ORDER:
It is proposed to hold an enquiry against Sri Shaik Ahmed, Assistant
Engineer, Office of the Deputy Executive Engineer, Panchayat Raj, PIU Sub-
Division, Haliya, Nalgonda District in accordance with the procedure laid down
in Rule 20 of the Andhra Pradesh Civil Services (Classification, Control &
Appeal) Rules, 1991.
2. The substance of imputations of misconduct or misbehaviour in respect
of which the enquiry is proposed to be held is set out in the enclosed statement
of articles of charges (Annexure–I). A statement of the imputations of
misconduct or misbehaviour in support of article of charge is enclosed as
Annexure-II. A list of witnesses by whom and a list of documents by which the
articles of charges is proposed to be sustained are also enclosed as Annexure-
III and IV.
3. Sri Shaik Ahmed, Assistant Engineer, Office of the Deputy Executive
Engineer, Panchayat Raj, PIU Sub- Division, Haliya, Nalgonda District, is
directed to submit within (10) days of the receipt of this order, a Written
statement of defense. He is informed that an inquiry will be held only in respect
of those articles of charges as are not admitted. He should, therefore,
specifically admit or deny each article of charge.
4. Sri Shaik Ahmed, Assistant Engineer, Office of the Deputy Executive
Engineer, Panchayat Raj, PIU Sub- Division, Haliya, Nalgonda District, is further
informed that if he does not submit his written statement of defense within the
stipulated period specified in para (3) above, further action will be processed
based on the material available.
5. Attention of Sri Shaik Ahmed, Assistant Engineer, Office of the Deputy
Executive Engineer, Panchayat Raj, PIU Sub- Division, Haliya, Nalgonda
District, is invited to Rule 24 of the Andhra Pradesh Civil Services (Conduct )
Rules 1964 under which no Government servant shall bring or attempt to bring
any political or outside influence to bear upon any superior authority to further
his interest in respect of matters pertaining to his service under the
Government. If any representation is received on his behalf from another
person in respect of any matter dealt within these proceedings, it will be
presumed that he is aware of such a representation and that it has been made
at his instance and action will be taken against him for violation of Rule 24 of
the Andhra Pradesh Civil Services (Conduct) Rules, 1964.

STATEMENT OF ARTICLES OF CHARGE FRAMED AGAINST SRI SHAIK
AHMED, ASST. ENGINEER, OFFICE OF THE DY.E.E., PANCHAYAT RAJ,
PIU SUB DIVISION, HALIYA, NALGONDA DISTRICT.
That Sri Shaik Ahmed, S/o Late Shaik Lateef, joined in Government
service on 26-04-1982 as Work Inspector, Grade-II in the office of Deputy
Executive Engineer, P.R. Sub-Division, Nalgonda and he was promoted as
Draftsman on 20-06-1991 and finally promoted as Assistant Engineer on 17-08-
1994. He worked as Assistant Engineer, PIU Sub-Division, O/o D.E.E.,
Panchayath Raj, Haliya, Nalgonda District from 11-02-2010 to 05-10-2010 and
during the said period, he has committed grave misconduct in as much as that
he was found in possession of Rs.16,000/- and for which he could not account
for and thereby failed to maintain absolute integrity in violation of A.P.C.S.
(Conduct) Rules, 1964.
Thus, Sri Shaik Ahmed, Asst. Engineer, by his above mentioned acts
has exhibited lack of integrity, devotion to duty and conduct, unbecoming of a
Government servant and thereby contravened Rule 9(8)(A) r/w rule 3 (1) and
(2) of A.P.C.S. (Conduct) Rules, 1964.

STATEMENT OF IMPUTATIONS OF MISCONDUCT OR MISBEHAVIOUR IN
SUPPORT OF THE ARTICLES OF CHARGE FRAMED AGAINST SRI SHAIK
AHMED, ASST. ENGINEER, OFFICE OF THE DY.E.E., PANCHAYAT RAJ,
PIU SUB DIVISION, HALIYA, NALGONDA DISTRICT .
That Sri Shaik Ahmed, S/o Late Shaik Lateef, age 49 years, occ: Asst.
Engineer, O/o D.E.E., Panchayath Raj, PIU Sub-Division, Haliya, Nalgonda
District is a native of Nalgonda. His date of birth is 10-04-1961. He joined as
Work Inspector, Grade-II in the office of Dy.E.E., P.R. Sub-Division, Nalgonda
on 26-04-1982. He was transferred from Nalgonda to Thungathurthy on 01-09-
1983 and to Munugoda on 03-03-1985. Later promoted as Draughtsman
Grade-II & posted at P.R Sub-Division, Huzurnagar, Nalgonda on 20-06-1991
and transferred to E.E., P.R., Miryalaguda on 18.03.1992. Further promoted as
A.E. and posted at P.R. Division, Devarakonda on 17-08-1994 and
subsequently transferred to Haliya, Nalgonda on 13-06-1998, O/o S.E., P.R.
Circle, Nalgonda on 12-07-2008 and Haliya, Nalgonda on 11-02-2010.
A case in Cr.No.21/ACB-CIU-HYD/2010 U/s 7 of P.C. Act 1988 was
registered on 05-10-2010 against Sri Shaik Ahmed, Asst. Engineer, O/o the Dy.
E.E., Panchayath Raj, PIU Sub Division, Haliya, Nalgonda District on the
complaint of Sri N. Sekhar Reddy, S/o N. Narayana Reddy, age 52 years
H.No.30-188, APHB Colony, Miryalaguda, Nalgonda District for demand of
Rs.1,00,000/- as bribe for doing an official favour of recording the works
executed by the complainant as a Sub Contractor of M/s SSR Crest Engineers
pertaining to the works of road formation under PMGSY (Pradanamantri
Gramina Sadak Yojana) from A.D. Pally (V) to Mudimanikyam (V) in PR
Division, Nalgonda in measurement book and forwarding the same to higher
ups for getting the bill amount around Rs. 36,00,000/-.
In due course of investigation, a trap was organized and Sri Shaik
Ahmed, A.E. was trapped on 05-10-2010 when he demanded the bribe amount
of Rs. 1,00,000/- from one of the complainant. The phenolphthalein test when
conducted over the both hand fingers of Sri Shaik Ahmed yielded positive and
also the phenolphthalein test conducted over the both wearing pant pockets of
Sri Shaik Ahmed yielded positive. The Tainted bribe amount of Rs.1,00,000/-
was recovered at the instance of Sri Shaik Ahmed, A.E. Haliya, P.R. Division,
Miryalaguda, Nalgonda District.
Thus Sri Shaik Ahmed, A.E., Haliya, PR Division, Miryalaguda, Nalgonda
District by his above mentioned acts has exhibited lack of integrity, devotion to
duty and conduct, unbecoming of a Government servant and thereby
contravened Rule 9(8)(A) r/w rule 3(1)&(2) of APCS (Conduct) Rules 1964.
Thus Sri Shaik Ahmed, A.E., Haliya, PR Division, Miryalaguda, Nalgonda
District rendered himself liable for regular departmental action for imposing
major penalty.
