No.TAMP/35/2016-Misc.This Authority had passed an Order No.TAMP/35/2016-Misc. dated 20 February
2020 relating to the uniform procedure for levy of penal berth hire charges/ incentive scheme under the Berthing
Policy for Dry Bulk Cargo for Major Ports, 2016 in line with Ministry of Shipping (MOS) letter
No.PD11033/73/2013-PT(Pt) dated 13 February 2020. This Order has been notified in the Gazette of India
Extraordinary (Part III Section 4) on 03 March 2020 vide Gazette No.90. Paragraphs 3.1 and 3.2 of the Order dated
20 February 2020 state that said Order is applicable to all Major Port Trusts [excluding Mormugao Port Trust
(MOPT), New Mangalore Port Trust (NMPT) and Kolkata Port Trust (KOPT)] in compliance with MOS letter dated
13 February 2020.
2.1. In this connection, the Visakhapatnam Port Trust (VPT) vide its email dated 19 August 2020 has
requested for the date of implementation of the said Order.
2.2. Normally, the notification takes effect only when it is published through recognized official
communication and from the date of publication of the notification, unless otherwise indicated. It is relevant to state
here that the Tariff Order relating to MOS letter dated 13 February 2020 as regards uniform procedure for levy of
penal berth hire charges/ incentive scheme under the Berthing Policy for Dry Bulk Cargo for Major Ports, 2016 was
notified by the Authority on 3 March 2020 vide Gazette No.90.
3.1. In view of the above, following para 3.2 is inserted in the said Order dated
20 February 2020 as regards effective date of implementation of the said Order for its uniform application:[भाग III—ख(cid:7003) ड 4] भारत का राजप(cid:7074) : असाधारण 3
3.2. This Order will come into effect from the date of notification of the Order in the Gazette of India i.e.
from 3 March 2020.”
3.2. The existing para 3.2 of the Order dated 20 February 2020 is renumbered as 3.3.
