ORDER:-
Sri A. Madhusudana Rao, former Junior Assistant, MPP. Mothkur of
Nalgonda district had misappropriated Education fund of Teaching and
Non-teaching staff to a tune of Rs.30,22,263/- by forging the signatures
of Mandal Education Officers during his tenure from 29.7.1987 to
6.4.2001. As a result, in the reference 1st cited, disciplinary proceedings
have been initiated under rule 20 of A.P. Civil Services (Classification,
Control & Appeal) Rules, 1991 against Sri A. Madhusudan Rao, former Jr.
Asst. while he was in service, as well as (6) Mandal Parishad Development
Officers who had worked in MPP Mothkur during the above period.
2] In the reference 2nd read above, the Commissioner, Panchayat Raj
and Rural Employment, AP- Hyd. has been directed to conduct common
enquiry in the matter by entrusting the case to a departmental inquiry
officer, duly following the rules and furnish the Inquiry report to
Government for taking further action in the matter. Accordingly, after
examining the written statement of defences submitted by the charged
officers, the CPR&RE in the ref.3rd read above, ordered common enquiry
under rule 24 (1) of A.P. Civil Services (Classification, Control & Appeal)
Rules, 1991 duly appointing the Chief Executive Officer, ZP Nalgonda as
Inquiry Authority and the MPDO MP Mothkur of Nalgonda district was
appointed as Presenting Officer. The Eos report is still awaited.
3] In the reference 4th read above, the Commissioner, Panchayat Raj
and Rural Employment, AP. Hyderabad has requested the Government to
issue appropriate orders as per A.P. Revised Pension Rules, 1980 and also
permit the Chief Executive Officer, ZPP Nalgonda to forward the Pension
Proposals to the Accountant General, AP- Hyderabad to release family
pension in favor of the applicant Smt. A. Radha Devi W/o Late
Madhusudan Rao, Jr. Asst. [expired while in service] withholding
entire DCRG, Encashment of Earned Leave until conclusion of disciplinary
proceedings by bringing the legal representatives on record for the
purpose of recovery of mis-appropriated amount.PTO

4] In the reference 6th read above, Smt. A. Radha Devi, W/o. Late A.
Madhusudhana Rao, in her representation, has stated that they are facing
severe financial problems for the maintenance of their family and their
higher education. Because of the financial issues, their children education
has been put off and cannot maintain her family without any help of the
Govt. Moreover, she has not been sanction family pension, gratuity and
other benefits, which are entitled. Therefore, she has requested to
release family pension and gratuity and benefits.
5] Government after careful examination of the matter and having the
circumstances of the case in detail, have decided to abate disciplinary
proceedings against Sri A. Madhusudhana Rao, Junior Assistant (expired
on 07.02.2010), and also hereby direct the Commissioner, Panchayat Raj
and Rural Employment, AP- Hyderabad to release the APGLI, GPF and
Pension to the wife of the deceased employee Smt. A. Radhadevi duly
withholding Gratuity, Encashment of Earned Leave and Dearness Relief on
Pension as per the orders issued in G.O.Ms.No.995, Fin. (Pen.I)
Department, dated.21.12.2002, G.O.Rt.No.1097, Fin. (Pen.I) Department,
dated.22.6.2000 and G.O.Ms.No.227, Fin. (Pen.I) Department,
dated.29.05.2011 respectively to cover the entire loss and then release
the balance, if any, subject to out come of the decision of the Government
on the enquiry report which is pending.
6] The Commissioner, Panchayat Raj and Rural Employment, AP-
Hyderabad/ the Chief Executive Officer, ZP Nalgonda shall take necessary
action accordingly.
7 This order issues with the concurrence of Finance (Pen.II)
Department vide their U.O.No.33679/331/A1/Pen.II/2011, dated.
17.01.2012.
