जनयम म,ें जब तक दक सदं भ वस ेऄन्य था ऄपजे क्षत न हग, - (क) ‘‘सक्षम प्राजधकारी’’ से केंद्रीय ररजवव पुजलस बल ऄजधजनयम, 1949 (1949 का 66) और केंद्रीय ररजव व पुजलस बल जनयम, 1955 में जनर्ददष्ट जनयुजतिय प्राजधकारी या प्राजधकारी ऄजभप्रेत ह ै; (ख) ‘‘महाजनदेिक ’’ से केंद्रीय ररजवव पुजलस बल का महाजनदिे क ऄजभप्रेत ह;ै (ग) ‘‘िेप-1’’ केन् द्रीय ररजव व पुजलस बल के स्ट्थायी अदिे सं0 2008 का 04, तारीख 15 ददसबं स्ट् तंभ (5) से स्ट्तंभ (13) में जवजनर्ददष् ट ह ं । 5. पवू व प्रगन्न जत पाठ्यक्रम.-पगषक प्रवगव म ें बल के प्रत् येक सदस्ट्य कग ईसकी ज्य ष्े ठ ता के क्रम म,ें ईच् चतर श्रणे ी पर प्रगन् नजत के जलए पात्रता सेवा ऄवजध पूरी करने से पूवव ऄहकव प्रगन् नजत पाठ्यक्रम या व्यावसाजयक पररक्षण ईत् तीण व करने के जलए भेजा जाएगा और बल के प्रत् येक ऐस े सदस्ट् य स,े दकसी भी प्रगन् नजत से पूव,व ईक्त ऄनुसूची के स्ट् तंभ (11) में यथाजवजनर्ददष् ट प्रगन् नजत पाठ्यक्रम या व्यावसाजयक पररक्षण या पाठ्यक्रम कग ईत् तीण व करना ऄपेजक्ष त हगगा । परंत ु यह दक यदद महाजनदेिक, केन् द्रीय ररजव व पुजलस बल का यह समाधान हग जाता ह ै दक सवे ा की अवश् यकतां या ऄन् य ऄपररहायव कारण स,े यदद कगइ सदस्ट् य प्रजिक्षण में जाने या ऄपेजक्षत प्रगन् नजत पाठ्यक्रम या व्यावसाजयक पररक्षण या पाठ्यक्रम कग ऄर्हह त करन े में समथ व नहीं ह,ै तग वह कारण कग लेखबद्ध करन े के पश् चात,् ईसकी प्रगन् नजत की तारीख स े दग वषव की ऄवजध के भीतर प्रगन्न जत प्राठ्यक्रम या व्यावसाजयक पररक्षण या पाठ्यक्रम कग ईत्त ीणव करने के ऄध्यधीन, बल के ऐसे सदस्ट् य कग प्रगन् नत कर सकेगा, जजसके न हग सकने पर ईसे पूववत् तर श्रेणी और प्राजस्ट्थजत पर प्रजतवर्हतत कर ददया जाएगा । 6. ज्य ष्े ठ ता.-ज्य ष्े ठ ता, केन् द्रीय ररजव व पुजलस बल जनयम, 1955 और केन् द्रीय सरकार द्वारा समय-समय पर जारी साधारण ऄनुदेि के ऄनुसार जवजनयजमत की जाएगी । 7. जनरहतव ा.-वह व्य जतिय,- (क) जजसने ऐसे व् यजतिय से जजसका पजत या जजसकी पत् नी जीजवत ह,ै जववाह दकया ह;ै या (ख) जजसने ऄपन ेपजत या ऄपनी पत्न ी के जीजवत रहते ुए, दकसी व् यजतिय से जववाह दकया ह,ै ईक्त पद पर जनयुजतिय का पात्र नहीं हगगा । परंत ु यदद केन् द्रीय सरकार का यह समाधान हग जाता ह ै दक ऐसे जववाह ऐसे व् यजतिय और जववाह के ऄन् य पक्षकार कग लागू स्ट् वीय जवजध के ऄधीन ऄनज्ञु ेय ह ै और ऐसा करन े के जलए ऄन् य अधार ह ं तग वह दकसी व् यजतिय कग आस जनयम के प्रवतवन से छूट दे सकेगी । 8. गरै -भारतीय नागररक की ऄपात्रता.-वह व् यजतिय, जग भारत का नागररक नहीं ह,ै आन जनयम के ऄधीन जलजखत म ें केन् द्रीय सरकार की पूवव ऄनुमजत के जसवाय जनयुक्त नहीं दकया जाएगा: परंत ु यह दक आस जनयम म ें ऄंतर्हवष्ट दकसी बात के हगत े ुए भी, नेपाल या भूटान के नागररक की बल म ें जनयुजतिय या जनयगजन कग वर्हजत नहीं दकया जाएगा । 9. ऄजधवर्हषता.-(1) आन जनयम के ऄधीन जनयुक्त प्रत् येक व् यजतिय, जजस माह में 60 वषव की अयु पूरी करता/करती ह,ै ईस महीने के ऄंजतम ददन के ऄपराह्न से सेवाजनवृत् त हगगा । परंतु यह दक वह व् यजतिय जजसकी जन् म तारीख महीने की पहली तारीख कग ह ै वह 60 वषव की अयु पूरी करने के पूवववती महीने के ऄंजतम ददन के ऄपराह्न से सेवाजनवृत् त हगगा । (2) दकसी व् यजतिय कग ऄजधवर्हषता पर सेवाजनवृजि के जलए जवजहत अय ु के पश् चात सेवा म ें जवस्ट् तार नहीं ऄनुदि हगगा । 10. जिजथल करन े की िजतिय.-जहां केंद्रीय सरकार की यह राय है दक ऐसा करना अवश् यक या समीचीन ह,ै वहां वह ईसके जलए जग कारण ह,ं ईन् ह ें लेखबद्ध करके, आन जनयम के दकसी ईपाबंध कग दकसी वग व या प्रवगव के व् यजतियय की बाबत, अदेि द्वारा जिजथल कर सकेगी । 11. व्य ावृजि.-आन जनयम की कगइ भी बात, ऐसे अरक्षण, अय-ु सीमा में छूट और ऄन् य ररयायत पर प्रभाव नहीं डालगे ी, जजनका केंद्रीय सरकार द्वारा आस संबंध में समय-समय पर जारी दकए गए अदिे के ऄनुसार ऄनुसूजचत जाजतय , ऄनुसूजचत जनजाजतय , ऄन् य जपछडा वगगों, भूतपूवव सैजनक और ऄन् य जविेष प्रवग व के व् यजतियय के जलए ईपबंध कराना ऄपेजक्षत ह ै । 12. जनवचव न.-यदद आन जनयम के जनववचन स े संबंजधत कगइ प्रश्न ईठता ह,ै तग ईसका जवजनश् चय केन् द्रीय सरकार द्वारा दकया जाएगा हग । iii) जद्वतीय कमान ऄजधकारी, या ईप कमांडेंट, केन् द्रीय ररजव व पुजलस बल- रटप्प ण : जहां ऐसे कजनष् ठ व् यजक्य के संबंध में, जजन् ह ने ऄपनी सदस्ट् य-II ऄहकव या पात्रता सेवा पूरी कर ली है, प्रगन् नजत के जलए जवचार दकया जा रहा हग वहां ईनसे ज्य ेष् ठ व् यजतियय के संबंध में भी जवचार iv) सहायक कमांडेंट, केन् द्रीय ररजवव दकया जाएगा परन् तु यह तब जब दक ईनके द्वारा की गइ ऐसी ऄहवक पुजलस बल- सहयगजजत सदस्ट् य, या पात्रता सेवा, ऄपेजक्षत ऄहकव या पात्रता सेवा के अधे से ऄजधक v) बल का एक सदस्ट् य जग ईप से या दग वषव से, आनमें से जग भी कम हग, कम न हग और ईन् ह न े जनरीक्षक की श्रेणी से नीचे का न हग ऄपने ऐसे कजनष् ठ व् यजतियय सजहत, जजन् ह ने ऐसी ऄहकव या पात्रता तथा जजसे सुसंगत रेड में पयावप्त ज्ञान सेवा पहले ही पूरी कर ली है, ऄगली ईच् चतर श्रेणी में प्रगन् नजत के हग । जलए ऄपनी पररवीक्षा की ऄवजध सफलतापूववक November, 2023. G.S.R. 857(E).