Revised Pension Rules, 1980 – Penalty of Withholding of 20% (twenty percent) pension for a period of four years under Rule 9 of A.P. Revised Pension Rules, 1980 – Imposed – Orders – Issued. Home (Services-III) Department G.O.Ms.No. 44 dated: 03.03.2012 Read the following:- 1. From the Director General of Police, Andhra Pradesh, Hyderabad, Lr.No.1959/Appeal-1/2009, dated 12.7.2010. 2. Govt. Memo.No.21216/Ser-III/A2/2010, dated: 29.9.2010. 3. From Sri M. Manohar, Senior Assistant (Retired) Explanation dated: 23.1.2011. 4. Govt.Letter.No.21216/Ser-III/A2/10, dated: 21.01.2012. 5. From the Secretary, A.P. Public Service Commission, Hyderabad, Letter No.268/RT/2/2012, dated: 13.02.2012. ***** The Director General of Police, Andhra Pradesh, Hyderabad, in his letter 1st read above has reported that Sri M. Manohar, Senior Assistant of District Police Office, Sangareddy, who retired from service w.e.f. 31-3-2007, was handed upon a charge for involving OE for the following (4) counts: 1. “Gross neglect of duty in absenting himself un-authorizedly and frequently without leave or permission i.e. 2-7-2003 to 31-7-2003, 15-9- 2003, 26.9.2003 and 4-10-2003 to 14-10-2003.” 2. “Gross neglect of his legitimate duty and kept lot of pending work in CI seat i.e. ADR for the calendar year 2002, ADR for financial year 2002- 2003, Monthly return on custodial deaths/NHRC, Monthly return on escape of prisoners, quarterly return on police firing for the quarter ending 31-3-2003 and 30-6-2003, Annual return on Police firing for the year 2002, detailed reports in all the specially grave crime, submission of proposal for withdrawal of cases on receipt of proposal for subordinate and Monthly report on cheating cases for the month of January to May.” 3. “Gross neglect of duty in absenting when A.O., DPO, Sangaredddy, visited CI seat to inspect the section and not co-operated and refused to show the records, further.” 4. Gross neglect of legitimate duties by coming late to office after availing lunch time at the time of Inspection of CI seat by SDPO, Medak on 29-9-2003.” The SDPO, Toopran was appointed as E.O. to conduct the regular OE in Proceedings No.A6/PR/58/2003, dated 6-1-2004. The SDPO, Toopran conducted the OE examining (4) PWs and exhibiting (7) documents on behalf of prosecution and submitted his findings, dated 15-11-2008 holding the charge as proved. The Superintendent of Police, Medak District has agreed with the findings of the E.O. with regard to holding the allegations against the charged officer as ‘Proved’. Since, the charged officer retired from service on superannuation from 31.3.2007, the Director General of Police, Andhra Pradesh, Hyderabad, has forwarded the O.E. records to Government for taking further action under Rule 9 of A.P. Revised Pension Rules, 1980. (P.T.O):: 2 :: 2. After careful examination of the matter, Government accepted the findings of the disciplinary authority and provisionally decided to impose the penalty of “Withholding of 20% (twenty percent) pension for a period of four years” on Sri M. Manohar, Senior Assistant (Retired) of DPO, Medak District, under Rule 9 (2) (a) of A.P. Revised Pension Rules, 1980. 3. In Government Memorandum 2nd read above, a show cause notice was issued to the said Retired Charged officer, duly indicating the quantum of cut in pension, as required under A.P. Revised Pension Rules, 1980. 4. The charged officer in the reference 3rd read above has submitted his explanation to the show cause notice and requested the Government to drop further action, for the reasons mentioned therein. 5. After taking the explanation of the Charged Officer into consideration, Government have decided to impose a penalty of withholding of 20% pension for a period of 4 years on Sri M. Manohar, Senior Assistant, District Police Office, Sangareddy (now Retired), and sought the advice of A.P. Public Service Commission thereon, vide reference 4th read above. 6. The Secretary, Andhra Pradesh Public Service Commission, Hyderabad in his letter 5th read above, has conveyed the concurrence of the Commission on the proposal of the Government. 7. Government after careful examination of the entire matter, hereby impose the penalty of withholding of 20% pension for a period of 4 years, on Sri M. Manohar, Senior Assistant (Retired), District Police Office, Sangareddy, Medak District under Rule-9 (1) of A.P. Revised Pension Rules, 1980, read with rule 20 of APCS (CC&A) Rules, 1991. 8. A copy of the letter 5th read above received from the Secretary, Andhra Pradesh Public Service Commission, Hyderabad is herewith furnished to Sri M. Manohar, Senior Assistant (Retired), District Police Office, Sangareddy, Medak District as required under Rule-44 of APCS (CC&A) Rules, 1991. 9. The Director General of Police, AP, Hyderabad is requested to take follow up action on implementation of the said penalty. The records received in the reference 1st read above, are returned herewith to the Director General of Police, AP, Hyderabad and receipt of the same should be acknowledged.
