of Nalgonda District – Trapped by the ACB officials on 18.04.2008 – Prosecuted
in a court of law – Acquitted by the I Addl. Spl. Judge for SPE & ACB cases,
Hyderabad - Fully exonerated from the charge – Regularization of suspension
period i.e. from 18.04.2008 to 20.10.2010 as on duty as per the provisions of
FR 54(B) (3) and (4) – Orders – Issued.

ORDER:
In the reference 1st read above, the Commissioner, Panchayat Raj and
Rural Employment, AP-Hyderabad has issued orders placing Smt. D.
Kodandapani, former Mandal Parishad Development Officer, Yadagirigutta Mandal
of Nalgonda District under suspension on the allegation of demand and
acceptance of bribe from the complainant for doing official favour and in the
reference 2nd read above, sanction was accorded for prosecution of Smt. D.
Kodandapani, MPDO in a Court of Law. The suspension of individual was
reviewed from time to time and in the reference 3rd read above, orders were
issued reinstating Smt. D. Kodandapani, former MPDO, Yadagirigutta Mandal of
Nalgonda District, into service pending finalization of criminal proceedings.
2] In the reference 5th read above, the I Addl. Spl. Judge for SPE & ACB
cases, Cum V Addl. Chief Judge, Hyderabad in C.C.No.12 of 2009 pronounced the
judgement dated:28.03.2011 and opined that the prosecution has utterly failed
to prove the guilty of Accused Officer Smt. D. Kodandapani, former MPDO
Yadagirigutta, Nalgonda district for the offences punishable under section 7 &
13(1)(d) r/w Sec.13 (2) of Prevention of Corruption Act, 1988 beyond reasonable
doubt and accordingly she is acquitted under section 248 (1) of Cr.P.C. from the
leveled charges.
3] In the reference 6th read with reference to 8th read above, Government
have fully exonerated the Accused Officer Smt. D. Kodandapani, former MPDO,
Yadagirigutta Mandal of Nalgonda District from the charge, on the allegation of
corruption in trap case.

4] In the reference 7th read above, the Commissioner, Panchayat Raj and
Rural Employment, AP-Hyderabad has forwarded a representation submitted by
Smt. D. Kodandapani, former MPDO, Yadagirigutta Mandal of Nalgonda District,
for regularizing the period of suspension from 18.04.2008 to 20.10.2010. Smt.
D. Kodandapani, MPDO has requested to regularize her suspension period as on
duty as per the provisions of FR 54 (B) (3), as the I Addl. Spl. Judge for SPE &
ACB cases, Hyderabad has pronounced the judgement and found ‘not guilty’
from the charges leveled against her.
5] The Government, after careful examination of the matter, have decided
and accordingly, hereby order that the period of suspension from 18.04.2008 to
20.10.2010 of Smt. D. Kodandapani, former MPDO, Yadagirigutta Mandal of
Nalgonda District shall be treated as on duty as per the provisions of FR 54 (B)
(3) & (4).
6] This order issues with the concurrence of Finance (FR-II) Department vide
their U.O.No.1965/57/FR.II/12, dated:09.02.2012.
7] The Commissioner, Panchayat Raj and Rural Employment, AP-Hyderabad
shall take further action in the matter accordingly.
