Letter No. 35193/Ser.II/A3/2010, dated: 21-12-2011, addressed to the Secretary, APPSC, Hyderabad 5. From the Secretary, APPSC, Hyderabad,Lr.No.71/RT-I/2/2012, dated:23-1-2012 ***** ORDER: st The Director General of Police, Andhra Pradesh, Hyderabad, in his letter 1 read above, has reported that Sri N.C.Krishna Rao PC 2768, Hyderabad (now retired) was handed up an OE for the following charge: “ For absence w.e.f 22-11-1997 to 5-4-1999 ” 2. The Inspector of Police, Nallakunta, Hyderabad, has conducted the oral Enquiry and held the charges against the charged officer as proved. A copy of the enquiry report was supplied to the charged officer and he has submitted his written statement of representation on 15-7-2010. Since the delinquent i.e Sri N.C.Krishna Rao PC 2768, Hyderabad has retired from service on superannuation on 30-4-2009, the DGP has referred the case to Government to dispose the case under Rule 9 of A.P. Revised Pension Rules, 1980. The DGP has stated that the CP, Hyderabad, has agreed with the findings of the EO. 3. Government have examined the report of the Enquiry Officer and accepted the findings of Enquiry Officer. Government have, therefore, provisionally decided to withhold 10% (ten percent) of pension of the charged officer for a period of two years, under Rule 9 of AP Revised Pension Rules, 1980, for the charges held proved against him and also to treat his period of absence and suspension as not duty. Accordingly, a show cause notice was issued to the charged officer vide reference 2nd cited and he has submitted his explanation vide reference 3rd cited. 4. Government have examined the same and decided to confirm the provisional decision of withholding of ten percent pension of the charged officer for a period of two years duly treating the period of absence and suspension as not duty and the matter was referred to the A.P. Public Service Commission for its advice. The A.P. Public Service Commission, in the reference 5th read above (copy enclosed), has agreed with the proposal of the Government. 4. Therefore, Government hereby order to withhold 10 % (ten percent) pension of Sri N.C.Krishna Rao PC 2768, Hyderabad for a period of two years, duly treating the period of his absence and suspension as not duty 5. The DGP, Andhra Pradesh, Hyderabad, is requested to take follow up action in the matter accordingly.
