(1) इन जनयमों का संजिप्त नाम आयुध (संिोधन) जनयम, 2020 ह ै। (2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंग े। 2. आयुध जनयम 2016 म,ें - (i) जनयम 2 के उपजनयम (3) म,ें “1899 से पूवा जवजनर्मात अग्नायधु ” िब्िों और अंकों के स्ट्र्ान पर, “ऐसा अग्नायुध अजभप्रेत ह ैिो कम से कम सौ वर्षों से अजस्ट्तत्व में ह”ै िब्ि रखे िाएंगे; (ii) जनयम 10 के उपजनयम (5) के पश्चात् जनम्नजलजखत उपजनयम अंतःस्ट्र्ाजपत दकए िाएगं े, अर्ाता ्:- 857 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) “(6) कलाकृजत के प्रवग ा के अधीन आन े वाले लघ ु आयधु , स्ट्वामी द्वारा सुरजित ढंग से और अन्द्य व्यजियोोँ की पहुचं स े िरू रख े िाएंगे । ऐस े लघु आयुध जवजहत अनुज्ञजप्त के जबना उपयोग, वहन या पररवहन नहीं दकए िाएंगे।” (ख) "(7) कलाकृजत के प्रवगा के अधीन आन े वाल े लघु आयुधों के अिान, कब्िे हते ु भारतीय नागररकों के जलए कोई अनुज्ञजप्त अपेजित नहीं ह।ै तर्ाजप, यर्ाजवजहत समुजचत अनुज्ञजप्त ऐस े लघ ु आयधु ों के उपयोग या वहन या पररवहन के जलए अपेजित होगी । स्ट्वामी की जवजहत अनुज्ञजप्त म ें ऐसे आयुधो ोँ के पृष्ांकन के जबना उनके उपयोग हते ु कोई गोला बारूि जवक्रय नहीं दकया िाएगा ।” (iii) जनयम 15 के उपजनयम (4) के परंतुक, "परंत ु यह और दक प्ररूप 2, प्ररूप 3 और प्ररूप 4 में प्रत्येक अनुज्ञजप्त की ििा में और दकसी एकल जवजिष्ट पहचान संखयांक के अधीन तीन अग्नायुधों की दकसी समग्र सीमा के सार् अनुसूची 1 म ें जवजनर्िष्टा आयधु और गोला बारूि के जनबंजधत या अनज्ञु ेय प्ररूप के जलए प्ररूप 3 म ें अनुज्ञजप्त की ििा में पृर्क अनुज्ञजप्त पुजस्ट्तका सृजित करेगा।", के स्ट्र्ान पर परंतुक, "परंतु यह और दक प्ररूप 2, प्ररूप 3, प्ररूप 3क और प्ररूप 4 में प्रत्येक अनज्ञु जप्त की ििा में और दकसी एकल जवजिष्ट पहचान संखयांक के अधीन िो अग्नायुधों की समग्र सीमा के सार् अनुसूची 1 म ें जवजनर्िष्टा आयुध और गोला बारूि के जनबंजधत या अनुज्ञेय उपयोग के जलए प्ररूप 3 में अनुज्ञजप्त की ििा म ें या तो पजु स्ट्तका के रूप म ें या इलैक्ट्राजनक रूप म ें पृर्क अनुज्ञजप्त िारी करेगा ।”, रखा िाएगा । (iv) जनयम 18 म,ें "तीन अग्नायुधों की समग्र सीमा", िब्िों के स्ट्र्ान पर “िो अग्नायुधों की समग्र सीमा” िब्ि रख े िाएंगे; (v) जनयम 25 म,ें- (क) उपजनयम (1)(ख) म-ें (i) परंतुक म ें“नहीं ह”ैं िब्िों के स्ट्र्ान पर “नहीं ह:ैं” िब्ि रखे िाएंगे; (ii) पहले परंतुक के पश्चात्, जनम्नजलजखत परंतुक अतं ःस्ट्र्ाजपत दकया िाएगा, अर्ाात:् - “परंत ु यह और दक उत्तराजधकार के आधार पर या कुलागत आधार पर आयुध अनज्ञु जप्त अनुित्त करत े समय अग्नायुधों की सीमा िो से अजधक नहीं होगी।”; (ख) उपजनयम (3) के अधीन स्ट्पष्टीकरण में, "मृत अनुज्ञजप्तधारी का" िब्िों के पश्चात ् "जपता, माता,” िब्ि अंतःस्ट्र्ाजपत दकए िाएगं े । (vi) जनयम 26 के स्ट्र्ान पर, जनम्नजलजखत जनयम रखा िाएगा, अर्ाात:् - “26. कजतपय अनज्ञु जप्तयों का प्ररूप–एनडीएएल प्रणाली में अनुज्ञजप्तधारी के यू आई एन के अधीन सृजित प्ररूप 2, प्ररूप 3, प्ररूप 3क, प्ररूप 4, या प्ररूप 5 की अनुज्ञजप्त पस्ट्ु तक रूप में होगी, जिसे क्रमानुसार संखयांदकत दकया िाएगा या इलैक्ट्राजनक रूप म ें होगी और वह जनयमों में जवजनर्िष्टा प्रारूपों का कडाई से पालन करेगी और व्यजष्टक की ििा म ेंउसमें अनुज्ञजप्तधारी का नवीनतम फोटो भी अंतर्वाष्ट होगा: परंतु अग्नायुधों के जनबंजधत वग ा के जलए अनुज्ञजप्त पस्ट्ु तक गाढे भूरे रंग की होगी और अग्नायुधों के अनुज्ञेय वगा के जलए उसका रंग गहरा नीला होगा: परंत ु यह और दक अनुज्ञजप्त प्राजधकारी पुस्ट्तक प्ररूप में अनुज्ञजप्त प्रिान करन े हते ु अनुसूची 4 में यर्ा जवजनर्िष्टा फीस उद्ग्रहीत कर सकेगा, या केन्द्रीय सरकार द्वारा िारी स्ट्र्ानीय या जविेर्ष आिेि द्वारा यर्ा अजधसूजचत ब्यौरे अंतर्वाष्ट करते हुए, इलैक्ट्राजनक रूप में अनज्ञु जप्त िारी कर सकेगा, जिसके अंतगात अनुज्ञजप्त के ऐस े इलैक्ट्राजनक रूप के जलए फीस का उद्ग्रहण भी होगा।”[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (vii) जनयम 40 के उपजनयम (1) म,ें सारणी के क्रम संखयांक 5 के सामने प्रजवजष्टयों में, जनम्नजलजखत प्रजवजष्टया ोँ रखी िाएंगी, अर्ाात:् - 5. (1) These rules may be called the Arms (Amendment) Rules, 2020. