और ईि राजपत्र ऄजधसूचना की प्रजतयां जनसाधारण को 21 ऄक्टूबर, 2020 को ईपलब्ध करा दी गइ थी ; और ईि प्रारूप जनयमो की बाित जनसाधारण से कोइ अक्षेप और सुझाि प्राप्त नहीं हुए ह ैं; ऄतः, ऄब केंद्रीय सरकार, राष्ट्रीय न्यायालजयक जिज्ञान जिश् िजि्ालय ऄजधजनयम, 2020 (2020 का 32) की धारा 47 द्वारा प्रदत्त िजियों का प्रयोग करते हुए जन्नलजलजखत जनयम बनाती ह,, ऄथावत - 1. संजक्षप् त नाम तथा अरंभ – (1) आन जनयमों का संजक्षप् त नाम राष्ट्रीय न्यायालजयक जिज्ञान जिश् िजि्ालय जनयम, 2020 ह , । 6424 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) ये राजपत्र म ेंआनके प्रकािन की तारीख से प्रिृत्त होंगे। 2. पररभाषाएं – (1) आन जनयमों में, जब तक दक सन्दभ वसे ऄन्यथा ऄपेजक्षत न हो, - क) “ऄजधजनयम” से राष्ट्रीय न्यायालजयक जिज्ञान जिश् िजि्ालय ऄजधजनयम, 2020 (2020 का 32) ऄजभप्रेत ह;, ख) “िासी बोडव” से आस ऄजधजनयम की धारा 15 की ईप-धारा (1) में यथा ईपबंजधत िासी बोडव ऄजभप्रेत ह;, ग) ‘’केन्द्रीय सरकार“ से गृह मंत्रालय ऄजभप्रेत ह;, घ) “ऄध् यक्ष” से िासी बोडव का ऄध्य क्ष ऄजभप्रेत ह।, ड.) ‘’सदस्ट् य” से आस ऄजधजनयम की धारा 15 की ईप-धारा (1) में यथा ईपबंजधत िासी बोडव के सदस्ट् य ऄजभप्रेत ह,ैं और आसके ऄतं गतव पदेन और गर, -पदेन सदस्ट् य भी ह ैं । च) “नामजनर्ददष्ट सदस्ट्य” स े आस ऄजधजनयम की धारा 15 की ईप-धारा (1) के खंड (छ) म ें यथा ईपबंजधत िासी बोडव के नामजनर्ददष्ट ग,र-पदेन सदस्ट् य ऄजभप्रेत ह ैं । छ) ‘’जिश् िजि्ालय’’ से आस ऄजधजनयम के ऄधीन स्ट् थाजपत राष्ट्रीय न्यायालजयक जिज्ञान जिश् िजि्ालय ऄजभप्रेत ह।, ज) ‘’कुलपजत’’ स े आस ऄजधजनयम की धारा 21 म ें यथा ईपबंजधत राष्ट्रीय न्यायालजयक जिज्ञान जिश् िजि्ालय का कुलपजत ऄजभप्रेत ह ,। (2) िब्द और पद, जो आसमें प्रयुक् त ह ैं और पररभाजषत नहीं ह , ककतु ऄजधजनयम में पररभाजषत ह,ैं का नामजनर्ददष्ट िही ऄथ वहोगा जो ईनका ऄजधजनयम में ह , । 3. िासी बोडव के नामजनर्ददष्ट सदस्ट्य ों की जनयुजि के जलए जनबंधन और ितें – (1) आस ऄजधजनयम की धारा 15 की ईप-धारा (1) के खंड (छ) के ऄधीन नामजनर्ददष्ट सदस्ट् यों के चयन के प्रयोजन के जलए, कुलपजत प्रजतजठितत ्‍ यजियों का एक प,नल केंद्रीय सरकार को भेजगें ,े जो प्रजत ररजि पांच ्‍ यजियों से कम का नहीं होगा, जो न्यायालजयक जिज्ञान, जिजध, प्रितवन, ऄपराध जिज्ञान, कंप्यूटर जिज्ञान, आंजीजनयररग, प्रौ्ोजगकी, प्रबंधन, न्यायालजयक जिज्ञान औषध और भेषजी के क्षेत्रों से चयजनत होंगे। कुलपजत द्वारा यह सूची युजियुि समय, जो साधारणतया ररजि की संभाजित तारीख से अठ सप् ताह से ऄजधक नहीं होगा, के भीतर भेजी जाएगी। (2) केंद्रीय सरकार, िासी बोडव के नामजनर्ददष्ट सदस्ट् य का चयन करते समय कुलपजत द्वारा भेज े गए प्रजतजठितत ्‍ यजियों के प,नल पर जिचार कर सकेगी परन्तु केंद्रीय सरकार, दकसी सदस्ट् य को िासी बोडव में नामजनर्ददष्ट सदस्ट् य के रूप में नामजनर्ददष्ट करने से पूिव रा्‍य सरकार (रों) स,े जजन्ह े िह ठीक समझे, परामिव करेगी। (3) कोइ नामजनर्ददष्ट सदस्ट् य ऄगली पदािजध के जलए पुनः नामजनदिे न के जलए पात्र होगा। 