**1. Executive Summary:**
This report analyzes an amendment to the Mumbai Port Trust's (MBPT) Scale of Rates (SOR) regarding charges for the usage of a floating pontoon at Jetty No. 5, Gateway of India. The amendment, detailed in Gazette Notification No. 28 dated January 15, 2021, modifies the duration for the half-season pass for pontoon usage. This report outlines the specifics of the amendment, its likely rationale, affected stakeholders, and expected impact. The amendment aims to clarify the period covered by the half-season pass, likely leading to reduced ambiguity and potential disputes regarding payment.
**2. Introduction:**
This report provides an informative overview of the amendment to the Mumbai Port Trust's (MBPT) Scale of Rates (SOR) concerning charges for floating pontoon usage at Jetty No. 5, Gateway of India. This analysis is based solely on the provided Gazette of India Extraordinary notification.
**3. Policy Overview:**
* **Amendment to:** Order No. TAMP222020MBPT dated 28 December 2020 relating to the proposal received from Mumbai Port Trust MBPT for fixation of rate for usage of floating pontoon at Jetty 5, Gateway of India, notified in the Gazette of India Extraordinary Part III Section 4 on 15 January 2021 vide Gazette No. 28.
* **Core Objective (Inferred):** The original policy aimed to establish a rate structure for the usage of the floating pontoon at Jetty No. 5. The amendment aims to clarify and refine the existing rate structure, specifically concerning the duration of the half-season pass.
**4. Background and Rationale:**
The amendment was prompted by a request from MBPT (Letter No.FAACC200 FR147 dated 14 January 2021) to modify the duration specifications for the half-yearly pass for the second season. The likely reason for the amendment is to remove ambiguity or perceived unfairness regarding the start and end dates of the half-season pass. This could stem from users interpreting the original policy differently, leading to disputes about payment for usage.
**5. Key Provisions / Changes:**
This section details the specific changes introduced by the amendment:
* **Specific Part of Original Policy Changed:** Section 9.8 (Charges for Floating Pontoon usage at Jetty No.5, Gateway of India) under Chapter IX Miscellaneous Charges in the existing Scale of Rates (SOR) of MBPT.
* **New Rule/Provision:** The description of the half-season pass (iii) is amended to read: "iii 5000 per person for half season pass 1st October to 15th Jan or 16th Jan to 15th May".
* **Difference/Effect of Change:** The original policy's description is not provided in the given text, but the current amendment specifies that the half season pass is valid from "1st October to 15th Jan or 16th Jan to 15th May." This clarifies that the half-season is divided into two distinct periods, from October 1st to January 15th, and from January 16th to May 15th. This provides specific dates, removing potential ambiguity.
**6. Target Audience and Stakeholders:**
Based on the text, the directly affected stakeholders are:
* Individuals and organizations that use the floating pontoon at Jetty No. 5, Gateway of India.
* Individuals purchasing half-season passes for pontoon usage.
* Mumbai Port Trust (MBPT) staff involved in administering and collecting fees for pontoon usage.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Mumbai Port Trust (MBPT) is responsible for implementing the amended Scale of Rates. The Tariff Authority for Major Ports (TAMP) approved the amendment.
* **Timelines/Procedures:** The amendment is effective from the date of notification in the Gazette of India Extraordinary Part III Section 4 (January 15, 2021). The MBPT is responsible for updating its systems and informing users about the change.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this specific amendment is to:
* Reduce ambiguity and potential disputes regarding the duration of the half-season pass.
* Provide clarity for users and the MBPT regarding the start and end dates of each half-season period.
* Ensure a fair and consistent application of the half-season pass fees.
The amendment is expected to have a positive impact by clarifying the terms of the half-season pass, potentially improving customer satisfaction and reducing administrative burden.
**9. Conclusion:**
The amendment to the MBPT's Scale of Rates for floating pontoon usage at Jetty No. 5 represents a refinement of the existing policy. By clarifying the duration of the half-season pass, the amendment aims to reduce ambiguity and ensure fairer implementation. This change is significant for users of the pontoon facility and contributes to the overall efficiency and transparency of MBPT's operations.
