Whereas, in exercise of the powers conferred by sub-section (1) of Section 11 of the National Investigation Agency Act, 2008 (34 of 2008) (hereinafter referred to as the said Act), the Central Govt., had, vide notification number S.O. 2158(E) dated the 1st September, 2010.
This notification, S.O. 2349(E), issued by the Ministry of Home Affairs, Internal Security-I Division, dated August 27, 2015, pertains to the appointment of a judge to a Special Court under the National Investigation Agency (NIA) Act, 2008. Specifically, it appoints Sri Manoj Kumar Sinha, Additional District and Sessions Judge, Patna City, as the Judge to preside over the Special Court established for the State of Bihar. This appointment is made in exercise of the powers conferred by subsection 3 of section 11 of the NIA Act, 2008, and is based on the recommendation of the Chief Justice of the High Court of Judicature at Patna. This notification also supersedes notification number S.O. 2996(E), dated the 3rd October, 2013, which appointed Sri Anil Kumar Singh as the Judge to preside over the said Special Court, except for actions taken prior to this supersession. The original notification establishing the Special Court was S.O. 2158(E), dated September 1, 2010, designating the Court of the Additional District and Sessions Judge-I, Patna, as the Special Court for NIA cases in Bihar. NOTIFICATION
New Delhi, the 27th August, 2015
S.O. 2349(E).—Whereas, in exercise of the powers conferred by sub-section (1) of Section 11 of the
National Investigation Agency Act, 2008 (34 of 2008) (hereinafter referred to as the said Act), the Central
Government had, vide notification number S.O. 2158(E) dated the 1st September, 2010, published in the
Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 1st September, 2010, notified
the Court of the Additional District and Sessions Judge-I, Patna as the Special Court for the purposes of
sub-section (1) of Section 11 of the said Act having Jurisdiction throughout the State of Bihar for the trial of
scheduled offences;
And whereas, Sri Anil Kumar Singh, I Additional District and Sessions Judge, Patna who was
appointed as the Judge to preside over the said Special Court vide notification number S.O. 2996(E), dated
3rd October, 2013 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated
the 3rd October, 2013, has been transferred;
Now, therefore, in exercise of the powers conferred by sub-section (3) of section 11 of the said Act
and in supersession of the notification number S.O. 2996(E), dated the 3rd October, 2013, except as regards
to things done or omitted to be done before such supersession, the Central Government, on the
recommendation of the Hon’ble Chief Justice of the High Court of Judicature at Patna, hereby appoints
Sri Manoj Kumar Sinha, Additional District and Sessions Judge, Patna City as the Judge to preside over the
said Special Court.
