L.-33004/99 सी.जी.-डी.एल.-अ.-03102023-249102 CG-DxLx-xEG-I0D3H1x0x2x0 23-249102 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4121] नई दिल्ली, मगं लवार, अक्त बू र 3, 2023/आजश्व न 11 , 1945 No. 4121] NEW DELHI, TUESDAY, OCTOBER 3, 2023/ASVINA 11, 1945 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 3 अक्त ूबर, 2023 का.आ. 4292(अ).—यत: निे नल जलब्रेिन फ्रंट ऑफ जत्रपुरा तथा उसके अनेक स्ट् कंधों (जिसे इसमें इसके पश् चात एनएलएफटी कहा गया ह)ै तथा ऑल जत्रपुरा टाइगर फोसस (जिसे इसमें इसके पश् चात एटीटीएफ कहा गया ह)ै का स्ट् पष्ट लक्ष्य , जत्रपुरा के अन् य सिस्ट् त्र अलगाववािी संगठनों के सहयोग से और सिस्ट् त्र संघर् स के माध् यम स े जत्रपुरा को भारत स े अलग करके एक अलग राष्र की स्ट् थापना करना तथा ऐसे अलगाव के जलए जत्रपरु ा के स्ट्थ ानीय लोगों को भड़काना ह;ै और यत : , केद्र सरकार का मत ह ैदक एनएलएफटी और एटीटीएफ, - (i) अपन े लक्ष्य ों को प्राप् त करन े के जलए जवद्रोही तथा हहसं क गजतजवजधयों में जलप्त रह े ह ैं और इस प्रकार य े सरकार के प्राजधकार को क्षजत पहचं ाते रह ेह ैंऔर लोगों में डर एवं आतंक फैलात े रह ेह;ैं (ii) पूवोत् तर के अन् य जवजधजवरूद्ध संगठनों का समथनस प्राप् त करन े के उद्देश् य से उनस े घजनष्ठ संबंध बनाए हए ह;ैं (iii) जपछले कुछ समय से अपन े उद्दश्े य एवं लक्ष्य की प्राजि के जलए, हहसं क तथा जवजधजवरूद्ध गजतजवजधयों में जलप् त रह ेह ैं िो दक भारत की सम्‍प प्रभुता तथा अखंडता के जलए हाजनकर ह;ैं (iv) नागररकों तथा पुजलस एवं सुरक्षा बलों के कार्मसकों की हत् या करते आए ह;ैं (v) जत्रपुरा में व् यवसाजययों एवं व् यापाररयों सजहत िनता से िबरन धन ऐंठन े में सलं ग् न रह ेंह;ैं और (vi) सुरजक्षत आश्रय, प्रजिक्षण, िस्ट् त्र एवं गोलाबारूि आदि की प्राजि के प्रयोिन के जलए 6226 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पड़ोसी िेिों म ेंजिजवर स्ट् थाजपत करना तथा उन् ह ेंरखने म ेंसंलग्न ह।ैं और यत:, केन् द्र सरकार का यह भी मत ह ै दक एनएलएफटी और एटीटीएफ की उपयुसक्त गजतजवजधयां भारत की संप्रभुता एव ं अखडं ता के प्रजतकूल ह ैंतथा ये जवजधजवरूद्ध संगम हैं; और यत:, केन् द्र सरकार का यह भी मत ह ै दक यदि एनएलएफटी और एटीटीएफ की जवजधजवरूद्ध गजतजवजधयों पर तत्क ाल प्रजतबधं एव ं जनयंत्रण न लगाया गया तो इन सगं ठनों को जनम्‍पन जलजखत कायों के करन े का अवसर जमल िाएगा; - (i) अलगाववािी, जवद्रोही एवं हहसं क गजतजवजधयों को बढावा िेन ेके जलए अपन ेकाडरों को संगरठत करना; (ii) भारत की संप्रभुता एवं राष्र ीय अखंडता के प्रजत वैमनस्ट् य भाव रखने वाली ताकतों के साथ जमलकर राष्र जवरोधी गजतजवजधयों का प्रचार करना; (iii) नागररकों की हत् याएं करने म ेंसंजलप् त रहना तथा पुजलस एवं सरु क्षा बलों के कार्मसकों को जनिाना बनाना; (iv) अंतरासष्र ीय सीमा पार से अवैध िस्ट् त्र एवं गोलाबारूि प्राप् त करना और लाना; और (v) अपनी अवैध गजतजवजधयों के जलए िनता स ेिबरन धन ऐंठना तथा बड़ी राजि इकठ्ठी करना। अत:, अब, जवजधजवरूद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) (जिसे इसम ें इसके बाि उक्त अजधजनयम कहा गया ह)ै की धारा 3 की उप-धारा (1) के तहत प्रित् त िजियों का प्रयोग करते हए, केन् द्र सरकार एतद्द्वारा नेिनल जलब्रेिन फ्रंट ऑफ जत्रपरु ा (एनएलएफटी) को, इसके सभी गुटों, स्ट् कंधों और अग्रणी संगठनों सजहत, तथा ऑल जत्रपरु ा टाइगर फोसस (एटीटीएफ) को, इसके सभी गुटों, स्ट् कंधों और अग्रणी सगं ठनों सजहत, जवजधजवरूद्ध संगम घोजर्त करती ह;ै उपयुसक् त पररजस्ट्थजतयों पर गौर करत े हए, केन् द्र सरकार की यह भी िढृ राय ह ै दक एनएलएफटी और एटीटीएफ को, इनके सभी गुटों, स्ट् कंधों तथा अग्रणी संगठनों के साथ, जवजधजवरूद्ध संगम घोजर्त करना आवश् यक ह ै और तिनुसार, उक्त अजधजनयम की धारा 3 की उप-धारा (3) के परन्त ुक द्वारा प्रित् त िजियों का प्रयोग करते हए, केन्द्र सरकार एतद्द्वारा यह जनिेि िेती ह ै दक यह अजधसूचना, उक्त अजधजनयम की धारा 4 के अंतगसत दकए िाने वाल े दकसी भी आिेि के अध् यधीन, दिनांक 3 अक् टूबर, 2023 से पांच वर् स के जलए प्रभावी होगी। [फा.