पत्तन न् यास (केीपीटी) म ें एक बीीटी प्रचालक, से उनके दरमानों के सामान् य संिोधन के जलए प्रा्‍ त प्रस्ट् ताव क से संबंजधत ह।श 2.1. टीएमआईएलएल अपने दरमानों के सामान् य संिोधन के जलए 01 अ्‍ तूबर, 2019 के अपने पत्र के द्वारा एक प्रस्ट् ताव क दायर िकया था। उ्‍त प्रस्ट्त ाव क को लाइसेंस प्रदात्ता पत्तन अथागत् कोलकाता पत्तन न् यास (केीपीटी) र टीएमआईएलएल के संबंजधत प्रयो्‍त ाओं/प/प्रयो्‍त ा संगठनों के साथ परामि ग के जलए जलया गया। िकसी भी प्रयो्‍त ा/प्रयो्‍त ा सगं ठन न े अपनी रट्‍ पजणयां प्रस्ट् तुत नहक की। 2.2. टीएमआईएलएल के प्रस्ट्त ाव क की आंतररक संव कीषा ा की गई। टीएमआईएलएल से अजतरर्‍त सूचना/स्ट् पष्ट ीकरण मांग े गए। टीएमआईएलएल ने मांगी गई अजतरर्‍त सूचना/स्ट् पष्ट ीकरण का उत्तर िदया। इस मामले में 17 अ्‍ तूबर, 2019 को केीपीटी के कोलकाता जस्ट्थत पररसर म ें एक संयु्‍ त सुनव काई का आयोिन िकया गया। संयु्‍त सुनव काई म ें टीएमआईएलएल र केीपीटी ने अपन-े अपने जनव केदन रखे। 3. मामले की संििया के दौरान एकत्र की गई सूचना की समग्रता के हव काले से, इस प्राजधकरण ने टीएमआईएलएल के संिोजधत दरमानों का अनुमोदन िकया। 4.1. इस प्राजधकरण द्वारा पाररत सकारण आदेि भारत के रािपत्र में अजधसूचना की प्रििया म ें ह श र अजधसूचना के जलए अभी र समय लगने की संभाव कना ह।श अत: यह प्राजधकरण चाहता ह श िक संिोजधत दरमान इस आदेि की अजधसूचना की प्रतीषा ा िकये जबना लाग ू हो िाएं। तदनुसार, यह प्राजधकरण टीएमआईएलएल के संिोजधत दरमानों को, अनलु ग्न क के रूप में सलं ग् न ह,ं अजधसूजचत कराता ह।श संिोजधत दरमान इस आदेि के भारत के रािपत्र म ें अजधसूचना की तारीख से 30 िदन की समाजि के पश् चात ् प्रभाव की हो िायेंगे र इसके बाद तीन व कष ग तक प्रभाव की रहगें े र नीचे पशरा 5 में की गई चचाग के अनुसार व कार्तष क सूचकांकन के अधीन होंगे। 4.2. इसी बीच, टीएमआईएलएल के मौिूदा दरमानों की व कशधता का 01 अप्रलश 2020 स े टीएमआईएलएल के संिोजधत दरमानों के लाग ूहोने की तारीख तक जव कस्ट् तार िकया गया सम ा िाए। 4.3. टीएमआईएलएल के संबंध में इस प्राजधकरण द्वारा पाररत सकारण आदेि को अलग से अजधसूजचत िकया िायेगा तथा टीएमआईएलएल, केीपीटी र संबंजधत प्रयो्‍त ाओं/प/प्रयो्‍त ा संगठनों को बाद में भेि िदया िायेगा। 5. प्रिुल् क िदिाजनददेशि 2019 के खंड 2.12 के अनुसार, दरमानों को संबंजधत व कष ग के 1 िनव करी से 31 िदसंबर, के बीच होने व काले थोक मूल् य सूचकांक (ड्‍ ल् यपू ीआई) में भारत सरकार द्वारा घोजष त जव कचलन के 60% की सीमा तक मुद्रास्ट् फीजत के प्रजत व कार्तष क सूचकांिकत िकया िायेगा। ऐसे समंजित दरमान संबंजधत व कष ग के 1 मई से लागू होंगे र आगामी व कष ग की 30 अप्रशल तक प्रभाव की रहगें े। यहा ं यह उल्ल ेख करना समीचीन होगा िक इस मामल े म ें व कष ग 2019-20 में सूचकांकन को एआरआर में र दरमान जनकालने के जलये पहले ही सुजव कचार में ले जलया गया ह श । इस प्रकार पहला व कार्तष क सूचकांकन संिोजधत दरमानों के लागू होन े की तारीख से लाग ू होगा। बाद के व कष ों के जलए व कार्तष क सूचकांिकत दरमान संबंजधत व कष ग की 1 मई से लाग ू होकर आगामी व कष ग की 30 अप्रलश तक लागू रहगे ा। सूचकांिकत दरमानों की सूचना टीएमआईएलएल द्वारा केीपीटी, पत्‍त्‍ न न्यास के हजल्दया डजक पररसर का दरमान कहा िाएगा। 2. पररभाष ा इस दरमान म,ें िब तक िक संदभग अन् यथा अपेजषा त न हो, जनम्न जलजखत पररभाष ाएं लाग ूहोगी : (i) “टीएम इंटरनशिनल लोजिजस्ट्ट्‍स जलजमटेड” का अथ ग 43, चौरंगी रोड, कोलकाता-71 पर अपने पंिीकृत कायागलय के साथ कंपनी अजधजनयम, 2013 के अधीन पंिीकृत कंपनी होगा । (ii) टीएमआईएलएल पररसर का अथ ग लाइसेंस करार के अधीन आबंरटत बशकअप षा ेत्र र कोई अन् य अजतरर्‍त भूजम सजहत टीएमआईएलएल को लाइसेंस पर िदया गया षा ेत्र होगा । (iii) ‘िदव कस’का अथग िदन के प्रात: 6 बिे से िुरू होकर आगामी िदन को प्रात: 6 बिे तक की अव कजध होगा । (iv) ‘जव कलंब िुल् क’ का अथ ग इस दरमान में यथा जव कजनर्ददष् ट जन:िल्ु क अव कजध से अजधक टीएमआईएलएल पररसर के भीतर कागों के भंडारण के जलए देय प्रभार होगा र लाइसेंस अव कजध के दौरान कागों के भडं ारण के जलए लाइसेंस आधार पर पत्‍ तन प्रयो्‍त ा को आबंरटत षा ेत्र म ेंभंडाररत कागों िाजमल नहक होगा। (v) ‘िोजखमपूणग-।‘ का अथग कोलकाता पत्‍ त्‍ न न् यास द्वारा समय-समय पर अंगीकृत िोजखमपूण ग कागों की सूची म ें िोजखमपूणग-। के रूप म ेंव कगीकृत कागो होगा । (vi) ‘माह’ का अथग अव ककाि िदव कसों सजहत 30 लगातार कशलेंडर िदव कस, अन् यथा जव कजनर्ददष् ट को ोो़ककर, होगा । (vii)‘ऑन बोड ग प्रहस्ट्त न प्रभारों’ का अथ ग लदाई / उतराई प्रचालन के जलए िनिजि की आपूर्तत के रूप म ें टीएमआईएलएल द्वारा ऑन बोडग सेव काएं प्रदान करन े के जलए कोगो/घटक/ व कस्ट् तु/पशकेि/कंटेनर पर प्रभार होगा । (viii)‘ऑन बोड ग पयगव केषा ण’ का अथ ग पोत प्रचालन म ें अजधक उत्‍प ादकता / दषा ता अर्तित करने के जलए कागो के पोत स े तट / तट से पोत स्ट्थ ानांतरण प्रचालन के दौरान टीएमआईएलएल द्वारा प्रदत्‍ त जव किेष सेव काएं दोनों ऑन-बोडग र ऑन-िोर जिन्ह ेआन-बोडग प्रहस्ट्तन प्रभारों अथव का लदान/उतराई प्रभारों अथव का जव कजव कध प्रभारों के अजधकार षा ेत्र के भीतर िाजमल नही िकया गया ह श होगा र प्राकृजत म ें अनुष गं ी ह ं र इनम ें से कुोेक पोत प्रचालन के दौरान बेहतर उत्‍पादकता/कायगकुिलता प्राि करन े के जलये िरूरी ह।