को यह िनदशे (cid:4)दया (cid:4)क वह इन संपि8य! को राज संपि8 के (cid:26)प म(cid:13) ले ले Oय !(cid:4)क अब कोई भी वैध दावेदार नहQ है। अत: मंLालय ने

7. यह (cid:25) प6 ट ह ै (cid:4)क जहां भी असली दावेदार पाए गए थे उ0ह (cid:13) उनके दाव! के अनुसार सामान वापस कर (cid:4)दये गए थे। शेष सामान
आर बी आई के पास िवगत कई दशक! से पड़े ह&। मंLालय Nारा 1979 और इसके प>च ाr~ 1991 म(cid:13) िवYापन जारी करने के बावजूद, कोई
वैध दावेदार आगे नहQ आया ह।ै इसिलए, आज क: ि(cid:25)थित म,(cid:13) न तो कोई असली दावा और न ही दावा मामल! के संबंध म(cid:13) ऐसा कोई

10. यह (cid:4)क उO त संपि8 से संबंिधत सभी अिधकार! को अब भारत सरकार म(cid:13) िनिहत (cid:4)कया जा रहा ह।ै इसिलए, के0 ^ सरकार अब
इन बॉO स! म(cid:13) मौजूद सामान का िनपटान उस तरीके से करने के िलए स9म ह ैजैसा भी वह उिचत समझे।

NOTIFICATION
New Delhi the 20th February, 2015
No. 2/16/2014-R&SO.—In the aftermath of partition of the country in 1947, a large number of people had
migrated from the then West Pakistan leaving behind their valuables in their respective banks in Pakistan. Similarly,
many Muslim evacuees, had migrated to Pakistan at that time leaving behind their valuables in various banks in this
country. These were under the custody of the then Custodian of Evacuee Property.
2. In order to return these moveable properties lying in the respective banks, an Agreement was signed between
India and Pakistan in 1950. Thereafter, the Government of India enacted an Act called the Transfer of Evacuee Deposits
Act, 1955. Under the said Agreement, the contents of lockers and safe deposits of displaced persons with the banks in
West Pakistan were brought from Pakistan to India in sealed packets in November/December, 1961 and were kept in safe
custody of the RBI, New Delhi. A major portion of these valuables have been restored to their original owners but there
were still some valuables which have either not been claimed or where the claimants were unable to furnish documentary
and other satisfactory proofs. This, together with the jewellery of Muslim Evacuees, have been lying with the RBI since
the past many decades.
3. In 1965, the then Ministry of Rehabilitation filed an Application under the Indian Trusts Act before the District
Judge, Delhi praying that lockers and safe deposits be taken over by the Court or alternatively, a new Trustee in place of
the Department be appointed to take care of these jewellery. The Court of District Judge passed an order in August,
1971 that there is no point in appointing a new Trustee. Since no one is coming forward to claim the property, the
property ultimately has to be escheated to the Government of India. The Court noted that the Government will deduct¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 3
from the sale proceeds all sorts of amounts due to it and the residue shall stand escheated to the Government. The Court
further noted that it will serve no useful purpose to appoint a new Trustee to administer the contents of the unclaimed
lockers and safe.
4. After this Order of the Court, the Department sought the views of the Ministry of Law. The Ministry of Law
advised that in the interest of natural justice, public notices be issued to invite any remaining claimants. As a result, the
Department took out two Public Notices in 1979 and in 1991. All the applications received in response to these public
notices were again examined and no lockers could be released for want of rightful claimants.
5. After the Ministry of Law, the Ministry of External Affairs was also approached for political clearance, which
was obtained. It was thought then, in 1990s, to prepare an inventory of all the contents in these boxes lying with RBI
before an informed decision could be taken. However, these efforts got distracted when the ANZ Grindlays Bank and
SBI too came forward to inform that they had some lockers/articles with them and asked the Ministry to take back these
items. In ANZ Grindlays Bank V/s UOI (CW 1132/90), the Delhi High Court vide its judgement dated 8th August, 1991
directed the Union Government to take over the property as an escheat since there are no more valid claimants. The
Ministry, therefore, first drew the inventory of the boxes of these banks and deposited them with the RBI. Finally, the
Ministry was in a position to prepare a consolidated inventory.
6. Subsequently, a consolidated inventory of the boxes was prepared by constituting a Committee comprising
officers from the Ministry, RBI and local Executive Magistrate. The process of preparing the inventory was completed
in January, 2015.
7. It is clear that whenever genuine claimants were found, they were handed over the items as per their claims.
The remaining items have been lying with the RBI since the last many decades. No valid claimant came forward in spite
of the Ministry taking out advertisements, once in 1979 and then in 1991. Therefore, as on date, there is neither a
genuine claim pending nor any dispute in regard to the claim cases, which were rejected earlier. Given the above fact
and in light of the judgement of the District Judge, Delhi, it is highly improbable that there are any more claimants for
the contents of these boxes and as such all the contents stand unclaimed. All through these years, the Central
Government has been acting as a constructive trustee of the said contents.
8. Whereas the said property is in the possession of the Reserve Bank of India since a very long time with the
Government of India as a Constructive Trustee and since there is no valid claim being preferred by any person, therefore,
it appears to be just and reasonable to declare the said property as ‘Unclaimed Property’ in terms of the General
principles of escheatment.
9. Whereas no claim has been preferred for the said property nor any legal dispute for the rejected cases is
pending, therefore, the Government of India, by this order, hereby declares the said property as ‘Unclaimed Property’
and declares that the ownership of the said property shall now be vested in the Government of India for all intents and
purposes.
10. That all the rights with respect to the said property are now being vested in the Government of India. Therefore,
the Central Government is now competent to dispose of the contents in these boxes in such manner as it deems fit.
11. This issues with the approval of the Competent Authority.
