HOME (SERVICES-I) DEPARTMENT G.O.Rt.No. 136 Dated: 27/01/2012 Read the following:- 1. From the Director General of Police, A.P. Hyderabad, Letter Rc.No.761/O2/2010, dated 29.12.2010. 2. Govt.Memo No.119/Ser.I/A2/2011-3, dated 3.8.2011. 5. From the Commissioner of Printing, Stationary & Stores Purchases, A.P. Hyderabad, Extraordinary Gazette dated 8.8.2011. o-o-o O R D E R: The Director General of Police, A.P., Hyderabad, in his letter 1st read above, has requested the Government to initiate disciplinary proceedings against Sri G.Amarnath, Superintendent of Police (NC), for the reasons mentioned therein. 2. In the reference 2nd read above, Government issued a charge Memorandum against the said Sri G.Amarnath, Superintendent of Police (NC), under rule-20 of APCS (CC&A) Rules, 1991, for the following delinquencies:- (1) “During his tenure as CVO, APCPDCL, he exhibited gross misconduct, and dereliction of duty and behaved in a manner unbecoming of a Police officer by showing poor performance, not taking interest in his work as CVO, and abusing and issuing regular routine memos to his subordinates inspite of an advisory memo”. (2) “He is in the habit of bullying subordinates, extorting favours and receiving services and threatens them by saying that he would file a case under the SC/ST (POA) Act, 1989 against them. Thus, he brought disrepute to the image of police and caused disaffection in the APTS (Anti Power Theft Squad) organization”. Thereby, he violated sub-rules 1, 2, 3 of Rule 3 and Rule 26 of APCS (Conduct) Rules, 1964 and APPM Order Nos. 112(7), 113(4) & 113(10). 3. The Director General of Police, A.P., Hyderabad in his letter 3rd above has reported that the efforts have been made to serve the said charge memo to the Charged Officer, but the Charged Officer has been evading to take the charge memo. Therefore, Government have decided to take action under rule-42 (iii) APCS (CC&A) Rules, 1991. 4. In the reference 4th read above, the Commissioner of Printing, Stationery, Stores and Purchases, A.P. Hyderabad was requested to publish the said charge Memorandum in an Extra-ordinary Gazette. 5. In the reference 5th read above, the Commissioner of Printing, Hyderabad has published the said charge Memorandum in an Extraordinary Gazette dated 8.8.2011, and the charged officer has failed to submit his written statement of defense, within the stipulated time. 6. After careful examination of the entire matter, Government have construed that the charged officer has no explanation to offer, and decided to take action, exparte, and to conduct Oral Enquiry against the said Charged Officer by appointing Enquiry Officer and Presenting Officer. 7. Now, therefore, Government in exercise of the powers conferred under sub-rule 2 read with sub-rule 5(b) of Rule 20 of APCS (CC&A) Rules, 1991, hereby appoint Sri Atul Singh, IPS, Joint Commissioner of Police (L&O), Cyberabad as Inquiring Authority and Smt K.Swarna Seshu, Advocate, as the Presenting Officer to present the case before the Inquiring Authority. p.t.o.2 8. The Presenting Officer appointed in para-7 above shall acquaint himself with the facts of the case by procuring the records relating to the case and present the case before the Inquiring Authority effectively on behalf of the Government. The Presenting Officer shall also obtain and furnish records to the Inquiring Authority, if necessary which are required during the course of enquiry. 9. The Inquiring Authority shall conduct enquiry strictly in terms of the procedure prescribed under Rule 20 of APCS (CC&A) Rules, 1991 and shall submit his report to the Government in terms of sub-rule 18 of the said rules, as expeditiously as possible and however it shall not be more than two months from the date of issue of these orders. 10. The connected records in original are herewith enclosed and furnished to the Inquiring Authority in this case.