ं (ix) ‘ीव कर-साइड उतराई / नौभरण’ का अथग उतराई / नौभरण प्रचालन के समय घाट से जबना गुिरे पोत से / पर कागों की उतराई / लदाई प्रचालन होगा । (x) ‘िट आऊट कागो’ का अथग टीएमआईएलएल पररसर में प़का जनयागत कागों िो पोत पर ऑन बोडग नौभाररत नहक िकया गया होगा जिसके जलए यह टीएमआईएलएल पररसर में प्रा्‍ त हुआ था। (xi) ‘स्ट् टजक कागो’ का अथ गजबना जनयागत दस्ट् ताव केिों के पोतांतरण के जलए पत्‍ तन पर प्रा्‍ त कागो होगा । (xii)‘टीईय’ू का अथ गकंटेनर की बीस फीट समकषा इकाई होगा । (xiii)‘पोतांतरण’ का अथ ग अन् य पत्‍ तन/पत्‍ तनों गंत्‍ य के जलए समुद्रगामी पोत / बािग स े दसू रे समुद्रगामी पोत / बािग को कागों / कंटेनर का स्ट्थ ानांतरण होगा ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (xiv)‘घाटिुल् क’ का अथग टीएमआईएलएल पररसर के भीतर लादे गए अथव का नौभाररत अथव का पोतांतररत सभी कागों / कंटेनर पर व कसूली योग् य मलू दये ताएं होगा । (xv)तट प्रहस्ट्तन म ें कागो को हुक स्ट्थान स े / को व्यव कजस्ट्थत र प्राि करना, अंतर माडल पररव कहन से घाट स े स्ट्टा्‍याड ग व क इसके जव कपरीत र कागो को व कशगन/रक से/को प्राजि र सुपदु गग ी िाजमल ह।श 3. जनधारग ण के समान्य जस्ातं : (i) न् यनू तम प्रभायग भार / माप 1 टन / 1 घन मी0 होगा िबिक सकल भार / माप 1 टन /1 घन मी0 से कम हो सकता ह श। उस मामले में िहां प्रभार भार पर आधाररत ह श र सकल भार सही 100 िक0ग्रा0 के गुणक में नहक ह शतो उस े 100 िक0ग्रा0 के अगले उच् चतर गुणक पर पूणागिकत िकया िाएगा । िहां सकल घन मी0 दिमलव क में हो व कहां उस े घन मी0 की अगली उच् चतर पणू ग इकाई म ेंपणू ागिकत िकया िाएगा । (ii) िकसी अव कजध / भार से इतर इकाई के जलए लागू दरें उसकी अव कजध / इकाई के जहस्ट्स े पर लाग ूहोंगी । (iii) िब तक अन् यथा जव कजनर्ददष् ट न हो, यिद टीएमआईएलएल उपस्ट्क र पोत से / पर कागों / कंटेनर की लदाई / नौभरण के जलए अथव का पोत द्वारा िकसी अन् य प्रयोिन के जलए खंड 10.1 में यथा जव कजनर्ददष् ट उपस्ट् कर िकराया प्रभार व कसूल िकया िाएगा। (iv) कागों संबंधी प्रभार कागों के स्ट्व क ाजमयों अथव का उनके जनकासी तथा अग्रेष ण एिेंटों / प्रहस्ट्तन एिेंटों से व कसूल िकए िाएंगे परंत ु व कहा ं नहक िहा ं अन्यथा जव कजनर्ददष् ट हो, अथव का उन मामलों म ें िहां िलयान स्ट् व कामी /स्ट् टीमर एिेंटस ऐसे प्रभार अदा करने के जलए सहमत हो । (v) नमूने सारजणयां र अन् य व कस्ट्त ुएं जिसके जलए जिुपग कंपजनयां मालभाडाऺ व कसूल नहक करती ह श र जिस पर सीमा िुल् क देय नहक ह श रािनजयक डाक बशग, िू का सामान र बथग सं0 13 से संबंजधत टीएमआईएलएल की पररयोिना सुजव कधाओं/प में प्रयोग के जलए सभी व कस्ट् तुए एचडीसी सभी कागों संबंधी प्रभारों के भुगतान में ोूट प्रा्‍ त होगा । (vi) उन िदनों के जलए जव कलंब िुल् क व कसूल नहक िकया िाएगा जिसके दौरान पत्‍ तन/टीएमआईएलएल के कमगचाररयों द्वारा हडताल के कारण सुपुदगग ी नहक की िा सकती, बितदेश आयातक अथव का उसका प्राजधकृत एिेंट ह़कताल की िुरूआत स े पहल े सभी प्रभारों के भुगतान पर संपूण ग सुपुदगग ी दस्ट् ताव केि दाजखल कर दते ा ह श। (vii) जव कलंजबत भुगतानों / व कापजसयों पर ्‍ याि : (क) प्रयोिा जव कलंजबत भगु तानों पर इस दरमान के अधीन दंडात्‍ मक ्‍ याि अदा करेगा। इसी प्रकार टीएमआइरएलएल जव कलंजबत व कापजसयों पर दाडं ात् मक ्‍ याि अदा करेगा। (ख) दडं ात्‍ मक ्‍ याि की दर 15 प्रजतित होगी। यह दंडात्‍ मक ्‍य ाि दर टीएमआईएलएल र पत्‍ तन उपयो्‍त ाओं/प दोनों पर समान रूप से लागू होगी। (ग) व कापजसयों में जव कलंब सेव का के समा्‍ त होने की तारीख अथव का उपयो्‍त ाओं/प से अपेजषा त सभी दस्ट् ताव केि प्रस्ट् तुत करने पर िो भी बाद में हो से केव कल 20 िदन जगना िाएगा। (घ) उपयो्‍त ाओं/प द्वारा भुगतानों में जव कलंब टीएमआईएलएल द्वारा जबल जनकाले िाने की तारीख के पश् चात केव कल 10 िदन जगनती िकया िाएगा। तथाजप, यह प्रचालन उन मामलों में लागू नहक होगा िहां भुगतान महापत्‍ त्‍न न् यास अजधजनयम म ें यथा जव कजनर्ददष्ट टीएमआईएलएल की सुजव कधाओं/प की सेव काएं प्रा्‍ त करने / प्रयोग करने स े पहले िकया िाना होता ह श र / अथव का िहां प्रभारों का अजग्रम भुगतान इस दरमान में ितग रूप में जनधागररत हो। (viii) कागों प्रहस्ट् तन प्रभारों की व कसूली के जलए कागों की प्रकृजत िानने के जलए िकसी कागों को ‘अजव कजनर्ददष् ट व कगग’ अथव का अन् यथा के अधीन व कगीकृत करने स े पहल े यिद अपेजषा त हो यह देखन े के जलए प्रासंजगक सीमा िल्ु क व कगीकरण को[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 देख जलया िाए िक ्‍य ा यह कागो अनुसूजचयों में उजल्लजखत जव कजनर्ददष् ट व कगों में से िकसी व कगग के अधीन व कगीकृत िकया िा सकता ह श। (ix) प्रयो्‍त ाओं/प को टीएमआईएलएल पर आरो्‍ य, उपयु्‍ त स्ट् तर से ऊपर जव कलंबों के जलए प्रभार अदा करने की आव कश् यकता नहक होगी । (x) (क) िहां कही टीएमआईएलएल के अजधसूजचत दरमान में िकसी नई सेव का / कागों / उपस्ट्कर / सुजव कधा के जलए जव कजिष्ट प्रिुल् क उपल्‍ध नहक हो तो टीमएआईएलएल नई सेव का / कागों / उपस्ट्कर के प्रिुल्क के जलय े िकसी भी महापत्तन न्यास अथव का प्रिुल्क िदिाजनददेशि 2019 द्वारा िाजसत बीीटी प्रचालक के दरमानों में तलु नीय सेव का / कागों / उपस्ट्कर/सुजव कधा के जलये जनधागररत प्रिुल्क को अपनाने के जलय े प्राजधकरण को सम्पकग कर सकता ह।