2. िवदिे शय(cid:15) का रिज(cid:20)(cid:21) ीकरण िनयम, 1992 म,0-
(i) िनयम 14 का लोप (cid:1)कया जाएगा ;
(ii) िनयम 18 का लोप (cid:1)कया जाएगा ;

New Delhi, the 18th March, 2016
G.S.R. 324(E).—Whereas, certain draft rules further to amend the Registration of Foreigners Rules,
1992, were published as required by section 3 of the Registration of Foreigners Act, 1939 (16 of 1939), vide
notification of the Government of India in the Ministry of Home Affairs number G.S.R. 27(E), dated the 14th
January, 2016, inviting objections and suggestions from all persons likely to be affected thereby before the
expiry of a period of fifteen days from the date of publication of the said notification;
And whereas, copies of the said Gazette notification were made available to the public on the
14th January, 2016;
And whereas, the suggestions on the said draft rules received from the public have been considered by
the Central Government;
Now, therefore, in exercise of the powers conferred by section 3 of the said Act, the Central
Government hereby makes the following rules further to amend the Registration of Foreigners Rules, 1992,
namely:—
1. (1) These rules may be called the Registration of Foreigners (Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Registration of Foreigners Rules, 1992.-
(i) rule 14 shall be omitted;
(ii) rule 18 shall be omitted;
(iii) Form C shall be omitted;
(iv) Form F shall be omitted;
(v) Form G shall be omitted.

1. (1) इस आदशे का सिं (cid:27)5त नाम िवदिे शय(cid:15) िवषयक (संशोधन) आदशे , 2016 ह ै।

2. िवदिे शय(cid:15) िवषयक आदेश, 1948 (िजसे इसम0 इसके पR चात् मूल आदशे कहा गया ह)ै म,0 पैरा 2 के पR चात ् िनD निलिखत

“2क. िवदिे शय(cid:15) िवषयक अिधिनयम, 1946 क(cid:23) धारा 7 के ’योजन के िलए िविहत ’ािधकारी,- िवदिे शय(cid:15) िवषयक
अिधिनयम, 1946 क(cid:23) धारा 7 के ’योजन के िलए िविहत ’ािधकारी रिज(cid:20) (cid:21)ीकरण अिधकारी होगा ।”।
3. मलू आदशे म,0 परै ा 14 के पRच ात ्िनDन िलिखत परै ा अतं :(cid:20)थ ािपत (cid:1)कया जाएगा, अथा(cid:9)त:्—

(3) इस परै ा के उपबंध उन 8य ि2त य(cid:15) को या उनके संबंध म0 लागू नह> ह(cid:15)गे जो नागPरकता अिधिनयम, 1955 के
अधीन भारत के िवदशे ी काड (cid:9)धारक नागPरक के (प म 0रिज(cid:20) (cid:21)ीकृत ह ^।
16. होटल दखे भालकता (cid:9)को या उसके .ारा क(cid:23) जाने वाली Pरपोट(cid:9):-
(1) होटल का ’Bय ेक दखे भालकता (cid:9) आगंतकु स े यह अपे(cid:27)ा करेगा (cid:1)क वह ’(प ख म0 इस ’योजन के िलए रख े गए रिज(cid:20) टर म 0
होटल म0 उसके आगमन पर उसका नाम और रा_(cid:21) ीयता अिभिलिखत करने के िलए आवR यक िविशि_ टया ं’(cid:20) तुत करे और उसम 0
ह(cid:20)त ा(cid:27)र करे और य(cid:1)द ऐसा आगंतुक िवदशे ी 8य ि2 त ह ैतो उससे,-
(क) होटल म 0उसके आगमन पर उ2त रिज(cid:20)ट र क(cid:23) मद 4 से मद 11 म0 िविन‘द_ ट अ? य िविशि_ट यां ’(cid:20) तुत करन;े और

रिज(cid:20)ट र म 0 अपना नाम और रा_(cid:21) ीयता अिभिलिखत करने के िलए आवR यक िविशि_ टयां ’(cid:20) तुत करेगा और उसम 0 ह(cid:20)त ा(cid:27)र

क(cid:23) जाएगी या अ?य था भारतीय भाषा म 0अिभिलिखत क(cid:23) जाएगी ।
(5) य(cid:1)द आगंतकु अंaेजी भाषा को नह> समझता ह ैतो होटल के दखे भालकता (cid:9) का यह कत(cid:9)8 य होगा (cid:1)क वह ऐसा अनुरोध (cid:1)कए
जान ेपर इस आदशे क(cid:23) अपे(cid:27)ाY को आगंतकु को (cid:20) प_ ट करे ।
(6) होटल का दखे भालकता(cid:9) िवदशे ी 8य ि2त के आगमन के पR चात् यथासंभव शीb cकतु चौबीस घंटे से अनिधक रिज(cid:20) (cid:21)ीकरण

