Sub-Division, Wardhannapet, Warangal District - Disciplinary proceedings under Rule 20 of Andhra Pradesh Civil Services (Classification, Control & Appeal), Rules, 1991 – Article of charges –Issued. ---------------------------------------------------------------------------------------------------------- PANCHAYAT RAJ & RURAL DEVELOPMENT (VIG.I) DEPARTMENT G.O.Rt.No. 292 Dated:17.02.2012. ***** ORDER: It is proposed to hold an enquiry against Sri Sampathi Dilip Kumar, Deputy Executive Engineer, P.R. Sub-Division, Wardhannapet, Warangal District in accordance with the procedure laid down in Rule 20 of the Andhra Pradesh Civil Services (Classification, Control & Appeal) Rules, 1991. 2. The substance of imputations of misconduct or misbehaviour in respect of which the enquiry is proposed to be held is set out in the enclosed statement of articles of charges (Annexure–I). A statement of the imputations of misconduct or misbehaviour in support of article of charge is enclosed as Annexure-II. A list of witnesses by whom and a list of documents by which the articles of charges is proposed to be sustained are also enclosed as Annexure-III and IV. 3. Sri Sampathi Dilip Kumar, Deputy Executive Engineer, P.R. Sub-Division, Wardhannapet, Warangal District is directed to submit within (10) days of the receipt of this order, a Written statement of defense. He is informed that an inquiry will be held only in respect of those articles of charges as are not admitted. He should, therefore, specifically admit or deny each article of charge. 4. Sri Sampathi Dilip Kumar, Deputy Executive Engineer, P.R. Sub-Division, Wardhannapet, Warangal District is further informed that if he does not submit his written statement of defense within the stipulated period specified in para (3) above, further action will be processed based on the material available. 5. Attention of Sri Sampathi Dilip Kumar, Deputy Executive Engineer, P.R. Sub-Division, Wardhannapet, Warangal District is invited to Rule 24 of the Andhra Pradesh Civil Services (Conduct ) Rules 1964 under which no Government servant shall bring or attempt to bring any political or outside influence to bear upon any superior authority to further his interest in respect of matters pertaining to his service under the Government. If any representation is received on his behalf from another person in respect of any matter dealt within these proceedings, it will be presumed that he is aware of such a representation and that it has been made at his instance and action will be taken against him for violation of Rule 24 of the Andhra Pradesh Civil Services (Conduct) Rules, 1964. That Sri Sampathi Dilip Kumar S/o Rajaiah, joined in Government service as Assistant Executive Engineer, Panchayat Raj, Sub-Division, Eturunagaram at O/o M.P.D.O., Thadvai Mandal of Warangal District on 25-04-1992. On 10- 05-2010 he has been promoted as Deputy Executive Engineer, Panchayat Raj-1, Sub-Division, Wardhannapet, Warangal District. While working as D.E.E., P.R.1, Sub-Division, Waradhannapet he facilitated the Government Servant for keeping the M.Book and other files pertaining to the work of C.C. Road executed by the complainant with him at his residence though the Government Servant was on sick leave and failed to maintain absolute integrity in violation of the provisions A.P. Civil Services (Conduct) Rules, 1964. Thus, Sri Sampathi Dilip Kumar, Deputy Executive Engineer, P.R. Sub- Division, Wardhannapet by his above-mentioned acts has exhibited lack of integrity, devotion to duty and conduct, unbecoming of a Government servant and thereby violated Rule 3(5) r/w Rule 3 (1) (2) of A.P.C.S. (Conduct) Rules 1964. C.R. BISWAL PRINCIPAL SECRETARY TO GOVERNMENT (PR) SECTION OFFICERANNEXURE -II IMPUTATIONS OF MISCONDUCT OF MISBEHAVIOUR IN SUPPORT OF THE ARTICLES OF CHARGES FRAMED AGAINST SRI SAMPATHI DILIP KUMAR, DEPUTY EXECUTIVE ENGINEER, PANCHAYAT RAJ DEPARTMENT, SUB- DIVISION, WARDHANNAPET, WARANGAL DISTRICT. That Sri Sampathi Dilip Kumar is a native of H.No.4-6-151, Kumarpally, Hanamkonda of Warangal District. His date of birth is 15-08-1966. On 25- 04-1992, he joined in Government service as Assistant Executive Engineer, Panchayat Raj, Sub-Division, Eturunagarm at O/o M.P.D.O., Thadvai Mandal of Warangal District and worked there upto 24-12-2008. On 12-04-2008, he was transferred to APIIIT Nuziveedu of Krishna District and worked there up to 09- 05-2010. Later n 10-05-2010 he has been promoted as Deputy Executive Engineer and posted at O/o Panchayat Raj-I, Sub-Division, Waradhannapet of Warangal District. He is drawing basic pay of Rs.15,025/- in the scale of pay Rs.9,285/- - Rs.21,550/-. His date of attaining superannuation is 31-08-2024. The brief facts of the case are that the Anti-Corruption Bureau Officials of Warangal Range, Warangal laid a trap against Sri D. Sadanandam, A.E., P.R., Parvathagiri on 23-10-2010, when he demanded and accepted the tainted bribe amount of Rs.7,000/- from the complainant, Sri Errabelli Murali Mohan Rao S/o Venkatram Narsaiah age: 61 years, Occ: Contractor and Ward member of Kalleda Village, Parvathagiri mandal of Warangal District for showing official favour of having recorded the measurements in M.Book and facilitated the release of Rs.2,19,761/- pertaining to work of C.C. road and for recording the measurement in respect of the remaining work executed by the complainant in Cr.No.10/ACB- WRL/2010 13(2) r/w13(1)(d) of P.C. Act, 1988 dated 23-10-2010. During the course of investigation of the case it is established that Sri Sampathi Dilip Kumar, Deputy Executive Engineer, facilitated the said A.E. for keeping the M.Book and other files pertaining to the work of C.C. Road executed by the complainant with him though the A.O. was on sick leave. Thus, Sri Sampathi Dilip Kumar, Deputy Executive Engineer, by his above mentioned acts has exhibited lack of integrity, devotion to duty and conduct there by violated Rule 3(5) and 3(1)(2) of A.P.C.S. (Conduct) Rules 1964. Sri Sampathi Dilip Kumar, Deputy Executive Engineer, P.R. Sub-Division, Wardhannapet has therefore rendered himself liable for regular departmental action. C.R.