श यिद िकसी भी महपत्तन न्यास अथव का प्रिल्ु क िदिाजनददेशि 2019 द्वारा िाजसत बीीटी प्रचालक के दरमानों म ें प्रस्ट्ताजव कत नई सेव का / कागों / उपस्ट्कर/सुजव कधा का प्रजतजनजधत्‍व क नही करता ह श तो टीएमआईएलएल को िदिाजनददेशि 2008 म ें िदय े गए जस्ांतों के अंतगगत जनधागररत इष्टतम षा मता के हव काले स े या सेव का / सुजव कधा / उपस्ट्कर की धाररत षा मता अथव का तकनीकी जव कजिजष्टयों के आधार पर प्रिल्ु क की अजधसूचना के जलए प्रस्ट्ताव क दायर कर सकता ह।श यिद ऊपर व कर्तणत जव ककल्पों के आधार पर प्रिुल्क जनधागरण उपल्‍ध नही होता तब टीएमआईएलएल पयागि कारण बतात ेहुए लागत िमा 16% प्रजतफल फामलुग े के आधार पर दरों का प्रस्ट् ताव क प्रस्ट् तुत कर सकता ह।श (ख) नई सुजव कधा अथव का नई सव के ा के प्रयोग के जलये दरों की अजधसूचना का प्रस्ट्ताव क नए कागो/सुजव कधा अथव का नई सेव का के आरम्भ होने की प्रत्‍याजित तारीखसे 60 िदन पहले जमल िाना चाजहये। नई सेव का / नये कागों के प्रिल्ु क जनधागरण के जलय े प्राजधकरण यथा जनधागररत सामान्य परामि ग प्रििया का अनुसरण करेगा। नई जव कजव कध सेव काओं/प के प्रिुल्क जनधागरण के मामल े में बीीटी प्रचालक को सेव काओं/प के लागू होन े की तारीख से 15 िदन पहल े से अनजधक नही की अव कजध म ेंप्रस्ट्ताव क प्रस्ट्ततु करना चाजहये। (ग) प्रस्ट्त ाव क प्रस्ट् तुत करने के साथ ही साथ, िब तक इस दर को अंजतम रूप से अजधसूजचत नहक िकया िाता तब तक प्रस्ट्त ाजव कत दर तदथग आधार पर व कसूल की िा सकती ह श। (घ) अंतररम अव कजध में लाग ू की िाने व काली तदथ ग दर प्रिुल्क िदिाजनददेशि 2019 के खडं 5.6.1. म ें दी गयी प्जत के आधार पर ्‍ युत्‍ पन् न होनी चाजहए। (ड) नए कागो/सेव का के जलए, जिसके जलये दरमानों में दर जनधागररत नही ह,ं प्राजधकरण द्वारा जनधागररत अंजतम दर सामान् यत: उत्तर व्यापी प्रभाव क से प्रभाव की होगी। तदथग रूप से अंगीकृत अंतररत दर इस प्रकार संजस्ट्व ककार की िाएगी िब तक यह पूव कग्‍ यापी प्रभाव क से िकसी संिोधन की अपेषा ा से अजधक नहक पायी िाती। (xi) इस दनमान म ें जनधागररत दरें अजधकतम दरें ह श इसी प्रकार ररयायत ें र ोूट जनम्न तम स्ट् तर पर ह ं । यिद टीएमआईएलएल चाह ेतो कमतर दरों म ेंबदलाव क कर सकता ह श र / अथव का उच् चतर ररयायतें र ोूट प्रदान कर सकता ह श। (xii) टीएमआईएलएल बथग स.ं 13 पर जनम्न जलजखत कागों का प्रहस्ट् तन नहक करेगा: (क) थोक में थमलग कोयला । (ख) थोक में कोिकग कोयला । (ग) जव कजभन् न प्रकार के कोक र अन् य काला कागो थोक में । (घ) पाइपलाइनों के माध् यम स ेप्रहजस्ट्तत द्रव्य बल् क कागों के जव कजभन् न प्रकार । (xiii) कंटेनरों के प्रहस्ट् तन के जलए जनधागररत दर 20 फीट कंटेनर के जलए ह।श 20 फीट से अजधक र 40 फीट तक के कंटेनर के जलए दर जनधागररत दर का 150 प्रजतित होगी । 40 फीट से अजधक कंटेनरों के जलए दर जनधागररत दर का 200 प्रजतित होगी ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (xiv) तटीय कागों / कंटेनरों के माल े में, थमगल कोयला स े इतर, लौह अयस्ट् क र लौह अयस्ट् क गुरट्काएं, जनधागररत दरों का 60 प्रजतित लाग ूहोगा । (xv) प्राजधकरण द्वारा अनुमोिदत दरमान इस प्राजधकरण द्वारा घोजष त िकय े िाने व काले ड्‍ल्यूपीआई के 60% पर स्ट्व कत: ही व कार्तष क सूचकांकन के अधीन होंगे। व कार्तष क सूचकांकन 01 मई 2020 स े लाग ू होगा। टीएमआईएलएल द्वारा सूचकांिकत दरमान की सूचना केीपीटी, प्रयोिाओं/प र इस प्राजधकरण को देनी होगी। 4. घाट िल्ु क प्रभार: 4.1 जव कदेिी कागों पर घाट िुल् समय-समय पर कोलकाता पत्‍ तन न् यास द्वारा स्ट् व कीकृत िकए िा सकते ह ंद्वारा आयजतत कागो । रट्‍प णी: (i) अंजतम उतराई तारीख (एलएलडी) व कह तारीख ह श जिस पर एक पोत अपनी आयात उतराई परू ी करता ह।श तथाजप, टीएमआईएलएल पोत से पहले से ही उतारे िा चुके कागों के जलए एलएलडी रूप म ेंकोई अन्य तारीख घोजष त कर सकता ह शिब पोत टीएमआईएलएल पर आरो्‍ य िकसी गलती / कारण के जलए 24 घंटो से अजधक के जलए कायगरत बथग म ें कागों प्रचालन कायग नहक कर रहा हो। ऐसे मामलों में, एक पोत के पास एक स े अजधक एलएलडी हो सकती ह श। (ii) जन:िुल् क समय की गणना के प्रयोिन के जलए, सीमा िुल् क अजधसूजचत िदव कस र केीपीटी/ टीएमआईएलएल के अथव का उसके भाग की दर से व कसलू िकया िाएगा । 10.5 िोजखमपूणग-1 का जनयागत कागौ केव कल प्रत्‍ यषा नौभरण के जलए प्रा्‍ त होगा । यिद ऐसा कागों प्राजि की तारीख को नौभररत नहक िकया िाता ह शतो प्राजि की तारीख के अगले िदन से नौभरण की तारीख तक अथव का पत्‍ त्‍ न पररसर से हटाने तक 227.16 रू. प्रजत टन प्रजत िदन अथव का उसका भाग की दर से व कसूल िकया िाएगा । 