4. िासी बोडव का सदस्ट् य होने स े ऄनहतव ा – (1) सदस्ट् य के रूप में दकसी ्‍ यजि की जनयुजि से पूिव, ईसे यह घोषणा करनी होगी दक जिश् िजि्ालय के मामलों म ें ईसका दकसी भी प्रकार से जहतों का टकराि नहीं ह,, और यदद, ईसके कायवकाल के दौरान पश् चातित ऄिजध में दकसी भी समय आस प्रकार का कोइ भी जहतों का टकराि ईत् पन् न होता ह,, तो िह तत्क ाल पद से त् यागपत्र दे दगे ा/देगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र ऄसाधारण 3 परन्त ु , यदद जांच की सम्यक प्रदिया के पश् चात्, यह जसद्ध हो जाता ह , दक सदस्ट् य के जहतों का टकराि ह , और िासी बोडव आस जनष्कषव पर पहुचं ता ह , दक ईि जहत का टकराि जिश् िजि्ालय के जहतों को प्रजतकूल रूप से प्रभाजित कर रहा ह,, तो िासी बोडव यह जिजनश् चय कर सकेगा दक ईक्त सदस्ट् य, िासी बोडव की कायविाजहयों में भाग नहीं लगे ा। (2) यदद कोइ प्रि न् ईठता ह , दक क्य ा कोइ ्‍ यजि ईपजनयम (1) में ईजल्लजखत दकसी भी ऄनहतव ा के ऄध् यधीन ह , तो, यह मामला केंद्रीय सरकार को जनर्ददष्ट दकया जाएगा, जजसका जिजनश् चय ऄंजतम होगा । 5. िासी बोडव के सदस्ट् य का हटाया जाना – (1) िासी बोडव का कोइ सदस्ट् य ईसका सदस्ट् य नहीं रहगे ा यदद िह – (i) ऄपनी सदस्ट् यता से त्य ागपत्र द ेदेता/देती ह;, ऄथिा (ii) जिकृत जचत्त हो जाता/जाती ह;, ऄथिा (iii) ददिाजलया हो जाता/जाती ह,, ऄथिा (iv) न,जतक ऄधमता ऄन्तर्विष्ट करन े िाल े दकसी दांजडक ऄपराध में जसद्धदोष हो जाता/जाती ह;, ऄथिा (v) जिश् िजि्ालय में पूणवकाजलक पद स्ट् िीकार करता/करती ह;, ऄथिा (vi) ऄध् यक्ष की ऄनुमजत के जबना िासी बोडव की तीन ब,ठकों म ें लगातार ऄनुपजस्ट्थत रहता/रहती हो; ऄथिा (vii) िासी बोडव द्वारा जनयम 4 के जनबंधनो के ऄनुसार, जनरर्वहत दकया गया हो परन्त,ु कोइ भी सदस्ट्य पद स े तब तक नहीं हटाया जाएगा/जाएगी जब तक दक ईसे मामल े में सुनिाइ का ईजचत ऄिसर नहीं ददया गया ह।, (2) नामजनर्ददष्ट सदस्ट् य के मामले म,ें हटाने का अदेि, केंद्रीय सरकार द्वारा जारी दकया जायेगा। 6. िासी बोडव की ब,ठक – (1) िासी बोडव की ब,ठक अिश् यकता के ऄनुसार, ककतु एक क,लडें र िष व के दौरान कम स े कम दो बार की जाएगी । (2) सामान् यत िासी बोड व की ब,ठकें ऄध् यक्ष द्वारा या तो स्ट्ियं के प्रस्ट्त ाि पर या जिश् िजि्ालय मु्‍य ालय के पररसर जनदेिक के ऄनरु ोध पर या िासी बोडव के कम स ेकम तीन सदस्ट् यों द्वारा हस्ट्त ाक्षररत ऄध्यपेक्षा पर अयोजजत की जाएंगी। (3) ्‍ यजिगत रूप से ऄथिा जिजडयो कां्ेंस, ऄथिा टेजलकां्ेंस के माध् यम से सजम्मजलत कम से कम छह सदस्ट्यों की ईपजस्ट्थजत ब,ठक के जलए गणपूर्वत होगी । परन्त,ु यदद गणपूर्वत की कमी के कारण ब,ठक स्ट्थजगत की जाती ह ,तो ऄध्यक्ष द्वारा यथाऄिधाररत ऄन् य समय और स्ट्थान पर, ईसी तारीख या दकसी ऄन्य तारीख पर अयोजजत की जाएगी ; और यदद ऐसी बठ, क में, ब,ठक अयोजजत दकए जाने के जनयत समय के अध े घटं े के भीतर गणपूर्वत ईपजस्ट्थत नहीं होता ह ,तो ईपजस्ट्थत सदस्ट्य गणपूर्वत परू ा करेंगे। (4) िासी बोडव की ब,ठकों म ें जिचार दकए सभी जिषयों पर ईपजस्ट्थत सदस्ट् यों के बहुमत द्वारा जनणवय दकया जाएगा । यदद बराबर मतजिभाजन होता ह , तो ऄध् यक्ष का मत जनणावयक मत होगा। (5) कायवपालक कुलसजचि द्वारा प्रत्य ेक सदस्ट् य को ब,ठक की तारीख से कम से कम दो सप् ताह पिू व ब,ठक का जलजखत नोरटस भेजा जाएगा। आस नोरटस में ब,ठक का स्ट् थान, तारीख और समय ईजल्लजखत होगा। यह नोरटस डाक, आलेक्र ॉजनक मेल ऄथिा फ,क्स के माध् यम से प्रत् येक सदस्ट् य के जिश् िजि्ालय में ऄजभजलजखत दकए गए पते पर भेजा जाएगा, और यदद आसे आस प्रकार भेजा गया हो तो आसे पररदत्त दकया गया समझा जाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (6) ईपजनयम (5) में ऄन्तर्विष्ट दकसी बात के होते हुए भी, ऄध् यक्ष ऄत्य ािश् यक मामलों पर जिचार करने हते ु ऄल्प सूचना पर िासी बोडव की ब,ठक बुला सकेगा । (7) कायवपालक कुलसजचि द्वारा ब,ठक से कम से कम दस ददन पूिव सभी सदस्ट् यों को ब,ठक की कायवसूची भेजी जाएगी। (8) कायसव ूची