L.-33004/99 सी.जी.-डी.एल.-अ.-22122020-223854 xxxGIDHxxx CG-DL-E-22122020-223854 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 651] नई दिल्ली, मगं लवार, दिसम्ब र 22, 2020/पौष 1, 1942 No. 651] NEW DELHI, TUESDAY, DECEMBER 22, 2020/PUHSA 1, 1942 अल्पसख्ं यक काय यमत्रं ालय अजधसचू ना नई दिल्ली 21 दिसम् बर, 2020 सा.का.जन. 783(अ).—केंद्रीय सरकार, राष्ट्रीय अल्पसंख्यक आयोग अजधजनयम, 1992 (1992 का 19) की धारा 15 के उप-धारा (2) के खंड (क) द्वारा प्रित्त िजियों का प्रयोग करत े हुए और राष्ट्रीय अल्पसंख्यक आयोग (अजधकाररयों और अन्य कमयचाररयों की सेवा के ितें और जनबंधन और ितें) जनयम, 1994 का िहां तक उनका संबंध प्रिासजनक अजधकारी, अनुसंधान अजधकारी, अनुभाग अजधकारी, जनिी सजचव और पुस्ट्तकालयाध्यक्ष के पिों स े हैं, उन बातों के जसवाय, अजधक्ांत करत े हुए जिन्ह ें ऐस े अजधक्मण से पूवय दकया गया ह ै या करन े का लोप दकया गया है, राष्ट्रीय अल्पसंख्यक आयोग के कजतपय पिों पर भती की जवजध को जवजनयजमत करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अर्ायत:- 1. संजक्षप्त नाम और प्रारंभ - (1) इन जनयमों का संजक्षप्त नाम राष्ट्रीय अल्पसंख्यक आयोग (अजधकाररयों और अन्य कमयचाररयों की सेवा की ितें एवं जनबंधन और जनयम) जनयम, 2020 ह ै। (2) ये िासकीय रािपत्र में इनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. लाग ूहोना - ये जनयम, इन जनयमों से उपाबद्ध अनुसूची के स्ट्तम्भ (1) में उजल्लजखत पिों पर लागू होंगे। 3. पिों की सख्ं या, वगीकरण और वते न मरै रक्स म ें स्ट्तर - उि पिों की संख्या, उनका वर्गकय रण और उनका वेतन मैररक्स में स्ट्तर वे होंगे िो इन जनयमों से उपाबद्ध अनुसूची के स्ट्तम्भ (2) से स्ट्तम्भ (4) में जवजनर्िष्टय ह।ै 6253 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. भती की पद्धजत, आय ु सीमा, अहतय ाएँ आदि - उि पि पर भती की पद्धजत, आय-ु सीमा, अहतय ाएँ और इससे संबजन्धत अन्य बात ें वें होंगी िो उि अनसु ूची के स्ट्तभ (5) से (13) में जवजनर्िष्टय ह।ैं 5. प्रारंजभक गठन - राष्ट्रीय अल्पसंख्यक आयोग में जनयजमत आधार पर प्रधान जनिी सजचव के पि पर काययरत वह पिधारी, इन जनयमों के प्रारम्भ होने की तारीख से, अनुसूची म ें उजल्लजखत सिश्ृ य पिों के जनयमों के अधीन जनयुि माना िाएगा और उि पि पर उनके द्वारा िी गयी सेवाओं को पररवीक्षा, प्रोन्नजत हते ु अहकय सेवाएँ, पुजष्टकरण और पेंिन के प्रयोिनार् य ध्यान में रखा िाएगा। 