10.6 िूटआउट / स्ट् टजक कागो, िोजखमपूण-ग 1 कागौ से इतर, पर कागो की प्राजि की तारीख से नौभररत नहक िकए िाने पर पत्‍ त्‍ न पररसर से कागो को हटाने की तारीख तक 13.36 रू. प्रजत टन प्रजत िदन अथव का उसका भाग की दर से व कसूल िकया िाएगा । यिद िूटआऊट कागो िकसी अनुव कती पोत नौभररत िकया िाता ह श तो खंड 10.4 का उपबंध लाग ूहोगा । 10.7 ऐसे कागो / घटक पर िोिक न तो आयात न ही जनयागत र न ही नौभरण के जलए प्रा्‍ त हाे ता ह श जव कलंब िुल् क कागो प्राजि की तारीख से कागो को पत्‍ त्‍ न पररसर के हटाने की तारीख तक 53.46 रू. प्रजत टन अथव का उसका भाग की दर से व कसूल िकया िाएगा । 10.8 नीलामी अथव का जनजव कदा अथव का जनिी करार अथव का कसी अन्य तरीके से खरीद े गए अजनकाजसत / सीमा िुल् क अजधहररत कागो पर जव कलब िुल् क सुपुदगग ी के जलए कागो उपल्‍ ध करव काए िाने की तारीख के पश् चात 10 िदन का जन:िुल् क समय स्ट्व कीकार िकए िाने के पश् चात खंड 9.2 अथव का 9.3 िो भी लागू हो, में जव कजनर्ददष् ट दरों पर प्रभायग होगा । 10.9 कागो पर जव कलंब िुल् क उस अव कजध के जलए प्रोदभूत नहक होगा जिसके दौरान टीएमआईएलएल अपने पर आरो्‍ य कारणों से कागो सुपुदगग ी की जस्ट्थजत म ेंनहक होता ह,शिब उपयो्‍त ा द्वारा अनुरोध िकया िाता ह श। 11. चल हाबरग िेन प्रभार तथा आन बोड गप-े लोडर / फाकगजलटट: ि.स.ं जव कव करण दर प्रजत मी0ट0 (रू. म)ें 11.(क) आन-बोडग उपस्ट्कर प्रचालन (परू े पासगल आकार पर लागू) सभी िुष्क 2020 No. TAMP/53/2019-TMILL.—In exercise of the powers conferred under Section 48 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby notifies the revised Scale of Rates disposing of the proposal received from TM International Logistics Limited (TMILL) for General revision of its Scale of Rates (SOR) under Tariff Guidelines, 2019, as in the Order appended hereto. Tariff Authority for Major Ports Case No. TAMP/53/2019-TMILL TM International Logistics Limited - - - Applicant QUORUM (i). Shri. T.S. Balasubramanian, Member (Finance) (ii). Shri. Rajat Sachar, Member (Economic) O R D E R (Passed on this 1st day of June, 2020) This case relates to the proposal received from TM International Logistics Limited (TMILL), a BOT Operator at Kolkata Port Trust (KOPT), for general revision of its Scale of Rates. 2.1. The TMILL has filed a proposal vide its letter dated 01 October 2019 for general revision of its Scale of Rates. The said proposal was taken on consultation with the Licensor port viz., Kolkata Port Trust (KOPT) and concerned users/ user organisations at the TMILL. None of the users/ user organisations have furnished their comments. 2.2. The proposal of the TMILL was internally scrutinized in the office. The additional information/ clarifications were sought from the TMILL. The TMILL has responded to the additional information/ clarifications sought. A joint hearing in this case was held on 17 October 2019 at the KOPT premises in Kolkata. At the joint hearing, the TMILL and KOPT have made their submissions.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15 3. With reference to the totality of information collected during the processing of the case, this Authority has approved the revised Scale of Rates of TMILL. 4.1. The Speaking Order passed by this Authority is in the process of notification in the Gazette of India and it is likely to take some more time for notification. Therefore, this Authority desires that the revised Scale of Rates may come into force without waiting for notification of the Order. Accordingly, this Authority notifies the revised Scale of Rates of the TMILL immediately which is attached as Annex. The revised Scale of Rates will come into force after expiry of 30 days from the date of notification of this Order in the Gazette of India and shall be in force for a period of three years thereafter, subject to annual indexation, as discussed in para no. 5 below. 4.2. In the meanwhile, the validity of the existing SOR of TMILL is deemed to have been extended from 01 April 2020 till the revised SOR of TMILL comes into effect. 