में दकसी भी मद को सजम्मजलत दकए जान े के संबंध में नोरटस कायवपालक कुलसजचि तक को ब,ठक स े कम से कम दस ददन पूिव पहुचं जाना चाजहए। ऄध् यक्ष ऐसी दकसी भी मद, जजसके जलए समुजचत नोरटस प्राप् त न हुअ हो, को सजम्मजलत करन े की ऄनुमजत द ेसकेगा । (9) ब,ठक की प्रदिया से संबंजधत सभी मामलों के संबंध म ेंऄध् यक्ष का जनणवय ऄंजतम होगा। (10) िासी बोडव की ब,ठक की कायविाजहयों के कायविृत कायवपालक कुलसजचि द्वारा त,यार दकए जाएंगे और जििेषत सात कायव ददिस ऄिजध के भीतर िासी बोडव के सभी सदस्ट्यों को पररचाजलत दकए जाएगं ,े ईनकी रटप्पजणयां मांगी जाएंगी और यदद कायविृत जारी होने की तारीख से दस ददन के भीतर कोइ रटप्पणी प्राप्त नहीं होती ह , तो ईन् हें ऄंजतम माना जाएगा। यदद दकसी सदस्ट्य द्वारा पररितवन का सुझाि ददया जाता ह,, तो ईस े पांच कायव ददिसों के भीतर, डाक स े या आलेक्रॉजनक रूप स,े जारी करन े की तारीख से दस ददन के भीतर पुजष्ट के जलए िासी बोड व के सदस्ट्यों को पररचाजलत दकया जाएगा। ऄध्यक्ष, ईस पर दकसी भी रटप्पणी पर जिचार करन े के पश् चात,् कायविृत की पुजष्ट और ईस पर हस्ट्ताक्षर कर सकेगा। हस्ट्ताक्षररत कायविृत को िासी बोडव का संकल्प माना जाएगा। 7. िासी बोडव के सदस्ट् यों को देय यात्रा और ऄन् य भत्ते – (1) िासी बोडव के सदस्ट् य, व्यय जिभाग, जित्त मंत्रालय, भारत सरकार द्वारा गर, -कार्वमकों के जलए जिजनर्ददष्ट समय-समय पर यथा संिोजधत यात्रा भत्ता या द,जनक भत्ता की दरों पर, यात्रा भत्ते और द,जनक भत्ते के हकदार होंगे। (2) दकसी सदस्ट् य द्वारा िासी बोड व की ब,ठक में ईपजस्ट्थत होन े से संबंजधत यात्रा भत्तों और द,जनक भत्तों की लागत जिश् िजि्ालय द्वारा िहन की जाएगी। (3) िासी बोडव के ऐसे सदस्ट् य जो सरकारी कमवचारी ह,ैं िे यात्रा भत्ता और द,जनक भत्ता, ईनके जलए ऄनुमत दरों पर ईस स्रोत से प्राप् त करेंगे जहा ं से िे ऄपना िेतन प्राप् त करत े ह।ैं तथाजप, यदद सदस्ट् यों द्वारा ऄपजे क्षत हो और िे यह घोषणा करते ह ैं दक ि े यात्रा भत्ता एिम द,जनक भत्ता का दकसी और ऄन्य स्रोत स े दािा नहीं करेंग े तो जिश् िजि्ालय संबंजधत सदस्ट्यों की पात्रता के ऄनुसार, यात्रा भत्ते और द,जनक भत्ते की प्रजतपूर्वत करेगा। (4) जिश् िजि्ालय के कमवचाररयों से जभन्न, िासी बोडव के सदस्ट् य, िासी बोडव की ब,ठक में ईपजस्ट्थत होन े के जलए, िासी बोडव द्वारा समय-समय पर यथा जिजनर्ददष्ट ईपजस्ट्थजत भत्ता के हक़दार होंगे। 8. िासी बोडव के कृत्यों की रीजत– (1) कायवपालक कुलसजचि बोडव के संकल् प के ऄनुसार कायविाही अरंभ करेंगे। (2) संकल् प के ऄनुसार की गइ कायविाइ के बारे म,ें जहा ं तक संभि हो सके िासी बोड व की ब,ठकों में ररपोट व प्रस्ट्त ुत की जाएगी। (3) िासी बोडव के सभी अदेिों और जिजनश् चयों को कायवपालक कुलसजचि के हस्ट्त ाक्षर द्वारा ऄजधप्रमाजणत दकया जाएगा। [फा.सं. 23011/21/2020-डब्लल्य.ूएस-III] पुण्य सजलला श्रीिास्ट्ति, ऄपर सजचि[भाग II—खण् ड 3(i)] भारत का राजपत्र ऄसाधारण 5 MINISTRY OF HOME AFFAIRS (WOMEN SAFETY DIVISION) NOTIFICATION New Delhi, the 30th December, 2020 G.S.R. 803(E).