकार के सिचव क( िव4ीय शिYय; का (cid:16)योग कर(cid:15)ग,े iii. शासी बोड(cid:13) के अधी8ण के अधीन, सीईओ के पास पीएमजेएवाई के काया(cid:13)(cid:23)वयन के िलए एनएचए का पूण(cid:13) (cid:16)चालना3मक िनयं(cid:4)ण होगा। तथािप, सभी नीितगत मामल; के िलए, सीईओ शासी बोड(cid:13) को #रपोट(cid:13) कर(cid:15)ग े और इसके माग(cid:13)दश(cid:13)न म(cid:15) काय(cid:13) कर(cid:15)गे। iv. मु>य काय(cid:13)कारी अिधकारी (सीईओ) का एनएचए के अिधका#रय; और अ(cid:23)य कम(cid:13)चा#रय; No. 3(4)/2018-H&FW(Part-III) Vol. 2.—Pursuant tothe Cabinet decision dated 2nd January, 2019; the existing National Health Agency (which was functioning as a registered society) is restructured and reconstituted as the National Health Authority (NHA) for better implementation of Pradhan Mantri-Jan ArogyaYojana (PM-JAY). The contours of the NHA is detailed as under: 2. The National Health Authority (NHA): 2.1 The NHA shall be an attached office of the Ministry of Health & Family Welfare. The NHA will however have full functional autonomy and shall be chaired by the Health and Family Welfare Minister. 2.2 NHA shall be governed by a Governing Board comprising of a Chairman and 11 members detailed underneath:- i. Chairman- Minister for Health and Family Welfare, Govt. of India. ii. Member-Chief Executive Officer, NITI Aayog,Govt. of India(Ex Officio) iii. Member -Secretary (Expenditure), Ministry of Finance, Govt. of India(Ex Officio) iv. Member-Secretary (Health and Family Welfare), Ministry of Health and Family Welfare, Govt. of India (Ex Officio) v. Members 4 and 5 - Two Domain Experts from the fields such as Administration, Insurance, Public & Private Health care providers, Economics, Public health, Management etc. vi. Members (6 – 10) : Five Principal Secretaries (Health) of the State Governments( one representing each of the five zones of the country viz; North, South, East, West and North East) on a rotational basis, and vii. Member - Chief Executive Officer (CEO) of the National Health Authority (Ex Officio) 2.3 The CEO of the NHA shall function as the Member Secreatry of the Governing Board 2.4 Powers and functions of the Governing Board shall be as under:- i. The Governing Board shall be the supreme decision making authority of the NHA and will be responsible for all policy related matters to PM JAY and the Authority, ii. The Governing Board shall frame rules, regulations, guidelines and procedures for the selection, recruitment of staff, personnel rules for the Authority, iii. The Governing Board shall also lay down rules, procedures, guidelines for procurement of Goods & Services for the Authority and the scheme PM-JAY, iv. All major regulations issued in the name of the Authority shall require the approval of the Governing Board and shall follow a public consultation route in the interest of transparency,¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 7 v. The Governing Board may delegate powers to CEO of the NHA as deemed appropriate, vi. The Governing Board may form sub Committees for the areas as deemed appropriate for the smooth functioning of PMJAY, vii. The Governing Board shall meet at least once a quarter to decide issues, proposals made by CEO of the Authority, viii. The Governing Board shall periodically review the performance of the Authority on such parameters as may be considered expedient by the Board, including expenditure of the budgets allocated, ix. To effectively carry out tasks allotted to it; National Health Authority, through the Governing Board, will be responsible for the following; a) frame, amend and repeal policies and administrative and financial procedures related to hiring/retention/utilization/ mobilization of resources, outsourcing of various tasks, budgetary support and release of funds including guidelines for bank accounts (escrow/ other type of bank accounts as the case maybe) for the management and administration of the Authority and for the conduct of the activities of the Authority, b) acquire, hire or take on lease, construct property, movable or immovable, and provide their maintenance as may be necessary to carry out the objects of the Authority, c) initiate and enter into contracts and other such instruments by whatever name called to achieve the stated objects of the Authority, d) receive budgetary support from the Government of India. In addition, generate funds for the Authority, if possible, e) develop strategic partnerships and collaboration with Central and State Governments, other public and private institutions including not-for-profit institutions, banks, insurance companies, academic institutions including universities, missions, think tanks, and other national and international bodies of repute in areas relevant to the objectives of PM-JAY, and f) undertake any other role as required to reach its objectives effectively. 2.5 Inaddition, for developing Standard Treatment Guidelines, cost effectiveness of new technologies and benefit packages and their prices, the Authority will mandatorily seek inputs from the Department of Health Research, Directorate General of Health Services and other relevant stakeholders. 3. The Governing Board (GB) shall meet at least once in 3 months to decide issues, proposals made by CEO of the Authority. 4. The two domain experts of the Governing Body( Member 4 and Member 5) shall be persons of ability and integrity having experience and knowledge of at least fifteen years in matters relating to health insurance, governance, law, economics, finance, management, public affairs or administration and shall be appointed by the Government of India, 5. Chief Executive Officer (CEO) of the National Health Authority i. A full time Chief Executive Officer (CEO), in the rank of Secretary to the Government of India, shall be appointed by the Central Government. The CEO shall be the Ex-Officio Member Secretary to the Governing Board and shall exercise such administrative powers within the Authority and over its staff, as may be delegated to him by the Governing Board, ii. The CEO shall exercise the financial powers of a Secretary to the Government of India as envisaged under GFR and Financial Rules & regulations of Government of India, iii. Subject to the superintendence of the Governing Board, the CEOwill have complete operational control over the NHA for the implementation of PMJAY. However, for all policy matters, the CEO will report to the Governing Board and will work under its guidance. iv. The CEO shall have complete administrative control over the officers and other employees of the NHA. v. The powers and functions of CEO shall be as under: a) the day-to-day administration of the Authority. For this purpose, heshall report to the Chairman of the Governing Board, b) implementing the work programmes and decisions adopted by the Authority;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] c) drawing