4.3. The Speaking Order passed by this Authority in respect of TMILL will be notified separately and communicated to the TMILL, KOPT and the relevant users/ user organisations in due course of time. 5. As per Clause 2.12 of the Tariff Guidelines, 2019, the SOR will be indexed annually to inflation to the extent of 60% of the variation in Wholesale Price Index (WPI) announced by the Government of India occurring between 1st January to 31st December of the relevant year. Such adjusted SOR is to come into force from 1st May of the relevant year to 30th April of the following year. It is relevant here to state that in the instant case indexation for the year 2019- 20 is already considered in the ARR and for drawing the SOR. Thus, the first annual indexation will be applicable from the date the revised SOR comes into effect. For the subsequent years, the annual indexed SOR will come into force from 1st May of the relevant year to 30th April of the following year. The indexed SOR shall be intimated by the TMILL to the KOPT, users and to this Authority. T.S. Short title of Commencement The Scale of Rates set out herein shall be called SCALE OF RATES of the T M International Logistics Limited (TMILL), Berth No. 13, Haldia Dock Complex of the Kolkata Port Trust. 2. Definition In this Scale of Rates, unless the context otherwise requires, the following definitions shall apply:— (i). ‗T M International Logistics Limited‘ shall mean the company registered under Companies Act, 2013 having its registered office at 43, Chowringhee Road, Kolkata – 71. (ii). TMILL premises shall mean the area licensed to TMILL including the backup area and any additional land allotted under the License agreement. (iii). ‗Day‘ shall mean the period starting from 6 am of a day and ending at 6 am on the following day. (iv). ‗Demurrage‘ shall mean charges payable for storage of cargo within TMILL premises beyond free period as specified in this Scale of Rates and shall not include the cargo stored at the area allotted to a port user on licence basis for storage of cargo. (v). ‗Hazardous I‘ shall mean the cargo categorized as Hazardous-I in the list of Hazardous Cargo adopted by the Board of Trustees of Kolkata Port Trust from time to time. (vi). ‗Month‘ shall mean 30 consecutive calendar days including holidays unless otherwise specified.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (vii). ‗On Board handling Charges‘ shall mean charges on Cargo/ Commodity/ Article/ Package/ Container for rendering on board services by the TMILL in the form of supply of manpower for ship loading/ unloading operation. (viii). ‗On-board supervision‘ shall mean certain services, both on-board and on-shore, rendered by TMILL during ship to shore/shore to ship transfer operation of cargo which are not included within the purview of On-board handling charges or loading / unloading charges or Miscellaneous charges and are ancillary in nature and some of which are needed for achieving better productivity / efficiency during vessel operation. (ix). ‗Over-side Discharge/ Shipment‘ shall mean the operation of unloading/ loading of cargo ex/into vessel without passing through the quay at the time of discharge/ shipment operation. (x). ‗Shut out‘ cargo shall mean export cargo left in the TMILL premises having not been shipped on board the vessel for which it was received for shipment in TMILL premises. (xi). 'Stock Cargo' shall mean cargo received at the Port for shipment without export documents. (xii). ‗TEU‘ shall mean Twenty Feet Equivalent Unit of container. (xiii). ‗Transhipment‘ shall mean transfer of cargo/ container from a sea going vessel/ barge to another sea going vessel/barge for destination to other Port/ Ports. (xiv). ‗Wharfage‘ shall mean the basic dues recoverable on all cargo/ container landed or shipped or transhipped within the TMILL premises. (xv) Shore Handling includes arranging and receiving the cargo to/from the hook point, intermodal transport from wharf to stackyard and vice-versa and also receiving and delivering of cargo from/to wagons/trucks. 