— Whereas the draft rules were published, as required under sub-section (1) of section 47 of the National Forensic Sciences University Act, 2020 (32 of 2020) , vide notification of the Government of India in the Ministry of Home Affairs number G. S. R. 654 (E), dated 20th October, 2020 in the Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (i) inviting objections and suggestions from affected persons before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public ; And, whereas, copies of the said Gazette notification were made available to the public on the 21st October, 2020 ; And, whereas, no objections and suggestions received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by section 47 of the National Forensic Sciences University Act, 2020 (32 of 2020), the Central Government hereby makes the following rules, namely:- 1. Short title and commencement. – (1) These rules may be called the National Forensic Sciences University Rules, 2020. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. –(1) In these Rules, unless the context otherwise requires, – (a) ―Act‖ means the National Forensic Sciences University Act, 2020 (32 of 2020); (b) ―Board of Governors‖ means the Board of Governors as provided in sub-section (1) of section 15 of the Act; (c) ―Central Government‖ means the Ministry of Home Affairs; (d) ―Chairperson‖ means chairperson of the Board of Governors; (e) ―member‖ means the members of the Board of Governors as provided in sub-section (1) of section 15 of the Act, and includes ex-officio and non ex-officio members; (f) ―nominated member‖ means the nominated non-ex-officio members of the Board of Governors as provided in clause (g) of sub-section (1) of section 15 of the Act; (g) ―University‖ means the National Forensic Sciences University established under the Act; (h) ―Vice-Chancellor‖ means Vice-Chancellor of the National Forensic Sciences University as provided in section 21 of the Act. (2) Words and expressions used herein and not defined, but defined in the Act, shall have the same meanings assigned to them in the Act. 3. Terms and conditions for appointment of nominated members of the Board of Governors.– (1) For the purpose of selecting members under clause (g) of sub-section (1) of section 15 of the Act, the Vice-Chancellor shall furnish a panel of persons of eminence, not less than five persons per vacancy, selected from the fields of forensic science, law, enforcement, criminology, computer science, engineering, technology, management, forensic medicine and pharmacy, to the Central Government. The list shall be furnished by the Vice-Chancellor within a reasonable time not ordinarily exceeding eight weeks prior to the likely date of vacancy. (2) The Central Government may consider the panel of persons of eminence sent by the Vice-Chancellor while selecting a nominated member to the Board of Governors: Provided that the Central Government shall consult State the Government(s) as it deems fit before nominating a member as a nominated member in the Board of Governors. (3) A nominated member shall be eligible for re-nomination for the next term. 4. Disqualification for member of the Board of Governors.