—In exercise of the powers conferred by sub-section (1) and clauses (a) and (c) of sub-section 2 of section 18 of the Central Reserve Police Force Act, 1949 (66 of 1949), the Central Government hereby makes the following rules regulating the method of recruitment to the post of Assistant Sub-Inspector (Motor Transport), Technical Cadre, Group „C‟ post in the Central Reserve Police Force, namely:- 1. Short title and commencement.- (1) These rules may be called the Central Reserve Police Force, Assistant Sub-Inspector (Motor Transport) Technical Cadre, Group „C‟ Post Recruitment Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.- (1) In these rules, unless the context otherwise requires,- (a) “Competent Authority” means the appointing authority or authority referred to in the Central Reserve Police Force Act, 1949 (66 of 1949) and Central Reserve Police Force Rules, 1955; (b) “Director General” means the Director General, Central Reserve Police Force; (c) “SHAPE-I” refers to the Medical Category as specified under the Central Reserve Police Force Standing Order No. 04 of 2008 dated the 15th December, 2008 and subsequent amendments issued by the Directorate General, Central Reserve Police Force from time to time. (2) The words and expressions used herein and not defined shall have the same meanings assigned to them in the Central Reserve Police Force Act, 1949(66 of 1949) and the Central Reserve Police Force Rules, 1955. 3. Number of post, classification and level in the pay matrix.- The number of post, its classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 4. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule. 5. Pre-Promotional courses.- Every member of the Force in the feeder category shall be detailed to undergo qualifying promotional courses or trade test, before completing the service eligibility period for promotion to higher rank, in order of his seniority and every such member of the Force shall, before any promotion, be required to pass promotional course or trade test or courses as specified in column (11) of the said Schedule : Provided that if the Director General, Central Reserve Police Force is satisfied that due to exigencies of service or other unavoidable reasons, any such member is not able to undergo or qualify the required promotional course or trade test or courses, he after the reasons to be recorded in writing, may promote such member of Force, subject to passing of promotional course or trade test or courses within a period of two years, from the date of his promotion, failing which he shall be reverted to previous rank and status. 6. Seniority.- Seniority shall be regulated in accordance with the Central Reserve Police Force Rules, 1955 and general instructions issued by the Central Government from time to time. 7. Disqualification.- No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post : Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule. 8. Ineligibility of non-citizens of India.-No person who is not a citizen of India shall, except with the prior permission of the Central Government in writing, be appointed under these rules: Provided that nothing contained in this rule shall debar the appointment or employment of a subject of Nepal or Bhutan in the Force.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 9. Superannuation.- (1) Every person appointed under these rules shall retire from service on the afternoon of the last day of the month in which he or she attains the age of sixty years : Provided that a person whose date of birth is on the first day of a month shall retire from service in the afternoon of the last day of the preceding month on attaining the age of sixty years. (2) No person shall be granted extension in service beyond the prescribed age of retirement on superannuation. 10. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 11. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and others special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard. 12.
