HOME (WNT) DEPARTMENT G.O. Rt. No. 436 Date: 19-03-2012 Read: From the DGP., AP., Hyderabad, Lr Rc No. 728/U3/2011, dated 08-12-2011 and 21-12-2011 *** ORDER: The Director General of Police, AP., Hyderabad, in his letter read above, has reported that Smt Kurre Narsavva, W/o Sri Narsaiah, filed EP No. 7/2011 in MVOP No. 311 of 2009 at MACT, Kamareddy, Nizamabad District, claiming compensation of an amount of Rs. 1,00,000/- for sustaining injuries due to the accident caused by Police Vehicle (Jeep) bearing No. AP 9 P 1949 on 11-04-2004 at 15.30 AM. The MACT-Cum-IX Additional District & Sessions Judge, Kamareddy, on 30-09-2010 awarded a compensation of Rs. 80,400/- (Rupees Eighty thousand Four hundred only) with interest @ 7.5% per annum from the date of the petition till the date of realization and proportionate cost, including Advocate’s fee. 2. Sri T. Narender Reddy, Government Pleader, Kamareddy, in his letter, dated 30-09-2011 has opined that it is just and proper to deposit the decreetal amount before the court, or otherwise there is very likelihood that the aggrieved party may go ahead with the execution of proceedings seeking the relief of attachment of movable properties. 3. The DGP., AP., Hyderabad, has worked out the total compensation amount to be deposited in the case as follows: 1. Decreetal amount : Rs. 80,400/- 2. Interest amount @ 7.5% per annum from 21-12-2006 to : Rs. 30,150/- 20-12-2011 (5 years) 3. Cost of O.P. & : Rs. 2,560/- Advocate fee 4. Costs of EP : Rs. 1,000/- ______________ TOTAL : Rs. 1,14, 110/- ______________ 4. The DGP., AP., Hyderabad, has, therefore, requested to accord administrative sanction for an amount of Rs. 1,14,110/- (Rupees One lakh Fourteen thousand One hundred and Ten only) towards compensation with interest in EP No. 7/2011 in MVOP No. 311/2009 filed by Smt Kurre Narsavva, W/o Sri Narsaiah, Nizamabad District, and to provide funds by way of advance from the contingency fund of AP under the Head of Account “2055 Police – MH 109 – District Police – SH (03) District Police Force – 500/501 Compensation (Charged)”. PTO-2- 5. Government, after careful examination of the matter, hereby accord sanction for payment of an amount of Rs. 1,14,110/- (Rupees One lakh Fourteen thousand One hundred and Ten only) towards compensation with interest in EP No. 7/2011 in MVOP No. 311/2009 filed by Smt Kurre Narsavva, W/o Sri Narsaiah, Nizamabad District, and to provide funds by way of advance from the contingency fund of AP. 6. The expenditure sanctioned in para (5) above shall be debited to the Head of Account “2055 Police – MH 109 – District Police – SH (03) District Police Force – 500/501 Compensation (Charged)” and shall initially be met by way of an advance from the Contingency Fund of AP, for which orders will be issued by the Finance (BG.I) Department, separately. 7. The Director General of Police, AP., Hyderabad, is requested to draw and disburse the amount to the concerned and submit the necessary proposals for obtaining supplementary grants at appropriate time during the financial year 2011-2012 towards recoupment of advance drawn from the Contingency Fund. 8. This order issues with the concurrence of Finance (Expr. Home) Department, vide their U.O. No. 5482/86/A1/Expr. Home/2012, dated 13-03-2012.