– (1) Prior to the appointment of a person as member, he or she shall give a declaration that he or she has no conflict of interest in any manner with the affairs of the University, and in case, any such conflict of interest arises at any later period during his or her tenure, shall resign from the position forthwith: Provided that if after a due process of inquiry, it is established that there is a conflict of interest of a Member, and the Board of Governors comes to a conclusion that the said conflict of interest is adversely affecting the interest of6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] the University, then the Board of Governors may decide that the said member shall not participate in the proceedings of the Board of Governors. (2) If any question arises as to whether a person is or had been subjected to any of the disqualifications mentioned in sub-rule (1), the question shall be referred to the Central Government, whose decision shall be final. 5. Removal of a member of the Board of Governors. – (1) A member of the Board of Governors shall cease to be such member, if he or she, - (i) resigns his or her membership; or (ii) becomes of unsound mind; or (iii) becomes insolvent; or (iv) is convicted of criminal offence involving moral turpitude; or (v) accepts a full-time appointment in the University; or (vi) fails to attend three consecutive meetings of the Board of Governors without the leave of the Chairperson; or (vii) is disqualified by the Board of Governors as member in terms of rule 4: Provided that no member shall be removed from office unless he or she has been given a reasonable opportunity of being heard in the matter. (2) In case of nominated member, the order of removal shall be issued by the Central Government. 6. Meeting of the Board of Governors. — (1) The Board of Governors may meet as often as may be necessary but not less than twice during a calendar year. (2) Meetings of the Board of Governors shall ordinarily be chaired by the Chairperson either on his or her motion or at the request of a Campus Director of the University Headquarter or on a requisition signed by not less than three members of the Board of Governors. (3) Six members, either through personal presence or video conference or teleconference, shall form quorum for a meeting: Provided that if a meeting is adjourned for want of quorum, it shall be held at such other time and place, on the same day or such other date as the Chairperson may determine; and if at such a meeting, a quorum is not present within half an hour from the appointed time for holding the meeting, the members present shall form the quorum. (4) All the matters considered at the meetings of the Board of Governors shall be decided by a majority of the votes of the members present. If the votes are equally divided, the Chairperson shall have the casting vote. (5) A written notice of the meeting shall be sent by the Executive Registrar to every member at least two weeks before the date of the meeting. The notice shall state the place, the date, and the time of the meeting. The notice may be delivered by post, electronic mail, or FAX at the address of each member as recorded in the University and if so sent, shall be deemed