The Director General of Police, Andhra Pradesh, Hyderabad, in his letter 1 read above, has
reported that Sri Nader Abbas HC 2219 (now retired) of Hyderabad was handed up an OE for
the following charge:
“For his unauthorized absence from duty on three spells w.e.f 20-9-2005 to 18-10-2005,
from 20-11-2005 to 2-12-2005 and from 15-12-2005 to 5-5-2006 and also for refusing to
take the posting order to Traffic Branch”
2. The Inspector of Police, Tappachaputra PS., has conducted the oral Enquiry and held the
charges against the charged officer Sri Nader Abbas HC 2219 as proved . The CP, Hyderabad
has issued a memo supplying a copy of the enquiry report to the charged officer but it could not
be served on the charged officer as he was not present at his residence. However, the same along
with the enquiry report was pasted to the house of the charged officer on 24-5-2010 in the
presence of two witnesses. Since, the charged officer has retired from service on superannuation
on 30-4-2010, further action has to be taken by the Government under Rule 9 of A.P. Revised
Pension Rules, 1980.
3. Government have examined the report of the Enquiry Officer and accepted the findings
of Enquiry Officer. Government have therefore provisionally decided to withhold 15% (fifteen
percent) of pension of the charged officer for a period of four years, under Rule 9 of A.P.
Revised Pension Rules, 1980, for the charges held proved against him and also to treat his
period of absence and suspension as not duty. Accordingly, a show cause notice was issued to
the charged officer vide reference 2nd cited. However, the DGP has stated that the charged
officer has acknowledged the show cause notice (on 18-2-2011), but no explanation received
from him till date.
4. Government have finally decided to confirm the provisional decision of withholding of
fifteen percent pension of the charged officer for a period of four years by treating his period of
absence as LWP and period of suspension as not duty and the matter was referred to the A.P.
Public Service Commission for its advice. The A.P. Public Service Commission, in the reference
5th read above (copy enclosed), has agreed with the proposal of the Government.
4. Therefore, Government hereby order to withhold 15 % (fifteen percent) pension of
Sri Nader Abbas HC 2219 (now retired) of Hyderabad, for a period of four years and also to treat
his period of absence as LWP and period of suspension as not duty

5. The Director General of Police, Andhra Pradesh, Hyderabad, is requested to take follow
up action in the matter accordingly. The records received through reference 1st read above are
herewith returned and the receipt of the same should be acknowledged.