सं. 11011/2/2023-एन ई -V] जपयूर् गोयल, अपर सजचव MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 3rd October, 2023 S.O. 4292(E).—Whereas the National Liberation Front of Tripura and the various wings thereof (hereinafter referred to as the NLFT) and All Tripura Tiger Force (hereinafter referred to as the ATTF) have, as their professed aim, establishment of an independent nation by secession of Tripura from India through armed struggle in alliance with other armed secessionist organisations of Tripura and to incite indigenous people of Tripura for such secession; And whereas, the Central Government is of the opinion that the NLFT and the ATTF have been, - (i) engaging in subversive and violent activities, thereby undermining the authority of the Government and spreading terror and violence among the people for achieving their objectives; (ii) maintaining close nexus with other unlawful associations of North East with the aim of mobilising their support; (iii) in pursuance of their aims and objectives in recent past, engaging in violent and unlawful activities which are prejudicial to the sovereignty and integrity of India; (iv) killing civilians and personnel belonging to the police and security forces; (v) engaged in extortion of funds from the public including businessmen and traders in Tripura; and (vi) establishing and maintaining camps in neighbouring countries for the purpose of safe sanctuary, training, procurement of arms and ammunitions, etc;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 And whereas, the Central Government is also of the opinion that the aforesaid activities of the NLFT and the ATTF are detrimental to the sovereignty and integrity of India and that they are unlawful associations; And whereas, the Central Government is also of the opinion that if there is no immediate curb and control of the NLFT and the ATTF they will take the opportunity to, - (i) mobilise their cadres for escalating their secessionist, subversive, and violent activities;¬ (ii) propagate anti-national activities in collusion with forces inimical to India’s sovereignty and national integrity; (iii) indulge in killings of civilians and targeting of the Police and Security Forces personnel; (iv) procure and induct illegal arms and ammunitions from across the international border; and (v) extort and collect huge funds from the public for their unlawful activities; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), (hereinafter referred to as the said Act) the Central Government hereby declares the National Liberation Front of Tripura (NLFT) along with all its factions, wings and front organisations and the All Tripura Tiger Force (ATTF) along with all its factions, wings and front organisations as unlawful associations; The Central Government, having regard to the above circumstances, is of the further opinion that it is necessary to declare the NLFT and the ATTF along with all their factions, wings and front organisations as unlawful associations and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, the Central Government hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect from 3rd October, 2023 for a period of five years.
