In exercise of the powers conferred by sub-section (1) of section 56 of the Waqf Act, 1995 (43 of 1995), the Central Govt., hereby makes the following rules to amend the Waqf Properties Lease Rules, 2014, namely.

2. व(cid:17) फ संपि* त प+ा िनयम, 2014 (िजसे इसम@ इसके पCच ात् उ(cid:17)त िनयम कहा गया ह)ै के िनयम 7 के उप-िनयम (1) के (cid:8)थ ान
पर िन2 निलिखत उप िनयम रखा जाएगा, अथा8त् :
"(1) (cid:1)कसी (cid:8) थावर व(cid:17) फ संपि* त के प+े के िलए (cid:31)ित वग8 फुट का आरि<त मू(cid:3)य िन2न ानुसार होगा –
(क) अ(cid:8) पताल$, शैि<क सं(cid:8) थाI और सामािजक से(cid:17)ट र$ के िलए संपि*त के बाजार मू(cid:3)य के 2 (cid:31)ितशत (cid:31)ित वष8 से कम नहL
होगा ;
(ख) वािणिN यक काय8कलाप$ के िलए संपि*त के बाजार मू(cid:3)य के 2.5 (cid:31)ितशत (cid:31)ित वष8 से कम नहL होगा;"
3. उ(cid:17) त िनयम$ के िनयम 17 के उप िनयम (1) के (cid:8)थ ान पर िन2न िलिखत उप िनयम रखा जाएगा, अथा8त् :
"(1) तीन वष8 क(cid:19) अविध से अिधक और तीस वष8 तक िव(cid:8)ताPरत अविध के िलए (cid:1)कसी (cid:8)थ ावर व(cid:17)फ संपि*त का प+ा (cid:1)कसी
वािणिN यक काय8कलाप को चलाने, शैि<क या (cid:8)व ा(cid:8)Q य (cid:31)योजन$ के िलए राNय सरकार के अनुमोदन से अनुद*त (cid:1)कया जा सकेगा
और य(cid:1)द राN य सरकार पैतािलस (cid:1)दन क(cid:19) अविध के भीतर अनुSा (cid:31)दान करने म@ असफल रहती है तो अनुSा अनुद*त क(cid:19) गई

NOTIFICATION
New Delhi, the 25th August, 2015
G.S.R. 663(E).– In exercise of the powers conferred by sub-section (1) of section 56 of the Waqf Act, 1995 (43
of 1995), the Central Government hereby makes the following rules to amend the Waqf Properties Lease Rules, 2014,
namely:—
1. (1) These rules may be called the Waqf Properties Lease (Amendment) Rules, 2015.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 7 of the Waqf Properties Lease Rules, 2014 (hereinafter referred to as the said rules), for sub-rule (1), the
following sub-rule shall be substituted, namely:—
“(1) The reserve price per square feet for lease of an immovable waqf property shall–
(a) for hospitals, educational institutions and social sectors, be not less than 2% per annum;
(b) for commercial activities, be not less than 2.5% per annum,”
of the market value of the property.
3. In rule 17 of the said rules, for sub-rule (1), the following sub-rule shall be substituted, namely:—
“(1) A lease of any immovable waqf property exceeding the period of three years and extending upto thirty years
may be granted for the purposes of carrying out any commercial activity, education or health purposes, with the
approval of the State Government and if the State Government fails to grant permission within forty-five days, the
permission shall be deemed to be granted.”.
