- - ….. आवदे क गणपर्तू त (i). श्री टी.एस. बालासुब्रमजनयन, सदस्ट्य (जवत् त) (ii). श्री रजत सच् चर, सदस्ट् य (आर्तथक) 2645 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] आदिे (जून, 2020 के 1वें ददन पाररत) यह मामला जवाहरलाल नेहरू पत्तन न् यास (जेएनपीटी) जेएनपीटी की संपदा के दरमानों के जनधाारण के जलय े प्राप् त प्रस्ट् ताव स ेसंबंजधत ह।ै 2. जेएनपीटी न े 20, अगस्ट्त 2019 के अपन े पत्र संख् या जेएनपीटी/दिन/एिए/2019/5970 के द्वारा जेएनपीटी की संपदा के दरमानों के जनधाारण के जलय े सिं ोधन का प्रस्ट् ताव दायर दकया। उक्त प्रस्ट् ताव को संबंजधत प्रयोक्त ाओं/प्रयोक्त ा संगठनों के साथ परामि ा के जलय े जलया गया। जेएनपीटी के प्रस्ट् ताव की कायाालय म ें आंतररक समीक्षा की गई। जेएनपीटी स े अजतररक्त सूचना / स्ट् पष्ट ीकरण मांगे गए। जेएनपीटी न े अजतररक्त सचू ना / स्ट् पष्ट ीकरण का उत् तर ददया। इस मामले म ें प्राजधकरण के कायाालय म ें 13 नवंबर, 2019 को संयुक् त सुनवाई का आयोजन दकया गया। संयुक् त सुनवाई म ें जेएनपीटी तथा संबंजधत प्रयोक्त ाओं / प्रयोक्त ा संगठनों ने अपन-े अपने जनवेदन रखे। 3. मामले की जववेचना के दौरान एकत्र की गई सूचना की समग्रता के हवाले स,े इस प्राजधकरण न े जेएनपीटी की संपदा के संिोजधत दरमानों का अनुमोदन दकया और एक सकारण आदेि पाररत दकया। 4. इस प्राजधकरण द्वारा पाररत सकारण आदेि भारत के राजपत्र म ें अजधसूचना की प्रदिया म ें ह ै और अजधसूचना म ें कुछ और समय लगने की संभावना ह।ै यह प्राजधकरण चाहता ह ै दक संिोजधत दरमान आदेि की अजधूसचना की प्रतीक्षा दकय े जबना, प्रभावी हो जाएं। इसजलए यह प्राजधकरण के जेएनपीटी की संपदा के संिोजधत दरमानों को, अनलु ग् नक के रूप म ें संलग् न, तत्क ाल अजधसूजचत कराता ह।ै उि दरमान भारत के राजपत्र म ें इस आदिे की अजधसूचना की तारीख स े 30 ददन की समाजि पर लाग ू होंगे। इस प्राजधकरण द्वारा पाररत सकारण आदिे अलग स े अजधसूजचत दकया जायेगा तथा जेएनपीटी तथा सबं ंजधत प्रयोक्त ाओं / प्रयोक्त ा सगं ठनों को बाद म ें संसूजचत कर ददया जायेगा। टी.एस. बालसुब्रमजनयन, सदस्ट् य (जवत् त) [foKkiu&III@4@vlk-@71@2020&21] अनलु ग्न क जवाहरलाल नहे रु पत्तन न्यास जेएनपीटी संपदा के पट्टा दकराय े ि.स.ं मद इकाई दर (रु.) 1 पत्तन में कहीं भी एजेंजसयों, वाजणज्य क एजेजसयों, बैंकों, सरकार की को प्रजत वग ामीटर या 500.00 रु. प्रजत वग ा उसका भाग प्रजत पत्तन में कहीं भी आबंरटत, जेएनपीटी के पुराने भवन और नगर क्षेत्र के मीटर या उसका एक भाग माह या उसका भाग प्रजतमाह जमा 333.36 रु. जसवाए, कायाालय स्ट् थान का पट्टा िुल् क प्रजत माह प्रीजमयम 2 पत्तन संपदा में सीमािुल् क बद्ध क्षेत्र के बाहर कहीं भी +5.5 एम सीडी - 45.00 और उससे अजधक तक जवकजसत भूजम का लाइसेंस िुल् क 3 पत्तन संपदा में सीमािुल् क बद्ध क्षेत्र के भीतर कहीं भी +5.5 एम सीडी - 54.00 और उससे अजधक तक जवकजसत भूजम का लाइसेंस िुल् क 4 पत्तन संपदा में कहीं पर भी अजवकजसत भूजम का लाइसेंस िुल्क - Rajat Sachar, Member (Economic)4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] O R D E R (Passed on this 1st day of June, 2020) This case relates to the proposal received from Jawaharlal Nehru Port Trust (JNPT) for fixation of Scale of Rates for Estate of JNPT. 2. The JNPT has filed a proposal vide its letter no JNP/FIN/FA/2019/5970 dated 20 August 2019 for fixation of Scale of Rates for estate of JNPT. The said proposal was taken for consultation with concerned users/user organisations. The proposal of the JNPT was internally scrutinized in the office. The additional information/ clarification were sought from the JNPT. The JNPT has furnished the additional information/ clarifications sought. A joint hearing in this case was held on 13 November 2019 at the Office of this Authority. At the joint hearing, the Users/User Organisations and JNPT have made their submissions. 3. With reference to the totality of information collected during the processing of the case, this Authority has approved the Scale of Rates for Estate of JNPT and passed a Speaking Order. 4. The Speaking Order passed by this Authority is in the process of notification in the Gazette of India and it is likely to take some more time for notification. Therefore, this Authority desires that the Scale of Rates may come into force without waiting for notification of the Order. Therefore, this Authority notifies the Scale of Rates for the estate of the JNPT, which is attached as Annex. The said Scale of Rates will come into force after expiry of 30 days from the date of notification of this Order in the Gazette of India. The Speaking Order passed by this Authority will be notified separately and communicated to the JNPT and the relevant users/ user organisations in due course of time. T.S. ( “ 22.50 Undeveloped means any land not filled up to +5.5. m CD) Note for all the Cases of Sr No 1,2,3 and 4 i. The license fee/ lease rent will be enhanced by 20% as weightage for the activities which are not related to Port “ Activities and defined as Commercial activities. ii. The land rent applicable to Government agencies will be on nomination basis for Port Use as per the provisions of the Land Policy Guidelines issued by MoS from time to time. iii.