3. General Principles of Assessment: (i). The minimum weight/ measurement chargeable shall be 1 tonne/1 CBM although the gross weight/measurement may be less than 1 tonne/1 CBM. In case where the charge is on weight basis and the gross weight is not an exact multiple of 100 Kgs, the same will be rounded off to the next higher multiple of 100 Kgs. Where the gross CBM includes decimals, the same should be rounded off to the next higher whole unit of CBM. (ii). Rates applicable for a period/ unit other than weight shall be applicable to the part of a period/ unit thereof. (iii). Unless otherwise specified, if TMILL equipment is booked for landing/ shipment of cargo/ container from/ into vessel or for any other purpose by the vessel, equipment hire charge as specified in Section 10.1 shall be levied. (iv). Cargo Related Charges shall be levied on the owners of the cargo or their Clearing and Forwarding Agents / Handling Agents except where specified otherwise, or in cases where Ship Owners/Steamer Agents agree to pay such charges. (v). Samples, Catalogues and other articles for which Shipping Companies charge no freight and on which no Customs duty is payable, diplomatic mail bags, crew baggage and all goods meant for TMILL's use at Berth no.12, HDC shall be exempted from payment of all cargo related charges. (vi). No demurrage shall be charged for the days during which delivery cannot be effected due to strike by the Kolkata Port Trust/ TMILL employees provided, the concerned Importer or his Authorized Agent files the complete delivery documents on payment of all charges prior to commencement of the strike.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 17 (vii). Interest on delayed payments / refunds: (a). The user shall pay penal interest on delayed payments under this Scale of Rates. Likewise, the TMILL shall pay penal interest on delayed refunds. The rate of penal interest will be 15%. The penal interest rate will apply to both the TMILL and the port (b). users equally. The delay in refunds will be counted only 20 days from the date of completion of services or on (c). production of all the documents required from the users, whichever is later. The delay in payments by the users will be counted only 10 days after the date of raising the bills by the (d). TMILL. This provision shall, however, not apply to the cases where payment is to be made before availing the services / use of TMILL Terminal facilities as stipulated in the Major Port Trust Act and / or where payment of charges in advance is prescribed as a condition in this Scale of Rates. (viii). Before classifying any cargo under ―unspecified category‖ or otherwise, if required, to know the nature of cargo for levy of cargo handling charges, the relevant Customs classification shall be referred to in order to find out whether the cargo can be classified under any of the specified categories mentioned in the schedules. (ix). Users will not be required to pay charges for delays, beyond a reasonable level, attributable to TMILL. (x). (a). Whenever a specific tariff for a new service/ cargo/ equipment/ facility is not available in the SOR of TMILL, the TMILL can approach TAMP for notification of tariff for the said new cargo/ equipment/ service adopting the tariff if any fixed for comparable cargo/ equipment/ service in any Major Port Trust or BOT operator governed under Tariff Guidelines, 2019. If there is no rate available in any Major Port Trust or BOT operator governed under Tariff Guidelines, 2019, or if the rate available is not representative enough of the proposed new cargo/ service/ equipment/ facility, then the TMILL may file the proposal for notification of tariff for the said new cargo/equipment/service/ facility with reference to optimal capacity assessed following the principles of 2008 guidelines or based on rated capacity or technical specification of service/facility/equipment. If determination of tariff based on the above prescribed options is not available, then the TMILL after giving sufficient reasons may propose rates based on cost plus 16% return formula. (b). Proposal for notification of rate for use of a new facility or a new service shall be forwarded to TAMP at least 60 days prior to the expected date of commissioning of the new cargo/ facility or a new service. For determination of tariff for new cargo/new service, TAMP will follow normal consultation process as prescribed. In case of prescription of tariff for new miscellaneous services, the BOT operator shall submit a proposal not later than 15 days from the date of introducing the services. (c). Simultaneously with the submission of proposal, the proposed rate can be levied on an ad hoc basis till the rate is finally notified. (d). The ad hoc rate to be operated in the interim period must be based on the approach outlined in clause 5.6.1 of Tariff