ORDER:
It was brought to the notice of the Government that Sri P. Samba Murthy,
Asst. Engineer, Panchayat Raj, and Sri G. Hanumatha Rao, Work Inspector, Panchayat
Raj, Inkollu Mandal, Prakasam District were trapped by the ACB officials on 05.08.2003
when they demanding and accepting bribe from the complainant Sri V. Anjaneyulu,
Nagandla (V), Inkollu Mandal, Prakasam District for doing official favour.
2. After examining the final report furnished by the D.G., ACB in the reference 1st
read above, sanction was accorded for prosecution of Sri P. Samba Murthy, Asst.
Engineer, Panchayat Raj, and Sri G. Hanumatha Rao, Work Inspector, Panchayat Raj,
Inkollu Mandal, Prakasam District, in a Court of Law, vide reference 2nd and 3rd read
above respectively. Accordingly, the Bureau filed charge sheet against the A.Os. on
24.07.2004 in the Court of Spl..Judge for SPE & ACB cases, Nellore.
3. In the reference 4th read above, the Hon’ble Special Judge for SPE & ACB
cases, Nellore has delivered judgement on 14.10.2011 in C.C.No.26/2004 and found that
the accused officers Sri P. Samba Murthy, Asst. Engineer, Panchayat Raj and Sri G.
Hanumantha Rao, Technical Work Inspector, Panchayat Raj, Inkollu Mandal, Prakasam
District, were not guilty for the charges framed u/s 7 & 13 (2) r/w 13 (1) (d) of P.C. Act,
1988 and were acquitted under section 248 (1) Cr.P.C.
4. In his representation 6th read above, Sri P. Samba Murthy, Asst. Engineer, PR,
Inkollu Mandal, Prakasam District (Retd.) has stated that the Spl. Judge for SPE & ACB
cases, Nellore acquitted him on 14.10.2011 in C.C.No.26/2004 under Section 248 (1)
Cr.P.C. as the charges framed u/s 7 & 13 (2) r/w 13 (1) (d) of P.C. Act, 1988 were not
found guilty. Further, he has stated that he has retired from service while continuing
under suspension on 31.07.2005 on superannuation. He has, therefore, requested to
drop further action against him in the light of the above judgment so as to settle his
pensionery benefits.

5. In his representation 7th read above, Sri G. Hanumantha Rao, Technical Work
Inspector, Inkollu Mandal, Prakasam District has stated that the Spl. Judge for SPE &
ACB cases, Nellore acquitted him on 14.10.2011 in C.C.No.26/2004 under Section 248
(1) Cr.P.C. as the charges framed u/s 7 & 13 (2) r/w 13 (1) (d) of P.C. Act, 1988 were
not found guilty. He has, therefore, requested to drop further action against him in the
light of the above judgment.
6. Government, after careful examination of the matter in detail, have decided to
drop further action against Sri P. Samba Murthy, Asst. Engineer, Panchayat Raj (Retd.)
and Sri G. Hanumantha Rao, Technical Work Inspector, Panchayat Raj, Inkollu Mandal,
Prakasam District, keeping inview their acquittal in C.C.No.26/2004 by the Court of
Hon’ble Special Judge for SPE &ACB cases, Nellore and accordingly hereby drop further
action against them.
7. The Engineer-in-Chief, Panchayat Raj, Hyderabad shall take necessary action in
the matter.