6. जनरहतय ा - वह व्यजि – (क) जिसन े ऐसे व्यजि से जिसका पजत या पत्नी िीजवत ह,ै के सार् जववाह दकया हो या –जववाह की संजविा की ह,ै या (ख) जिसने अपन े पजत या पत्नी के िीजवत रहत े हुए दकसी व्यजि स े जववाह दकया है, या जववाह की संजविा की ह ै उि पि पर जनयुजि का पात्र नहीं होगा; परंत ु यदि केंद्रीय सरकार का यह समाधान हो िाता ह ै दक ऐसा जववाह ऐसे व्यजि और जववाह के अन्य पक्षकार को लाग ू स्ट्वीय जवजध के अधीन अनुज्ञेय ह ैऔर ऐसा करने के जलए अन्य आधार ह ैंतो वह दकसी व्यजि को इस जनयम के प्रवतनय से छूट िे सकेगी। 7. जिजर्ल करन े की िजि - िहाँ केंद्रीय सरकार की यह राय ह ै दक ऐसा करना आवश्यक या समीचीन है, वहाँ वह उसके जलए िो कारण ह ै उन्ह ें लेखबद्ध करके इन जनयमों के दकसी उपबंध को दकसी वग य या प्रवग य के व्यजियों की बाबत, आिेि द्वारा जिजर्ल कर सकेगी। 8. व्यावजृ त - इन जनयमों की कोई बात, ऐसे आरक्षण, आय-ु सीमा में छूट और अन्य ररयायतों पर प्रभाव नहीं डालगे ी, जिनका केंद्रीय सरकार द्वारा इस संबंध म ें समय-समय पर जनकाले गए आिेिों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों, भूत पूवय सैजनकों और अन्य जविेष प्रवग यके व्यजियों के जलए उपबंध करना अपेजक्षत ह।ै अनसु चू ी पिनाम पिों की सख्ं या वगीकरण प-े मरै रक्स म ेंस्ट्तर चयन अर्वा अचयन पि ( 1) (2) (3) (4) (5) 1. प्रधान जनिी 1* (2020) लागू नहीं होता। स्ट्तर - 11 (रु. 67700- चयन। सजचव। *काययभार के आधार 208700/-) पर पररवतयन दकया िा सकता ह।ै सीधी भती दकए िान े सीधे भती दकए िान े सीधे भती दकए िाने वाले व्यजियों के पररवीक्षा की अवजध, यदि कोई हो। वालों के जलए आयु वालों के जलए अपेजक्षत जलए जवजहत आयु और िैजक्षक अहतय ाएँ सीमा। िैजक्षक एवं अन्य प्रोन्नत व्यजियों की ििा में लागू होंगी अहतय ाएँ। या नहीं। (6) (7) (8) (9) लागू नहीं होता। लागू नहीं होता। लागू नहीं होता। प्रोन्नतों करने वाले व्यजियों के जलए 02 वषय।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 भती की पद्धजत: भती सीधे प्रोन्नजत/प्रजतजनयुजि/आमेलन द्वारा यदि जवभागीय प्रोन्नजत सजमजत भती करने में दकन होगी या प्रोन्नजत द्वारा या भती की ििा में वे श्रेजणयाँ जिनसे ह,ै तो इसकी संरचना। पररजस्ट्र्जतयों में संघ प्रजतजनयुजि/आमेलन द्वारा प्रोन्नजत/प्रजतजनयुजि/आमेलन दकया लोक सेवा आयोग स े तर्ा जवजभन्न पद्धजतयों द्वारा िाएगा। परामिय दकया िाएगा। भरे िाने वाले पिों की प्रजतितता। (10) (11) (12) (13) प्रोन्नजत द्वारा जिसके न होन े प्रोन्नजत: जवभागीय प्रोन्नजत सजमजत लागू नहीं होता। पर प्रजतजनयुजि द्वारा। राष्ट्रीय अल्पसंख्यक आयोग में वेतन (प्रोन्नजत पर जवचार करने के मैररक्स में स्ट्तर - 7 (रु. 44900- जलए) जिसमें जनम्नजलजखत िाजमल होंगे: 142400/-) में जनिी सजचव जिसने इस श्रेणी में सात वषय की जनयजमत (1) संयुि सजचव, राष्ट्रीय सेवा की ह।