From the DGP., AP., Hyderabad, Lr Rc No. 629/U3/2010, dated 22-12-2010. 2. From the DGP., AP., Hyderabad, Lr Rc No. 629/U3/2010, dated 19-01-2012. *** ORDER: The Director General of Police, AP., Hyderabad, in his letter read above, has reported that Smt A. Malleshwari, has filed MVOP No 40/2009 at MACT Ongole, Prakasam District, claiming compensation amount for the death of her husband i.e late Venkat Reddy, in an accident caused by Police Vehicle (Jeep) bearing No. AP 9P 8653 on 07-11-2008 at 2.00 PM. The VII Addl. District Judge, MACT Ongole, Prakasam District, in his judgment, dated 30-08-2010, awarded a compensation of Rs. 3,45,500/- with interest @ 6% per annum thereon from the date of filing of petition i.e 02-01-2009, till the date of realization and proportionate cost including Advocate’s Fee. 2. Sri T. Ramulu, Government Pleader for Arbitration, High Court Buildings, Hyderabad, in his letter, dated 30-11-2010 has opined that it is not a fit case for filing appeal. 3 . The DGP., AP., Hyderabad, in his letter 2nd read above, has reported that the B.P. Vehicle (Sumo) bearing No. AP 9 P 8038 was attached in EP No. 3/2011 in MVOP No. 40 of 2009 for delay of payment of compensation an amount of Rs. 4,02,075/- with cost of Rs. 4,704/. He has worked out the total compensation amount to be deposited in this case as follows: 1. Decreetal amount : Rs. 3,45,500/- 2. Interest amount @ 6% per annum from 02-01-2009 to : Rs. 62,190/- 01-01-2012 (3 years) 3. Proportionate costs & : Rs. 4,750/- Advocate fee _____________ TOTAL Rs. 4,12,440/- _____________ 4. The DGP., AP., Hyderabad, has, therefore, requested to accord administrative sanction for an amount of Rs. 4,12,440/- (Rupees Four lakhs Twelve thousand Four hundred and Forty only) towards compensation with interest in EP No. 3/2011 in MVOP No. 40/2009 filed by Smt A. Malleshwari, W/o late Venkat Reddy, Prakasham District and to provide funds by way of advance from the contingency fund of AP under the Head of Account “2055 Police – MH 001 – Direction and Administration – SH (01) Headquarter office - 500/501 Compensation”. PTO-2- 5. Government, after careful examination of the matter, hereby accord sanction for payment of an amount of Rs. 4,12,440/- (Rupees Four lakhs Twelve thousand Four hundred and Forty only) towards compensation with interest in EP No. 3/2011 in MVOP No. 40/2009 filed by Smt A. Malleshwari, W/o late Venkat Reddy, Prakasham District and to provide funds by way of advance from the contingency fund of AP. 6. The expenditure sanctioned in para (5) above shall be debited to the Head of Account “2055 Police – MH 001 – Direction and Administration - SH (01) Headquarter office – 500/501 Compensation (charged)” and shall initially be met by way of an advance from the Contingency Fund of AP, for which orders will be issued by the Finance (BG.I) Department, separately. 7. The Director General of Police, AP., Hyderabad, is requested to draw and disburse the amount to the concerned and submit the necessary proposals for obtaining supplementary grants at appropriate time during the financial year 2011-2012 towards recoupment of advance drawn from the Contingency Fund. 8. The Director General of Police, AP., Hyderabad, is further directed to take action for recovery of the amount from the persons responsible for unauthorized driving of the Police Vehicle and user of the vehicle and report compliance to Government. 9. This order issues with the concurrence of Finance (Expr. Home) Department, vide their U.O. No. 5481/85/A1/Expr. Home/2012, dated 13-03-2012.
