O R D E R: -
It is proposed to hold an enquiry agaisnt the said Sri Gangidi Malla
Reddy, the then Executive Engineer, RWS&S, Guntur of Guntur District, in
accordance with the procedure laid down in Rule 20 of Andhra Pradesh Civil
Services (Classification, Control and Appeal) Rules, 1991.
2. The substance of the imputations of misconduct or misbehaviour in
respect of which the enquiry is proposed to be held is set out in the enclosed
statement of articles of charges (Annexure-I). A statement of imputations of
misconduct or misbehaviour in support of each article of charge is enclosed
(Annexure-II). A list of documents by which, and a list of witnesses by whom,
the articles of charges are proposed to be sustained are also enclosed
(Annexure-III and IV).
3. Sri G. Malla Reddy, the then Executive Engineer, RWS&S, Guntur of
Guntur District is directed to submit within (10) days from the date of receipt of
this order, a written statement of defence.
4. Sri G. Malla Reddy, the then Executive Engineer, RWS&S, Guntur of
Guntur District is informed that an enquiry will be held only in respect of those
articles of charges as are not admitted. He should, therefore, specifically admit
or deny each article of charge.
5. Sri G. Malla Reddy, the then Executive Engineer, RWS&S, Guntur of
Guntur District is further informed that if he does not submit his written
statement of defence on or before the period specified in Para 3 above, or
otherwise fails or refuses to comply with the provisions of Rule 20 of Andhra
Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 or the
orders / directions issued in pursuance of the said rules, the Inquiring Authority
may hold the inquiry against him ex-parte.
6. Attention of Sri G. Malla Reddy, the then Executive Engineer, RWS&S,
Guntur of Guntur District, under which no Government servant shall bring or
attempt to bring any political or outside influence to bear upon any superior to
further his interest in respect of matters pertaining to his service under the
Government. If any representation is received on his behalf from another
person in respect of any matter dealt with these proceedings it will be
presumed that Sri G. Malla Reddy, the then Executive Engineer, RWS&S,
Guntur of Guntur District is aware of such a representation and that it has been
made at his instance and action will be taken against him for violation of Rule
24 of Andhra Pradesh Civil Services (Conduct) Rules, 1964.

STATEMENT OF ARTICLE OF CHARGE AGAINST SRI GANGIDI MALLA
REDDY, THE THEN EXECUTIVE ENGINEER, RWS&S (PANCHAYAT RAJ)
DIVISION, GUNTUR OF GUNTUR DISTRICT.
CHARGE:
That Sri Gangidi Malla Reddy, S/o Late Lakshma Reddy joined in
Government Service on 01.06.1981 as Assistant Executive Engineer in
Panchayat Raj and Rural Development Department and subsequently got
promotion as Deputy Executive Engineer on 13.02.1991, Executive Engineer
on 14.02.2006. While working as public servant in various capacities during the
period from 01.06.1981 (i.e. date of appointment) to 19.08.2008 (i.e. date of
house search) he committed grave misconduct in as much as he failed to
obtain prior permissions in acquisition of assets in his name and in the names
of his family members and in submission of Annual Property Returns to the
competent authority except for the years from 2001 to 2006 and he failed to
take permission for the competent authority prior to the investment made in the
name of his wife and failed to inform about such investments to the competent
authority. He failed to maintain absolute integrity in violation of A.P.C.S
(Conduct) Rules, 1964.
Thus Sri Gangidi Malla Reddy by his above mentioned acts has
exhibited lack of integrity, devotion to duty and conduct unbecoming of public
servant and thereby contravened Rule 3(1),(2) and Rule 9 (1)(2) &(7) & Rule
10 of A.P.C.S (Conduct Rules), 1964.

STATEMENT OF IMPUTATIONS OF MISCONDUCT OR MISBEHAVIOUR IN
SUPPORT OF THE ARTICLE OF CHARGES AGAINST SRI GANGIDI MALLA
REDDY, THE THEN EXECUTIVE ENGINEER, RWS & S (PANCHAYAT RAJ)
DIVISION, GUNTUR OF GUNTUR DISTRICT.
That Sri Gangidi Malla Reddy, S/o Late Lakshma Reddy is a native of
Nidigonda Village, Raghunadhapally (M) of Warangal District. His date of birth
is 06.05.1956. He joined in Government Service on 01.06.1981 as Assistant
Executive Engineer in Panchayat Raj and Rural Development Department and
subsequently got promotion as Deputy Executive Engineer on 13.02.1991,
Executive Engineer on 14.02.2006. He worked as Executive Engineer, RWS&S
(Panchayat Raj) Division, Guntur of Guntur District from 26.06.2008 to
19.08.2008 (i.e. date of house search). His date of Superannuation is
31.05.2014. He is here-in-after referred as Government Servant.
The brief facts of the case are that, on credible information that the
Government Servant has acquired assets disproportionate to known sources of
his income by corrupt and illegal means, a case in Cr.No.17/ACB-CIU-
HYD/2008 u/s 13(2) r/w 13(1) (e) of PC Act, 1988 was registered after
obtaining permission from the Competent Authority.
In pursuance of the Search Warrants issued by the Hon’ble Principal
Special Judge for SPE &ACB Cases, Hyderabad searches were conducted on
the residential premises of Government Servant. During the searches several
incriminating documents were seized showing the possession of assets in the
name of Government Servant and his family members. During the course of
investigation in Cr.No.17/ACB-CIU-HYD/2008, the information regarding prior
permission in acquisition of assets and Annual Property Returns of the
Government Servant was collected from the Engineer-in-Chief, RWS&S,
Hyderabad. The Engineer-in-Chief, Rural Water Supply & Sanitation,
Hyderabad vide his Letter No. G(1)/RWS&S/5605/2007, dated:24.10.2008
furnished the copies of APRs from 2001 to 2006 filed by the Government
Servant by informing that no permission was obtained by him in acquisition of
assets except the house bearing H.No.16-2-738/4/5/14/1, SBH Colony,
Asmanghad, Hyderabad vide proceedings No.G3/25037/95, dated:22.06.1996
of the Engineer-in-Chief, PR, Hyderabad. The Government Servant failed to
take permission from the competent authority prior to the investment made in
the name of his wife and failed to inform about such investment to the
department through APRs.
The said Government Servant by above acts exhibited lack of integrity,
devotion to duty and unbecoming of a Member of Service and thereby violated
Rule 3(1), (2) and Rule 9 (1), (2) & (7) & Rule 10 of Andhra Pradesh Civil
Services (Conduct) Rules, 1964.
Thus, the Government Servant has rendered himself liable for
Departmental action for major penalty.