Guidelines, 2019. (e). The final rate fixed by the TAMP for new cargo/service for which rate is not prescribed in the SOR will ordinarily be effective only prospectively. The interim rate adopted in an ad hoc manner will be recognised as such unless it is found to be excessive requiring some moderation retrospectively. (xi). The rates prescribed in this Scale of Rates are ceiling level; like-wise the rebates and discounts are floor levels. The TMILL may, if it so desires, change lower rates and/ or allow higher rebates and discounts. (xii). The TMILL does not handle the following cargoes at Berth no. 12: (a). Thermal Coal in bulk. (b). Coking Coal in bulk. (c). Various types of coke and other black cargo in bulk. (d). Various types of liquid bulk cargo handled through pipelines. (xiii). The rate prescribed for handling of containers is applicable for 20 ft. container. For container above 20 ft. and up to 40 ft. the rate would be 150% of the prescribed rate. For containers exceeding 40 ft. the rate would be 200% of the prescribed rate.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (xiv). In case of coastal cargo/ containers, other than thermal coal, iron ore and iron ore pellets, 60% of the prescribed rates shall be applicable. (xv). The SOR approved by the Authority is subject to automatic annual indexation at 60% of the WPI to be announced by the Authority. The annual indexation will be from 01 May 2020. The indexed SOR shall be intimated by the TMILL to the KOPT, users and to the Authority. 4. Wharfage Charges: 4.1 Wharfage on Foreign cargo shall be levied at the rates as mentioned in the table below: Rate per MT SL. No additional wharfage shall be levied on shutout cargo if the same is subsequently shipped without being removed from port premises. 5. Demurrage: 10.1 Demurrage shall be levied on Import cargo (other than containerised cargo) after allowing a demurrage-free period as specified below: - Sl. No. Description Demurrage-free period 1. However, TMILL may declare any other date as such LLD for cargo already discharged from the vessel when the vessel is not doing cargo operation work in working berth for more than 24 hours for any fault/ reason not attributable to TMILL. In such cases, a vessel may have more than one LLD. ii) For the purpose of calculation of free time, Customs notified holidays and the KoPT/ TMILL‘s non- operational days shall be excluded. Sundays shall not be excluded for the purpose of calculation of free time unless Customs notified holidays and the KOPT/ TMILL‘s non-operational days fall on Sundays. After demurrage charge begins to accrue no allowance is made for Customs notified holidays or KOPT/ TMILL‘s non-operational days. 10.2 Demurrage on Import cargo (except log, timber, veneer) shall be levied after the expiry of demurrage free period at the following rates: - Rate in `. per tonne per day or part thereof. In case such cargo is not shipped on the date of receipt, demurrage shall be levied at rate of `. 227.16 per tonne per day or part thereof from the day following the date of receipt upt o the date of shipment or removal from port premises. 10.6 Demurrage shall be levied on shutout/stock cargo, other than Hazardous I cargo, @ `. 13.36 per tonne per day or part thereof from the date of receipt of cargo upto the date of removal of cargo from the port premises without being shipped. If shutout cargo is shipped by any subsequent vessel provision of clause 10.4 shall apply.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 10.7 On cargo/commodity which is received neither as import nor as export nor as stock for shipment, demurrage shall be levied @ `. 53.46 per tonne per day or part thereof from the date of receipt upto the date of removal of the cargo from the port premises. 10.8 On uncleared /Customs confiscated cargo sold by auction or tender or private agreement or in any other manner demurrage shall be levied at the rates specified at clause 9.2 or 9.3, as the case may be, after allowing free time of 10 days after the date the cargo is made available for delivery. 