(7) इस परै ा के ’योजन के िलए,-
(क) “होटल” के अंतग(cid:9)त कोई बोfडग हाऊस, 2 लब, डाक बंh ला, िवiामगृह, हो(cid:20) टल, पेइंग गे(cid:20) ट हाऊस, सराय, (cid:1)कराय े
पर िलया गया आवास, अ(cid:20)प ताल या अ? य वसै ी ही ’कृित के अ?य पPरसर, ससु िjज त या असुसिj जत, जहा ंआवास
या शयन आवासन परु (cid:20)क ार के िलए उपल< ध कराया जाता ह ै;
(ख) “होटल के दखे भालकता”(cid:9) से ऐसा 8य ि2 त अिभ’ते ह ैिजसके पास होटल का ’बधं न ह ैऔर इसके अंतग(cid:9)त उसके .ारा
’ािधकृत कोई ऐसा 8य ि2त भी है जो इस पैरा के अधीन होटल के दखे भालकता (cid:9) के कत(cid:9)8 य(cid:15) का पालन करने के िलए
स(cid:27)म हो ;
(ग) “ह(cid:20)त ा(cid:27)र” के अंतग(cid:9)त, ऐसे आगंतुक जो िलखने म0 असमथ(cid:9) ह ै के संबंध म,0 अंगूठा िनशान का िच? k लगाना या अ? य
िच?ह िजसके .ारा वह (cid:1)कसी द(cid:20)त ावेज को अ?य ून ’मािणत करन ेके िलए अ[ य(cid:20) त ह ै;और
(घ) “आगंतकु ” से ऐसा 8य ि2त अिभ’ते ह ैिजसके िलए होटल म 0आवास उपल< ध कराया जाता ह ै।
(8) ’(प ग ऑनलाइन उपल<ध होगा और रिज(cid:20) (cid:21)ीकरण अिधकारी को उसके .ारा िनदशे दी गई रीित म 0 इले2 (cid:21)ािनक (प स े
’(cid:20)त ुत (cid:1)कया जाएगा ।

ORDER
New Delhi, the 18th March, 2016
G.S.R. 325(E).—In exercise of the powers conferred by section 3 read with section 7 of the
Foreigners Act, 1946 (31 of 1946), the Central Government hereby makes the following order further to
amend the Foreigners Order, 1948, namely:—
1. (1) This Order may be called the Foreigners (Amendment) Order, 2016.
(2) This Order shall come into force on the date of its publication in the Official Gazette.
2. In the Foreigners Order, 1948 (hereinafter referred to as the principal order), after paragraph 2, the
following paragraph shall be inserted, namely:-
“2A. Authority prescribed for the purpose of section 7 of the Foreigners Act, 1946.- For the
purpose of section 7 of the Foreigners Act,1946, the prescribed authority shall be the Registration
Officer. ” .
3. In the principal order, after paragraph 14, the following paragraphs shall be inserted, namely:-
“15. Report to be made by Universities and Educational Institutions.- (1) Every University
and Educational Institution shall furnish to the Registration Officer, information in respect of foreign
students enrolled in the University or the Educational Institution in Form A within the period
mentioned therein.
(2) The Form A shall be available online and may be submitted electronically to the Registration
Officer in the manner directed by him.
(3) The provisions in this paragraph shall not apply to, or in relation to, the persons registered as
Overseas Citizen of India Cardholder under the Citizenship Act,1955.
16. Report to be made to and by hotel keepers.- (1) Every keeper of a hotel shall require
every visitor to the hotel to furnish the particulars necessary for recording, and sign, on his arrival at
the hotel, his name and nationality in a register maintained for the purpose in Form B and, if such
visitor is a foreigner shall further require him -
(a) on his arrival at the hotel to furnish the other particulars specified in Items 4
to 11 of the said register; and
(b) at the time of his departure from the hotel to furnish the particulars necessary
for recording in the said register, the date and time of his departure and the
address to which he is proceeding.
(2) The register referred to in sub-paragraph (1) shall at all time be made available for
inspection, on the demand of any Registration Officer, magistrate or police officer not below

(3) Every visitor to any hotel shall, on being required to do so by the keeper of the hotel,
furnish the particulars necessary for recording, and sign, his name and nationality, in the
register referred to in sub-paragraph (1), and if such visitor is a foreigner, shall also,-
(a) on his arrival at the hotel furnish the other particulars specified in Items 4 to 11
of the said register; and
(b) at the time of his departure from the hotel, furnish the particulars necessary for
recording, in the said register, the date and time of his departure and the
address to which he is proceeding.
(4) Every particular, other than the signature of the keeper of a hotel or a visitor, which is
required by this order to be recorded in the said register, shall be recorded by the keeper of the
hotel in English language, if he is so able, or otherwise, in an Indian language.
(5) If a visitor does not understand English language, it shall be the duty of the keeper of the
hotel, if so requested to explain to the visitor the requirements of this order.
(6) The keeper of the hotel shall, as soon as may be but not more than twenty-four hours,
after the arrival of a foreigner, transmit a copy of Form C, duly completed from the
particulars furnished by the foreigner, to the Registration Officer.
(7) For the purpose of this paragraph,-
(a) “hotel” includes any boarding-house, club, dak-banglow, rest house, hostel,
paying guest house, sarai, rented accommodation, hospital, or other premises of
like nature, furnished or unfurnished, where lodging or sleeping accommodation
is provided for reward;
(b) “keeper of a hotel” means the person having the management of a hotel and
includes any person authorised by him, and competent to perform the duties of
the keeper of the hotel under this paragraph;
(c) “sign” includes, in respect of a visitor who is unable to write, the marking of a
thumb impression or other mark by means of which he is accustomed to attest a
document; and
(d) “visitor” means a person for whom accommodation is provided at the hotel.
(8) The Form C shall be available online and may be submitted electronically to the
Registration Officer in the manner directed by him.
(9) The provisions in this paragraph shall not apply to, or in relation to, the persons registered
as Overseas Citizen of India Cardholder under the Citizenship Act,1955.