to have been delivered. (6) Notwithstanding the provisions of sub-rule (5), the Chairperson may call a meeting of the Board of Governors at short notice to consider urgent matters. (7) The agenda of the meeting shall be circulated by the Executive Registrar to the members at least ten days before the meeting. (8) Notices for inclusion of any item on the agenda must reach the Executive Registrar at least ten days before the meeting. The Chairperson may permit inclusion of any item for which due notice has not been received. (9) The decision of the Chairperson in regard to all matters relating to procedure of the meeting shall be final. (10) The minutes of the proceedings of a meeting of the Board of Governors shall be prepared by the Executive Registrar and circulated to all the members of the Board of Governors preferably within a period of seven working days, seeking their comments and if no comments are received within ten days from the date of issue of the minutes, the same shall be treated as final. In case, modification is suggested by a member, the same shall be circulated within five working days, through post or electronically, to members of the Board of Governors for confirmation within ten days from the date of issue. Chairperson, may, after taking into account any comments received thereon, confirm and sign the minutes. The signed minutes will be treated as resolution of the Board of Governors. 7. Travelling and other allowances payable to the members of the Board of Governors. – (1) The members of the Board of Governors shall be entitled to travelling allowance and daily allowance as per the rates for travelling[भाग II—खण् ड 3(i)] भारत का राजपत्र ऄसाधारण 7 allowance or daily allowance entitlements for non-officials specified by the Department of Expenditure, Ministry of Finance, Government of India as amended from time to time. (2) The cost of travelling allowance and daily allowance arising in relation to a member attending a meeting of the Board of Governors shall be borne by the University. (3) The members of the Board of Governors who are Government employees, shall receive Travelling allowance and daily allowance from the source from which they draw their salaries at the rates admissible to them. If, however, required by the members, the University shall reimburse the travelling allowance and daily allowance as per entitlement to the members concerned if they declare that they shall not claim travelling allowance and daily allowance from any other source. (4) The members of the Board of Governors, other than employees of the University, shall be entitled to sitting allowance for attending meeting of the Board of Governors as specified by the Board of Governors from time to time. 8. Manner of functions of the Board of Governors.—(1) The Executive Registrar shall initiate action as per the resolution of the Board of Governors. (2) The action taken as per the resolution shall be reported to the Board of Governors, as far as possible, in its meetings.
