ORDER:
Smt.P.Jagadamba, Mandal Parishad Development Officer,
Iragavaram Mandal , West Godavari District was trapped by the Anti-
Corruption Bureau authorities on 17.09.2005 when she demanded and
accepted a bribe of Rs.1,000/- from the complainant and she was arrested
on 17.9.2005 at 5.45 p.m. and produced before the Spl.Judge for
SPE&ACB Cases, Vijayawada and released on bail on 21.9.2005 A.N.
After considering the same, the Government has issued directions to the
Commissioner of Panchayat Raj, Hyderabad, vide Memo., Dt:5.10.2005 for
placing her under suspension. later it was decided that Smt. P.
Jagadamba, Mandal Parishad Development Officer (u/s) may be reinstated
into service without prejudice to the disciplinary proceedings pending
against her and accordingly, vide Memo., dated:12.06.2006 the
Commissioner of Panchayat Raj have been directed to reinstate her into
service.
2. Further, the Director General, Anti-Corruption Bureau, has sent his
final report dt:07.06.2006 recommending to place the Accused Officer on
her defence before the Tribunal for Disciplinary Proceedings, Government
after considering the report of the Director General, Anti-Corruption
Bureau, and as advice by the Andhra Pradesh Vigilance Commissioner it
was decided to appoint an enquiry Officer to conduct detailed enquiry in to
the allegations leveled against Smt.P.Jagadamba, Mandal Parishad
Development Officer, Iragavaram Mandal , West Godavari District.
3. The Commissioner of Panchayat Raj & Rural Employment was
instructed to initiate major penalty proceedings for departmental inquiry
under APCS (CCA) Rules, 1991 against the Accused Officer Smt.
P.Jagadamba, Mandal Parishad Development Officer, M.P. Iragavaram
West Godavari District for having demanded and accepted a bribe of
Rs.1,000/- from the complainant, vide Memo., dt:23-12-2006 by framing
draft Articalls of charges.4. The Commissioner of Panchayat Raj & Rural Employment,
Hyderabad in his letter, 5th read above, while sending the enquiry report
along with records, stated that article of charge has been framed against
the individual and the individual has submitted her explanation to the
charge memo. After examining the explanation of the charged officer, the
Chief Executive Officer, West Godavari District has been appointed as
Enquiry Officer and Sri V.Subbaraju, Inspector, Anti-Corruption Bureau,
Eluru was appointed as presenting Officer. The Enquiry Officer has
submitted his report in respect of the charges framed against
Smt.P.Jagadamba, Mandal Parishad Development Officer, West Godavari,
District. While furnishing the Inquiry report, the Commissioner of Panchayat
Raj & Rural Employment, Hyderabad requested the Government to issue
appropriate orders in this matter.
5. On perusal of the enquiry report, the Enquiry Officer has reported
that there were no evidences direct or indirect to sustain the charges that,
the CGS actuated with corrupt motive, exhibited lack of integrity, devotion
to duty and conduct of unbecoming of a Government Servant. On the
flimsy circumstantial evidences and grounds without any direct evidences
the bonafides and integrity of a responsible officer could not be called into
question. Hence, he concluded that the CGS did not contravene the Rule
3(1) and (2) of APCS (Conduct) Rules, 1964 and the charge was not
proved.
6. After having examined the entire matter with reference to the
enquiry report in reference 6th read above, and Government have decided
to accept the E.O’s. report and accordingly further action against
Smt.P.Jagadamba, Mandal Parishad Development Officer, Iragavaram
Mandal , West Godavari District, has been dropped.
7. The Commissioner of Panchayat Raj & Rural Employment, shall
take further necessary action accordingly.