10.9 The demurrage on cargo shall not accrue for the period during which the TMILL is not in a position to deliver cargo for reasons attributable to the TMILL when requested by the user. 11. The following conditions shall be followed in such cases: (i). The period of license shall not exceed (11) eleven months. (ii). The space allotted shall not be sub-let/ assigned/ transferred/ shared by the allottees. (iii). Encroachment or unauthorized occupation of land and Railway Tracks etc. by the licensee will involve a liability to pay a penalty at the rate of ten times the scheduled license fee in addition to the cost of rectification of damages caused to the TMILL‘s properties. If the licensee fails to remove the cargo from the encroached area in spite of notice to do so, the cargo will be removed elsewhere[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 23 within TMILL‘s allotted area by TMILL at the risk and cost of the licensee and penal license fee at the rate of ten times the normal rate will be levied on the space occupied by the cargo so removed. (iv). Cargo stored under a license shall be at the entire risk and responsibility of the licensee. The licensee shall post his own watchman to safeguard the cargo stored at the allotted space and to prevent any unauthorized occupation of such space by others. (v). The licensee shall not construct or put up any building, erection or convenience on space occupied under license. (vi). In case the licensee fails to hand over the space in vacant possession on the date of expiry of the license, TMILL shall levy normal demurrage charges as per TMILL‘s Scale of Rates as applicable from time to time for the period the cargo remains in TMILL‘s premises beyond the period for which the license was granted. (vii). The licensee shall agree to comply with all rules and directions issued by TMILL from time to time. If the licensee neglects to comply with such rules or directions, TMILL may terminate the license. (viii). The license is terminable on 15 days‘ notice on either side. No claim for any compensation whatsoever for revocation of the license will be entertained. (ix). The licensee shall agree that all payments and expenses of whatever sort due to TMILL in respect of the license be recovered at the rates prescribed on TMILL‘s Scale of Rates from time to time. (x). The licensee shall comply with all instructions, rules or regulations that may from time to time be issued by KOPT, Municipal Authority, the Chief Controller of Explosives, Government of India or whosoever concerned in relation to storage of cargo. (xi). The license fee will be charged from the date of handing over possession of the land on the actual area to be found on demarcation. (xii). When the storage area is allotted on license basis for storage of import / export cargo, demurrage on cargo stored in the licensed premises shall not be levied again. (xiii). The licensee shall be required to utilize the allotted land for the purpose for which it is licensed. No change in purpose of utilization will be allowed without specific written permission from TMILL. (xiv). The licensee will not cause any damage to TMILL‘s properties. If, however, any damage is caused, the licensee shall be liable to make good the damages at his own cost and arrangement to the satisfaction of TMILL. (xv). The licensee shall have to make his own arrangements to keep the allotted land and its surroundings neat, clean and in proper sanitary condition. (xvi). After the expiry of the licences of the yard/shed, or termination or determination or forfeiture of licence, if the licensee continues to occupy it unauthorisedly, the licensee shall be liable to pay compensation for wrongful use and occupation at the following rates till vacant possession is obtained: - First 30 days 3 times the rate as per prevailing SOR Next 30 days 5 times the rate as per prevailing SOR Continued unauthorized occupation beyond 60 days 10 times the rate as per prevailing SOR 14. Rebates/ Refunds: (a). In case a vessel idles at berth no. 12 due to non-availability or breakdown of the port equipment or power failure at TMILL or for any other reasons attributable to TMILL, rebate equivalent to the berth hire charges accrued during the idling period of vessel shall be levied. (b). If a vessel discharges more than 25000 MT of Limestone/ Fertiliser/ raw material for fertiliser in a single call at Berth no.12, a rebate of 10% shall be allowed on Wharfage charge on quantity exceeding 25000 MT.
