ORDER:
It is proposed to hold an inquiry against Sri B.Manohar Rao, former
Senior Assistant, MP, Regode, Medak District, in accordance with the
procedure laid down in rule 20 of the Andhra Pradesh Civil Service
(Classification, Control and Appeal) Rules, 1991.
2. The substance of the imputations of misconduct or misbehavior in
respect of which the inquiry is proposed to be held is set out in the enclosed
statement of articles of charges (Annexure-I). A list of documents by which and
list of witnesses, by whom, the articles of charges are proposed to be sustained
are also enclosed (Annexure-II and III).
3. Sri B.Manohar Rao, former Senior Assistant, MP, Regode, Medak
District, is directed to submit within (10) days of the receipt of this order, a
written statement of his defence.
4. Sri B.Manohar Rao, former Senior Assistant, MP, Regode, Medak
District, is informed that an inquiry will be held only in respect of those articles
of charge as are not admitted. He should, therefore, specifically admit or deny
each article of charge.
5. Sri B.Manohar Rao, former Senior Assistant, MP, Regode, Medak
District, is further informed that if he does not submit his written statement of
defence on or before the date specified in para 3 above or otherwise fails or
refuses to comply with the provisions of rule 20 of Andhra Pradesh Civil
Services (CCA) Rules, 1991 or the order/directions issued in pursuance of the
said rules, the Inquiry Authority may hold the inquiry against him ex-parte.
6. Attention of Sri B.Manohar Rao, former Senior Assistant, MP, Regode,
Medak District, is invited to Rule 24 of the A.P. Civil Service (Conduct) Rules,
1964, under which no Government servant shall bring or attempt to bring any
political or outside influence to bear upon any superior authority to further his
interest in respect of matters pertaining to his service under the Government. If
any representation is received on his behalf from another person in respect of
any matter dealt with these proceedings it will be presumed that Sri B.Manohar
Rao, former Senior Assistant, MP, Regode, Medak District, is aware of such a
representation and that it has been made at his instance and action will be
taken against him for violation of rule 24 of the A.P. Civil Service (Conduct)
Rules, 1964.

Statement showing the Article of Charge framed against
Sri B.Manohar Rao, former Senior Assistant, MP, Regode, Medak District
Charge:
That Sri B.Manohar Rao, former Senior Assistant, MP, Regode, Medak
District has committed certain irregularities in the execution of FFWP works in
Regode Mandal of Medak District as per the survey and inspection taken up by
the ESCI and excess expenditure of Rs.25,81,408/- was involved due to
allowing of lead of gravel in the execution of (149) Gravel Roads in Regode
Mandal under 100% FFWP which is against the 100% FFWP guidelines which
caused loss of Rs.25,81,408/- to the State Exchequer.
Basis:
The Vigilance & Quality control , Panchayat Raj Department in their
Report No.QC4/DEE3/CE.V&QC/1866/MDK/04, Dt.11.5.06 of CE,Vig.&QC ,
Hyd. reported that Sri B.Manohar Rao, former Senior Assistant, MP, Regode in
Medak District has allowed lead of gravel in execution of (149) Gravel Road
Works causing excess payment of Rs.25,81,408-00 even though clear
instructions/guidelines were issued not to allow any lead for the material
collected on 100% rice component programme ie., FFWP which led to loss of
Rs.25,81,408/- to the State Exchequer.
Hence the charge.