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Arms Rules, 2016, - (i) in rule 2, in sub-rule (3), for the words and figures “firearms manufactured before 1899”, the words “firearm which has been in existence for not less than one hundred years;” shall be substituted; (ii) in rule 10, after sub-rule(5), following sub-rules shall be inserted, namely:- (a) “(6) Small arms falling under the category of curio shall be kept securely and out of reach of other persons by the owner. Such small arms shall not be used, carried or transported without the prescribed licence.” (b) “(7) No licence is required for Indian citizens for acquisition, possession of small arms falling under the category of curio. However, appropriate licence as prescribed would be required for use or to carry or transport such small arms. Without the endorsement of such firearms in the prescribed licence of the owner, no ammunition shall be sold for their use.” (iii) in rule 15, in sub-rule (4), for the proviso “Provided further that separate licence books shall be generated in case of each licence in Form II, Form III and Form IV and in case of a licence in Form III, separately for restricted and permissible categories of arms and ammunition specified in Schedule I, with an overall4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ceiling of three firearms under a single UIN”, the proviso “Provided further that separate licence either in book form or in electronic form shall be generated in case of each licence in Form II, Form III, Form IIIA and Form IV and in case of a licence in Form III, separately for restricted and permissible categories of arms and ammunition specified in Schedule I, with an overall ceiling of two firearms under a single UIN” shall be substituted. (iv) in rule 18, for the words “overall limit of three firearms”, the words “overall limit of two firearms” shall be substituted; (v) in rule 25, - (a) in sub-rule (1)(b) – (i) in the proviso, for the words “police report.” the words “police report:” shall be substituted; (ii) after the first proviso, the following proviso shall be inserted, namely:- “Provided further that while granting arms licence on inheritance or heirloom basis, the limit of two firearms shall not be exceeded.” ; (b) in sub-rule (3), under Explanation, for the word “includes”, the words “includes father, mother,” shall be substituted. (vi) for rule 26, the following rule shall be substituted, namely:- “26. Form of certain licences.—A licence in Form II, Form III, Form IIIA, Form IV or Form V generated under the UIN of the licensee in NDAL system, shall either be in book form serially numbered or in electronic form and strictly as per the formats specified in the rules and in case of individuals, shall contain the latest photograph of the licensee: Provided that the licence in book form for restricted category of firearms shall be of dark maroon colour and for permissible category of firearms shall be of navy blue colour: Provided further that the licensing authority may levy fee as specified in Schedule IV for providing licence in book form, or issue the licence in electronic form containing details as notified by a local or special order issued by the Central Government including levy of the fee for such electronic form of licence.”; (vii) in rule 40, in sub-rule (1), for the entries against serial number 5 of the Table, the following entries shall be substituted, namely:- 5. “Other shooters (not falling under Sl. No. .22 LR Rifle/Pistol 500 5000 1 to 4 above) holding valid arms licences and who are also members of National Rifle Association of India or affiliated Any other Pistol/ Revolver 300 2000 State Rifle Association(s) of NRAI or caliber shooting clubs/District Rifle Association affiliated with State Rifle Association Shotgun caliber 250 5000 Any other Rifle 200 500” [F.