ै अल्पसंख्यक आयोग - अध्यक्ष; रटप्पण: िहां ऐसे कजनष्ठ व्यजियों (2) जनििे क अर्वा उप सजचव, के संबंध में, जिन्होंने अपनी अहकय / राष्ट्रीय अल्पसंख्यक आयोग पात्रता सेवा पूरी कर ली है, प्रोन्नजत – सिस्ट्य; के जलए जवचार दकया िा रहा है, (3) अवर सजचव राष्ट्रीय वहाँ उनसे ज्येष्ठ व्यजियों के संबंध अल्पसंख्यक आयोग – सिस्ट्य; में भी जवचार दकया िाएगा परंतु (4) अवर सजचव, अल्पसंख्यक यह तब िबदक उसके द्वारा की गयी कायय मंत्रालय – सिस्ट्य। ऐसी अहकय या पात्रता सेवा, अपेजक्षत अहकय या पात्रता सेवा के आधे से अजधक या िो वषय, इनमें से िो भी कम हो, से कम न हो और उन्होने अपने ऐसे कजनष्ठ व्यजियों सजहत, जिन्होंने ऐसी अहयक/पात्रता सेवा पहले पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नजत के जलए अपनी पररवीक्षा अवजध को सफलतापूवयक पूरा कर जलया हो। प्रजतजनयजु ि: केंद्रीय सरकार या राज्य सरकारों या संघ राज्यक्षेत्र के प्रिासन या सावयिजनक क्षेत्र के उपक्मों या जवश्वजवद्यालयों या मान्यता प्राप्त अनुसंधान संस्ट्र्ानों या अधय- सरकारी या स्ट्वायत्त जनकायों या सांजवजधक संगठनों के अजधकारी,- (i) िो मूल संवगय या जवभाग में जनयजमत आधार पर सििृ पि धाररत दकए हुए हैं; या (ii) जिन्होंने मूल संवगय या जवभाग में वेतन मैररक्स में स्ट्तर - 10 (रु. 56100-177500/-) या समतुल्य में जनयुजि के बाि जनयजमत आधार पर इस श्रेणी में पांच वषय की जनयजमत सेवा की ह;ै और (ख) जनम्नजलजखत िैजक्षक योग्यता और अनुभव का होना: (i) दकसी मान्यता प्राप्त जवश्वजवद्यालय या संस्ट्र्ान से जवजध में स्नातक की जडग्री और जवजध मामलों में छह वषय का अनुभव; या (ii) दकसी मान्यता प्राप्त जवश्वजवद्यालय या संस्ट्र्ान से जवजध में मास्ट्टर जडग्री और जवजध मामलों में पांच वषय का अनुभव। रटप्पण 1: प्रजतजनयुजि की अवजध (जिसके अंतगयत अल्पकाजलक संजविा भी ह)ै जिसके अंतगयत केंद्रीय सरकार के उसी या दकसी अन्य संगठन/जवभाग में इस जनयुजि से ठीक पहले धाररत दकसी अन्य संवगय वाह्य पि पर प्रजतजनयुजि की अवजध है, साधारणतया तीन वषय से अजधक नहीं होगी। रटप्पण 2: प्रजतजनयजु ि पर जनयुजि के जलए अजधकतम आयु-सीमा आवेिन प्राप्त करने की अंजतम तारीख को छप्पन वषय से अजधक नहीं होगी। ( 1) (2) (3) (4) (5) 3. प्रिासजनक अजधकारी। 1* (2020) लागू नहीं होता। स्ट्तर - 10 (रु. 56100- चयन। * काययभार के आधार 177500/-) पर पररवतयन दकया िा सकता ह।ै (6) (7) (8) (9) लागू नहीं होता। लागू नहीं होता। लागू नहीं होता। प्रोन्नतों करने वाले व्यजियों के जलए 02 वषय। (10) (11) (12) (13) प्रोन्नजत द्वारा प्रोन्नजत: जवभागीय प्रोन्नजत सजमजत लागू नहीं होता। जिसके न होने पर (प्रोन्नजत के संबंध में जवचार अनुभाग अजधकारी के रूप में वेतन मैररक्स में स्ट्तर - 7 प्रजतजनयुजि द्वारा। करने के जलए) िो जनम्नजलजखत (रु. 