GOVERNMENT OF ANDHRA PRADESH ABSTRACT Public Services - Disciplinary proceedings against Sri D.N.A. Basha, Commandant (Zone-II) SPF – Appointment of Enquiry Officer and Presenting Officer – Orders – Issued. HOME (SERVICES-III) DEPARTMENT G.O.Rt.No.429 dated: 17.03.2012. Read the following:- 1. From the DG, SPF, Sec’bad, Lr.No.A3/144/SPF/2011, dated: 27.9.2011. 2. Government Memo.No.29050/Ser-III/A3/2011, dated: 28.11.2011. 3. From Sri D.N.A. Basha, Commandant (Zone-II) SPF, written statement of defense dated: 27.12.2011. ***** ORDER: The DG, SPF in his letter 1st read above, has requested the Government to initiate disciplinary proceedings against Sri D.N.A. Basha, Commandant (Zone-II), SPF for the adultery and illegal activities committed by him in Room.No.101 of Madapati Guest House, Vijayawada, while on official visit to Vijayawada on 10.9.2011. 2. In the Government Memo 2nd read above, article of charge was issued to the said charged officer, for the following delinquencies: Charge No.1: “That the said Sri. D.N.A. Basha, Commandant (Zone-II), SPF, Hqrs., Secunderabad was permitted by the DG, SPF to visit SPF Unit, Vijayawada to surprise the guards on 10.09.2011. After checking the guards, he instructed the Sub-Inspector, Sri Vijay Kumar, SPF, Vijayawada to arrange accommodation for him at Sri Madapati Guest House of Sri Durga Malleshwara Swamy Devasthanam. He also asked the SI to arrange one full bottle of Peter Scot whisky and non-vegetarian dinner for three to four persons and one train ticket for Hyderabad in Machilipatnam Express. The SI incurred Rs. 2000/- for arranging the train tickets and other food articles, but he was not repaid the said amount to the SI by him. When the SI deputed Sri Balaji Naik, CT-4347 as orderly to him, he abused the CT-4347 in un- parliamentary language without any reason and instructed him to leave the guest house premises. He has also instructed the SI not to bring any SPF personnel to the guest house premises. Thus Sri D.N.A. Basha, Commandant (Zone-II), SPF by his above mentioned acts, has exhibited lack of integrity, devotion to duty and conduct unbecoming of a Government Servant and contravened Rule-3 Sub Rule (1) (2) (3) & (4) of APCS (conduct) Rules-1964.” Charge No.2: “That the said Sri. D.N.A. Basha, Commandant (Zone-II), SPF, Hqrs., Secunderabad, while he was residing in Room No.101 of Sri Madapati Guest House on 10.09.2011 the Inspector, I Town P.S., Vijayawada surprised the guest house and found 2 ladies in his room along with him. On enquiry of the Inspector, he informed the Inspector that, the two ladies were his wife and sister respectively. He did not produce any authentic proof that the two ladies were his wife and sister. Also, the requisition for guest house accommodation made by SI, Sri Vijay Kumar, SPF, Vijayawada mentioned requirement of room for himself. Later, the two ladies left his room in the Guest House in odd hours i.e., 0250 hrs. on 11.09.2011, in an Auto. Further, he has neither applied nor taken permission from the HOD to take his family members to Vijayawada. (P.T.O)::2:: Thus Sri D.N.A. Basha, Commandant (Zone-II), SPF by his above mentioned acts, has exhibited lack of integrity, devotion to duty and conduct unbecoming of a Government Servant and contravened Rule-3 Sub Rule (1) (2) (3) & (4) of APCS (conduct) Rules-1964.” Charge No.3: “That the said Sri. D.N.A. Basha, Commandant (Zone-II), SPF, Hqrs., Secunderabad before occupying the guest house and after surprise visit of the Inspector, I Town PS., Vijayawada made and received several calls to the mobile number 9948961869 and 9494475888 from his official mobile. He has not revealed the owners of these mobile numbers during the enquiry. Thus Sri D.N.A. Basha, Commandant (Zone-II), SPF by his above mentioned acts, has exhibited lack of integrity, devotion to duty and conduct unbecoming of a Government Servant and contravened Rule-3 Sub Rule (1) (2) (3) & (4) of APCS (conduct) Rules-1964.” Charge No.4: “That the said Sri. D.N.A. Basha, Commandant (Zone-II), SPF, Hqrs., Secunderabad consumed alcohol and had non vegetarian food in the temple guest house premises which are prohibited as temple guest house rules. Being a superior officer in the rank of Commandant working in a disciplined armed force, by violating the guest house rules, has brought disrepute to the department. Thus Sri D.N.A. Basha, Commandant (Zone-II), SPF by his above mentioned acts, has exhibited lack of integrity, devotion to duty and conduct unbecoming of a Government Servant and contravened Rule-3 Sub Rule (1) (2) (3) & (4) of APCS (conduct) Rules-1964.” 3. In the reference 3rd read above, the Charged Officer has submitted his written statement of defense, denying the charges framed against him. 4. Since the Charged Officer has not admitted the charge framed against him, Government have decided to conduct Oral Enqiry against the said Charged Officer by appointing Enquiry Officer and Presenting Officer. 5. Now, therefore, Government in exercise of the powers conferred under sub-rule 2 and read with sub-rule 5 (b) of Rule 20 of APCS (CC&A) Rules, 1991, hereby appoint Sri Lingaraju Panigrahi, IAS, Commissioner of Inquiries as Inquiring Authority and Sri S. Srinivasa Rao, Advocate, as the Presenting Officer to present the case before the Inquiring Authority. 6. The Presenting Officer appointed in para-5 above shall acquaint himself with the facts of the case by procuring the records relating to the case and present the case before the Inquiring Authority effectively on behalf of the Government. The Presenting Officer shall also obtain and furnish records to the Inquiring Authority, if necessary which are required during the course of enquiry. 7. The Inquiring Authority shall conduct enquiry strictly in terms of the procedure prescribed under Rule 20 of APCS (CC&A) Rules, 1991 and shall submit his report to the Government in terms of sub-rule 18 of the said rules, as expeditiously as possible and however it shall not be more than two months from the date of issue of these orders.
