Charges were framed against (1) Sri V.Balagurappa, EE, PR (Retd.), (2) Sri T.Satyanarayana, DEE, P.R. and (3) Sri G.Pothu Raju, AEE, P.R. under A.P. Revised Pension Rules 1980/A.P.C.S. (CC&A) Rules, 1991 by calling their written statements of defense vide references 2nd to 4th read above and the Charged Officers submitted their written statements of defense vide references 5th to 7th read above. 2. After examining the matter, in the reference 8th read above, orders were issued appointing the Commissioner of Inquiries, G.A.D. as Inquiry Officer for conducting detailed inquiry against Sri V.Balagurappa, EE, PR (Retd.) and others, as per Rule 20 (2) of A.P.Civil Services (Classification, Control & Appeal) Rules, 1991. 3. The COI, GAD has furnished her inquiry report, vide reference 9th read above, wherein the Inquiry Officer has stated that it is found that all the concerned COs in their defence have stated that the deficiencies in execution under the concerned charges are within tolerable limits. It is notable that in the written statement of Presenting Officer who is also the SE, PR, Anantapur has stated that there are no guidelines or instructions from the higher authorities regarding permissible deficiencies allowable on the works. Apparently, there is ambiguity on this issue of tolerance limits. In the light of the above, a liberal view may be taken in so far as the charges against the C.Os. are concerned. Furthermore, most of the works cited are small in nature and there has been some time gap between execution and inspection. P.T.O.::2:: 4. Government have also issued orders, imposing the following penalties against the (3) C.Os. i.e., (1). Sri V. Balagurappa, EE, PR (Retd.), (2) Sri T. Satyanarayana, Dy.EE, P.R. and (3) Sri G. Pothu Raju, AEE, P.R. in respect of the work i.e., Road from Dudyala to Lingala (via) Iskala and Chellimilla (in another case). Name of the C.O. & Punishment imposed Designation Sri V. Balagurappa, 5% cut in pension for a period of 5 years, vide G.O.Rt.No.1570, EE, PR (Retd.) PR & RD (Vig.I) Dept., dt. 02.11.2006. Sri T. Satyanarayana, Two annual grade increments without cumulative effect vide Dy.EE, PR G.O.Rt.No.1975, PR & RD (Vig.I) Dept., dt. 26.11.2005. Sri G. Pothu Raju, Two annual grade increments without cumulative effect vide A.E.E., PR G.O.Rt.No.1976, PR & RD (Vig.I) Dept., dt. 26.11.2005. 5. Government, after careful examination of the matter, keeping in view of the punishment imposed in para (4) above in another case and the observations of C.O.I. in this present case at para (3) above, decided to drop further action against (1) Sri V.Balagurappa, EE, PR (Retd.), (2) Sri T.Satyanarayana, DEE, P.R. and (3) Sri G.Pothu Raju, AEE, P.R. Accordingly, further action is hereby dropped against (1) Sri V.Balagurappa, EE, PR (Retd.), (2) Sri T.Satyanarayana, DEE, P.R. and (3) Sri G.Pothu Raju, AEE, P.R. 6.