up of proposal for the Governing Board’s decisions and work programmes, d) the preparation of the statement of revenue and expenditure and the execution of the budget of the Authority; e) performing such other functions, or exercising such other powers, as may be specified by regulations; f) ensure compliance to rules, procedure, regulations related to selection and recruitment of staff for the Authority, as laid by the Governing Board; and g) any other activities as assigned by the Government of India from time to time. 6. Functions of NHA: a) Formulation of various operational guidelines related to PM-JAY, model documents and contracts to ensure standardisation and interoperability, b) Determine the central ceiling for premium (or maximum central contribution for trusts) per family per year to be provided to the States/ UTs and review it from time to time, based on the field evidence and actuarial analysis, c) Develop, and enforce compliance with, standards for treatment protocols, quality protocols, minimum documentation protocols, data sharing protocols, data privacy and security protocols, fraud prevention and control including penal provisions etc., d) Develop mechanisms for strategic purchasing of health care services through PM-JAY, so as to get best return on Government’s investment. Create conducive conditions for strategic purchasing by preparing list of packages and their rates and updating those from time to time using a transparent, predictable and evidence-based process. Set up effective and efficient mechanisms to pay to the health care providers, e) Set up systems and processes for convergence of PM-JAY with other health insurance/assurance schemes. This will include schemes being implemented by both State and Central Governments. Proposed National Health Authority will also develop a pathway to converge PM-JAY with schemes targeting both formal and informal sector workers, f) Build a state of the art health information technology ecosystem with requisite foundational components on which PM-JAY and other health systems can be hosted/linked; Information Technology standards will be developed in consultation with Ministry of Electronics and Information Technology (MeitY), g) Explore options including ways to link PM-JAY with the larger health care system, especially primary care, in consultation with the Ministry of Health and Family Welfare, GOI, h) Work closely with Insurance Regulatory and Development Authority on development and implementation of Health Insurance Regulations targeting insurance companies, Third Party Administrators, hospitals and other stakeholders, i) Effective Implementation of PM-JAY across the country and its regular monitoring including taking course correction actions, as and when required, j) Coordinate with various State Governments on a regular basis for implementation of PM- JAY, k) Capacity building of State Health Agencies and other stakeholders continuously, l) Carrying out awareness activities for informing beneficiaries and other stakeholders about the scheme, m) Prevention, detection and control of frauds and abuse, n) Grievance redressal for all the stakeholders at various levels, o) Set up an efficient monitoring system for the scheme, p) Stimulate cross learning, sharing of best practices amongst States and documentation of these practices, q) Ensure interoperability, standardization, and convergence amongst schemes of Central Ministries, r) Conduct and facilitate policy relevant research and evaluation studies including knowledge sharing and information dissemination at national and international levels, s) Develop strategic partnerships and collaboration with Central and State Governments, other public and private institutions including not-for-profit institutions, banks, insurance companies, academic institutions including universities, missions, think tanks, and other national and international bodies of repute in areas relevant to the objectives of PM-JAY,¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 9 t) Generate evidence for the policymakers from schemes’ data and other research/evaluations so as to facilitate evidence-based decision making and policy formulation by the Government, u) Act as apex body for State Health Agencies that have been set up to implement PM-JAY, v) Take any decision related to the implementation of the scheme, recruitment rules and hiring of staff, disbursement of grant in aid to the States, and issue relevant directions from time to time, as required, and w) Any other activities as assigned by the Government of India from time to time. 7. Miscellaneous: 7.1 The National Health Authority shall be the successor organization of the National Health Agency and inherit all its assets and liabilities including the posts created.The assets and budgets shall include rights, powers, authorities and all property movable and immovable including cash balances, any fund available and all other rights and interests in such assets and property as were immediately before the said date in the ownership, possession, power and control of the National Health Agency. 7.2 The National Health Agency (functioning as a registered society) shall be dissolved forthwith as per the provisions of the Societies Registration Act, 1860 and the Memorandum of Association taking appropriate decision regarding its outstanding assets and liabilities as indicated in para 7.1 above 7.3 The supersession of the Resolution constituting National Health Agency (dated 7th May, 2018) shall not affect the previous decisions taken by the Agency in regard to (but not limited to) allocation of resources including personnel appointed/engaged by the Agency, execution, audit, examination, accounting, investigation, inquiry or any other action taken or to be taken in relation thereto unless amended or modified by the National Health Authority as the successor in interest of the said Agency. 7.4 Existing budgetary provisions/arrangements shall continue till the new budgetary arrangements are made so that there is no disruption in the functioning of the scheme PM-JAY. 7.5 The Ministry of Health & Family Welfare shall be the nodal ministry for the National Health Authority in respect of all Parliamentary matters. The Authority shall be mandatorily required to present an Annual Report and an audited statement of its Annual Accounts to the Parliament through the Ministry of Health & Family Welfare. 7.6 Government housing from the general/tenure pool, CGHS and other applicable benefits to Central Government Offices appointed on deputation shall be provided by the Authority, as applicable for UIDAI. 7.7 The post of Joint Secretary (NHA/Ayushman Bharat) will be transferred fromthe Ministry of Health & Family Welfare to the National Health Authority.