44900-142400/-) में तीन साल की जनयजमत सेवा के सार् और प्रिासजनक प्रजतष्ठान और लेखा के क्षेत्र में से जमलकर बनेगी: 12 सप्ताह का सफलतापूवयक प्रजिक्षण प्राप्त दकया हो। (i) संयुि सजचव, राष्ट्रीय रटप्पण: िहां ऐसे कजनष्ठ व्यजियों के संबंध में, जिन्होंन े अल्पसंख्यक आयोग - अध्यक्ष; अपनी अहकय / पात्रता सेवा पूरी कर ली है, प्रोन्नजत के (ii) जनििे क अर्वा उप जलए जवचार दकया िा रहा है, वहाँ उनसे ज्येष्ठ व्यजियों सजचव, राष्ट्रीय अल्पसंख्यक के संबंध में भी जवचार दकया िाएगा। परंतु यह तब आयोग – सिस्ट्य; िबदक उसके द्वारा की गयी अपेजक्षत अहकय या पात्रता (iii) अवर सजचव, राष्ट्रीय सेवा ऐसी अहकय या पात्रता सेवा के आधे से अजधक या िो वषय, इनमें से िो भी कम हो से, कम न हो और उन्होन े अल्पसंख्यक आयोग – सिस्ट्य; अपने ऐसे कजनष्ठ व्यजियों सजहत, जिन्होंने ऐसी (iv) अवर सजचव, अल्पसंख्यक अहकय /पात्रता सेवा पहले पूरी कर ली है, अगली उच्चतर कायय मंत्रालय – सिस्ट्य। ग्रेड में प्रोन्नजत के जलए अपनी पररवीक्षा अवजध को सफलतापूवयक पूरी कर ली हो।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रजतजनयजु ि : केंद्रीय सरकार या राज्य सरकारों या संघ राज्यक्षेत्रों के प्रिासन या सावयिजनक क्षेत्र के उपक्मों या जवश्वजवद्यालयों या मान्यता प्राप्त अनुसंधान संस्ट्र्ानों या अध-य सरकारी या स्ट्वायत्त जनकायों या सांजवजधक संगठनों के ऐसे अजधकारी जिन्होंने,- (क) (i) िो मूल संवगय या जवभाग में जनयजमत आधार पर सििृ पि धाररत दकए हुए हैं; या (ii) जिन्होंने मूल संवगय या जवभाग में वेतन मैररक्स में स्ट्तर - 7 (रु. 44900-142400/-) या समतल्ु य म ें जनयुजि के बाि जनयजमत आधार पर इस श्रेणी में तीन वषय की जनयजमत सेवा की ह;ै तर्ा (ख) िो जनम्नजलजखत िैजक्षक अहतय ाएँ और अनुभव रखते हों: (i) दकसी मान्यता प्राप्त जवश्वजवद्यालय या संस्ट्र्ान स े स्नातक की जडग्री; और (ii) सरकारी कायायलय/सावयिजनक क्षेत्र के उपक्म/स्ट्वायत्त जनकाय / सांजवजधक जनकाय में लेखा, प्रिासन, स्ट्र्ापना कायय में तीन वषय का अनुभव। रटप्पण 1: पोषक प्रवगय के ऐसे जवभागीय अजधकारी, िो प्रोन्नजत की सीधी पंजि में ह,ै व े प्रजतजनयजु ि पर जनयुजि के जलए जवचार के योग्य नहीं होंगे और इसी प्रकार प्रजतजनयुजि पर जनयुि व्यजि प्रोन्नजत द्वारा जनयुजि के जलए जवचार दकए िाने के पात्र नहीं होंगे। रटप्पण 2: प्रजतजनयजु ि की अवजध (जिसके अंतगयत अल्पकाजलक संजविा भी ह)ै जिसके अंतगयत केंद्रीय सरकार के उसी या दकसी अन्य संगठन/ जवभाग में इस जनयुजि से ठीक पहले धाररत दकसी अन्य काडर वाह्य पि पर प्रजतजनयुजि की अवजध है, साधारणतया तीन वषय से अजधक नहीं होगी। रटप्पण 3: प्रजतजनयजु ि पर जनयुजि के जलए अजधकतम आयु-सीमा आवेिन प्राप्त करने की अंजतम तारीख को छप्पन वषय से अजधक नहीं होगी। (1) (2) (3) (4) (5) 4. अनुसंधान 1* (2020) लागू नहीं होता। स्ट्तर - 10 (रु. 