O R D E R:
In the reference 1st read above, the Industries and Commerce (Mines-I)
Department have stated that the Government vide G.O.Ms.No.24 Ind. & Com.
Dept., dated 12.2.2007 transferred the subject matter “auctioning of sand” from
Panchayat Raj & Rural Development Department to Industries & Commerce
Department. Subsequently, certain amendments have been made to Rule 9-B of
APMMC Rules, 1966 through G.O.Ms.No.84 Ind. & Com. Dept., dated 10.4.2007
devising revised procedure for auctioning of sand bearing areas. Among others,
one of the conditions is that the Assistant Director of Mines & Geology concerned
shall issue notice in “Form-S1” by publishing in (2) State Level Newspapers
about conducting of auction as a part of wide publicity. As per G.O.Ms.No.84
I&C (M.I) Department, dated 10.4.2007, 95% of the knocked down amount of
sand auctions is debited to the concerned Zilla Parishad Head of account and
5% of knocked down amount is debited to the State Government Head of
Account.
2. The Industries and Commerce (Mines.I) Department have further stated
that, due to non allotment of the budget for advertisement charges to the Mines &
Geology Department, the issue of payment of advertisement charges is not
getting resolved and accumulated the outstanding dues. Since the Local Bodies
are the direct beneficiary in getting more revenue by issue of notifications in the
Newspapers, the Industries & Commerce Department has proposed to issue of
suitable instructions to the Chief Executive Officers of all Zilla Praja Parishads in
the State for payment of Advertisement charges incurred for notification on
“auction of sand reaches” in the concerned District and also to clear the
outstanding dues of Advertisement charges and to pay the amount whenever the
notification is issued on auctions of sand reaches on regular basis.
3. The A.P. News Papers Association has also represented on the above
issue and requested the Government to issue necessary instructions to Chief
Executive Officers of Zilla Praja Parishads in the State to accept the bills
pertaining to the sand auction (within their jurisdiction) and clear all the pending
bills as well as future publication bills on submission from time to time, to enable
them to continue publication of the sand auctions notices immediately on receipt
from the concerned.

4. In the reference 2nd read above the Commissioner, Panchayat Raj and
Rural Employment, Hyderabad has stated that the local bodies are the direct
beneficiaries of auctioning of sand. Hence, it may be more appropriate that
payment of advertisement charges is made from Zilla Praja Parishads concerned
from sand auction amounts. He has therefore requested the Government to
issue appropriate orders in this matter.
5. In the circumstances reported by the Industries and Commerce
Department and keeping in view the recommendations of the Commissioner,
Panchayat Raj and Rural Employment, Hyderabad, Government after careful
examination, hereby accord permission to all the Chief Executive Officers of Zilla
Praja Parishads in the State to clear the outstanding dues and to pay the
advertisement charges for conducting “auction of sand reaches” from the funds
of the sand auction amounts.
6. The Commissioner, PR&RE, Hyderabad/Chief Executive Officers in the
State shall take further necessary action accordingly.