56100- चयन। अजधकारी। * काययभार के आधार पर 177500/-) पररवतयन दकया िा सकता ह।ै (6) (7) (8) (9) लागू नहीं होता। लागू नहीं होता। लागू नहीं होता। प्रोन्नतों के जलए 02 वषय। (10) (11) (12) (13) प्रोन्नजत द्वारा जिसके न प्रोन्नजत: जवभागीय प्रोन्नजत सजमजत (प्रोन्नजत पर लागू नहीं होता। हो सकने पर जवचार करने के जलए) जिसमें वेतन मैररक्स स्ट्तर - 6 में (रु. 35400- प्रजतजनयुजि द्वारा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 112400/-) के वेतनमान म ें ऐसे जनम्नजलजखत िाजमल होंगे: अनुसंधान सहायक जिसने इस श्रेणी म ें (1) संयुि सजचव, राष्ट्रीय अल्पसंख्यक आठ वषय की जनयजमत सेवा की ह।ै आयोग - अध्यक्ष; रटप्पण: िहां ऐसे कजनष्ठ व्यजियों के संबंध में, जिन्होंने अपनी अहकय /पात्रता (2) जनििे क अर्वा उप सजचव, राष्ट्रीय सेवा पूरी कर ली है, प्रोन्नजत के जलए अल्पसंख्यक आयोग – सिस्ट्य; जवचार दकया िा रहा है, वहाँ उनसे (3) अवर सजचव, राष्ट्रीय अल्पसंख्यक ज्येष्ठ व्यजियों के संबंध में भी जवचार आयोग – सिस्ट्य; दकया िाएगा। परंतु यह तब िबदक (4) अवर सजचव, अल्पसंख्यक कायय उसके द्वारा की गयी अपेजक्षत अहयक या मंत्रालय – सिस्ट्य। पात्रता सेवा के ऐसी अहयक या पात्रता सेवा के आधे से अजधक या िो वषय, इनमें से िो भी कम हो से, कम न हो और उन्होने अपने ऐसे कजनष्ठ व्यजियों सजहत जिन्होंने ऐसी अहकय /पात्रता सेवा पहले पूरी कर ली है, अगली उच्चतर ग्रेड में प्रोन्नजत के जलए अपनी पररवीक्षा अवजध को सफलतापूवयक पूरा कर जलया हो। प्रजतजनयजु ि: केंद्रीय सरकार या राज्य सरकारों या संघ राज्यक्षेत्रों के प्रिासन या सावयिजनक क्षेत्र के उपक्मों या जवश्वजवद्यालयों या मान्यता प्राप्त अनुसंधान संस्ट्र्ानों या अधय-सरकारी या स्ट्वायत्त जनकायों या सांजवजधक संगठनों के ऐसे अजधकारी,- (क) (i) िो मूल संवगय या जवभाग में जनयजमत आधार पर सििृ पि धाररत दकए हुए हैं; या (ii) जिन्होंने मूल संवगय या जवभाग में वेतन मैररक्स में स्ट्तर -8 (रु. 47600- 151100/-) या समतुल्य के वेतनमान में जनयुजि के पश्चात जनयजमत आधार पर इस श्रेणी में िो वषय की जनयजमत सेवा की है; या (iii) जिन्होंने मूल संवगय या जवभाग में वेतन मैररक्स में स्ट्तर - 6 (रु. 35400- 112400/-) या समतुल्य के वेतनमान में जनयजु ि के बाि जनयजमत आधार पर इस श्रेणी में आठ वषय की जनयजमत सेवा की है; तर्ा (ख) जनम्नजलजखत िैजक्षक अहतय ाएँ और अनुभव रखता हो: (i) दकसी मान्यता प्राप्त जवश्वजवद्यालय या संस्ट्र्ान से समाििास्त्र या सामाजिक कायय या जवजध या सांजख्यकी8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] में स्नातक की जडग्री;
